2000 Municipal Code Ordinance 291 - Amending the Rolling Hills Municipal Code

City Manager Nealis presented the staff report indicating that this Ordinance is being presented for consideration of second reading and adoption. Hearing no discussion, 'Mayor Hill called for a motion. Councilmember Lay moved that the City Council waive further reading and adopt Ordinance No. 291. Mayor Pro Tern Heinsheimer seconded the motion, which carried unanimously. ORDINANCE NO. 291: AN ORDINANCE OF THE CITY OF ROLLING HILLS AMENDING THE ROLLING HILLS MUNICIPAL CODE RELATING TO PERSONAL CONDUCT. • City Manager Nealis presented the staff report providing background regarding the proposed ordinance. Hearing no discussion, Mayor Hill called fora motion. Mayor Pro Tem Heinsheimer moved that the City Council waive further reading and introduce Ordinance No. 291. Councilmember Lay seconded the motion, which carried unanimously. Mr. Richard Colyear, 35 Crest Road West, commented on the proposed ordinance and stated that the reason he brought it up at the Candidate's Forum in February was because he had reviewed the Municipal Code and thought that the City Council may not be aware of this section. He commented on other sections in the Municipal Code that have been updated and urged the City Council to review the Code and remove sections that are nb Icinger relevant. The City Council voted Monday to repeal an old ordinance that prohibited immoral conduct, including extramarital sex. The law was passed after the city incorporated in 1957. "So this is a pro -adultery thing?" joked Councilman James Black in an interview with the Daily Breeze before the meeting. "Good for us!" The ordinance banned immoral conduct defined as "any person exposing his or her person or the private parts thereof; or the doing of any other act with the intent of arousing, appealing to or gratifying the lust or passions or sexual desires of any person to whom he or sheds not married." Violating the law could result in a $250 fine or three months in jail, or both. The repeal issue arose when a resident scouring the municipal code mentioned it at council candidates forum. They were unsure if anyone had been cited for breaking the law and why it was enacted. "Why this particular law has been dormant and allowed to remain on the books all these years is anyone's guess," City Attorney Mike Jenkins said. "I can only venture to say that when a new city incorporates it's not unusual for it to borrow heavily from an already existing city for its municipal code so they don't have to start from scratch. I doubt it had anything to do with the rate of adultery in Rolling Hills." Local laws criminalizing sexual behavior were superseded by a California Supreme Court decision in 1962 that ruled the state has authority over such matters, Jenkins said. The ordinance will be formally repealed at the end of May, 30 days after the repeal is given a second reading on April 28. Well, the city council of an affluent gated town in southern California has repealed an official ban on immorality, giving legitimacy to those who might commit adultery within city limits. The repeal also gives the wealthy youngsters of the town legal freedom - at least on a municipal level - to engage in premarital sex. On Monday, the Rolling Hills City Council voted to take the 46 -year -old ordinance banning "immoral conduct" off the books. The council members claim they are not endorsing the breaking of the seventh commandment, but simply doing away with an archaic, unenforceable law. The statute was the second one adopted by the city when it was first incorporated in 1957. A resident of the city, which has 1,900 residents, spotted the law when perusing the municipal code and mentioned it at a city council meeting. Nearby Torrance, Calif., has a 1924 ordinance banning unmarried men and women from living together - or occupying the same hotel room - in the city. That one is still on the books. Tuesday, April 15, 2003 Yesterday was a big day for Martinsville and Henry County, and yet, the biggest event in town went largely unnoticed. The Virginia Museum of Natural History announced a tentative schedule Monday for construction of an 89,500 -square -foot building on Starling Avenue in that vacant lot where our Hospital used to be. The construction, funded by a $14.8 million state bond issue, is scheduled to begin by January . The new building is expected to open in January 2006. The museum will begin seeking bids from contractors this month. Interim museum director Judy Watson apparently issued a statement Monday, but you must have had to have been on a group of a selected list to get notification. I learned about it from today's Roanoke Times, I haven't heard it anywhere else. The selective nature of the Museum staffers is about to get more selective in short order as trustees are planning to launch an $8 million capital campaign to cover costs of exhibits for the new museum building and they're going to ask you for the money. I'm glad we've got the museum, I know how hard we've fought for it, and how hard our local legislators have worked to