City Manager Nealis reported that this ordinance adopts by reference the most recent County
Codes and does not amend of the specific building regulations adopted by the City Council.
He indicated that adoption of this ordinance is in keeping with past actions of the City Council
to keep the most up to date regulations in force in the City.
Mayor Lay opened the public hearing. Hearing no testimony or discussion, Mayor Lay closed
the public hearing. Cuuncilmember Heinsheimer moved that the City Council waive further
reading and adopt Ordinance No. 290-U. Mayor Pro Tern Hill seconded the motion, which
carried unanimously.

Code) of Title 15 (Buildings and Construction) of the Rolling Hills Municipal Code are hereby
amended to read as' follows:
15.04.010 Adoption of Building Code
A. Except as hereinafter provided, Title 26, Building Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Building Code, 2001 Edition (Part 2 of Title 24 of the California Code of
Regulations), including Sections 101.17.1 through 101.17.16 of Chapter 1, Chapters 2 through
21A, Divisions I - III and VI -XI of Chapter 22, Chapters 22A through 35, Division II of
Appendix Chapter 3, Appendix Chapter 3A, Division II of Appendix Chapter 4, and Appendix
Chapter 9, Division IIA of Appendix Chapters 12, 15, 16, 30, 31, and 33 is hereby adopted by
reference, and shall be known and may be cited as the building code of the City of Rolling
Hills.
B. In the event of any conflict between provisions of the California Building Code,
2001 Edition, Title 26 of the Los Angeles Code, or any amendment to the Building Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 26 of the Los Angeles County Code and the California Building
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
15.04.020 Short Title. This Chapter shall be known as the "Building Code of the
City of Rolling Hills" and will be referred to herein as "this code".
15.04.030 Section 105 amended. Section 105 of the Building Code is amended to add
a new subsection 105.7 to read:
105.7 Review Hearing. The City Council of the City of Rolling Hills may
conduct a public hearing to review any decision or order of the Board of Appeals upon
an affirmative vote of three members of the City Council within thirty (30) calendar
days of the decision or order. The City Council may, upon conclusion of the public
hearing, sustain or reverse in whole or in part any action or order of the Board of
Appeals. Notice of the City Council public hearing shall be given by the City Clerk not
less than ten (10) days prior to the hearing by first class mail to all property owners
within 1,000 feet of the exterior boundaries of the subject property and all owners of
record of the subject property at the time of mailing said notice.
Section 2. Section 15.04.040 of Chapter 15.04 of Title 15 of the Rolling Hills Municipal
Code is hereby amended to change the definition of "Building Department" to read as follows:
"Building Department" shall mean the Building and Safety Division of the Public
Works Department.
Section 3. Section 15.04.180 of Chapter 15.04 of Title 15 is hereby renumbered as
Section 15.04.190 and a new Section 15.04.180 is hereby added to read:

15.04.180 Section 3309.13 amended. Section 3309.13 of Appendix Chapter 33 of the
Building Code, entitled "Land Use" is amended to read:
3309.13 LAND USE. The building official shall not issue a grading permit for
work on a site unless the proposed land use for the site shown on the grading plan application
complies with the provisions of Title 17, entitled "Zoning" of the City of Rolling Hills
Municipal Code.
Section 4. Section 15.08.010 of Chapter 15.08 (Plumbing Code) of Title 15 (Buildings
and Construction) of the Rolling Hills Municipal Code is hereby amended to read as follows:
15.08.010 Adoption of Plumbing Code
A. Except as hereinafter provided, Title 28, Plumbing Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Plumbing Code, 2001 Edition (Part 5 of Title 24 of the California Code of
Regulations), including Sections 101.11 through 101.11.15 of Chapter 1, Chapters 2 through 16
and Appendices A, B, C, D, G -A, H, I and K is hereby adopted by reference, and shall be
known and may be cited as the plumbing code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Plumbing Code,
2001 Edition, Title 28 of the Los Angeles Code, or any amendment to the Plumbing Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 28 of the Los Angeles County Code and the California Plumbing
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
Section 5. Section 15.12.010 of Chapter 15.12 (Mechanical Code) of Title 15 (Buildings
and Construction) of the Rolling Hills Municipal Code is hereby amended to read as follows:
15.12.010 Adoption of Mechanical Code
A. Except as hereinafter provided, Title 29, Mechanical Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Mechanical Code, 2001 Edition (Part 4 of Title 24 of the California Code of
Regulations), including Sections 108.1.1 through 108.15 of Chapter 1, Chapters 2 through 14,
Chapter 16 and Appendices A, B, C and D is hereby adopted by reference and shall be known
and may be cited as the mechanical code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Mechanical
Code, 2001 Edition, Title 29 of the Los Angeles Code, or any amendment to the Mechanical
Code contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 29 of the Los Angeles County Code and the California Mechanical
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
Section 6. Section 15.12.030 of Chapter 15.12. of Title 15 of the Rolling Hills
Municipal Code is amended by amending the definition of "Building Department" contained
in paragraph B. therein to read as follows:
B. "Building Department" shall mean Building and Safety Division of the
Public Works Department.
Section 7. Section 15.16.010 of Chapter 15.16 (Electrical Code) of Title 15 (Buildings
and Construction) of the Rolling Hills Municipal Code is hereby amended to read as follows:
15.16.010 Adoption of Electrical Code.
A. Except as hereinafter provided, Title 27, Electrical Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Electrical Code, 2001 Edition (Part 3 of Title 24 of the California Code of
Regulations), including Section 089-7 of Article 089, Article 90, Chapters 1 through 9, and
Ordinance No. 290 -2-
Appendices A, B, C, D, and E is hereby adopted by reference and shall be known and may be
cited as the electrical code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Electrical Code,
2001 Edition, Title 27 of the Los Angeles Code, or any amendment to the Electrical Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 27 of the Los Angeles County Code and the California Electrical
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
Section 8. Sections 15.20.010 and 15.20.170 of Chapter 15.20 (Fire Code) of Title 15
(Buildings and Construction) of the Rolling Hills Municipal Code are hereby amended to read
as follows:
15.20.010 Adoption of Fire Code
A. Except as hereinafter provided, Title 32, Fire Code, of the Los Angeles County
Code, as amended, changed, modified and in effect on November 1, 2002, which constitutes an
amended version of the California Fire Code, 2001 Edition (Part 9 of Title 24 of the California
Code of Regulations), including Appendix I -C, Appendix II -C, Appendix II -D, and Appendix
VI -A, excluding all other appendices is hereby adopted by reference and shall constitute and
be known and may be cited as the fire code of the City of Rolling Hills. -
B. In the event of any conflict between provisions of the California Fire Code 2001
Edition, -Title 32 of the Los Angeles Code, or any amendment to the Fire Code contained in the
Rolling Hills Municipal Code, the provision contained in the later listed document shall

