ORDINANCE NO. 256: AN ORDINANCE OF THE CITY OF ROLLING HILLS

City Manager Nealis presented the staff report providing background on Ordinance No.
256. City Manager Nealis reported that the School District met with the residents who
previously expressed concerns relating to this project and that all reports from that
meeting were extremely positive. Mayor Pernell opened the continued public hearing and
called for testimony. Hearing none, Mayor Pernell closed the public hearing and called for
a motion.
Councilmember Heinsheimer moved that the City Council waive further reading and
adopt Ordinance No. 256. Councilmember Hill seconded the motion which carried by the
following roll call vote:
AYES: Councilmembers Heinsheimer, Hill, Lay, Mayor Pro Tem Murdock and
Mayor Pernell.
NOES: None.
ABSENT: None.
ABSTAIN: None.
Palos Verdes Transit Authority Chair Rosemary Humphrey thanked the City Council and
staff for their efforts and reported that the residents objecting to the Conditional Use
Permit indicated that they will not be filing an appeal.

CONSIDERATION OF:
ORDINANCE NO. 255-U: AN ORDINANCE OF THE CITY OF ROLLING

AND AMENDING TITLE 17 OF THE ROLLING HILLS MUNICIPAL CODE,
AND DECLARING THE URGENCY THEREOF.

City Manager Nealis presented the staff report outlining Ordinance No. 255-U and
Ordinance No. 256. Councilmembers discussed the impact of the adoption of Ordinance
No. 255-U on Planning Commission Resolution No. 95-16 if the Planning Commission
action is appealed. City Manager Nealis explained that the Urgency Ordinance will take
effect immediately, if adopted this evening, and it will enable Resolution No. 95-16 to take
effect.
• Mr. Hal Lindsey, 19 Coveview Drive, .Rancho Palos Verdes, stated that he was present
when the Planning Commission took action on the School District's application for a
Conditional Use Permit and Zone Text Amendment and was under the impression
that those wishing to give public testimony would be able to do so at the City Council
meeting.
City Manager Nealis apologized for any misunderstanding and explained the public
hearing and appeal process.
In response to Mayor Pernell, Palos Verdes Estates Councilmember Rosemary Humphrey,
Chair of the Palos Verdes Peninsula Transit Authority, stated that if the Council were to
adopt the Urgency Ordinance, the Authority would want to place the Administrator at the
location, however, would hold off placing the vans on the School District property until
the appeal period was over.
In response to Councilmember Heinsheimer, City Manager Nealis explained that the
Municipal Code states that a decision of the Planning Commission relative to a
Conditional Use Permit is considered final on the date the Commission adopts a
Resolution setting forth a decision. He further stated that the decision shall become
effective 30 days after the adoption of the Resolution unless an appeal is filed or the City
Council takes jurisdiction in accordance with the procedures set forth in the Municipal
Code. He explained that the Urgency Ordinance would accelerate approval of the
application to November 17, 1995.
Councilmembers discussed the conditions set forth in Resolution No. 95-16 requiring the
applicant and other affected agencies to coordinate meetings with area residents regarding
their concerns prior to the March, 1996, Planning Commission meeting and report to the
Planning Commission on the results of that meeting. Mayor Pernell stated that he feels
that the Planning Commission did an exemplary job in addressing this issue and the
concerns raised during their deliberations. He further stated that given the urgency of the
request and thorough review by the Planning Commission, that this item should be
considered this evening. Mayor Pernell invited those present at the meeting to come
forward with their concerns regarding the Ordinance.
Mayor Pernell reminded those in attendance that their testimony must be limited to the
City Council's action relative to this Ordinance. Mayor Pernell opened the public hearing
and called for testimony. .
• Mrs. Judy McFarland, 5 Coveview Drive, Rancho Palos Verdes, questioned whether an
environmental review was prepared. She expressed concern for noise and . exhaust
from the ten vans which may impact her property.
City Manager Nealis reported that a Negative Declaration was prepared and presented to
the Planning Commission at their public hearing. He further reported that it was
determined that this request poses no significant impact on the environment. City
Manager Nealis offered to send Mrs. McFarland and copy of the staff report which contains
the environmental worksheet for her review.

• Dr. H. ndsey, 19 Coveview Drive, Rancho Pal 'erdes, expressed that he feels
noise .,aturally amplified from the School District property, up the hill, to his
property. He stated that he can hear conversations and other noise created by the
maintenance activities. He stated that he and his wife work nights and are awakened
each morning at 7:00 a.m. by this noise. He reported that his wife has addressed this
issue with the maintenance personnel without positive results. Dr. Lindsey stated that
he feels that this noise has a significant environmentalimpact on his property.
• Mrs. Kim Lindsey, 19 Coveview Drive, Rancho Palos Verdes, stated that her health is
being affected by being awakened each morning by the noise emanating from the
School District property. Mrs. Lindsey suggested that other places on the Peninsula be
sought for the purpose of storing transit vans.
• Mrs. Ruth Baldridge, 11 Coveview Drive, Rancho Palos Verdes, expressed concern
about noise from the School District property. Mrs. Baldridge also stated that she feels
that the District property presents an unsightly view from her home.
• Mrs. Jenny Snider, 25 Buggy Whip Drive, urged the City Council to adopt the
Ordinance. She stated that she attended the Planning Commission meeting relative to
this Ordinance and feels that the Planning Commission did a thorough job in
reviewing this case.
• Mrs. Anita Bailin, 17 Coveview Drive, Ranch Palos Verdes, stated that she left the first
Planning Commission public hearing with the understanding that the Transit'
Authority would be finding another location in which to store their vehicles and was '
unable to attend the continued public hearing in October.
Mayor Pernell reminded those giving testimony that they must limit their comments to
the Ordinance rather than the merits of Zoning Case No. 532. Mayor Pernell explained
that the City Council has already accepted the Planning Commission Resolution of
approval in that Zoning Case and is now discussing the appropriateness of the Urgency
Ordinance.
In response to Mrs. Bailin, to set the record straight, City Manager Nealis explained that the
Planning Commission suggested numerous locations to the District for evaluation. He
reported that the District prepared and presented written correspondence addressing this
issue and also presented oral testimony at the Planning Commission meeting on October
17, 1995, relative to their research. City Manager Nealis stated that after evaluation of the
Districts report and public testimony, the Planning Commission approved the project with
conditions which they felt addressed concerns raised by those in opposition to the project.
• Rancho Palos Verdes Mayor Lee Byrd, addressed the City Council regarding the degree
of urgency of this Ordinance. He reported that he understands that some Rancho Palos
Verdes residents are effected by the School District Maintenance facility noise. He
reported that the cost savings to the transit system are crucial to its future. Mayor Byrd
indicated that he is willing to work with the Rancho Palos Verdes residents who are
opposed to this proposal to assist in mitigating their concerns.
In response to Mayor Pro Tem Murdock, Palos Verdes Transit Authority Chair Rosemary
Humphrey stated that the transit vehicle capacity is sixteen to nineteen passengers. Chair
Humphrey explained that the transit vehicles are only in operation on Monday through
Friday.
In response to Councilmember Heinsheimer, City Manager Nealis stated that the
alternative locations suggested by the Planning Commission were investigated and
deemed to be unacceptable for use by the Authority. Transit Authority Chair Humphrey
reported on the alternative sites which were considered and the reasons they were deemed
unacceptable. She also explained that the School District site best suites their needs and is
consistent with the uses already established on the property.
Mayor Pernell closed the public hearing. In response to Councilmember Heinsheimer,
City Manager Nealis explained that the Conditional Use Permit will expire on June 30,

that the City Council can at any time direct staff to bring- before them a modification to a
section in the Municipal Code. Councilmember Lay suggested that staff be directed to bring
this Ordinance back to the City Council's attention for review in September, 1996.

Ordinance No. 255-U. Councilmember Heinsheimer seconded the motion which carried

Councilmember Heinsheimer moved that the City Council waive further reading and
introduce Ordinance No. 256. Mayor Pro Tem Murdock seconded the motion which
carried unanimously. Hearing no further discussion, Mayor Pernell continued the public
hearing to the next regularly scheduled meeting of the City Council to be held on Monday,
November 13, 1995.
In response to Mrs. Kim Lindsey, City Manager Nealis explained the appeal process. He
also stated that Ordinance 256 will be considered for second reading and adoption at the
next regularly scheduled meeting of the City Council. City Manager Nealis offered to have
Principal Planner Ungar meet with those persons objecting to the approval of the
Conditional Use Permit and the adoption of Ordinance Nos. 255-U and 256 in the lobby
after the meeting for further explanation and to obtain the paperwork necessary for an
appeal.