make sure the museum happens here and not in Roanoke, or Richmond, or some affluent area of Northern Virginia. They will no longer be subject to a jail term for, gratifying the "lust or passions" of a member of the opposite sex to whom they were not married. A law stretching back to the 1950s made it an offence for any unmarried men or women in Rolling Hills to have sex in a "bed, car, structure or public place". Violators were subject to three months in jail or a $250 (£175) fine. Introduced at the time that the area was incorporated as a city, the law has remained on the books until it was spotted recently by a local resident, Richard Colyear, who was leafing through the municipal code in preparation for a city council candidates meeting. City officials said this week that removing the law was a formality because the state had taken over all sex offence legislation in 1962. But the Rolling Hills code will now be amended to reassure any nervous couple slipping into the back seat of their Mustang in this expensive suburb just to the west of Long Beach. Puritanical attitudes to sex and hypocrisy were at their height in Los Angeles when the law was first introduced. In 1950, the actress Ingrid Bergman was denounced on the floor of the Senate as "Hollywood's apostle of degradation" and a "free -love cultist" for leaving her husband and becoming pregnant by the Italian film director Roberto Rosselini. Bergman did not make another American movie for seven years. Earlier, in the 1930s, the Hays Office had been founded to restrict the burgeoning sexual content in Hollywood films. The 1941 film Kings Row, which helped a young actor by called Ronald Reagan to make his mark, was delayed by the office because of its depiction of "illicit relations" and "much loose sex everywhere". It was in the same spirit, it seems, that the guardians of morality in Rolling Hills passed their ordinance. Anyway, there is no record of anyone having done jail time for the offence. It is possible that the police took the view of another former LA resident, Aldous Huxley, who concluded in Antic Hay that "there are few who would not rather be taken in adultery than in provincialism". The city of Rolling Hills, a plush little community of 1871 people southwest of Los Angeles, has decided to repeal the statute that threatens to punish philanderers with a fine and up to three months in jail. The city's mayor, Frank Hills, said the move was not intended to encourage Rolling Hills' spouses to be unfaithful, but was rather aimed at ridding the books of an outdated statute. "It's an antiquated law that has been there almost for half a century," he said, adding that the decision to repeal it did not mean that locals could now run morally amok. The law was integrated into Rolling Hills' rules when the eight square -kilometre city was founded in January 1957 and comes with a draconian set of restrictions on local residents' moral conduct. The law outlaws everything from exposing oneself to "arousing or appealing to anyone" or "being in any bedroom, room, car or public place" with anyone other than one's spouse "for the purpose of having sex." Such transgressions are, according to the second ordinance ever adopted by the city, punishable by a fine of up to $250 or three months behind bars or both. The origins of the law are unknown. "This is news to me," said local resident Jim Louder. "I'd have to read it first to see if I have been abiding by it." The city moved to scrap the law after a resident brought it to the council's attention, City Manager Craig Nealis said. But he stressed that scrapping the law would have no effect on local residents as it had never been enforced and that in any case the city's right to enforce personal conduct rules was taken over by the state in 1962. "This does not make adultery either legal or illegal in Rolling Hills," he said. But the disappearance of the strangely draconian law does not entirely strip rights -obsessed southern California of its legal colour. The Los Angeles area city of Torrance has since 1924 banned men and women who are not married from living together or from even sharing a hotel room within the city's limits. "The law still exists, but frankly its not very enforceable and we have never tried to apply it," Torrance City Attorney John Fellows said. "Any attempt to do that would probably make people angry." Furthermore, any person stupid enough to behave in an immoral way could get a $250 fine and three months , in jail, or two days in the village stocks or 20 minutes on the dunking chair. And just when I thought that all the council's dirty talk had ended, they fur- ther defined immoral conduct as, "any person exposing his or her person or the private parts thereof or the doing of any other act with the intent of arous- ing, appealing to or gratifying the lust or passion or sexual desires of any per- son to whom he or she is not married." Just think, for the next six weeks cops could still raid a stripper -featur- ing bachelor party or try to prove that a 19 -year -old jogger in a halter top is in- tent on arousing the lust of a 50 -year - old CEO on his way to the grocery store. Of course, and this is the sad part (or the redeeming part), repealing this law doesn't make the folks of RH any more or less free to do as they please because of something I'll call mate -based moral- ity. That is to say, if you are half a cou- ple of any sort and you are caught breaking the usual covenant — the one that sounds strangely like the RH city ordinance — your life will almost cer- tainly become a.hell involving Carl "Big Tony" Capozzola or someone like him (if there is in fact someone else like him). This always conflicted, confusing and explosive end of human behavior seems to be self -policing. Still, many U.S. states and the feder- al government firmly believe that it's their business to ban certain private acts and human combinations that are certainly better left to the judgments and religious beliefs of consenting adults. Sure, the Rolling Hills ordinance sur- vived as a comical oversight but the tragedy of this kind of thinking stays with us. Now take Iraq. Go ahead, take it. But not without soldiers, airmen and sailors willing to do the taking for you, servicemen who — in many cases it was reported this week — are unable to carry into battle photos of the people they love best. So take the Rolling Hills law as a throwback, a novelty of some distant age, or take it for what it is, a reminder of where no government belongs. 023 Q.s ... Could you please tell me if the law further goes on to include such other immoral conduct such as child molestation, lewd public display, pornography, etc. I am thinking that it most surely does include such language and you being from a profoundly aberrant liberal situation cannot even recognize what you and your town proposes. I am so thankful that some parts of this Country still has enough sense to understand moral values that do not degrade any part of our daily lives to the point of self destruction such as you are going to experience at some point in your life. With minimal comment, the City Council on Monday repealed a 46 -year -old ordinance banning "immoral conduct," which includ- ed extramarital sex — or for that matter premarital sex. "So, this is a pro -adultery thing?" joked Councilman James Black in an interview before the meeting. "Good for us!" he added with a laugh before wondering aloud whether he should make any fur- ther comment on the off -chance his wife might read the article. The council in the city of about 1,900 was not endorsing adultery, of course.. It was simply removing an archaic law — in this case the sec- ond one adopted after the city incorporated in 1957 — that is LAW/A9 LAW: Repealed ordinance dated from city's founding FROM.PAGE Al deemed unenforceable. The ordinance bans immoral conduct that it defines as "any person exposing his or her per- son or the private parts thereof; or the doing of any other act with the intent of arousing,.ap- pealing to or gratifying the lust or passions or sexual desires of any person to whom he or she is not married." Also prohibited is "the act of any person occupying, using or being present in any bed, room, automobile, structure or public place with a person of the oppo- site sex, to whom he or she is not married, for the purpose of having sexual intercourse with said person." Violating the law could result in a $250 fine and/or three months in jail. Resident spotted old law City officials heard about the ordinance after a keen -eyed res- ident scouring the' municipal code mentioned it at a recent forum for City Council candi- dates. "Why this particular law has been dormant and allowed to re- main on the books all these years is anyone's guess," said contract City Attorney Mike Jenkins of Manhattan Beach. "I frankly wasn't even aware it was in there." Jenkins recommended the or- dinance's removal. Local laws purporting to cri- minalize sexual behavior were superseded by a California Su- preme Court decision in 1962 that ruled the state has authori- ty over such matters, Jenkins said. Torrance bans cohabitation Rolling Hills isn't the' only city with laws that try to govern sexual behavior. In 1924, Torrance passed an ordinance banning unmarried men and women from living to- gether — or occupying the same hotel room — in the city. That ordinance remains on the books. It's unclear why Rolling Hills officials decided they needed the law barring adultery and pre- marital sex in the first place. Was promiscuity rampant dur- ing the Ozzie and Harriet era in Rolling Hills? Jenkins thinks not, although he acknowledged he was a mere lad in those days. "I can only venture to say that when a new city incorpo- rates it's not unusual for it to borrow heavily from an already existing city for its municipal code so they don't have to start from scratch," he said. "I doubt it had anything to do with the rate of adultery in Rolling Hills." On Monday, the City Council voted to repeal a 46 -year -old ordinance that prohibited immoral conduct, which included extramarital sex. The archaic law, which could result in a 5250 fine or three months in jail, was passed after the city was incorporated