This letter is to advise you of our determination regarding the referenced ordinance with
express findings received from your agency on April 19, 2017.
Our review finds the submittal to contain one ordinance, No. 351, modifying provisions of
the 2016 California Building Standards Code in Title 24, California Code of Regulations
(code), and express findings complying with Health and Safety Code Sections 17958.7 and
18941.5. The code modifications are accepted for filing and are enforceable. This letter
attests only to the satisfaction of the cited law for filing of local code amendment supported
by an express finding with the California Building Standards Commission (CBSC). CBSC is
not authorized by law to evaluate the merit of the code modification or the express finding.
Local modifications to the code are specific to a particular edition of the code. They must
be readopted and filed with CBSC in order to remain in effect when the next triennial edition
of the code is published.
On a related matter, should your city receive and ratify Fire Protection District ordinance's
making modifications to the code, be advised that Health and Safety Code Section
13869.7(c) requires such ratified ordinances and express findings to be filed with the
Department of Housing and Community Development, Division of Codes and Standards,
State Housing Law Program, rather than CBSC. Also, ordinances making modifications to
the energy efficiency standards of the code may require approval from the California Energy
Commission pursuant to Public Resources Code Section 25402.1(h)(2).

AN ORDINANCE OF THE CITY OF ROLLING HILLS AMENDING
TITLE 15 (BUILDINGS AND CONSTRUCTION) OF THE CITY OF
ROLLING HILLS MUNICIPAL CODE BY ADOPTING BY
REFERENCE TITLE 32 OF LOS ANGELES COUNTY CODE (FIRE

CONTAINED IN THAT CODE, AND DELEGATING ENFORCEMENT
OF THE FIRE CODE IN THE CITY TO THE FIRE CHIEF.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Section 15.20.010 of Title 15, Chapter 15.20 (Fire Code) of the Rolling Hills
Municipal Code is hereby amended to read as follows:
15.20.010 Adoption of Fire Code.
Except as hereinafter provided in this chapter, Title 32 Fire Code of the Los Angeles County Codes, as
amended and in effect on February 24, 2017, which constitutes an amended version of the California
Fire Code, 2016 Edition and an amended version of the International Fire Code, 2015 Edition is hereby
adopted by reference and shall constitute and may be cited as the Fire Code of the City of Rolling Hills.
In the event of any conflict between provisions of the Califomia Fire Code, 2016 Edition, Title 32 of the
Los Angeles County Code, or any amendment to the Fire Code contained in the Rolling Hills Municipal
Code, the provision contained in the later listed document shall control.
A copy of Title 32 of the Los Angeles County Code, along with a copy of the California Fire Code, 2016
Edition has been deposited in the office of the City Clerk and shall be at all times maintained by the
Clerk for use and examination by the public.
Section 2. Ratification of More Stringent Building Standards. Pursuant to Health and Safety
Code section 13869.7, subdivision (a), as part of its amendments to Title 32 (Fire Code), the
Consolidated Fire Protection District of Los Angeles County proposed building standards relating to fire
and public safety that are more stringent than those building standards adopted by the State Fire Marshal
and contained in the California Building Code. Pursuant to Health and Safety Code section 13869.7,
subdivision (c), by adoption of this ordinance, the City Council hereby ratifies the building standards
included within the ordinance amending Title 32 (Fire Code) as amended and in effect on February 24,
2017.
Section 3. The City Council hereby finds that the changes and modifications to the Fire
Code that has been enacted by this ordinance are reasonably necessary because of the City's local
climate, characterized by hot, dry summers, often resulting in drought conditions, followed by strong
Santa Ana winds, often resulting in hazardous fire conditions, and the City's geological characteristics in
that the area is characterized by geological instability; location in Southern California; and the relatively
hilly topography of the City. The City Council hereby finds that the modifications to the California Fire
Code in Title 32 of the Los Angeles County Code are reasonably necessary because of the local climatic,
geological, and topographical conditions indicated above. Accordingly, the City Council finds the
modifications in this Ordinance to the Fire Code to be necessary for the protection of the public health,
safety, and welfare.

Section 4. To the extent the provisions of this ordinance are substantially the same as z

sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections,

Section 1. Section 15.20.010 of Title 15, Chapter 15.20 (Fire Code) of the Rolling Hills
Municipal Code is hereby amended to read as follows:
15.20.010 Adoption of Fire Code.

Consolidated Fire Protection District of Los Angeles County proposed building standards relating to fire
and public safety that are more stringent than those building standards adopted by the State Fire Marshal
and contained in the California Building Code. Pursuant to Health and Safety Code section 13869.7,
subdivision (c), by adoption of this ordinance, the City Council hereby ratifies the building standards
included within the ordinance amending Title 32 (Fire Code) as amended and in effect on February 24,
2017.
Section 3. The City Council hereby finds that the changes and modifications to the Fire
Code that has been enacted by this ordinance are reasonably necessary because of the City's local
climate, characterized by hot, dry summers, often resulting in drought conditions, followed by strong
Santa Ana winds, often resulting in hazardous fire conditions, and the City's geological characteristics in
that the area is characterized by geological instability; location in Southern California; and the relatively
hilly topography of the City. The City Council hereby finds that the modifications to the California Fire
Code in Title 32 of the Los Angeles County Code are reasonably necessary because of the local climatic,
geological, and topographical conditions indicated above. Accordingly, the City Council finds the
modifications in this Ordinance to the Fire Code to be necessary for the protection of the public health,
safety, and welfare.
Section 4. To the extent the provisions of this ordinance are substantially the same as
previous provisions of the Rolling Hills Municipal Code, these provisions shall be construed as
continuations of those provisions and not as new enactments.