Section 9. The City Council hereby finds that the changes and modifications to the
California Building Code, Plumbing Code, Mechanical Code, Electrical Code and Fire Code
that have been enacted by this Ordinance are reasonably necessary because of the City's local
climate, characterized by hot, dry summers, often resulting in drought conditions, followed by
strong Santa Ana winds, often resulting in hazardous fire conditions, and heavy winter rains,
often resulting in expansive soil conditions: the City's geological characteristics in that the area
is characterized by geological instability including active and ancient landslides; and the
extremely hilly topography of the City.
The City Council hereby further finds that the modifications to the California Building,
Electrical, Mechanical, Plumbing and Fire Codes in Titles 26, 27, 28, 29, and 32 of the Los
Angeles County Code and Chapters 15.04, 15.08, 15.12, 15.16, and 15.20 of the Rolling Hills
Municipal Code regarding administrative provisions are necessary to allow the uniform
application of the codes by procedures suited to the size and nature of the City's staff and
administrative agencies and their experience with local climatic, geological, and topographical
conditions and to provide sufficient staff support for the time-consuming inspections and
analysis required by the City's fire and geological hazards.
Section 10. To the extent the provision of this ordinance are substantially the same as
previous provisions of the Rolling Hills Municipal Code, those provisions shall be construed
as continuation of those provisions and not as new enactments.
Section 11. If any section, subsection, subdivision, paragraph, sentence, clause or
phrase of this ordinance or any part thereof is for any reason held to be invalid, such invalidity
shall not affect the validity of the remaining portions of this ordinance or any part thereof. The
City Council of the City of Rolling Hills hereby declares that it would have passed each
section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of
the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences,
clauses or phrases be declared invalid.
Section 12. State law requires that localities adopt the California Building Standards
Codes and modifications thereto, by November 1, 2002. It is essential that the City have in
effect on that date codes that comply with state law and contain those modifications
necessitated by unique topographic, geologic and climatic conditions. In the absence of
immediate effectiveness, the provisions of the Building, Electrical, Plumbing, Mechanical and
Fire Codes unique to the City's special circumstances will not be in place and this will have a
detrimental effect on the public, health, safety and welfare. The Council finds the
Ordinance No. 290 -4-
modifications in this Ordinance to the California Building Code, Electrical Code, Mechanical
Code, Plumbing Code and Fire Code to be necessary for the protection of the public health,
safety and welfare, and that this ordinance take effect immediately. For these reasons, the
public health, safety and welfare require that this ordinance take effect immediately. This is an
urgency ordinance adopted pursuant to Government Code Section 36937.
Section 13. This ordinance shall be effective upon adoption and shall become
operative on November 1, 2002.

15.04.180 Section 3309.13 amended. Section 3309.13 of Appendix Chapter 33 of the
Building Code, entitled "Land Use" is amended to read:
3309.13 LAND USE. The building official shall not issue a grading permit for
work on a site unless the proposed land use for the site shown on the grading plan application
complies with the provisions of Title 17, entitled "Zoning" of the City of Rolling Hills
Municipal Code.
Section 4. Section 15.08.010 of Chapter 15.08 (Plumbing Code) of Title 15 (Buildings
and Construction) of the Rolling Hills Municipal Code is hereby amended to read as follows:
15.08.010 Adoption of Plumbing Code
A. Except as hereinafter provided, Title 28, Plumbing Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Plumbing Code, 2001 Edition (Part 5 of Title 24 of the California Code of
Regulations), including Sections 101.11 through 101.11.15 of Chapter 1, Chapters 2 through 16
and Appendices A, B, C, D, G -A, H, I and K is hereby adopted by reference, and shall be
known and may be cited as the plumbing code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Plumbing Code,
2001 Edition, Title 28 of the Los Angeles Code; or any amendment to the Plumbing Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 28 of the Los Angeles County Code and the California Plumbing
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
Section 5. Section 15.12.010 of Chapter 15.12 (Mechanical Code) of Title 15 (Buildings
and Construction) of the Rolling Hills Municipal Code is hereby amended to read as follows:
15.12.010 Adoption of Mechanical Code
A. Except as hereinafter provided, Title 29, Mechanical Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Mechanical Code, 2001 Edition (Part 4 of Title 24 of the California Code of
Regulations), including Sections 108.1.1 through 108.15 of Chapter 1, Chapters 2 through 14,
Chapter 16 and Appendices A, B, C and D is hereby adopted by reference and shall be known
and may be cited as the mechanical code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Mechanical
Code, 2001 Edition, Title 29 of the Los Angeles Code, or any amendment to the Mechanical
Code contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 29 of the Los Angeles County Code and the California Mechanical
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
Section 6. Section 15.12.030 of Chapter 15.12. of Title 15 of the Rolling Hills
Municipal Code is amended by amending the definition of "Building Department" contained
in paragraph B. therein to read as follows:
B. "Building Department" shall mean Building and Safety Division of the
Public Works Department.
Section 7. Section 15.16.010 of Chapter 15.16 (Electrical Code) of Title 15 (Buildings
and Construction) of the Rolling Hills Municipal Code is hereby amended to read as follows:
15.16.010 Adoption of Electrical Code.
A. Except as hereinafter provided, Title 27, Electrical Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Electrical Code, 2001 Edition (Part 3 of Title 24 of the California Code of
Regulations), including Section 089-7 of Article 089, Article 90, Chapters 1 through 9,. and
Ordinance No. 290 -2-
Appendices A, B, C, D, and E is hereby adopted by reference and shall be known and may be
cited as the electrical code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Electrical Code,
2001 Edition, Title` 27 of the Los Angeles Code, or any amendment to the Electrical Code
contained in the'Rolling.Hills Municipal Code, the provision contained in the later listed