AN ORDINANCE OF THE CITY OF ROLLING HILLS AUTHORIZING JOINT
POWER TRANSIT AUTHORITY LIMITED USES AS A CONDITIONALLY
PERMITTED USE IN THE RA -S-2 ZONE, AND AMENDING TITLE 17 OF
THE ROLLING HILLS MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. On August 7, 1995, applications were duly filed by the Palos Verdes
Peninsula Unified School District with respect to real property at the ±31.14 acre western
portion of Lot 72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting (1) to
amend the Rolling Hills Zoning Ordinance to allow joint powers transit authority uses as
a conditionally permitted use in the RA -S-2 Zone; and (2) a Conditional Use Permit to
allow portions of school district property used as a maintenance and warehouse facility at
the Palos Verdes Peninsula Unified School District property to be used by a joint powers
transit authority for administrative uses and the storage parking only of 10 vans at the
Palos Verdes Peninsula Unified School District Crest Road property at 38 Crest Road West,
Rolling Hills, CA (±31.14 acre western portion of Lot 74 -MS).
Section 2. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2) education
material and library facility building, (3) warehouse building, (4) district maintenance
building, and (5) an elementary school building. The Conditional Use Permit expired on
February 26, 1964 and no new buildings were constructed.
Section 3: On, June 5, 1964 a Conditional Use Permit was. denied by the Planning
Commission to permit the construction of an (1) administration building, (2) elementary
school building, and (3) district maintenance building. The Planning Commission found
that the construction and location of the proposed administration building, maintenance
building and garage would establish and permit a commercial use of the property that
would consist of a garage for the storage of approximately thirty-seven (37) diesel school
buses, a facility for repairing, maintaining and servicing the buses, a warehouse for the
storage of school supplies and a repair/workshop for the repair and maintenance of school
property, all of which use:; will create noise, dirt and confusion from 6 AM in the morning
until approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property adjoining
the school property and interfere with the enjoyment of the residential use of the adjacent
properties by the residents and owners.
Section 4. Applications were made for the subject uses by the Palos Verdes
Peninsula Unified School District on August 7, 1995. On August 17, 1995, Planning staff
prepared an initial study for the project. The initial study found that the project would not
have a significant effect on the environment. A Negative Declaration was prepared and
was circulated to the applicant and other interested parties in accordance with State of
California CEQA Guidelines. The public notice of the Planning Commission's intent to
recommend approval of the Negative Declaration was published on August 31, 1995.
Copies of the Negative Declaration were sent to adjacent cities and other government
agencies. No comments on the Negative Declaration were received.
Section 5. The project as proposed is to permit portions of school district property
used as a maintenance and warehouse facility to be used by a joint powers transit authority
for administrative uses and the storage parking only of 10 vans at the site. The site will
continue to be used for the storage and maintenance of school district vehicles and
equipment. The school district proposes to permit a joint powers transit authority to use
500 square feet of the northernmost portion of a 7,600 square foot warehouse for
administrative uses and 2,500 square feet of an existing asphalt paved area of school district
property for the storage parking only of 10 vans.
Section 6. On September 19, 1995 and October 17, 1995, the Planning Commission
held a public hearing regarding the proposed ordinance regarding public transportation
limited uses by a joint powers transit authority on school district property. The
Ordinance No. 256 -1-
Co ssion adopted Resolution No. 95-15, reo ending modification of Paragraph B of
Sec 17.16.040 of the Zoning Ordinance.
Section 7. On October 23, 1995 and November 13, 1995, the City Council held a
public hearing regarding the proposed ordinance regarding public transportation limited
uses by a joint powers transit authority on school district property. Palos Verdes Peninsula
Unified School District representatives were in attendance at the hearing.
Section 8. The City Council has reviewed the proposed Negative Declaration and
finds that it represents the independent judgment of the City and that it was prepared in
compliance with CEQA. Therefore, the City Council finds that the proposed project could
not have a significant effect on the environment. Based upon these findings, the City
Council hereby adopts the Negative Declaration in accordance with the California
Environmental Quality Act.
Section 9. With respect to the request to amend the Rolling Hills Zoning
Ordinance to include a joint powers transit authority under Section 17.16.040(B)
Conditional Use Permit as Primary Use, the City Council finds:
A. The proposed project is consistent with the General Plan goals and policies to
maintain Rolling Hills' distinctive rural residential character (Land Use Element, p. 15.),
to maintain the rural character of Rolling Hills' road system (Circulation Element, p. 13.)
and to maintain the private status of the streets within the City boundaries (Circulation
Element, p. 13) because there will not be any development on the site and access shall
continue from outside the gates of the City.
B. The proposed use will fulfill a public necessity in the use of portions of school
district property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of 10 vans at the site
for Peninsula students and residents. The proposed use will conserve public costs related
to van storage, van fuel, van use and driver commuting distances.
C. The proposed use will be convenient in that portions of school district
property used by the joint powers transit authority for administrative uses and the storage
parking only of 10 vans at the site will be accessed from outside of the gates of the City.
The transit vans will be stored at the school district property during the time they are not
in use which will decrease road traffic on the Peninsula, reduce fuel consumption and
preserve air quality.
D. The proposed use will benefit the health, safety and general welfare of the
citizens of the City of Rolling Hills, as well as the citizens of the Palos Verdes Peninsula, in
that portions of school district property used by the joint powers transit authority for
administrative uses and the storage parking only of 10 vans at the site will not use Rolling
Hills' roads, traffic will be decreased on the Palos Verdes Peninsula, fuel consumption will
be reduced on the Peninsula, and the air quality of the Peninsula will be preserved.
Section 10. Based upon the findings contained in Sections 8 and 9 of this
ordinance, Paragraph B of Section 17.16.040 of Chapter 16 of Title 17 (Zoning Ordinance) of
the Rolling Hills Municipal Code is amended to read:
"B. Conditional Use As Primary Use. The following conditional uses may be
permitted as a primary use on a lot:
1. Elementary school offering State -mandated curriculum;
2. Fire station;
3. Gate house;
4. Park and/or playground;
5. Public transportation limited uses by a joint powers transit authority
on school district property which is developed as a school maintenance
facility in the RA -S-2 Zone;
6. Public utility building or structure, including a reservoir or tank,
necessary for the provision of essential utility services to permitted
uses in the City, but excluding wires, pipelines or poles;
7. Temporary manufactured home."