RECOMMENDATION
It is recommended that the City Council waive full reading and adopt Ordinance No.
351, adopting by reference the 2017 Los Angeles County Fire Code
BACKGROUND
In January 2017 the City Council adopted the LA County Codes, except for the Fire
Code. Normally, the County Board of Supervisors adopts the Fire Code at the same
time as the other County codes. This year the adoption of the Fire Code was delayed
and it was adopted in February 2017.
The State of California, through the State Building Standard Commission, publishes
uniform building standards applicable throughout the state. The State Fire Code is part
of the California Code of Regulations, Building Standards Code, Title 24, part 9, and is
updated tri-annually. Local jurisdictions, including the County and District are required
by law to adopt the latest edition of the California Fire Code. The 2017 County Fire
Code adopts by reference with some changes the 2016 California (State) Fire Code.
State law allows cities, counties and fire protection districts to adopt more restrictive
building standards than those contained in the State of California Fire Code if those
standards are necessary due to the unique climatic, geological, and topographical
conditions existing in the local jurisdiction. In order to adopt these more restrictive
building standards, the County and District must make findings justifying the more
restrictive provisions.
As part of the amended Fire Code adopted by the BOS, the Consolidated Fire
Prevention District of Los Angeles County proposed building standards relating to fire
safety that are more stringent than those building standards contained in the California
Building Standards Code, pursuant to Health and Safety Code section 13869.7. District
amendments that are more restrictive building standards must be ratified by the City in
order for those amendments to be enforceable within the City's jurisdiction.
If the City were to choose not to adopt the County Code; then by default the California
Building Standards Code of California Fire Code becomes effective in the City.
DISCUSSION
The resolution before you adopts the Los Angeles County Fire Protection District Fire
Code as the City's Fire Code and ratifies the building standards, relating to fire and life
safety, which are more restrictive than those adopted by the State Fire Marshal and
contained within the California Building Standards Code. California law requires
building standards adopted by local jurisdictions that are more restrictive than those
adopted by the state to be enacted by ordinance within 180 days after the state adopts
and publishes the California Building and Fire Code. The California Health and Safety
Code Section 13869.7 authorizes the Fire District to adopt such standards but requires
ratification by the legislative body where the standards will apply.
There are no changes in the 2017 LA County Fire Code pertinent to regulations for
single-family residential construction. The 2014 Fire Code has adopted all of the more
restrictive building standards that apply to single-family residential construction.
The only change relevant to residential construction is a change in fees for plan check
and inspection.
At the March 27, 2017 meeting of the City Council, this Ordinance was introduced for
first reading and full reading was waived. There were no public comments when the
ordinance was heard on first reading and staff was directed to bring the ordinance back
for second reading and adoption. Also at the March 27, 2017 meeting, upon a
recommendation from the City Attorney, this same ordinance was adopted as an
Urgency Ordinance with the necessary findings and that ordinance became effective

immediately. It is a good practice to adopt both ordinances, in case the urgency
provisions are challenged. If the urgency provisions were challenged, the Fire
Department staff would be able to process projects applying the new Fire Code adopted
under the non -urgency ordinance, although a little later. This non -urgency ordinance
becomes effective 30 -days following the second reading and adoption by the City
Council.
FISCAL IMPACT
Building plan check and Fire Department permit fees are paid to compensate the City
for expenditures associated with fire code implementation activities. The fees collected
will continue to match the expenditures, and there will be no net fiscal impact to the
City.
NOTIFICATION
A notice of this public hearing was published in the Peninsula News on March 16, 2017,
in the City's Newsletter and was posted at City Hall. The City Council agenda is also
available on the City's website.
CONCLUSION
Staff recommends that the City Council waive full reading and adopt Ordinance No.
351.

RESTRICTIVE FIRE STANDARDS CONTAINED IN THAT CODE,
AND DELEGATING ENFORCEMENT OF THE FIRE CODE IN THE
CITY TO THE FIRE CHIEF, AND DECLARING THE URGENCY
THEREOF.
WHEREAS, the City of Rolling Hills lies within the jurisdictional boundaries of the Consolidated Fire
Protection District of Los Angeles County (District); and
WHEREAS, the District has responsibility for fire protection within said jurisdictional boundaries; and
WHEREAS, the County Board of Supervisors, acting as the Governing Body of the District did on
January 24, 2017, adopt amendments to the District Fire Code by adopting by reference, with certain
changes and amendments, the 2016 Edition of the California Fire Code and the 2015 edition of the
International Fire Code; and
WHEREAS, as allowed by state law, the District Fire Code contains local amendments that constitute
more restrictive building standards relating to fire and panic safety than those adopted by the State Fire
Marshal and contained in the California Building Standards Code; and
WHEREAS, pursuant to Section 13869.7(c) of the California Health and Safety Code, local
amendments containing such more restrictive building standards are not effective within the
jurisdictional boundaries of the City until ratified by the City Council; and
WHEREAS, it is the intention of the City to ratify all of these more restrictive building standards and to
have those standards be enforced in the City;
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Section 15.20.010 of Title 15, Chapter 15.20 (Fire Code) of the Rolling Hills
Municipal Code is hereby amended to read as follows:
15.20.010 Adoption of Fire Code.
Except as hereinafter provided in this chapter, Title 32 Fire Code of the Los Angeles County Codes, as
amended and in effect on February 24, 2017, which constitutes an amended version of the California
Fire Code, 2016 Edition and an amended version of the International Fire Code, 2015 Edition is hereby
adopted by reference and shall constitute and may be cited as the Fire Code of the City of Rolling Hills.
In the event of any conflict between provisions of the California Fire Code, 2016 Edition, Title 32 of the w
Los Angeles County Code, or any amendment to the Fire Code contained in the Rolling Hills Municipal a
Code, the provision contained in the later listed document shall control.