Section 9. The City Council hereby finds that the changes and modifications to the
California Building Code, Plumbing Code, Mechanical Code, Electrical Code and Fire Code
that have been enacted by this Ordinance are reasonably necessary because of the City's local
climate, characterized by hot, dry summers, often resulting in drought conditions, followed by
strong Santa Ana winds, often resulting in hazardous fire conditions, and heavy winter rains,
often resulting in expansive soil conditions: the City's geological characteristics in that the area
is characterized by geological instability including active and ancient landslides; and the
extremely hilly topography of the City.
The City Council hereby further finds that the modifications to the California Building,
Electrical, Mechanical, Plumbing and Fire Codes in Titles 26, 27, 28, 29, and 32 of the Los
Angeles County Code and Chapters 15.04, 15.08, 15.12, 15.16, and 15.20 of the Rolling Hills
Municipal Code regarding administrative provisions are necessary to allow the uniform
application of the codes by procedures suited to the size and nature of the City's staff and
administrative agencies and their experience with local climatic, geological, and topographical
conditions and to provide sufficient staff support for the time-consuming inspections and
analysis required by the City's fire and geological hazards.
Section 10. To the extent the provision of this ordinance are substantially the same as
previous provisions of the Rolling Hills Municipal Code, those provisions shall be construed
as continuation of those provisions and not as new enactments.
Section 11. If any section, subsection, subdivision, paragraph, sentence, clause or
phrase of this ordinance or any part thereof is for any reason held to be invalid, such invalidity
shall not affect the validity of the remaining portions of this ordinance or any part thereof. The
City Council of the City of Rolling Hills hereby declares that it would have passed each
section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of
the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences,
clauses or phrases be declared invalid.
Section 12. State law requires that localities adopt the California Building Standards
Codes and modifications thereto, by November 1, 2002. It is essential that the City have in
effect on that date codes that comply with state law and contain those modifications
necessitated by unique topographic, geologic and climatic conditions. In the absence of
immediate effectiveness, the provisions of the Building, Electrical, Plumbing, Mechanical and
Fire Codes unique to the City's special circumstances will not be in place and this will have a
detrimental effect on the public, health, safety and welfare. The Council finds the

modifications in this Ordinance to the California Building Code, Electrical Code, Mechanical
Code, Plumbing Code and Fire Code to be necessary for the protection of the public health,
safety and welfare, and that this ordinance take effect immediately. For these reasons, the
public health, safety and welfare require that this ordinance take effect immediately. This is an
urgency ordinance adopted pursuant to Government Code Section 36937.
Section 13. This ordinance shall be effective upon adoption and shall become
operative on November 1, 2002.

public hearing concerning the adoption be reference of the County's Codes. The

by the County.
The only change specific to our jurisdiction that was adopted was to delete
several items from the "LIST OF INFRACTIONS" from our current code, which
are not applicable to our City, i.e. wharfs. Please find enclosed a copy of the

15.04.020 Short Title. This Chapter shall be known as the "Building Code of the
City of Rolling Hills" and will be referred to herein as "this code".
15.04.030 Section 105 amended. Section 105 of the Building Code is amended to add
a new subsection 105.7 to read:
105.7 Review Hearing. The City Council of the City of Rolling Hills may
conduct a public hearing to review any decision or order of the Board of Appeals upon
an affirmative vote of three members of the City Council within thirty (30) calendar
days of the decision or order. The City Council may, upon conclusion of the public
hearing, sustain or reverse in whole or in part any action or order of the Board of
Appeals. Notice of the City Council public hearing shall be given by the City Clerk not
less than ten (10) days prior to the hearing by first class mail to all property owners
within 1,000 feet of the exterior boundaries of the subject property and all owners of
record of the subject property at the time of mailing said notice.
Section 2. Section 15.04.040 of Chapter 15.04 of Title 15 of the Rolling Hills Municipal
Code is hereby amended to change the definition of "Building Department" to read as follows:
"Building Department" shall mean the Building and Safety Division of the Public