School District property to be used by a joint powers transit
authority for administrative uses and the storage parking only of
10 vans at the Palos Verdes Peninsula Unified School District Crest
Road property at 38 Crest Road West, Rolling Hills, CA (±31.14
acre western portion of Lot 74 -MS).
Section 2. On February 26, 1963, a Conditional
Use Permit was approved by the Planning Commission for the
following five structures to be constructed at the Palos Verdes
Peninsula Unified School District site: (1) administration
building, (2) education material and library facility building, (3)
warehouse building, (4) district maintenance building, and (5) an
elementary school building. The Conditional Use Permit expired
on February 26, 1964 and no new buildings were constructed.
Section 3. On, June 5, 1964 a Conditional Use
Permit was denied by the Planning Commission to permit the
construction of an (1) administration building, (2) elementary
school building, and (3) district maintenance building. The
Planning Commission found that the construction and location of
the proposed administration building, maintenance building and
garage would establish and permit a commercial use of the property
that would consist of a garage for the storage of approximately
thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of
school supplies and a repair/workshop for the repair and
maintenance of school property, all of which uses will create
noise, dirt and confusion from 6 AM in the morning until
approximately 5 PM in the afternoon each day the facilities are in
operation, and these uses would constitute a nuisance and
depreciate the value of all property adjoining the school property
and interfere with the enjoyment of the residential use of the
adjacent properties by the residents and owners.
Section 4. Applications were made for the subject
uses by the Palos Verdes Peninsula Unified School District on
August 7, 1995. On August 17, 1995, Planning staff prepared an
initial study for the project. The initial study found that the project
would not have a significant effect on the environment. A
Negative Declaration was prepared and was circulated to the
applicant and other interested parties in accordance with State of
California CEQA Guidelines. The public notice of the Planning
Commission's intent to recommend approval of the Negative
Declaration was published on August 31, 1995. Copies of the
Negative Declaration were sent to adjacent cities and other
government agencies. No comments on the Negative Declaration
were received.
Section 5. The project as proposed is to permit
portions of school district property used as a maintenance and
warehouse facility to be used by a joint powers transit authority for
administrative uses and the storage parking only of 10 vans at the
site. The site will continue to be used for the storage and
maintenance of school district vehicles and equipment. The school
district proposes to permit a joint powers transit authority to use
500 square feet of the northernmost portion of a 7,600 square foot
warehouse for administrative uses and 2,500 square feet of an
existing asphalt paved area of school district property for the
storage parking only of 10 vans.
Section 6, On September 19, 1995 and October 17,
1995, the Planning Commission held a public hearing regarding
the proposed ordinance regarding public transportation limited
uses by a joint powers transit authority on school district
property. The Commission adopted Resolution No. 95-15,
recommending modification of Paragraph B of Section 17.16.040
of the Zoning Ordinance.
Section 7, On October 23, 1995 and November
13, 1995, the City Council held a public hearing regarding the
proposed ordinance regarding public transportation limited uses by
a joint powers transit authority on school district property. Palos
Verdes Peninsula Unified School District representatives were in
attendance at the hearing.
Section 8. The City Council has reviewed the proposed
Negative Declaration and finds that it represents the independent
judgment of the City and that it was prepared in compliance with
CEQA. Therefore, the City Council finds that the proposed
project could not have a significant effect on the environment.
Based upon these findings, the City Council hereby adopts the
Negative Declaration in accordance with the California
Environmental Quality Act.
Section 9, With respect to the request to amend the
Rolling Hills Zoning Ordinance to include a joint powers transit
authority under Section 17.16.040(B) Conditional Use Permit as
Primary Use, the City Council finds:
A. The proposed project is consistent with the General
Plan goals and policies to maintain Rolling Hills' distinctive rural
residential character (Land Use Element, p. 15.), to maintain the
rural character of Rolling Hills' road system (Circulation Element, p.
13.) and to maintain the private status of the streets within the City
boundaries (Circulation Element, p. 13) because there will not be
any development on the site and access shall continue from outside
the gates of the City.
B. The proposed use will fulfill a public necessity in
the use of portions of school district property used as, a maintenance
and warehouse facility to be used by a joint powers transit authority
for administrative uses and the storage parking only of 10 vans at
the site for Peninsula students and residents. The proposed use will
conserve public costs related to van storage, van fuel, van use and
driver commuting distances.
C. The proposed use will be convenient in that
portions of school district property used by the joint powers transit
authority for administrative uses and the storage parking only of 10
vans at the site will be accessed from outside of the gates of the
City. The transit vans will be stored at the school district property
during the time they are not in use which will decrease road traffic on
the Peninsula, reduce fuel consumption and preserve air quality.
D. The proposed use will benefit the health, safety and
general welfare of the citizens of the City of Rolling Hills, as well
as the citizens of the Palos Verdes Peninsula, in that portions of
school district property used by the joint powers transit authority
for administrative uses and the storage parking only of 10 vans at
the site will not use Rolling Hills' roads, traffic will be decreased on
the Palos Verdes Peninsula, fuel consumption will be reduced on the
Peninsula, and the air quality of the Peninsula will be preserved.
Section 10. Based upon the findings contained in
Sections 8 and 9 of this ordinance, Paragraph B of Section
17.16.040 of Chapter 16 of Title 17 (Zoning Ordinance) of the
Rolling Hills Municipal Code is amended to read:
"B. Conditional Use As Primary Use. The following conditional
uses may be permitted as a primary use on a lot:
1. Elementary school offering State- mandated
curriculum;
2: Fire station;
3. Gate house;
4. Park and/or playground;
5. Public transportation limited uses by a joint powers transit
authority on school district property which is developed as a school
maintenance facility in the RA -S-2 Zone;
6. Public utility building or structure, including a reservoir or
tank, necessary for the provision of essential utility services to
permitted uses in the City, but excluding wires, pipelines or poles;
7. Temporary manufactured home."

19, 1995, Commissioners opened the public hearing regarding this proposed Zoning
Code Text Amendment. This Zoning Code Text Amendment would amend
Paragraph B of Section 17.16.040 of the Rolling Hills Municipal Code to allow public
transportation limited uses by a joint powers transit authority on school district
property which is developed as a school district maintenance facility in the RA -S-2
Zone as a conditionally permitted use. At the regular meeting of the Commission
held Tuesday, October 17, 1995, Commissioners, by a unanimous vote,
recommended that the City Council adopt the urgency and regular form of this
Ordinance.
Adoption of these Ordinances provides a limited amendment to the Rolling Hills
Municipal Code for this specified use. A copy of the staff report that was presented
to the Planning Commission is attached to this staff report for consideration.
Specifics regarding the associated Conditional Use Permit application are provided
under a separate Agenda Item this evening.
RECOMMENDATION
It would be in order for members of the City Council to open the public hearing,
take testimony, and then consider adoption of the Urgency Ordinance and

School District Crest Road property at 38 Crest Road West, Rolling Hills, CA (±31.14
acre western portion of Lot 74 -MS).
Section 2. On February 26, 1963, a Conditional Use Permit was approved by
the Planning Commission for the following five structures to be constructed at the
Palos Verdes Peninsula Unified School District site: (1) administration building, (2)
education material and library facility building, (3) warehouse building, (4) district
maintenance building, and (5) an elementary school building, The Conditional Use
Permit expired on February 26, 1964 and no new buildings were constructed.
Section 3. On, June 5, 1964 a Conditional Use Permit was denied by the
Planning Commission to permit the construction of an (1) administration building,
(2) elementary school building, and (3) district maintenance building. The Planning
Commission found that the construction and location of the proposed
administration building, maintenance building and garage would establish and
permit a commercial use of the property that would consist Lof a garage for the
storage of approximately thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for the repair and maintenance of school property, all of
which uses will create noise, dirt and confusion from 6 AM in the morning until
approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.

Section 4, Applications were made for the subject uses by the Palos Verdes
Peninsula Unified School District on August 7, 1995. On August 17, 1995, Planning
staff prepared an initial study for the project. The initial study found that the project
would not have a significant effect on the environment. A Negative Declaration
was prepared and was circulated to the applicant and other interested parties in
accordance with State of California CEQA Guidelines. The public notice of the
Planning Commission's intent to recommend approval of the Negative Declaration
was published on August 31, 1995. Copies of the Negative Declaration were sent to
adjacent cities and other government agencies. No comments on the Negative
Declaration were received.
Section 5. The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of 10 vans at
the site. The site will continue to be used for the storage and maintenance of school
district vehicles and equipment. The school district proposes to permit a joint
powers transit authority to use 500 square feet of the northernmost portion of a 7,600
square foot warehouse for administrative uses and 2,500 square feet of an existing
asphalt paved area of school district property for the storage parking only of 10 vans.
Section 6. The Planning Commission conducted a duly noticed public
hearing to consider the applications on September 19, 1995 and October 17, 1995. The
applicants were notified of the public hearing in writing by first class mail. Evidence
was heard and presented from all persons interested in affecting said proposal, from
all persons protesting the same, and from members of the City staff and the
Planning Commission having reviewed, analyzed and studied said proposal. Palos
Verdes Peninsula Unified School District representatives were in attendance at the
hearing.
Section 7. The Planning Commission has reviewed the proposed Negative
Declaration and finds that it represents the independent judgment of the City and
that it was prepared in compliance with CEQA. Therefore, the Planning
Commission finds that the proposed project could not have a significant effect on
the environment. Based upon these findings, the Planning Commission hereby
recommends that the City Council adopt the Negative Declaration in accordance
with the California Environmental Quality Act.
Section 8. With respect to the request to amend the Rolling Hills Zoning
Ordinance to include a joint powers transit authority under Section 17.16.040(B)
Conditional Use Permit as Primary Use, the Planning Commission finds:
A. The proposed project is consistent with the General Plan goals and
policies to maintain Rolling Hills' distinctive rural residential character (Land Use
Element, p. 15.), to maintain the rural character of Rolling Hills' road system
(Circulation Element, p. 13.) and to maintain the private status of the streets within

the City boundaries (Circulation Element, p. 13) because there will not be any
development on the site and access shall continue from outside the gates of the City.
B. The proposed use will fulfill a public necessity in the use of portions of
school district property used as a maintenance and warehouse facility to be used by a
joint powers transit authority for administrative uses and the storage parking only
of 10 vans at the site for Peninsula students and residents. The proposed use will
conserve public costs related to van storage, van fuel, van use and driver
commuting distances.
C. The proposed use will be convenient in that portions of school district
property used by the joint powers transit authority for administrative uses and the
storage parking only of 10 vans at the site will be accessed from outside of the gates
of the City. The transit vans will be stored at the school district property during the
time they are not in use which will decrease road traffic on the Peninsula, reduce
fuel consumption and preserve air quality.
D. The proposed use will benefit the health, safety and general welfare of
the citizens of the City of Rolling Hills, as well as the citizens of the Palos Verdes
Peninsula, in that portions of school district property used by the joint powers
transit authority for administrative uses and the storage parking only of 10 vans at
the site will not use Rolling Hills' roads, traffic will be decreased on the Palos
Verdes Peninsula, fuel consumption will be reduced on the Peninsula, and the air
quality of the Peninsula will be preserved.
Section 9. Based upon the findings contained in Sections 7 and 8 of this
resolution, the Planning Commission recommends that the City Council adopt an
ordinance to amend Paragraph B of Section 17.16.040 of Chapter 16 of Title 17
(Zoning Ordinance) of the Rolling Hills Municipal Code to read:
"B. Conditional Use As Primary Use. The following conditional uses may
be permitted as a primary use on a lot:
1. Elementary school offering State -mandated curriculum;
2. Fire station;
3. Gate house;
4. Park and/or playground;
5. Public transportation limited uses by a joint powers transit
authority on school district property which is developed as a
school maintenance facility in the RA -S-2 Zone;
6. Public utility building or structure, including a reservoir or tank,
necessary for the provision of essential utility services to
permitted uses in the City, but excluding wires, pipelines or
poles;
7. Temporary manufactured home."