climate, characterized by hot, dry summers, often resulting in drought conditions, followed by strong
Santa Ana winds, often resulting in hazardous fire conditions, and the City's geological characteristics in
that the area is characterized by geological instability; location in Southern California; and the relatively
hilly topography of the City. The City Council hereby finds that the modifications to the California Fire
Code in Title 32 of the Los Angeles County Code are reasonably necessary because of the local climatic,
geological, and topographical conditions indicated above. Accordingly, the City Council finds the
modifications in this Ordinance to the Fire Code to be necessary for the protection of the public health,
safety, and welfare.
Section 4. To the extent the provisions of this ordinance are substantially the same as
previous provisions of the Rolling Hills Municipal Code, these provisions shall be construed as
continuations of those provisions and not as new enactments.
Section 5. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of
this ordinance or any part hereof is for any reason held to be invalid, such invalidity shall not affect the
validity of the remaining portions of this ordinance or any part thereof. The City Council of the City of
Rolling Hills hereby declares that it would have, passed each section, subsection, subdivision, paragraph,
sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections,
subdivisions, paragraphs, sentences, clauses or phrases be declared invalid.
Section 6. Urgency Findings. Title 32 (Fire Code) of the LA County Code took effect on
February 24, 2017. It is essential that the City have in effect as of that date codes that comport with
state law and contain those modifications necessitated by unique topographic, geologic and climatic
conditions. In the absence of immediate effectiveness, the provisions of the Fire Code unique to the
City's special circumstances will not be in place and this will have a detrimental effect on the public,
health, safety and welfare. The modifications to the Code contain vital provisions regarding
administrative procedures, and other similar matters necessitated by the City's exposure to Santa Ana
winds and its limited rainfall in summer and fall months and increased risk for fires. For these reasons,
the public health, safety and welfare require that this ordinance take effect immediately. This Ordinance
is an urgency ordinance adopted pursuant to Government Code Section 36967 and shall take effect
immediately.
Section 7. This Ordinance has been determined to be exempt from the California
Environmental Quality Act pursuant to State Guidelines Section 15061(b)(3) because it is not a project
that has the potential for causing a significant effect on the environment.
Section 8. Thee City Clerk shall certify the adoption of this Ordinance and shall file a copy
of this Ordinance as follows:

THEREOF.
WHEREAS, the City of Rolling Hills lies within the jurisdictional boundaries of the Consolidated Fire
Protection District of Los Angeles County (District); and
WHEREAS, the District has responsibility for fire protection within said jurisdictional boundaries; and
WHEREAS, the County Board of Supervisors, acting as the Governing Body of the District did on
January 24, 2017, adopt amendments to the District Fire Code by adopting by reference, with certain
changes and amendments, the 2016 Edition of the California Fire Code and the 2015 edition of the
International Fire Code; and
WHEREAS, as allowed by state law, the District Fire Code contains local amendments that constitute
more restrictive building standards relating to fire and panic safety than those adopted by the State Fire
Marshal and contained in the California Building Standards Code; and
WHEREAS, pursuant to Section 13869.7(c) of the California Health and Safety Code, local
amendments containing such more restrictive building standards are not effective within the
jurisdictional boundaries of the City until ratified by the City Council; and
WHEREAS, it is the intention of the City to ratify all of these more restrictive building standards and to
have those standards be enforced in the City;
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Section 15.20.010 of Title 15, Chapter 15.20 (Fire Code) of the Rolling Hills
Municipal Code is hereby amended to read as follows:
15.20.010 Adoption of Fire Code.
Except as hereinafter provided in this chapter, Title 32 Fire Code of the Los Angeles County Codes, as
amended and in effect on February 24, 2017, which constitutes an amended version of the California
Fire Code, 2016 Edition and an amended version of the International Fire Code, 2015 Edition is hereby
adopted by reference and shall constitute and may be cited as the Fire Code of the City of Rolling Hills.
In the event of any conflict between provisions of the California Fire Code, 2016 Edition, Title 32 of the
Los Angeles County Code, or any amendment to the Fire Code contained in the Rolling Hills Municipal
Code, the provision contained in the later listed document shall control.
A copy of Title 32 of the Los Angeles County Code, along with a copy of the California Fire Code, 2016
Edition has been deposited in the office of the City Clerk and shall be at all times maintained by the
Clerk for use and examination by the public.
Section 2. Ratification of More Stringent Building Standards. Pursuant to Health and Safety
Code section 13869.7, subdivision (a), as part of its amendments to Title 32 (Fire Code), the
Consolidated Fire Protection District of Los Angeles County proposed building standards relating to fire
and public safety that are more stringent than those building standards adopted by the State Fire Marshal
and contained in the California Building Code. Pursuant to Health and Safety Code section 13869.7,
subdivision (c), by adoption of this ordinance, the City Council hereby ratifies the building standards
included within the ordinance amending Title 32 (Fire Code) as amended and in effect on February 24,
2017.
Section 3. The City Council hereby finds that the changes and modifications to the Fire
Code that has been enacted by this ordinance are reasonably necessary because of the City's local