Section 9. The City Council hereby finds that the changes and modifications to the
California Building Code, Plumbing Code, Mechanical Code, Electrical Code and Fire Code
that have been enacted by this Ordinance are reasonably necessary because of the City's local
climate, characterized by hot, dry summers, often resulting in drought conditions, followed by
strong Santa Ana winds, often resulting in hazardous fire conditions, and heavy winter rains,
often resulting in expansive soil conditions: the City's geological characteristics in that the area
is characterized by geological instability including active and ancient landslides; and the
extremely hilly topography of the City.
The City Council hereby further finds that the modifications to the California Building,
Electrical, Mechanical, Plumbing and Fire Codes in Titles 26, 27, 28, 29, and 32 of the Los
Angeles County Code and Chapters 15.04, 15.08, 15.12, 15.16, and 15.20 of the Rolling Hills
Municipal Code regarding administrative provisions are necessary to allow the uniform
application of the codes by procedures suited to the size and nature of the City's staff and
administrative agencies and their experience with local climatic, geological, and topographical
conditions and to provide sufficient staff support for the time-consuming inspections and
analysis required by the City's fire and geological hazards.
Section 10. To the extent the provision of this ordinance are substantially the same as
previous provisions of the Rolling Hills Municipal Code, those provisions shall be construed
as continuation of those provisions and_not as new enactments.
Section 11. If any section, subsection, subdivision, paragraph, sentence, clause or
phrase of this ordinance or any part thereof is for any reason held to be invalid, such invalidity
shall not affect the validity of the remaining portions of this ordinance or any part thereof. The
City Council of the City of Rolling Hills hereby declares that it would have passed each
section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of
the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences,
clauses or phrases be declared invalid.
Section 12. State law requires that localities adopt the California Building Standards
Codes and modifications thereto, by November 1, 2002. It is essential that the City have in
effect on that date codes that comply with state law and contain those modifications
necessitated by unique topographic, geologic and climatic conditions. In the absence of
immediate effectiveness, the provisions of the Building, Electrical, Plumbing, Mechanical and
Fire Codes unique to the City's special circumstances will not be in place and this will have a
detrimental effect on the public, health, safety and welfare. The Council finds the
Ordinance No. 290 -4-
modifications in this Ordinance to the California Building Code, Electrical Code, Mechanical
Code, Plumbing Code and Fire Code to be necessary for the protection of the public health,
safety and welfare, and that this ordinance take effect immediately. For these reasons, the
public health, safety and welfare require that this ordinance take effect immediately. This is an
urgency ordinance adopted pursuant to Government Code Section 36937.
Section 13. This ordinance shall be effective upon adoption and shall become
operative on November 1, 2002.

BACKGROUND
Traditionally, the City of Rolling Hills has adopted the most recent Los Angeles
County Building, Plumbing, Electrical, Mechanical and Fire Codes shortly after
their adoption by the County. State law requires that the County's codes contain
the same requirements as are contained in the building standards published in
the California Building Standards Codes. State law allows the County to change
or modify these requirement's only if it determines that such changes or
modifications are reasonably necessary because of local climatic, geologic or
topographical conditions.
On September 24, 2002, the County of Los Angeles Board of Supervisors adopted
modifications to the 2001 edition of the California Building Standards Codes.
These changes and modifications will become effective on November 1, 2002.
In order for the City of Rolling Hills to adopt these amendments by reference and
have them effective on November 1, 2002, it is necessary to adopt them by an

urgency ordinance. The attached Ordinance No. 290-U has been prepared by the
City Attorney and staff. If the City fails to adopt the County ordinances, the
codes published by the State will automatically become law within the City.
RECOMMENDATION
It is recommended that the City Council waive further reading and adopt.

Section 1. Sections 15.04.010, 15.04.020, and 15.04.030 of Chapter 15.04
(Building Code) of Title 15 (Buildings and Construction) of the Rolling Hills Municipal
Code are hereby amended to read as follows:
15.04.010 Adoption of Building Code
A. Except as hereinafter provided, Title 26, Building Code, of the Los
Angeles County Code, as amended, changed and modified and in effect November 1,
2002, adopting the California Building Code, 2001 Edition (Part 2 of Title 24 of the
California Code of Regulations), including Sections 101.17.1 through 101.17.16 of
Chapter 1, Chapters 2 through 21A, Divisions I - III and VI -XI of Chapter 22, Chapters
22A through 35, Division II of Appendix Chapter 3, Appendix Chapter 3A, Division II
of Appendix Chapter 4, and Appendix Chapter 9, Division IIA of Appendix Chapters
12, 15, 16, 30, 31, and 33 is hereby adopted by reference, and shall be known and may
be cited as the building code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Building
Code, 2001 Edition, Title 26 of the Los Angeles Code, or any amendment to the
Building Code contained in the Rolling Hills Municipal Code, the provision contained
in the later listed document shall control.
C. A copy of Title 26 of the Los Angeles .County Code and the California
Building Code, 2001 Edition, have been deposited in the office of the City Clerk of the
City of Rolling Hills and shall be at all times maintained by the City Clerk for use and
examination by the public.
15.04.020 Short Title. This Chapter shall be known as the "Building Code
of the City of Rolling Hills" and will be referred to herein as "this code".
15.04.030 Section 105 amended. Section 105 of the Building Code is amended
to add a new subsection 105.7 to read:
105.7 Review Hearing. The City Council of the City of Rolling Hills may
conduct a public hearing to review any decision or order of the Board of
Appeals upon an affirmative vote of three members of the City Council within
thirty (30) calendar days of the decision or order. The City Council may, upon
conclusion of the public hearing, sustain or reverse in whole or in part any
action or order of the Board of Appeals. Notice of the City Council public
hearing shall be given by the City Clerk not less than ten (10) days prior to the
hearing by first class mail to all property owners within 1,000 feet of the exterior
boundaries of the subject property and all owners of record of the subject
property at the time of mailing said notice.
Section 2. Section 15.04.040 of Chapter 15.04 of Title 15 of the Rolling Hills
Municipal Code is hereby amended to change the definition of "Building Department"
to read as follows:
"Building Department" ,shall .mean the Building and Safety Division of the
Public Works Department.
Section 3. Section 15.04.180 of Chapter 15.04 of Title 15 is hereby renumbered
as Section 15.04.190 and a new Section 15.04.180 is hereby added to read:
15.04.180 Section 3309.13 amended. Section 3309.13 of Appendix Chapter 33 of
the Building Code, entitled "Land Use" is amended to read:
3309.13 LAND USE. The building official shall not issue 'a grading permit
for work on a site unless the proposed land use for the site shown on the grading plan
application complies with the provisions of Title 17, entitled "Zonin' �f the City of
Rolling Hills Municipal Code.
Section 4. Section 15.08.010 of Chapter 15.08 (Plumbing Code) of Title 15
(Buildings and Construction) of the Rolling Hills Municipal Code is hereby amended
to read as follows:
15.08.010 Adoption of Plumbing Code
A. Except as hereinafter provided, Title 28, Plumbing Code, of the Los
Angeles County Code, as amended, changed and modified and in effect November 1,
2002, adopting the California Plumbing Code, 2001 Edition (Part 5 of Title 24 of the
California Code of Regulations), including Sections 101.11 through 101.11.15 of
Chapter 1, Chapters 2 through 16 and Appendices A, B, C, D, G -A, H, I and K is hereby
adopted by reference, and shall be known and may be cited as the plumbing code of
the City of Rolling Hills.
B. In the event of any conflict between provisions of the California
Plumbing Code, 2001 Edition, Title 28 of the Los Angeles Code, or any amendment to
the Plumbing Code contained in the Rolling Hills Municipal Code, the provision
contained in the later listed document shall control.