BACKGROUND
1. At the September 19, 1995 meeting, the Planning Commission requested that
the school district explore alternative sites for the storage parking only of the
JPTA transit vans because of the complaints of adjacent residents who reside
in the City of Rancho Palos Verdes. The RPV residents who spoke at the
meeting were Ms. Kim Lindsay, 19 Cove View Drive; Mr. and Mrs. Stuart
Nelson, 21 Cove View Drive; and Mr. and Mrs. Fred Bailin, 17 Cove View
Drive.
2. Since that time, staff has received the attached letters of support from Mrs.
Rosemary Humphrey, Chairman, Palos Verdes Peninsula Transit Authority
and Councilmember, Palos Verdes Estates; Mr. James B. Hendrickson, City
Manager, City of Palos Verdes Estates and Mrs. Sheila Hoff, President, Palos
Verdes Peninsula League of Women Voters. We received the attached letter

of opposition from Mrs. Christa Hawkins, 37 Crest Road West in Rolling
Hills. Mrs. Humphrey's letter addresses issues discussed at the previous '
Planning Commission meeting, including noise.
Also attached are letters from Mr. Barry J. Hildebrand, President, Palos Verdes
Peninsula Unified School District Board of Education; Mr. Paul D. Bussey,
City Manager, City of Rancho Palos Verdes; and Mr. Douglas R. Prichard, City
Manager City of Rolling Hills Estates supporting the approval of the requested
use. Notices were sent to adjacent cities, other government agencies and to
citizens within a 1,000 foot radius of the property. No other comments have
been received. At the meeting, we will provide photos of the school district
site that include the proposed areas of use. Because of its urgency to the
School district, as noted in the letter from Assistant Superintendent Mr,
Michael Escalante, and the Palos Verdes Peninsula Transit Authority, who
would like the Commission to make a final recommendation at this meeting
we have attached eight separate draft resolutions as options for Planning
Commission review.
3. The project as proposed is to permit portions of school district property used
as a maintenance and warehouse facility to be used by a joint powers transit
authority for limited administrative uses and the storage parking only of 10
vans at the site. The site will continue to be used for the storage and
maintenance of school district vehicles and equipment. The school district
proposes to permit the Palos Verdes Peninsula Transit Authority to use 500
square feet of the northernmost portion of a 7,600 square foot warehouse for
limited administrative uses and 2,500 square feet of an existing asphalt paved
area of school district property for the storage parking only of 10 vans. There
will not be any transportation services behind the gates of the City of Rolling
Hills and the City will not be spending any funds to support the
transportation services. Palos Verdes Peninsula School District
representatives will be in attendance at the meeting.
4. The subject site is presently occupied by 7 school buildings, a maintenance
building, a warehouse building, a computer/office equipment repair building,
a vehicle repair shop, and an administration building. The site is located
within a one unit per 2 -acre designation and is surrounded at the north and
west by one-story ranch style development with agricultural outbuildings.
The Mary & Joseph Retreat property and St. John Fisher Church property,
respectively, are located directly to the west of the school district property in
the City of Rancho Palos Verdes. One and two story residential housing in
the City of Rancho Palos Verdes is located to the southwest. Staff has
inspected the portions of the site proposed for limited administrative office
uses and transit van storage parking only and cannot identify any significant
visual impacts to the City.

the maintenance of the school buses was the most objectionable issue. The
current request does not propose any vehicle maintenance of transit vans on
the school district property.
Nevertheless, state law permits local school facilities to exist for the direct
benefit or support of student activities. It is in this light that the existing
facilities exist. The current request is for transit uses that due to funding
limitations cannot be limited to school transportation only. However, the
reality is that the transportation vehicles will primarily serve school children
on the Peninsula.
7. On August 17, 1995, Planning staff prepared an initial study for the project.
The initial study found that the project would not have a significant effect on
the environment. A Negative Declaration was prepared and was circulated to
the applicant and other interested parties in accordance with State of
California CEQA Guidelines. The public notice of the Planning Commission's
intent to recommend approval of the Negative Declaration was published on
August 31, 1995.
RECOMMENDATION
It is recommended that the Planning Commission review the proposed plans, the
photos, the draft resolutions from which the Commission may choose one from the

Rancho Del Mar Continuation High School conducts classes at the property
site which serves the Palos Verdes Peninsula Unified School District.
The high school serves the communities of Rolling Hills, Rolling Hills
Estates, Rancho Palos Verdes and Palos Verdes Estates, The high school
has a capacity of 125 students but, varies substantially and quickly as
students can graduate at any time during the 10 month school year. Also
during the school year, eight teachers, one principal and a secretary
commute to and from the property.
For the entire year, a large portion of the site is used for the storage
and maintenance of school district vehicles and equipment. There are 23
school maintenance workers who park their vehicles at the property and
work off -site during the day. There are 5 warehouse workers who work
on -site during the business day. Access to the school district property
is via Crest Road from the west portion of the property outside the
gates of the City of Rolling Hills.
The Palos Verdes Peninsula community benefits are that the school
district site is being used for the education of Peninsula High School
students, and for the storage and maintenance of school district
vehicles and equipment. These uses do not impede one another. The site
is screened by landscaping from the road.

The text of the City's Zoning Ordinance must be amended. This is
because Section 17.16.040(B) of the Zoning Code lists the types of uses
allowed in the RA -S-2 Zone with a Conditional Use Permit. The uses that
are requested are not included in that list. Therefore, in order to
allow the maintenance and warehouse facility area to be used for the
storage parking only of local joint powers transit agency vans and for
the related administrative uses, Section 17.16.040(B) would have to be
amended to make that proposed use on• of the types permitted with a
Conditional Use Permit. In addition, the proposed use would require a

ENVIRONMENTAL SETTING
Item 31.148. Description of project site,
The project site is a large ±31.14 acre parcel consisting of undulating hillsides and
knolls covered by grasses, and mature shrubs and trees, with some areas being
heavily wooded. Currently, there are 12 one-story structures at the site. They consist
of 7 school buildings, 1 maintenance building, 1 warehouse building, 1
computer/office equipment repair building, 1 vehicle repair shop, and 1

administration building. A long tree lined driveway off Crest Road West outside
the City of Rolling Hills' gates beginning at the westernmost portion of the lot
serves as the accessway to the Palos Verdes School District property.
The school district is requesting to amend the Rolling Hills Zoning Ordinance and
requesting a Conditional Use Permit to permit portions of a high school
continuation school and maintenance and warehouse facility at the Palos Verdes
Peninsula Unified School District property to be used by a joint powers transit
agency for administrative uses and the storage parking only of 10 vans at the site.
The site will continue to be used for the Rancho Del Mar Continuation High School
and the storage and maintenance of.school district vehicles and equipment.
Native brush grows on the steep slope at the rear of the lot. Trees and shrubs
surround the existing facility at the south, west and north. with native plants,
grasses, shrubs, and trees beyond the facility area. Native birds and animals frequent
the area such as sparrows, crows, raccoons, possum, skunks, gophers and an
occasional fox.
Item 39. Description of surrounding properties,
The site is located within a one unit per 2 -acre designation and is surrounded at the
north and west by one-story ranch style development with agricultural
outbuildings. The Mary & Joseph Retreat property and St. John Fisher Church
property, respectively, are located directly to the west of the school district property
in the City of . Rancho Palos Verdes. One and two story residential housing in the
City of Rancho Palos Verdes is located to the southwest.