climate, characterized by hot, dry summers, often resulting in drought conditions, followed by strong
Santa Ana winds, often resulting in hazardous fire conditions, and the City's geological characteristics in
that the area is characterized by geological instability; location in Southern California; and the relatively
hilly topography of the City. The City Council hereby finds that the modifications to the California Fire
Code in Title 32 of the Los Angeles County Code are reasonably necessary because of the local climatic,
geological, and topographical conditions indicated above. Accordingly, the City Council finds the
modifications in this Ordinance to the Fire Code to be necessary for the protection of the public health,
safety, and welfare.
Section 4. To the extent the provisions of this ordinance are substantially the same as
previous provisions of the Rolling Hills Municipal Code, these provisions shall be construed as
continuations of those provisions and not as new enactments.
Section 5. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of
this ordinance or any part hereof is for any reason held to be invalid, such invalidity shall not affect the
validity of the remaining portions of this ordinance or any part thereof. The City Council .of the City of
Rolling Hills hereby declares that it would have passed each section, subsection, subdivision, paragraph,
sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections,
subdivisions, paragraphs, sentences, clauses or phrases be declared invalid.
Section 6. Urgency Findings. Title 32 (Fire Code) of the LA County Code took effect on
February 24, 2017. It is essential that the City have in effect as of that date codes that comport with
state law and contain those modifications necessitated by unique topographic, geologic and climatic
conditions. In the absence of immediate effectiveness, the provisions of the Fire Code unique to the
City's special circumstances will not be in place and this will have a detrimental effect on the public,
health, safety and welfare. The modifications to the Code contain vital provisions regarding
administrative procedures, and other similar matters necessitated by the City's exposure to Santa Ana
winds and its limited rainfall in summer and fall months and increased risk for fires. For these reasons,
the public health, safety and welfare require that this ordinance take effect immediately. This Ordinance
is an urgency ordinance adopted pursuant to Government Code Section 36967 and shall take effect
immediately.
Section 7. This Ordinance has been determined to be exempt from the California
Environmental Quality Act pursuant to State Guidelines Section 15061(b)(3) because it is not a project
that has the potential for causing a significant effect on the environment.
Section 8. Thee City Clerk shall certify the adoption of this Ordinance and shall file a copy
of this Ordinance as follows:

RECOMMENDATION
It is recommended that the City Council waive full reading, conduct a public hearing
and (1) adopt the attached Urgency Ordinance No. 351- U, by a 2/3 vote, adopting by
reference the 2017 Los Angeles County Fire Code as the City's Fire Code which allows
the Los Angeles County Fire Protection District to enforce certain more restrictive fire
and life safety building standards within the City than mandated by the California
Building Standards Fire Code; (2) introduce for first reading Ordinance No. 351,
adopting by reference the 2017 Los Angeles County Fire Code; conduct public hearing
and direct staff to schedule second reading and adoption of Ordinance No. 351 for the
April 10, 2017 City Council meeting.
BACKGROUND
In January 2017 the City Council adopted the LA County Codes, except for the Fire
Code. Normally, the County Board of Supervisors adopts the Fire Code at the same
time as the other County codes. This year the adoption of the Fire Code was delayed
and it was adopted in February 2017.
The State of California, through the State Building Standard Commission, publishes
uniform building standards applicable throughout the state. The State Fire Code is part
of the California Code of Regulations, Building Standards Code, Title 24, part 9, and is
updated tri-annually. Local jurisdictions, including the County and District are required
by law to adopt the latest edition of the California Fire Code. The 2017 County Fire
Code adopts by reference with some changes the 2016 California (State) Fire Code.
State law allows cities, counties and fire protection districts to adopt more restrictive
building standards than those contained in the State of California Fire Code if those
standards are necessary due to the unique climatic, geological, and topographical
conditions existing in the local jurisdiction. In order to adopt these more restrictive
building standards, the County and District must make findings justifying the more
restrictive provisions.
As part of the amended Fire Code adopted by the BOS, the Consolidated Fire
Prevention District of Los Angeles County proposed building standards relating to fire
safety that are more stringent than those building standards contained in the California
Building Standards Code, pursuant to Health and Safety Code section 13869.7. District
amendments that are more restrictive building standards must be ratified by the City in
order for those amendments to be enforceable within the City's jurisdiction.
The City may choose not to adopt the County Code; then by default the California
Building Standards Code of California Fire Code becomes effective in the City.
DISCUSSION
The resolution before you adopts the Los Angeles County Fire Protection District Fire
Code as the City's Fire Code and ratifies the building standards, relating to fire and life
safety, which are more restrictive than those adopted by the State Fire Marshal and