in 1957. Council members weren't endorsing adultery but they took some pleasure in commenting about the ordinance. "So this is a pro -adultery thing?" Councilman James Black joked before the meeting. "Good for us!" City officials heard about the ordinance after a resident scouring the municipal code mentioned it at a recent forum for City Council candidates. But they no longer have to fret about fines and jail time if caught sneaking around. The City Council in the wealthy gated community perched atop the Palos Verdes Peninsula moved late Monday to repeal a 50 -year -old ordi- nance prohibiting adulterous liaisons' in beds, buildings, cars and public places. "I wasn't even aware the law •-Nas there, but we have a voluminous municipal code," said Frank Hill, the town's 67 - year -old mayor. "At my age, I remember a time when people tried to legislate such things." The ordinance was passed in the late 1950s, soon after the city was incorporated. The rules also made it unlaw- ful for unmarried men and women to meet in any bed, car, structure or public place for the purpose of having sex. Violators faced fines of as much as $250 and as much as three months in City officials said they know of no residents ever charged with violating the law. And those who live in Rolling Hills say their town isn't exactly a hotbed of il- licit liaisons. Considered one of Califor- nia's most affluent communities, Rolling Hills has a median household income considerably higher than $200,000, according to the U.S. Census Bureau. The city's population is skewed toward older residents — 26% are older than 62. "Look up 'dead' in the diction- ary," said resident John Nunn, 60, describing his town. "This is sort of the opposite of wild up here. It has absolutely no party atmosphere at all, unless it's kids finding their parents not at home and trying to have a party. But that almost never happens." The law had been long forgot- ten until a few weeks ago. Richard Colyear, 63, stum- bled on it while flipping through the municipal code in February in preparation for a City Council candidates forum. At the event, Colyear asked the candidates if they felt there was a need to remove outdated laws and used the adultery rule as an example. "I wondered why these mem- bers of City Council — many who have been here for years — would want to continue it," Colyear said. Most of the candidates at the forum expressed little interest in repealing the law, in part be- cause they believed it would take too much time, Colyear said. So he said he was surprised when the repeal proposal turned up. on the council's agenda this week. City officials in Rolling Hills said taking the law off the books was only a formality because a state law passed in 1962 took such sex -related matters out of the hands of municipalities. DATE: APRIL 14, 2003 BACKGROUND From time -to -time, sections of the Rolling Hills Municipal Code require updating. The attached Ordinance updates the Municipal Code by removing language in Chapter 9.20 that is not regulated by the City. RECOMMENDATION It is recommended that members of the City Council consider this Ordinance for first reading and introduction. If this Ordinance is introduced this evening, it will be re- presented on April 28, 2003 for consideration of second reading and adoption. As recommended by the City Attorney, this ordinance is not enforceable by the City of Rolling Hills and has been preempted by State law since 1962. It was adopted in Rolling Hills in 1957. The origin of this ordinance is not known. It is an archaic ordinance and is being removed from the Municipal Code as a standard process of clearing unenforceable sections of the Municipal Code. OFFENSES AGAINST PUBLIC DECENCY Chapter 9.20 IMMORAL CONDUCT Sections: 9.20.010 Public place defined. 9.20.020 Immoral conduct prohibited. 9.20.030 Immoral conduct defined. 9.20.040 Violation --Penalty. 9.20.010 Publicplace defined. "Public place" is defined as including but not limited to a road, lane, walk, park, beach, vacant lot or any other place open to the public view. (Ord. 2 §2(c), 1957). 9.20.020 Immoral conduct prohibited. It is unlawful for any person to engage in or be a party to any immoral conduct in the City. (Ord. 2 §1, 1957). 9.20.030 Immoral conduct defined. For the purpose of this chapter, "immoral conduct" means and includes the following: A. The act of any person exposing his or her person or the private parts thereof, or the doing of any other act with the intent of arousing, appealing to or gratifying the lust or passions or sexual desires of any person to whom he or she is not married; or B. The act of any person occupying, using or being present in any bed, room, automobile, structure of public place with a person of the opposite sex, to whom he or she is not married, for the purpose of having sexual intercourse with said person. Any person violating this chapter shall, upon conviction thereof, be punished by a fine of not more than two hundred fifty dollars or by imprisonment in the City of County Jail for a period not exceeding three months, or by both such fine and imprison- ment.