The following analysis is a description of the findings contained in the
Environmental Information and Checklist Form which preceded this page. A
detailed discussion of all potential environmental impacts checked "Yes" or
"Maybe" is provided, along with appropriate mitigation measures.
ENVIRONMENTAL IMPACTS
Item 40. Earth.
The proposed use will not require any development on the site.
Item 41. Air
The proposed use will generate slight increases in vehicle trips. It is determined
that there will be approximately 40 additional average daily trips (ADT). The 10
transit agency vans will leave and return approximately 2 times a day. The total

transit agency vans will leave and return approximately 2 times a day. The total
number of vehicle trips are equivalent to the total ADT of 4 single family residences
which average 10 ADT's per residence. Regionally, the ADTs of the transit agency
vans will be shortened because it will not be necessary for the vans to travel from
and to the current Long Beach facility 4 times a day during "down" time. The
impact on air quality in the City of Rolling Hills will be less than significant.
Item 42. Water
The proposed use will not require any development on the site and the impact
generated from the storage parking only of 10 vans will be less than significant.
Item 43. Plant Life
The proposed use will not require any development on the site. No known rare
and endangered species of plants exist in the City. The impact of the current
proposal is expected to be less than significant.
Item 44. Animal Life
The proposed use will not require any development on the site. The only animal
listed by the Federal Government is the Palos Verdes Blue, a butterfly which was not
seen in the Rolling Hills area from 1986 to 1994. In 1994, the Palos Verdes Blue was
seen at the nearby San Pedro Fuel Depot Station. Several other animals do occur,
however, that are considered as candidates for protection by either the Federal
Government or the State Government. Recently, the California gnatcatcher was
added to the list of endangered species and, in a recent census, pairs were located in
the adjacent City of Rancho Palos Verdes. Other target species for the Rancho Palos
Verdes Peninsula Area that are being studied by the State of California Department
of Fish and Game are the Cactus Wren and the Coast Horned Lizard. The impact of
the proposed use of portions of a maintenance and warehouse facility area of school
district property to be used by a joint powers transit agency for administrative uses
and the storage parking only of 10 vans at the site is expected to be less than
significant.
Item 46. Light and Glare
The proposed use will not require any development on the site. The 10 joint
powers transit agency vans will leave and return approximately 2 times a day. The
use of running lights will be required only during dense fog or early winter
evenings. Vans will access the the school district site from outside the City. Dense
landscape screening surrounds the school district site at the west, north and east.
Light and glare impacts therefore are expected to be less than significant.

AN ORDINANCE OF THE CITY OF ROLLING HILLS AUTHORIZING JOINT
POWER TRANSIT AUTHORITY LIMITED USES AS A CONDITIONALLY
PERMITTED USE IN THE RA -S-2 ZONE, AND AMENDING TITLE 17 OF
THE ROLLING HILLS MUNICIPAL CODE, AND DECLARING THE
URGENCY THEREOF.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. On August 7, 1995, applications were duly filed by the Palos Verdes
Peninsula Unified School District with respect to real property at the ±31.14 acre western
portion of Lot 72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting (1) to
amend the Rolling Hills Zoning Ordinance to allow joint powers transit authority uses as
a conditionally permitted use in the RA -S-2 Zone; and (2) a Conditional Use Permit to
allow portions of school district property used as a maintenance and warehouse facility at
the Palos Verdes Peninsula Unified School District property to be used by a joint powers
transit authority for administrative uses and the storage parking only of 10 vans at the
Palos Verdes Peninsula Unified School District Crest Road property at 38 Crest Road West,
Rolling Hills, CA (±31.14 acre western portion of Lot 74 -MS).
Section 2. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2) education
material and library facility building, (3) warehouse building, (4) district maintenance
building, and (5) an elementary school building. The Conditional Use Permit expired on
February 26, 1964 and no new buildings were constructed.
Section 3. On, June 5, 1964 a Conditional Use Permit was denied by the Planning
Commission to permit the construction of an (1) administration building, (2) elementary
school building, and (3) district maintenance building. The Planning Commission found
that the construction and location of the proposed administration building, maintenance
building and garage would establish and permit a commercial use of the property that
would consist of a garage for the storage of approximately thirty-seven (37) diesel school
buses, a facility for repairing, maintaining and servicing the buses, a warehouse for the
storage of school supplies and a repair/workshop for the repair and maintenance of school
property, all of which uses will create noise, dirt and confusion from 6 AM in the morning
until approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property adjoining
the school property and interfere with the enjoyment of the residential use of the adjacent
properties by the residents and owners.
Section 4. Applications were made for the subject uses by the Palos Verdes
Peninsula Unified School District on August 7, 1995. On August 17, 1995, Planning staff
prepared an initial study for the project. The initial study found that the project would not
have a significant effect on the environment. A Negative Declaration was prepared and
was circulated to the applicant and other interested parties in accordance with State of
California CEQA Guidelines. The public notice of the Planning Commission's intent to
recommend approval of the Negative Declaration was published on August 31, 1995.
Copies of the Negative Declaration were sent to adjacent cities and other government
agencies. No comments on the Negative Declaration were received.
Section 5. The project as proposed is to permit portions of school district property
used as a maintenance and warehouse facility to be used by a joint powers transit authority
for administrative uses and the storage parking only of 10 vans at the site. The site will
continue to be used for the storage and maintenance of school district vehicles and
equipment. The school district proposes to permit a joint powers transit authority to use
500 square feet of the northernmost portion of a 7,600 square foot warehouse for
administrative uses and 2,500 square feet of an existing asphalt paved area of school district
property for the storage parking only of 10 vans.
Section 6. On September 19, 1995 and October 17, 1995, the Planning Commission
held a public hearing regarding the proposed ordinance regarding public transportation
limited uses by a joint powers transit authority on school district property. The
ORDINANCE NO. 255-U -1-
C fission adopted Resolution No. 95-15, re mending modification of Paragraph B of
Section 17.16.040 of the Zoning Ordinance.
Section 7, On October 23, 1995, the City Council held a public hearing regarding
the proposed ordinance regarding public transportation limited uses by a joint powers
transit authority on school district property. Palos Verdes Peninsula Unified School
District representatives were in attendance at the hearing.
Section 8. The City Council has reviewed the proposed Negative Declaration and
finds that it represents the independent judgment of the City and that it was prepared in
compliance with CEQA. Therefore, the City Council finds that the proposed project could
not have a significant effect on the environment. Based upon these findings, the City
Council hereby adopts the Negative Declaration in accordance with the California
Environmental Quality Act.
Section 9. With respect to the request to amend the Rolling Hills Zoning
Ordinance •to include a joint powers transit authority under Section 17.16.040(B)
Conditional Use Permit as Primary Use, the City Council finds:
A. The proposed project is consistent with the General Plan goals and policies to
maintain Rolling Hills' distinctive rural residential character (Land Use Element, p. 15.),
to maintain the rural character of Rolling Hills' road system (Circulation Element, p. 13.)
and to maintain the private status of the streets within the City boundaries (Circulation
Element, p. 13) because there will not be any development on the site and access shall
continue from outside the gates of the City.
B. The proposed use will fulfill a public necessity in the use of portions of school
district property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of 10 vans at the site
for Peninsula students and residents. The proposed use will conserve public costs related
to van storage, van fuel, van use and driver commuting distances.
C. The proposed use will be convenient in that portions of school district
property used by the joint powers transit authority for administrative uses and the storage
parking only of 10 vans at the site will be accessed from outside of the gates of the City.
The transit vans will be stored at the school district property during the time they are not
in use which will decrease road traffic on the Peninsula, reduce fuel consumption and
preserve air quality.
D. The proposed use will benefit the health, safety and general welfare of the
citizens of the City of Rolling Hills, as well as the citizens of the Palos Verdes Peninsula, in
that portions of school district property used by the joint powers transit authority for
administrative uses and the storage parking only of 10 vans at the site will not use Rolling
Hills' roads, traffic will be decreased on the Palos Verdes Peninsula, fuel consumption will
be reduced on the Peninsula, and the air quality of the Peninsula will be preserved.
Section 10. Based upon the findings contained in Sections 8 and 9 of this
ordinance, Paragraph B of Section 17.16.040 of Chapter 16 of Title 17 (Zoning Ordinance) of
the Rolling Hills Municipal Code is amended to read:
"B. Conditional Use As Primary Use. The following conditional uses may be
permitted as a primary use on a lot:
1. Elementary school offering State -mandated curriculum;
2. Fire station;
3. Gate house;
4. Park and/or playground;
5. Public transportation limited uses by a joint powers transit authority
on school district property which is developed as a school maintenance
facility in the RA -S-2 Zone;
6. Public utility building or structure, including a reservoir or tank,
necessary for the provision of essential utility services to permitted
uses in the City, but excluding wires, pipelines or poles;
7. Temporary manufactured home."
Section 11. This ordinance is an urgency ordinance which is necessary for the
immediate preservation of public health, safety and welfare and shall take effect
immediately. The Palos Verdes Peninsula Transit Authority is experiencing a budgetary
ORDINANCE NO. 255-U -2-
shortfall r ring the immediate reduction in costs I rvices. The Authority's use of
this site has been found by the City and the Authority to be the only site reasonably
available which could be used for the storage of transit vans without incurring substantial
costs. The Authority's use of the site will allow the Authority to reduce personnel time,
fuel costs, fuel consumption and provide more efficient service to area residents. In the
absence of these savings, the Authority will be required to immediately begin to curtail
services, which could have significant adverse impacts to the general welfare of the
community. For these reasons, this ordinance is an urgency ordinance and shall take effect
immediately.