1, Chapters 2 through 14, Chapter 16 and Appendices A, B, C and D is hereby adopted
by reference and shall be known and may be cited as the mechanical code of the City of
Rolling Hills.
B. In the event of any conflict between provisions of the California
Mechanical Code, 2001 Edition, Title 29 of the Los Angeles Code, or any amendment to
the Mechanical Code contained in the Rolling Hills Municipal Code, the provision
contained in the later listed document shall control.

Chapters 1 through 9, and Appendices A, B, C, D, and E is hereby adopted by reference
and shall be known and may be cited as the electrical code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Electrical
Code, 2001 Edition, Title 27 of the Los Angeles Code, or any amendment to the
Electrical Code contained in the Rolling Hills Municipal Code, the provision contained
in the later listed document shall control.

which constitutes an amended version of the California Fire Code, 2001 Edition (Part 9
of Title 24 of the California Code of Regulations), including Appendix I -C, Appendix
II -C, Appendix II -D, and Appendix VI -A, excluding all other appendices is hereby
adopted by reference and shall constitute and be known and may be cited as the fire
code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Fire
Code 2001 Edition, Title 32 of the Los Angeles Code, or any amendment to the Fire
Code contained in the Rolling Hills Municipal Code, the provision contained in the
later listed document shall control.
C. A copy of Title 32, as amended, of the Los Angeles County Code and the
California Fire Code, 2001 Edition, have been deposited in the office of the City Clerk

temperature rise and humidity drop, increasing the fire

continuous ties were required at certain spacing to
control cross grain tension in the interior of a
diaphragm. Additionally, subdiaphragm shear were to
be limited to control combined orthogonal stresses
within the diaphragm. The study also concluded that
stiffness incompatibility between entrance canopies
need to be addressed.

this region. .

Section is amended to limit use of stone and masonry
anchored veneer when using conventional framing
design. Additional weight attributed to use of heavy
veneer substantially increases seismic load of
conventionally braced wall panels. In addition, normal
to wall loads may overstress wood frame bearing walls
in combined loading. This is intended to reduce
earthquake damage as observed in past earthquakes.
The amendment is based on the recommendations of
LARUCP and SEAOC to reduce future earthquake
damage due to the high seismicity in this region.
2320.5.6
Geological
Section is amended to prohibit braced walls to be
constructed without continuous footings. It would
prohibit an interior wall line to transfer its lateral -forces
through a nonstructural concrete slab floor or wood
floor. Interior wall lines in a simple building could easily
be resisting 50 percent of the total lateral force on the
structure. Raised wood floor diaphragms and
perimeter sill bolting may be inadequate for the
horizontal shear imposed by these wall lines. This is
intended to reduce earthquake damage as observed in
past earthquakes. The amendment is based on the
recommendations of LARUCP and SEAOC to reduce
future earthquake damage due to the high seismicity in
this region.
2320.9.2
Geological
Section is amended to delete language that would
allow an increase in nail spacing when adhesives are
used. The increase in nail spacing will lead to an
increase in flexibility of floors. Adhesives cannot be
relied upon to maintain attachment after first seismic
motion. Adhesive attachment of floor sheathing to joist
cannot be expected to perform as substitute for nails
during seismic motions. The amendment is based on
the recommendations of LARUCP and SEAOC to
reduce future earthquake damage due to the high
seismicity in this region.
2320.11.3
Geological
Section is amended to limit use of structural wall panels
to materials and sizes that have performed reasonably
well or have been cyclically tested. Recent poor
experience with these materials requires that their use
be limited until tested and approved. It also requires
that braced wall panels extend to roof sheathing in
order to create a complete load path. The amendment
is based on the recommendations of LARUCP and
SEAOC to reduce future earthquake damage due to
the high seismicity in this region. .

Section is amended to limit the use of narrow braced
wall panels. Testing of narrow shear wall panels at the
University of California, Irvine show that narrow shear
walls have excessive lateral drift at their design force
levels that are mostly attributed to nail and fastener slip
in at vertical boundary members. This is intended to
reduce earthquake damage as observed in past
earthquakes. The amendment is based on the
recommendations of LARUCP and SEAOC to reduce
future earthquake damage due to the high seismicity in
this region.