contained within the California Building Standards Code. California law requires
building standards adopted by local jurisdictions that are more restrictive than those
adopted by the state to be enacted by ordinance within 180 days after the state adopts
and publishes the California Building and Fire Code. The California Health and Safety
Code Section 13869.7 authorizes the Fire District to adopt such standards but requires
ratification by the legislative body where the standards will apply.
There are no changes in the 2017 LA County Fire Code pertinent to regulations for
single-family residential construction. The 2014 Fire Code has adopted all of the more
restrictive building standards that apply to single-family residential construction.
The only change relevant to residential construction is a. change in fees for plan check
and inspection.
The City Attorney advises that two ordinances be considered by the City Council. The
Urgency Ordinance becomes effective immediately, and is necessary due to the fact that
the County Fire Code is already in effect and the City could be challenged if the Fire
Department applies the new requirements to City projects, when the City did not adopt
the new code. However, Urgency Ordinances require justification and must contain
valid, constitutional and persuasive facts to justify the urgency. A non -urgency
ordinance becomes effective 30 -days following the second reading by the City Council.
It is a good practice to adopt both ordinances, in case the Urgency Ordinance is
challenged. If the Urgency Ordinance were challenged, the Fire Department staff would
be able to process projects applying the new Fire Code adopted under the non -urgency
ordinance, although a little later.
FISCAL IMPACT
Building plan check and Fire Department permit fees are paid to compensate the City
for expenditures associated with fire code implementation activities. The fees collected
will continue to match the expenditures, and there will be no net fiscal impact to the
City.
NOTIFICATION
A notice of this public hearing was published in the Peninsula News on March 16, 2017,
in the City's Newsletter and was posted at City Hall. The City Council agenda is also
available on the City's website.
CONCLUSION
Staff recommends that the City Council, following a public hearing, adopt Urgency
Ordinance No. 351-U by a 2/3 vote and introduce for first reading Ordinance No. 351.

Consolidated Fire Protection District of Los Angeles County proposed building standards relating to fire
and public safety that are more stringent than those building standards adopted by the State Fire Marshal
and contained in the California Building Code. Pursuant to Health and Safety Code section 13869.7,
subdivision (c), by adoption of this ordinance, the City Council hereby ratifies the building standards
included within the ordinance amending Title 32 (Fire Code) as amended and in effect on February 24,
2017.
Section 3. The City Council hereby finds that the changes and modifications to the Fire
Code that has been enacted by this ordinance are reasonably necessary because of the City's local
climate, characterized by hot, dry summers, often resulting in drought conditions, followed by strong
Santa Ana winds, often resulting in hazardous fire conditions, and the City's geological characteristics in
that the area is characterized by geological instability; location in Southern California; and the relatively
hilly topography of the City. The City Council hereby finds that the modifications to the California Fire
Code in Title 32 of the Los Angeles County Code are reasonably necessary because of the local climatic,
geological, and topographical conditions indicated above. Accordingly, the City Council finds the

modifications in this Ordinance to the Fire Code to be necessary for the protection of the public health,
safety, and welfare.
Section 4. To the extent the provisions of this ordinance are substantially the same as
previous provisions of the Rolling Hills Municipal Code, these provisions shall be construed as
continuations of those provisions and not as new enactments.
Section 5. • If any section, subsection, subdivision, paragraph, sentence, clause or phrase of
this ordinance or any part hereof is for any reason held to be invalid, such invalidity shall not affect the
validity of the remaining portions of this ordinance or any part thereof. The City Council of the City of
Rolling Hills hereby declares that it would have passed each section, subsection, subdivision, paragraph,
sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections,
subdivisions, paragraphs, sentences, clauses or phrases be declared invalid.
Section 6. This ordinance shall be effective upon adoption and shall become operative as of
February 24, 2017.
Section 7. This Ordinance has been determined to be exempt from the California
Environmental Quality Act pursuant to State Guidelines Section 15061(h)(3) because it is not a project
that has the potential for causing a significant effect on the environment.
Section 8. Thee City Clerk shall certify the adoption of this Ordinance and shall file a copy
of this Ordinance as follows:

15.20.010 - Adoption of Fire Code.
Except as hereinafter provided in this chapter, Title 32 Fire Code of the Los Angeles County Codes, as
amended and in effect on April 24, 2014, which constitutes an amended version of the California Fire Code,
2013 Edition (Part 9 of Title 24 of the California Code of Regulations) and an amended version of the
International Fire Code, 2012 Edition is hereby adopted by reference and shall constitute and may be cited
as the Fire Code of the City of Rolling Hills.
In the event of any conflict between provisions of the California Fire Code, 2013 Edition, Title 32 of the
Los Angeles County Code, or any amendment to the Fire Code contained in the Rolling Hills Municipal
Code, the provision contained in the later listed document shall control.
A copy of Title 32 of the Los Angeles County Code, along with a copy of the California Fire Code, 2013
Edition, and the International Fire Code, 2012 Edition, has been deposited in the office of the City Clerk and
shall be at all times maintained by the Clerk for use and examination by the public.

15.20.020 - Short title.
This chapter shall be known as the "Fire Code of the City of Rolling Hills" and may be cited as such.

15.20.025 - Very high fire hazard severity zone (VHFHSZ).
The entire City of Rolling Hills is designated as a very high fire hazard severity zone, as prescribed by
the Director of California Department of Forestry and Fire Protection and as designated on a map titled
City of Rolling Hills VHFHSZ dated July 1, 2008 and which shall be retained on file in the City Clerk's office at
the Rolling Hills City Hall.