AN ORDINANCE OF THE CITY OF ROLLING
HILLS AUTHORIZING JOINT POWER
TRANSIT AUTHORITY LIMITED USES AS A
CONDITIONALLY PERMITTED USE IN THE
RA -S-2 ZONE, AND AMENDING TITLE 17 OF
THE ROLLING HILLS MUNICIPAL CODE, AND
DECLARING THE URGENCY THEREOF.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS
DOES HEREBY ORDAIN AS FOLLOWS:
Section 1, On August 7, 1995, applications were duly filed by the
Palos Verdes Peninsula Unified School District with respect to real property at
the ±31.14 acre western portion of Lot 72-RH, and currently, 38 Crest Road
West, Rolling Hills, requesting (1) to amend the Rolling Hills Zoning Ordinance
to allow joint powers transit authority uses as a conditionally permitted use in
the RA -S-2 Zone; and (2) a Conditional Use Permit to allow portions of school
district property used as a maintenance and warehouse facility at the Palos
Verdes Peninsula Unified School District property to be used by a joint powers
transit authority for administrative uses and the storage parking only of 10
vans at the Palos Verdes Peninsula Unified School District Crest Road property
at 38 Crest Road West, Rolling Hills, CA (±31.14 acre western portion of Lot
74 -MS).
Section 2, On February 26, 1963, a Conditional Use Permit was
approved by the Planning Commission for the following five structures to be
constructed at the Palos Verdes Peninsula Unified School District site: (1)
administration building, (2) education material and library facility building,
(3) warehouse building, (4) district maintenance building, and (5) an elementary
school building. The Conditional Use Permit expired on February 26, 1964
and no new buildings were constructed.
Section 3, On, June 5, 1964 a Conditional Use Permit was denied
by the Planning Commission to permit the construction of an (1) administration
building, (2) elementary school building, and (3) district maintenance building.
The Planning Commission found that the construction and location of the
proposed administration building, maintenance building and garage would
establish and permit a commercial use of the property that would consist of a
garage for the storage of approximately thirty-seven (37) diesel school buses,
a facility for repairing, maintaining and servicing the buses, a warehouse for
the storage of school supplies and a repair/workshop for the repair and
maintenance of school property, all of which uses will create noise, dirt and
confusion from 6 AM in the morning until approximately 5 PM in the afternoon
each day the facilities are in operation, and these uses would constitute a
nuisance and depreciate the value of all property adjoining the school property
and interfere with the enjoyment of the residential use of the adjacent properties
by the residents and owners.
Section 4. Applications were made for the subject uses by the Palos
Verdes Peninsula Unified School District on August 7, 1995. On August 17,
1995, Planning staff prepared an initial study for the project. The initial study
found that the project would not have a significant of fect on the environment.
A Negative Declaration was prepared and was circulated to the applicant and
other interested parties in accordance with State of California CEQA Guidelines.
The public notice of the Planning Commission' s intent to recommend approval
of the Negative Declaration was published on August 31, 1995. Copies of the
Negative Declaration were sent to adjacent cities and other government
agencies. No comments on the Negative Declaration were received.
Section 5, The project as proposed is to permit portions of school
district property used as a maintenance and warehouse facility to be used by a
joint powers transit authority_ for administrative uses and the storage parking
only of 10 vans at the site. The site will continue to be used for the storage and
maintenance of school district vehicles and equipment. The school district
proposes to permit a joint powers transit authority to use 500 square feet of the
northernmost portion of a 7,600 square foot warehouse for administrative uses
and 2,500 square feet of an existing asphalt paved area of school district property
for the storage parking only of 10 vans.
Section 6. On September 19, 1995 and October 17, 1995, the
Planning Commission held a public hearing regarding the proposed ordinance
regarding public transportation limited uses by a joint powers transit authority
on school district property. The Commission adopted Resolution No.
95-15, recommending modification of Paragraph B of Section 17.16.040 of
the Zoning Ordinance.
Section 7, On October 23, 1995, the City Council held a public
hearing regarding the proposed ordinance regarding public transportation
limited uses by a joint powers transit authority on school district property .
Palos Verdes Peninsula Unified School District representatives were in
attendance at the hearing.
Section 8, The City Council has reviewed the proposed Negative
Declaration and finds that it represents the independent judgm ent of the
City and that it was prepared in compliance with CEQA. Therefore, the City
Council finds that the proposed project could not have a significant effect on
the environment. Based upon these findings, the City Council hereby adopts
the Negative Declaration in accordance with the California Environmental
Quality Act.
Section 9, With respect to the request to amend the Rolling Hills
Zoning Ordinance to include a joint powers transit authority under Section
17.16.040(B) Conditional Use Permit as Primary Use, the City Council finds:
A. The proposed project is consistent with the General Plan
goals and policies to maintain Rolling Hills' distinctive rural residential
character (Land Use Element, p. 15.), to maintain the rural character of Rolling
Hills' road system (Circulation Element, p. 13.) and to maintain the private
status of the streets within the City boundaries (Circulation Element, p. 13)
because there will not be any development on the site and access shall continue
from outside the gates of the City.
B. The proposed use will fulfill a public necessity in the
use of portions of school district property used as a maintenance and warehouse
facility to be used by a joint powers transit authority for administrative uses
and the storage parking only of is at the site for Peninsula students and
residents. The proposed use will conserve public costs related to van storage,
van fuel, van use and driver commuting distances.
C. The proposed use will be convenient in that portions of
school district property used by the joint powers transit authority for
administrative uses and the storage parking only of 10 vans at the site will be
accessed from outside of the gates of the City. The transit vans will be stored
at the school district property during the time they are not in use which will
decrease road traffic on the Peninsula, reduce fuel consumption and preserve
air quality.
D. The proposed use will benefit the health, safety and
general welfare of the citizens of the City of Rolling Hills, as well as the
citizens of the Palos Verdes Peninsula, in that portions of school district property
used by the joint powers transit authority for administrative uses and the storage
parking only of 10 vans at the site will not use Rolling Hills' roads, traffic will
be decreased on the Palos Verdes Peninsula, fuel consumption will be reduced
on the Peninsula, and the air quality of the Peninsula will be preserved.
Section 1Q, Based upon the findings contained in
Sections 8 and 9 of this ordinance, Paragraph B of Section 17.16.040 of Chapter
16 of Title 17 (Zoning Ordinance) of the Rolling Hills Municipal Code is
amended to read:
"B. Conditional Use As Primary Use. The following
conditional uses may be permitted as a primary use on
a lot:
1. Elementary school offering State -mandated
curriculum;
2. Fire station;
3. Gate house;
4. Park and/or playground;
5. Public transportation limited uses by a joint
powers transit authority on school district
property which is developed as a school
maintenance facility in the RA -S-2 Zone;
6. Public utility building or structure, including a
reservoir or tank, necessary for the provision of
essential utility services to permitted uses in the
City, but excluding wires, pipelines or poles;
7. Temporary manufactured home."
Section 11. This ordinance is an urgency ordinance
which is necessary for the immediate preservation of public health, safety and
welfare and shall take effect immediately. The Palos Verdes Peninsula Transit
Authority is experiencing a budgetary shortfall requiring the immediate
reduction in costs or services. The Authority's use of this site has been found
by the City and the Authority to be the only site reasonably available which
could be used for the storage of transit vans without incurring substantial costs.
The Authority's use of the site will allow the Authority to reduce personnel
time, fuel costs, fuel consumption and provide more efficient service to area
residents. In the absence of these savings, the Authority will be required to
immediately begin to curtail services, which could have significant adverse '
impacts to the general welfare of the community. For these reasons, this
ordinance is an urgency ordinance and shall take effect immediately.