The building codes adoption process affects every citizen in every
municipality of California, on a daily basis. As the voice of local
government in that process, it is the mission of California Building
Officials (CALBO) to keep all relevant segments of local
government informed about the ever-changing state of building
codes in California. Sensible and efficient building code
enforcement is vital to the public safety of all Californians.
CALBO has been in existence for over forty years representing the
many dedicated men and women of over 540 jurisdictions that
enforce state mandated building codes in your jurisdiction. Our
organization was created in 1962 to ensure that the needs of local
government and the public we serve were adequately represented at
the state government level with respect to legislation, code adoption,
and in the development of reasonable and enforceable code
provisions by state agencies and commissions.
It is in this historical context that I address you on behalf of CALBO
to acquaint you with an issue of increasing concern and importance
to local government; namely, actions taken by the California
Building Standards Commission. (CBSC) over the past several years
that have the potential of gravely endangering the people of our
state. For example, as the most seismically active state in the nation,
it makes no sense that California should be relegated to the status of
having to use outdated code provisions from the 1997 edition of the
Building Code instead of the most current and up-to-date editions
available —the 2000 edition of the International Building Code. Yet,
that is precisely the circumstance with which we are mandated as a
result of actions taken by the CBSC.
Over the past several years, the customary conflicts and tensions between code publishing
organizations have erupted into a full-blown war. As a result, the code adoption process
has become inordinately political and heavily influenced by special interests and unsavory
political contributions. These are the circumstances that caused the adoption of the current
edition of the California Building Code (based upon the 1997 edition of the Uniform
Building Code) to be delayed for close to eighteen months. It is universally believed by
building code enforcement officials throughout California that such delays by the CBSC
are unnecessary, unreasonable and intolerable.
Because of the excessively political nature of the state code adoption process administered
by the CBSC, California will be utilizing code provisions from the 1997 building code
edition well into 2004. The current code adoption cycle, now underway, has been again
delayed almost four months due to delays in decision -making by the CBSC. This matter
can no longer be ignored by local officials, because we —not the CBSC—will suffer the
consequences of harm being visited upon our residents in the event of a building code
related catastrophe occurring in our communities. As a first step, CALBO recently
brought this matter to the attention of the governor and his Secretary of State and
Consumer Services.
Representatives of CALBO will be in attendance at the 2002 League of California Cities
Conference in Long Beach.. We will be present in booth 213 on Thursday October 3rd and
Friday October 4`h. Our only motivation and goal is to ensure that the most appropriate set
of building codes are adopted in California. It would be irresponsible and a dereliction of
our duty to do less than that. We will be available to have a conversation with you about
the current state of code adoption in California. We want to help you understand these
issues and garner your support to make sure that California stays in the forefront of
building code enforcement in America. As our nation evaluates the public safety needs of
our people one year after the tragic events of September 11, 2001, effective and up-to-date
building codes and their enforcement are an essential component in that evaluation.

Regulations), including Sections 101.17.1 through 101.17.16 of Chapter 1, Chapters 2 through
21A, Divisions I — III and VI —XI of Chapter 22, Chapters 22A through 35, Division II of
Appendix Chapter 3, Appendix Chapter 3A, Division II of Appendix Chapter 4, and Appendix
Chapter 9, Division IIA of Appendix Chapters 12, 15, 16, 30, 31, and 33 is hereby adopted by
reference, and shall be known and may be cited as the building code of the City of Rolling
Hills.
B. In the event of any conflict between provisions of the California Building Code,
2001 Edition, Title 26 of the Los Angeles Code, or any amendment to the Building Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 26 of the Los Angeles County Code and the California Building
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
15.04.020 Short Title. This Chapter shall be known as the "Building Code of the
City of Rolling Hills" and will be referred to herein as "this code".
15.04.030 Section 105 amended. Section 105 of the Building Code is amended to add
a new subsection 105.7 to read:
105.7 Review Hearing. The City Council of the City of Rolling Hills may
conduct a public hearing to review any decision or order of the Board of Appeals upon
an affirmative vote of three members of the City Council within thirty (30) calendar
days of the decision or order. The City Council may, upon conclusion of the public
hearing, sustain or reverse in whole or in part any action or order of the Board of
Appeals. Notice of the City Council public hearing shall be given by the City Clerk not
less than ten (10) days prior to the hearing by first class mail to all property owners
within 1,000 feet of the exterior boundaries of the subject property and all owners of
record of the subject property at the time of mailing said notice.
Section 2. Section 15.04.040 of Chapter 15.04 of Title 15 of the Rolling Hills Municipal
Code is hereby amended to change the definition of "Building Department" to read as follows:
"Building.Department" shall mean the Building and Safety Division of the Public
Works Department.
Section 3. Section 15.04.180 of Chapter 15.04 of Title 15 is hereby renumbered as
Section 15.04.190 and a new Section 15.04.180 is hereby added to read:

15.04.180 Section 3309.13 amended. Section 3309.13 of Appendix Chapter 33 of the
Building Code, entitled "Land Use" is amended to read:
3309.13 LAND USE. The building official shall not issue a grading permit for
work on a site unless the proposed land use for the site shown on the grading plan application
complies with the provisions of Title 17, entitled "Zoning" of the City of Rolling Hills
Municipal Code.
Section 4. Section 15.08.010 of Chapter 15.08 (Plumbing Code) of Title 15 (Buildings
and Construction) of the Rolling Hills Municipal Code is hereby amended to read as follows:
15.08.010 Adoption of Plumbing Code
A. Except as hereinafter provided, Title 28, Plumbing Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Plumbing Code, 2001 Edition (Part 5 of Title 24 of the California Code of
Regulations), including Sections 101.11 through 101.11.15 of Chapter 1, Chapters 2 through 16
and Appendices A, B, C, D, G -A, H, I and K is hereby adopted by reference, and shall be
known and may be cited as the plumbing code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Plumbing Code,
2001 Edition, Title 28 of the Los Angeles Code, or any amendment to the Plumbing Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed

County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Mechanical Code, 2001 Edition (Part 4 of Title 24 of the California Code of
Regulations), including Sections 108.1.1 through 108.15 of Chapter 1, Chapters 2 through 14,
Chapter 16 and Appendices A, B, C and D is hereby adopted by reference and shall be known
and may be cited as the mechanical code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Mechanical
Code, 2001 Edition, Title 29 of the Los Angeles Code, or any amendment to the Mechanical
Code contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 29 of the Los Angeles County Code and the California Mechanical
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
Section 6. Section 15.12.030 of Chapter 15.12. of Title 15 of the Rolling Hills
Municipal Code is amended by amending the definition of "Building Department" contained
in paragraph B. therein to read as follows:
B. "Building Department" shall mean Building and Safety Division of the
Public Works Department.
Section 7. Section 15.16.010 of Chapter 15.16 (Electrical Code) of Title 15 (Buildings
and Construction) of the Rolling Hills Municipal Code is hereby amended to read as follows:
15.16.010 Adoption of Electrical Code.
A. Except as hereinafter provided, Title 27, Electrical Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Electrical Code, 2001 Edition (Part 3 of Title 24 of the California Code of
Regulations), including Section 089-7 of Article 089, Article 90, Chapters 1 through 9, and
Ordinance No. 290 -2-
Appendices A, B, C, D, and E is hereby adopted by reference and shall be known and may be
cited as the electrical code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Electrical Code,
2001 Edition, Title 27 of the Los Angeles Code, or any amendment to the Electrical Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 27 of the Los Angeles County Code and the California Electrical
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
Section 8. Sections 15.20.010 and 15.20.170 of Chapter 15.20 (Fire Code) of Title 15
(Buildings and Construction) of the Rolling Hills Municipal Code are hereby amended to read
as follows:
15.20.010 Adoption of Fire Code
A. Except as hereinafter provided, Title 32, Fire Code, of the Los Angeles County
Code, as amended, changed, modified and in effect on November 1, 2002, which constitutes an
amended version of the California Fire Code, 2001 Edition (Part 9 of Title 24 of' the California
Code of Regulations), including Appendix I -C, Appendix II -C, Appendix II -D, and Appendix
VI -A, excluding all other appendices is hereby adopted by reference and shall constitute and
be known and may be cited as the fire code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Fire Code 2001
Edition, Title 32 of the Los Angeles Code, or any amendment to the Fire Code contained in the
Rolling Hills Municipal Code, the provision contained in the later listed document shall
control.
C. A copy of Title 32, as amended, of the Los Angeles County Code and the
California Fire Code, 2001 Edition, have been deposited in the office of the City Clerk of the
City of Rolling Hills and shall be at all times maintained by the City Clerk for use and
examination by the public.

Section 9. The City Council hereby finds that the changes and modifications to the
California Building Code, Plumbing Code, Mechanical Code, Electrical Code and Fire Code
that have been enacted by this Ordinance are reasonably necessary because of the City's local
climate, characterized by hot, dry summers, often resulting in drought conditions, followed by
strong Santa Ana winds, often resulting in hazardous fire conditions, and heavy winter rains,
often resulting in expansive soil conditions: the City's geological characteristics in that the area
is characterized by geological instability including active and ancient landslides; and the
extremely hilly topography of the City.
The City Council hereby further finds that the modifications to the California Building,
Electrical, Mechanical, Plumbing and Fire Codes in Titles 26, 27, 28, 29, and 32 of the Los
Angeles County Code and Chapters 15.04, 15.08, 15.12, 15.16, and 15.20 of the Rolling Hills
Municipal Code regarding administrative provisions are necessary to allow the uniform
application of the codes by procedures suited to the size and nature of the City's staff and
administrative agencies and their experience with local climatic, geological, and topographical
conditions and to provide sufficient staff support for the time-consuming inspections and
analysis required by the City's fire and geological hazards.
Section 10. To the extent the provision of this ordinance are substantially the same as
previous provisions of the Rolling Hills Municipal Code, those provisions shall be construed
as continuation of those provisions and not as new enactments.
Section 11. If any section, subsection, subdivision, paragraph, sentence, clause or
phrase of this ordinance or any part thereof is for any reason held to be invalid, such invalidity
shall not affect the validity of the remaining portions of this ordinance or any part thereof. The
City Council of the City of Rolling Hills hereby declares that it would have passed each
section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of
the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences,
clauses or phrases be declared invalid.
Section 12. State law requires that localities adopt the California Building Standards
Codes and modifications thereto, by November 1, 2002. It is essential that the City have in
effect on that date codes that comply with state law and contain those modifications
necessitated by unique topographic, geologic and climatic conditions. In the absence of
immediate effectiveness, the provisions of the Building, Electrical, Plumbing, Mechanical and
Fire Codes unique to the City's special circumstances will not be in place and this will have a
detrimental effect on the public, health, safety and welfare. The Council finds the
Ordinance No. 290 -4-
modifications in this Ordinance to the California Building Code, Electrical Code, Mechanical
Code, Plumbing Code and Fire Code to be necessary for the protection of the public health,
safety and welfare, and that this 'ordinance take effect immediately. For these reasons, the
public health, safety and welfare require that this ordinance take effect immediately. This is an
urgency ordinance adopted pursuant to Government Code Section 36937.
Section 13. This ordinance shall be effective upon adoption and shall become
operative on November 1, 2002.