15.20.030 - Permits.
Any permit heretofore issu _ _ )y the County of Los Angeles pursu_.. _ to the Fire Code of said County, .\,1
for work within the territorial boundaries of the City of Rolling Hills, shall remain in full force and effect
according to its terms.

15.20.050 - Violations.
Every person violating any provision of the Fire Code or of any permit or license granted hereunder, or
any rule, regulation or policy promulgated pursuant hereto, is guilty of a misdemeanor unless such
violation is declared to be an infraction by Section 5101.1 of the Fire Code. Each such violation is a
separate offense for each and every day during any portion of which such violation is committed,
continued or permitted, and conviction of any such violation shall be punishable by a fine not to exceed
one thousand dollars or by imprisonment in the County Jail for a period not to exceed six months, or by
both such fine and imprisonment.

15.20.060 - Responsibility.
Any person who personally or through another wilfully, negligently, or in violation of law sets a fire,
allows a fire to be set, or allows a fire kindled or attended by such person to escape from his or her
control, allows any hazardous material to be handled, stored or transported in a manner not in
accordance with nationally recognized standards, allows any hazardous material to escape from his or her
control, neglects to properly comply with any written notice of the Chief, or wilfully or negligently allows
the continuation of a violation of the Fire Code and amendments thereto is liable for the expense of
fighting the fire or for the expenses incurred during a hazardous materials incident, and such expense
shall be a charge against that person. Such charge shall constitute a debt of such person and is collectible
by the public agency incurring such expense in the same manner as in the case of an obligation under a
contract, expressed or implied.

the Los Angeles County Codes by reference with minor
modifications specific to the City. It is essential that the
City have in effect Fire Code that comport with state law
and contain those modifications necessitated by unique
topographic, geologic and climatic. conditions. In the
absence of immediate effectiveness, the provisions of
.the Fire Code unique to the Ctty's special circumstances
will not be in place and this will have a detrimental effect
on the public, health, safety and welfare.
Any person is welcome to review the proposed ordi-
nance prior to the public hearing at the City Hall
Administration Building located at 2 Portuguese Bend

This letter is to inform you that on January 24, 2017, the County of Los Angeles Board of
Supervisors, acting as the governing board for the Consolidated Fire Protection District of the
County of Los Angeles (District), adopted amendments to the Los Angeles County Code,
Title 32 and adopted Title 32 as the Fire Code for the District, effective March 1, 2017,
(2017 Fire Code). The 2017 Fire Code is the approved fire prevention code for the District
and, effective March 1, 2017, will apply to, and be enforced in, all areas within the jurisdiction
of the District.
RECOMMENDATIONS:
1. Adopt the 2017 Los County Fire Code as the City's Fire Code.
2. Ratify the more restrictive fire and life safety building standards contained in the
2017 Fire Code, which are listed in Section 324 at the end of the County's ordinance,
and make the necessary local findings in support of the more restrictive building
standards. (see attached sample resolution). A copy of the City's Resolution or
Ordinance ratifying the more restrictive building standards and making the necessary
findings must be filed with the California State Department of Housing and
Community Development and the California Building Standards Commission to make
them enforceable within your City.

WHEREAS, the City of lies within the jurisdictional
boundaries of the Consolidated Fire Protection District of Los Angeles County
(District); and
WHEREAS, the District has responsibility for fire protection within said
jurisdictional boundaries; and
WHEREAS, the County Board of Supervisors, acting as the Governing
Body of the District did on January 24, 2017, adopt amendments to the District
Fire Code by adopting by reference, with certain changes and amendments, the
2016 Edition of the California Fire Code and the 2015 edition of the International
Fire Code; and
WHEREAS, as allowed by state law, the District Fire Code contains local
amendments that constitute more restrictive building standards relating to fire
and panic safety than those adopted by the State Fire Marshal and contained in
the California Building Standards Code; and
WHEREAS, pursuant to Section 13869.7(c) of the California Health and
Safety Code, local amendments containing such more restrictive building
standards are not effective within the jurisdictional boundaries of the City until
ratified by the City Council; and
WHEREAS, it is the intention of the City to ratify all of these more
restrictive building standards and to have those standards be enforced in the
City;

NOW, THEREFORE, BE IT RESOLVED, that the City Council takes the
following action:
1. Adopts the 2017 District Fire Code as the Fire Code for the City,
2. Ratifies the Ordinance amending the District Fire Code adopted on
January 24, 2017, by the Board of Supervisors which contains more restrictive
building standards,
3. Finds that the more restrictive building standards contained in the
District Fire Code are reasonably necessary due to local climatic, geological, or
topographical conditions in the City and adopts by reference the specific findings
made in Section 324 of the Ordinance adopted by the Board of Supervisors
. regarding these local conditions, a copy of which is attached hereto as Exhibit 1,
4. Delegates authority to enforce the District Fire Code, including the
more restrictive building standards contained in the District Fire Code, to the
District Fire Chief, pursuant to Health and Safety Code section 1.3869.7,
5. Instructs the City Clerk to send a copy of this resolution to the