BACKGROUND
At the regular meeting of the Rolling Hills Planning Commission held September
19, 1995, Commissioners opened the public hearing regarding this proposed Zoning
Code Text Amendment. This Zoning Code Text Amendment would amend
Paragraph B of Section 17.16.040 of the Rolling Hills Municipal Code to allow public
transportation limited uses by a joint powers transit authority on school district
property which is developed as a school district maintenance facility in the RA -S-2
Zone as a conditionally permitted use. At the regular meeting of the Commission
held Tuesday, October 17, 1995, Commissioners, by a unanimous vote,
recommended that the City Council adopt the urgency and regular form of this
Ordinance.
Adoption of these Ordinances provides a limited amendment to the Rolling Hills
Municipal Code for this specified use. A copy of the staff report that was presented
to the Planning Commission is attached to this staff report for consideration.
Specifics regarding the associated Conditional Use Permit application are provided
under a separate Agenda Item this evening.

Conditional Use Permit as Primary Use, the City Council finds:
A. The proposed project is consistent with the General Plan goals and
policies to maintain Rolling Hills' distinctive rural residential character (Land Use
Element, p. 15.), to maintain the rural character of Rolling Hills' road system
(Circulation Element, p. 13.) and to maintain the private status of the streets within

the City boundaries (Circulation Element, p. 13) because there will not be any
development on the site and access shall continue from outside the gates of the City.
B. The proposed use will fulfill a public necessity in the use of portions of
school district property used as a maintenance and warehouse facility to be used by a
joint powers transit authority for administrative uses and the storage parking only
of 10 vans at the site for Peninsula students and residents. The proposed use will
conserve public costs related to van storage, van fuel, van use and driver
commuting distances.
C. The proposed use will be convenient in that portions of school district
property used by the joint powers transit authority for administrative uses and the
storage parking only of 10 vans at the site will be accessed from outside of the gates
of the City. The transit vans will be stored at the school district property during the
time they are not in use which will decrease road traffic on the Peninsula, reduce
fuel consumption and preserve air quality.
D. The proposed use will benefit the health, safety and general welfare of
the citizens of the City of Rolling Hills, as well as the citizens of the Palos Verdes
Peninsula, in that portions of school district property used by the joint powers
transit authority for administrative uses and the storage parking only of 10 vans at
the site will not use Rolling Hills' roads, traffic will be decreased on the Palos
Verdes Peninsula, fuel consumption will be reduced on the Peninsula, and the air
quality of the Peninsula will be preserved.
Section 10. Based upon the findings contained in Sections 8 and 9 of this
ordinance, Paragraph B of Section 17.16.040 of Chapter 16 of Title 17 (Zoning
Ordinance) of the Rolling Hills Municipal Code is amended to read:
"B. Conditional Use As Primary Use. The following conditional uses may
be permitted as a primary use on a lot:
1. Elementary school offering State -mandated curriculum;
2. 'Fire station;
3. Gate house;
4. Park and / or playground;
5. Public transportation limited uses by a joint powers transit
authority on school district property which is developed as a
school maintenance facility in the RA -S-2 Zone;
6. Public utility building or structure, including a reservoir or tank,
necessary for the provision of essential utility services to
permitted uses in the City, but excluding wires, pipelines or
poles;
7. Temporary manufactured home."

Section 11. This ordinance is an urgency ordinance which is necessary for
the immediate preservation of public health, safety and welfare and shall take effect
immediately. The Palos Verdes Peninsula Transit Authority is experiencing a
budgetary shortfall requiring the immediate reduction in costs or services. The
Authority's use of this site has been found by the City and the Authority to be the
only site reasonably available which could be used for the storage of transit vans
without incurring substantial costs. The Authority's use of the site will allow the
Authority to reduce personnel time, fuel costs, fuel consumption and provide more
efficient service to area residents. In the absence of these savings, the Authority will
be required to immediately begin to curtail services, which could have significant
adverse impacts to the general welfare of the community. For these reasons, this
ordinance is an urgency ordinance and shall take effect immediately.

THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. On August 7, 1995, applications were duly filed by the Palos
Verdes Peninsula Unified School District with respect to real property at the -±31.14
acre western portion of Lot 72-RH, and currently, 38 Crest Road West, Rolling Hills,
requesting (1) to amend the Rolling Hills Zoning Ordinance to allow joint powers
transit authority uses as a conditionally permitted use in the RA -S-2 Zone; and (2) a
Conditional Use Permit to allow portions of school district property used as a
maintenance and warehouse facility at the Palos Verdes Peninsula Unified School
District property to be used by a joint powers transit authority for administrative
uses and the storage parking only of 10 vans at the Palos Verdes Peninsula Unified
School District Crest Road property at 38 Crest Road West, Rolling Hills, CA (±31.14
acre western portion of Lot 74 -MS).
Section 2. On February 26, 1963, a Conditional Use Permit was approved by
the Planning Commission for the following five structures to be constructed at the
Palos Verdes Peninsula Unified School District site: (1) administration building, (2)
education material and library facility building, (3) warehouse building, (4) district
maintenance building, and (5) an elementary school building. The Conditional Use
Permit expired on February 26, 1964 and no new buildings were constructed.
Section 3. On, June 5, 1964 a Conditional Use Permit was denied by the
Planning Commission to permit the construction of an (1) administration building,
(2) elementary school building, and (3) district maintenance building. The Planning
Commission found that the construction and location of the proposed
administration building, maintenance building and garage would establish and
permit a commercial use of the property that would consist of a garage for the
storage of approximately thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for the repair and maintenance of school property, all of
which uses will create noise, dirt and confusion from 6 AM in the morning until
approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance .and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.
Section 4. Applications were made for the subject uses by the Palos Verdes
Peninsula Unified School District on August 7, 1995. On August 17, 1995, Planning

staff prepared an initial study for the project. The initial study found that the project
would not have a significant effect on the environment. A Negative Declaration
was prepared and was circulated to the applicant and other interested parties in
accordance with State of California CEQA Guidelines. The public notice of the
Planning Commission's intent to recommend approval of the Negative Declaration
was published on August 31, 1995. Copies of the Negative Declaration were sent to
adjacent cities and other government agencies. No comments on the Negative
Declaration were received.
Section 5. The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of 10 vans at
the site. The site will continue to be used for the storage and maintenance of school
district vehicles and equipment. The school district proposes to permit a joint
powers transit authority to use 500 square feet of the northernmost portion of a 7,600
square foot warehouse for administrative uses and 2,500 square feet of an existing
asphalt paved area of school district property for the storage parking only of 10 vans.
Section 6. On September 19, 1995 and October 17, 1995, the Planning
Commission held a public hearing regarding the proposed ordinance regarding
public transportation limited uses by a joint powers transit authority on school
district property. The Commission adopted Resolution No. 95-15, recommending
modification of Paragraph B of Section 17.16.040 of the Zoning Ordinance.
Section 7. On October 23, 1995 and November 13, 1995, the City Council
held a public hearing regarding the proposed ordinance regarding public
transportation limited uses by a joint powers transit authority on school district
property. Palos Verdes Peninsula Unified School District representatives were in
attendance at the hearing.
Section 8. The City Council has reviewed the proposed Negative
Declaration and finds that it represents the independent judgment of the City and
that it was prepared in compliance with CEQA. Therefore, the City Council finds
that the proposed project could not have a significant effect on the environment.
Based upon these findings, the City Council hereby adopts the Negative Declaration
in accordance with the California Environmental Quality Act.
Section 9. With respect to the request to amend the Rolling Hills Zoning
Ordinance to include a joint powers transit authority under Section 17.16.040(B)
Conditional Use Permit as Primary Use, the City Council finds:

BACKGROUND
1. At the September 19, 1995 meeting, the Planning Commission requested that
the school district explore alternative sites for the storage parking only of the
JPTA transit vans because of the complaints of adjacent residents who reside
in the City of Rancho Palos Verdes. The RPV residents who spoke at the
meeting were Ms. Kim Lindsay, 19 Cove View Drive; Mr. and Mrs. Stuart
Nelson, 21 Cove View Drive; and Mr. and Mrs. Fred Bailin, 17 Cove View
Drive.
2. Since that time, staff has received the attached letters of support from Mrs.
Rosemary Humphrey, Chairman, Palos Verdes Peninsula Transit Authority
and Councilmember, Palos Verdes Estates; Mr. James B. Hendrickson, City
Manager, City of Palos Verdes Estates and Mrs. Sheila Hoff, President, Palos
Verdes Peninsula League of Women Voters. We received the attached letter

of opposition from Mrs. Christa Hawkins, 37 Crest Road West in Rolling
Hills. Mrs. Humphrey's letter addresses issues discussed at the previous
Planning Commission meeting, including noise.
Also attached are letters from Mr. Barry J. Hildebrand, President, Palos Verdes
Peninsula Unified School District Board of Education; Mr. Paul D. Bussey,
City Manager, City of Rancho Palos Verdes; and Mr. Douglas R. Prichard, City
Manager City of Rolling Hills Estates supporting the approval of the requested
use. Notices were sent to adjacent cities, other government agencies and to
citizens within a 1,000 foot radius of the property. No other comments have
been received. At the meeting, we will provide photos of the school district
site that include the proposed areas of use. Because of its urgency to the
school district, as noted in the letter from Assistant Superintendent Mr.
Michael Escalante, and the Palos Verdes Peninsula Transit Authority who
would like the Commission to make a final recommendation at this meeting,
we have attached eight separate draft resolutions as Qptions for Planning
Commission review.
3. The project as proposed is to permit portions of school district property used
as a maintenance and warehouse facility to be used by a joint powers transit
authority for limited administrative uses and the storage parking only of 10
vans at the site. The site will continue to be used for the storage and
maintenance of school district vehicles and equipment. The school district
proposes to permit the Palos Verdes Peninsula Transit Authority to use 500
square feet of the northernmost portion of a 7,600 square foot warehouse for
limited administrative uses and 2,500 square feet of an existing asphalt paved
area of school district property for the storage parking only of 10 vans. There
will not be any transportation services behind the gates of the City of Rolling
Hills and the City will not be spending any funds to support the
transportation services. Palos Verdes Peninsula School District
representatives will be in attendance at the meeting.
4. The subject site is presently occupied by 7 school buildings, a maintenance
building, a warehouse building, a computer/office equipment repair building,
a vehicle repair shop, and an administration building. The site is located
within a one unit per 2 -acre designation and is surrounded at the north and
west by one-story ranch style development with agricultural outbuildings.
The Mary & Joseph Retreat property and St. John Fisher Church property,
respectively, are located directly to the west of the school district property in
the City of Rancho Palos Verdes. One and two story residential housing in
the City of Rancho Palos Verdes is located to the southwest. Staff has
inspected the portions of the site proposed for limited administrative office
uses and transit van storage parking only and cannot identify any significant
visual impacts to the City.

Nevertheless, state law permits local school facilities to exist for the direct
benefit or support of student activities. It is in this light that the existing
facilities exist. The current request is for transit uses that due to funding
limitations cannot be limited to school transportation only. However, the
reality is that the transportation vehicles will primarily serve school children
on the Peninsula.
7. On August 17, 1995, Planning staff prepared an initial study for the project.
The initial study found that the project would not have a significant effect on
the environment. A Negative Declaration was prepared and was circulated to
the applicant and other interested parties in accordance with State of
California CEQA Guidelines. The public notice of the Planning Commission's
intent to recommend approval of the Negative Declaration was published on
August 31, 1995.
RECOMMENDATION
It is recommended that the Planning Commission review the proposed plans, the
photos, the draft resolutions from which the Commission may choose one from the

Rancho Del Mar Continuation High School conducts classes at the property
site which serves the Palos Verdes Peninsula Unified School District.
The high school serves the communities of Rolling Hills, Rolling Hills
Estates, Rancho Palos Verdes and Palos Verdes Estates, The high school
has a capacity of 125 students but, varies substantially and quickly as
students can graduate at any time during the 10 month school year. Also
during the school year, eight teachers, one principal and a secretary
commute to and from the property.
For the entire year, a large portion of the site is used for the storage
and maintenance of school district vehicles and equipment. There are 23
school maintenance workers who park their vehicles at the property and
work off -site during the day. There are 5 warehouse workers who work
on -site during the business day. Access to the school district property
is via Crest Road from the west portion of the property outside the
gates of the City of Rolling Hills.
The Palos Verdes Peninsula community benefits are that the school
district site is being used for the education of Peninsula High School
students, and for the storage and maintenance of school district
vehicles and equipment. These uses do not impede one another. The site
is screened by landscaping from the road.

The text of the City's Zoning Ordinance must be amended. This is
because Section 17.16.040(B) of the Zoning Code lists the types of uses
allowed in the RA -S-2 Zone with a Conditional Use Permit. The uses that
are requested are not included in that list. Therefore, in order to
allow the maintenance and warehouse facility area to be used for the
storage parking only of local joint powers transit agency vans and for
the related administrative uses, Section 17.16.040(8) would have to be
amended to make that proposed use one of the types permitted with a
Conditional Use Permit. In addition, the proposed use would require a
Conditional Use Permit for the district property.

ENVIRONMENTAL SETTING
Item 31.148. Description of project site.
The project site is a large ±31.14 acre parcel consisting of undulating hillsides and
knolls covered by grasses, and mature shrubs and trees, with some areas being
heavily wooded. Currently, there are 12 one-story structures at the site. They consist
of 7 school buildings, 1 maintenance building, 1 warehouse building, 1
computer/office equipment repair building, 1 vehicle repair shop, and 1

administration building. A long tree lined driveway off Crest Road West outside
the City of Rolling Hills' gates beginning at the westernmost portion of the lot
serves as the accessway to the Palos Verdes School District property.
The school district is requesting to amend the Rolling Hills Zoning Ordinance and
requesting a Conditional Use Permit to permit portions of a high school
continuation school and maintenance and warehouse facility at the Palos Verdes
Peninsula Unified School District property to be used by a joint powers transit
agency for administrative uses and the storage parking only of 10 vans at the site.
The site will continue to be used for the Rancho Del Mar Continuation High School
and the storage and maintenance of school district vehicles and equipment.
Native brush grows on the steep slope at the rear of the lot. Trees and shrubs
surround the existing facility at the south, west and north. with native plants,
grasses, shrubs, and trees beyond the facility area. Native birds and animals frequent
the area such as sparrows, crows, raccoons, possum, skunks, gophers and an
occasional fox.
Item 39. Description of surrounding properties,
The site is located within a one unit per 2 -acre designation and is surrounded at the
north and west by one-story ranch style development with agricultural
outbuildings. The Mary & Joseph Retreat property and St. John Fisher Church
property, respectively, are located directly to the west of the school district property
in the City of Rancho Palos Verdes. One and two story residential housing in the
City of Rancho Palos Verdes is located to the southwest.

The following analysis is a description of the findings contained in the
Environmental Information and Checklist Form which preceded this page. A
detailed discussion of all potential environmental impacts checked "Yes" or
"Maybe" is provided, along with appropriate mitigation measures.
ENVIRONMENTAL IMPACTS
Item 40. Earth.
The proposed use will not require any development on the site.
Item 41. Air
The proposed use will generate slight increases in vehicle trips. It is determined
that there will be approximately 40 additional average daily trips (ADT). The 10
transit agency vans will leave and return approximately 2 times a day. The total

number of vehicle trips are equivalent to the total ADT of 4 single family residences
which average 10 ADT's per residence. Regionally, the ADT's of the transit agency
vans will be shortened because it will not be necessary for the vans to travel from
and to the current Long Beach facility 4 times a day during "down" time. The
impact on air quality in the City of Rolling Hills will be less than significant.
Item 42. Water
The proposed use will not require any development on the site and the impact
generated from the storage parking only of 10 vans will be less than significant.
Item 43. Plant Life
The proposed use will not require' any development on the site. No known rare
and endangered species of plants exist in the City. The impact of the current
proposal is expected to be less than significant.
Item 44. Animal Life
The proposed use will not require any development on the site. The only animal
listed by the Federal Government is the Palos Verdes Blue, a butterfly which was not
seen in the Rolling Hills area from 1986 to 1994. In 1994, the Palos Verdes Blue was
seen at the nearby San Pedro Fuel Depot Station. Several other animals do occur,
however, that are considered as candidates for protection by either the Federal
Government or the State Government. Recently, the California gnatcatcher was
added to the list of endangered species and, in a recent census, pairs were located in
the adjacent City of Rancho Palos Verdes. Other target species for the Rancho Palos
Verdes Peninsula Area that are being studied by the State of California Department
of Fish and Game are the Cactus Wren and the Coast Horned Lizard. The impact of
the proposed use of portions of a maintenance and warehouse facility area of school
district property to be used by a joint powers transit agency for administrative uses
and the storage parking only of 10 vans at the site is expected to be less than
significant.
Item 46. Light and Glare
The proposed use will not require any development on the site. The 10 joint
powers transit agency vans will leave and return approximately 2 times a day. The
use of running lights will be required only during dense fog or early winter
evenings. Vans will access the the school district site from outside the City. Dense
landscape screening surrounds the school district site at the west, north and east.
Light and glare impacts therefore are expected to be less than significant.

Item 52. Transportation/Circulation