the California Building Code, 2001 Edition (Part 2 of Title 24 of the California Code of
Regulations), including Sections 101.17.1 through 101.17.16 of Chapter 1, Chapters 2 through
21A, Divisions I — III and VI —XI of Chapter 22, Chapters 22A through 35, Division II of
Appendix Chapter 3, Appendix Chapter 3A, Division II of Appendix Chapter 4, and Appendix
Chapter 9, Division IIA of Appendix Chapters 12, 15, 16, 30, 31, and 33 is hereby adopted by
reference, and shall be known and may be cited as the building code of the City of Rolling
Hills.
B. In the event of any conflict between provisions of the California Building Code,
2001 Edition, Title 26 of the Los Angeles Code, or any amendment to the Building Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 26 of the Los Angeles .County Code and the California Building
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the
public.
15.04.020 Short Title. This Chaptershallbe known as the "Building Code of the
City of Rolling Hills" and will be referred to herein as "this code".
15.04.030 Section 105 amended. Section 105 of the Building Code is amended to add
a new subsection 105.7 to read:
105.7 Review Hearing. The City Council of the City of Rolling Hills may
conduct a public hearing to review any decision or order of the Board of Appeals upon
an affirmative vote of three members of the City Council within thirty (30) calendar
days of the decision or order. The City Council may, upon conclusion'of the public
hearing, sustain or reverse in whole or in part any action or order of the Board of
Appeals. Notice of the City Council public hearing shall be given by the City Clerk not
less than ten (10) days prior to the hearing by first class mail to all property owners
within 1,000 feet of the exterior boundaries of the subject property and all owners of
record of the subject property at the time of mailing said notice.
Section 2. Section 15.04.040 of Chapter 15.04 of Title 15 of the Rolling Hills Municipal
Code is hereby amended to change the definition of "Building Department" to read as follows:
"Building Department" shall mean the Building and Safety Division of the Public
Works Department.
Section 3. Section 15.04.180 of Chapter 15.04 of Title 15 is hereby renumbered as
Section 15.04.190 and a new Section 15.04.180 is hereby added to read:

15.04.180 Section 3309.13 amended. Section 3309.13 of Appendix Chapter 33 of the
Building Code, entitled "Land Use" is amended to read:
3309.13 LAND USE. The building official shall not issue a grading permit for
work on a site unless the proposed land use for the site shown on the grading plan application
complies with the provisions of Title 17, entitled "Zoning" of the City of Rolling Hills
Municipal Code.
Section 4. Section 15.08.010 of Chapter 15.08 (Plumbing Code) of Title 15 (Buildings
and Construction) of the Rolling Hills Municipal Code is hereby amended to read as follows:
15.08.010 Adoption of Plumbing Code
A. Except as hereinafter provided, Title 28, Plumbing Code, of the Los Angeles
County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Plumbing Code, 2001 Edition (Part 5 of Title 24 of the California Code of
Regulations), including Sections 101.11 through 101.11.15 of Chapter 1, Chapters 2 through 16
and Appendices A, B, C, D, G -A, H, I and K is hereby adopted by reference, and shall be
known and may be cited as the plumbing code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Plumbing Code,
2001 Edition, Title 28 of the Los Angeles Code, or any amendment to the Plumbing Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 28 of the Los Angeles County Code and the California Plumbing
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the

County Code, as amended, changed and modified and in effect November 1, 2002, adopting
the California Mechanical Code, 2001 Edition (Part 4 of Title 24 of the California Code of
Regulations), including Sections 108.1.1 through 108.15 of Chapter 1, Chapters 2 through 14,
Chapter 16 and Appendices A, B, C and D is hereby adopted by reference and shall be known
and may be cited as the mechanical code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Mechanical
Code, 2001 Edition, Title 29 of the Los Angeles Code, or any amendment to the Mechanical
Code contained in the Rolling Hills Municipal Code, the provision contained in the later listed
document shall control.
C. A copy of Title 29 of the Los Angeles County Code and the California Mechanical
Code, 2001 Edition, have been deposited in the office of the City Clerk of the City of Rolling
Hills and shall be at all times maintained by the City Clerk for use and examination by the

2001 Edition, Title 27 of the Los Angeles Code, or any amendment to the Electrical Code
contained in the Rolling Hills Municipal Code, the provision contained in the later listed

Code, as amended, changed, modified and in effect on November 1, 2002, which constitutes an
amended version of the California Fire Code, 2001 Edition (Part 9 of Title 24 of the California
Code of Regulations), including Appendix I -C, Appendix II -C, Appendix II -D, and Appendix
VI -A, excluding all other appendices is hereby adopted by reference and shall constitute and
be known and may be cited as the fire code of the City of Rolling Hills.
B. In the event of any conflict between provisions of the California Fire Code 2001
Edition, Title 32 of the Los Angeles Code, or any amendment to the Fire Code contained in the
Rolling Hills Municipal Code, the provision contained in the later listed document shall
control.

Quality Act (CEQA) and CEQA Guidelines of the City of Rolling Hills, the
Planning staff analyzed the proposed ordinance to adopt by reference the Los
Angeles County Codes and determined that it will not have the potential for
causing a significant effect on the environment. Based on this finding, staff has
determined the proposed ordinance to be categorically exempt from the CEQA
Guidelines.
Any person is welcome to review the proposed ordinance prior to the public
hearing at the City Hall Administration Building located at 2 Portuguese Bend
Road, Rolling Hills, CA.
If you challenge the approval or denial of the proposed ordinance in court, you
may be limited to raising only those issues you or someone else raised at the
public hearing described in this notice, or in written correspondence delivered to
the City of Rolling Hills at, or prior to, the public hearing.