SECTION 324. Findings in Support of Adoption of More
Restrictive Building Standards.
The provisions of this ordinance contain various changes, modifications,
and additions to the 2016 California Fire Code. Some of those changes are
administrative in nature in that they do not constitute changes or modifications to
requirements contained in the building standards adopted by the State Fire
Marshall and published in the California Building Standards Code. Pursuant to
Health and Safety Code Sections 17958.5, 17958.7, and 18941.5, the Board of
Supervisors hereby expressly finds and determines that all of the changes and
modifications to requirements contained in the building standards published in
the California Building Standards Code, contained in this ordinance, which are
not administrative in nature, are reasonably necessary because of local climatic,
geological, or topographical conditions in the County of Los Angeles and in the
Consolidated Fire Protection District of Los Angeles County. This expressed
finding is supported and based upon the following more specific determinations:
CLIMATIC - The County of Los Angeles is located in an area subject to
climatic conditions with long periods of low humidity and hot weather, combined
with unpredictable seasonal high winds (Santa Ana wind conditions), resulting in
increased exposure to fire risk. This combination of events creates an
environment that is conducive to rapidly spreading fires. Control of such fires

requires rapid response. With the time that is required to deal with potential
obstacles from the wind, such as fallen trees, street lights, and utility poles, in
addition to the time required to climb 75 feet vertically up flights of stairs, the
ability to respond rapidly is negatively impacted. Additionally, there is a
significant increase in the amount of wind at 60 feet above the ground. Use of
aerial -type firefighting apparatus above this height would place rescue personnel
at increased risk of injury. High winds will also cause burning embers to become
airborne resulting in the rapid spread of a fire to nearby structures. Immediate
containment of a fire is the only method by which it can be controlled during high
wind conditions. In high fire severity zones, a unique combination of low
humidity, strong winds, and dry vegetation exists.
GEOLOGICAL - The County of Los Angeles is located in the middle of the
seismically active area identified as Seismic Zone 4. The viability of the public
water system would be questionable at best after a major seismic event. Tall
buildings would become vulnerable to uncontrolled fires due to a lack of available
water and an inability to pump sufficient quantities of any available water to floors
above the 55 -foot level. A severe seismic event has the potential to negatively
impact any rescue or fire suppression activities because it is likely to create
significant physical obstacles and logistical challenges. With the probability of
strong aftershocks, there exists a need to provide increased protection for
anyone on upper floors.
Geological conditions created by the numerous faults will result in
increased fire danger to structures, delayed Fire Department response, and

unique rescue challenges. Seismic events of sufficient magnitude will cause
substantial damage to structures. These damages are likely to be accompanied
by a substantial number of fires that may exceed the Fire Department
suppression capabilities. Accordingly, built-in fire suppression systems provide
the only adequate measure to mitigate the potential hazards from and damage
caused by such fires.
The County of Los Angeles is subject to occasional severe rainstorms.
The impacts from these rainstorms are exacerbated if hillside areas have been
burned by wildland fires because significant mud and debris flows can occur.
Mud and debris flows can impair Fire Department access or delay response
times if access roads are obstructed by mud or debris.
TOPOGRAPHICAL - The topographical conditions of the County of Los
Angeles includes many mountains, hills, and canyons which tend to accelerate
the periodic high -velocity winds by means of a venturi effect. These canyon
winds and the significant growth of vegetation of a combustible nature increase
the fire danger. Additionally, long periods of dry, hot weather, combined with
unpredictable seasonal winds (Santa Ana wind conditions) result in increased
exposure to fire risk. The hillside areas have access roads that are narrow,
steep, and contain many sharp curves, all of which makes timely response by
large fire apparatus difficult.
The specific sections of this code that constitute more restrictive building
standards are identified in the table set forth below. The more restrictive building
standards contained in this code and identified in the table below shall be

applicable only in those cities served by the District which have ratified the
aforesaid sections in accordance with California Health and Safety Code Section
13869.

Los Angeles County Fire Protection District Ordinance No. 2017-0003
SUBJECT:
The adoption of a resolution of More Restrictive Building Standards of
Los Angeles County Fire Protection District Ordinance No. 2017-0003 within
jurisdictional boundaries of the City.
RECOMMENDATIONS:
1. Adopt by majority vote the attached resolution, which adopts the Fire
District Code as the City's Fire Code and allows the Los Angeles County
Fire Protection District to enforce certain more restrictive fire and life
safety building standards within the City.
2. File a copy of the ratification of the more restrictive building standards and
required local findings together with the adopted City Ordinance with the
State Department of Housing and Community Development and the
California Building Standards Commission.
Discussion:
The resolution before you adopts the Los Angeles County Fire Protection District
Fire Code as the City's Fire Code and ratifies the building standards, relating to
fire and life safety, which are more restrictive than those adopted by the State
Fire Marshal and contained within the California Building Standards Code.
California law requires building standards adopted by local jurisdictions that are
more restrictive than those adopted by the state to be enacted by ordinance
within 180 days after the state adopts and publishes the California Building and
Fire Code. The California Health and Safety Code Section 13869.7 authorizes
the Fire District to adopt such standards but requires ratification by the legislative
body where the standards will apply.
Similar more restrictive building standards are contained in the existing Fire
Protection District Fire Code and have been in effect and are an integral part of
the District's fire protection plan. Modifications were recently adopted on January
24, 2017 and are contained in the current Ordinance.
The proposed More Restrictive Building Standards have been editorially
reformatted and renumbered to be consistent with the State Building Standards
Code, Part 9 (State Fire Code).

COUNTY AND DISTRICT FIRE CODE
SUMMARY OF CHANGES
Changes in the 2017 County/District Fire Code from existing 2014 Fire Code
include:
• All existing fees have been adjusted. Fees have not increased since
their inception in 2007.
• New permit, plan review and inspection fees have been added.
• Helistops for high-rise buildings are re -named emergency Helicopter
Landing Facilities and are now only required for buildings greater than
twelve stories in height (120 feet).
• Added more restrictive code language for smoke and heat vents on
certain commercial buildings. These more restrictive requirements
were deleted mid -code cycle from the model code.
• Required fire flow for mobile home parks has been reduced from 4,000
gallons to 1,250 gallons per minute for two hours and 2,000 gallons in
the Very High Fire Hazard Severity Zones.
• Appendix B (Fire Flow Requirements for Buildings): Previously
adopted; adding our requirements for tank size, memorializing our
policy guiding when land owners have to connect to an existing water
system, changed fire flow requirements to mirror state requirements in
low -hazard wildland fire areas.
• Appendix C (Hydrant Locations and Distribution): Previously adopted;
remove state language, install our standards, added locations on our
streets.
• Appendix D (Fire Apparatus Access Roads): Not previously adopted;
adopt state appendix, a few changes to allowed road width and grade.
California Health and Safety Code Section 13869.7 requires the Fire District and
each city to make and to file findings that support the need for more restrictive
building standards based on local climatic, geological, or topographical
conditions. Those findings from the Ordinance adopted by the Board of
Supervisors are as follows:

SECTION 324. Findings in Support of Adoption of More
Restrictive Building Standards.
The provisions of this ordinance contain various changes, modifications,
and additions to the 2016 California Fire Code. Some of those changes are
administrative in nature in that they do not constitute changes or modifications to
requirements contained in the building standards adopted by the State Fire
Marshall and published in the California Building Standards Code. Pursuant to
Health and Safety Code Sections 17958.5, 17958.7, and 18941.5, the Board of
Supervisors hereby expressly finds and determines that all of the changes and
modifications to requirements contained in the building standards published in
the California Building Standards Code, contained in this ordinance, which are
not administrative in nature, are reasonably necessary because of local climatic,
geological, or topographical conditions in the County of Los Angeles and in the
Consolidated Fire Protection District of Los Angeles County. This expressed
finding is supported and based upon the following more specific determinations:
CLIMATIC - The County of Los Angeles is located in an area subject to
climatic conditions with long periods of low humidity and hot weather, combined
with unpredictable seasonal high winds (Santa Ana wind conditions), resulting in
increased exposure to fire risk. This combination of events creates an
environment that is conducive to rapidly spreading fires. Control of such fires
requires rapid response. With the time that is required to deal with potential
obstacles from the wind, such as fallen trees, street lights, and utility poles, in

containment of a fire is the only method by which it can be controlled during high
wind conditions. In high fire severity zones, a unique combination of low
humidity, strong winds, and dry vegetation exists.
GEOLOGICAL - The County of Los Angeles is located in the middle of the
seismically active area identified as Seismic Zone 4. The viability of the public
water system would be questionable at best after a major seismic event. Tall
buildings would become vulnerable to uncontrolled fires due to a lack of available
water and an inability to pump sufficient quantities of any available water to floors
above the 55 -foot level. A severe seismic event has the potential to negatively
impact any rescue or fire suppression activities because it is likely to create
significant physical obstacles and logistical challenges. With the probability of
strong aftershocks, there exists a need to provide increased protection for
anyone on upper floors.
Geological conditions created by the numerous faults will result in
increased fire danger to structures, delayed Fire Department response, and
unique rescue challenges. Seismic events of sufficient magnitude will cause
substantial damage to structures. These damages are likely to be accompanied
by a substantial number of fires that may exceed the Fire Department

suppression capabilities. Accordingly, built-in fire suppression systems provide
the only adequate measure to mitigate the potential hazards from and damage
caused by such fires.
The County of Los Angeles is subject to occasional severe rainstorms.
The impacts from these rainstorms are exacerbated if hillside areas have been
burned by wildland fires because significant mud and debris flows can occur.
Mud and debris flows can impair Fire Department access or delay response
times if access roads are obstructed by mud or debris.
TOPOGRAPHICAL - The topographical conditions of the County of Los
Angeles includes many mountains, hills, and canyons which tend to accelerate
the periodic high -velocity winds by means of a venturi effect. These canyon
winds and the significant growth of vegetation of a combustible nature increase
the fire danger. Additionally, long periods of dry, hot weather, combined with
unpredictable seasonal winds (Santa Ana wind conditions) result in increased
exposure to fire risk. The hillside areas have access roads that are narrow,
steep, and contain many sharp curves, all of which makes timely response by
large fire apparatus difficult.
The specific sections of this code that constitute more restrictive building
standards are identified in the table set forth below. The more restrictive building
standards contained in this code and identified in the table below shall be
applicable only in those cities served by the District which have ratified the
aforesaid sections in accordance with California Health and Safety Code Section
13869.

Provides various design and location
requirements for temporary haunted houses,
ghost walks, and similar amusement uses where
the means of egress are not apparent due to
decorative materials, confusing sounds, and/or
visual effects. Necessary because of increased
danger of fire in Los Angeles County due to
climatic and topographical conditions and the
prevalence of earthquakes in Los Angeles
County.
