CALL MEETING TO ORDER
A meeting of the Committee on Trees and Views was called to order by Chairperson Smith at 5:00 p.m. on
Wednesday, May 21, 2014, in the Ciry Council Chamber, at Ciry Hall, 2 Portuguese Bend Road, Rolling
Hills, California.
ROLL CALL
Committee Members Present Gray, Mirsch and Chairperson Smith.
Committee Members Absent: None.
Others Present: Raymond R Cruz, City Manager.
Yolanta Schwartz, Planning Director.

Samantha Lamberg, Attorney.
Michael Sherman, 33 Crest Road East.
Craig Ekberg, 35 Crest Road East.

APPROVAL OF MINUTES
MINUTES OF A MEETING OF THE COMMITTEE ON TREES AND VIEWS, WEDNESDAY,
APRIL 16, 2014 (SHERMAN/FOURNIER/OCCHIPINITl)
Committee Member Gray moved that the Committee approve the minutes of the Committee on Trees and
Views meeting held on Wednesday, April 16, 2014 as presented. Committee Member Mirsch seconded the
motion which carried without objection.
CONTINUTED PUBLIC HEARINGS
CONSIDERATION OF VIEW IMPAIRMENT COMPLAINT REGARDING TREES AT THE
FOLLOWING LOCATION:
LOCATION OF TREES: 33 CREST ROAD EAST
PROPERTY OWNER:MR. AND MRS. SHERMAN
COMPLAINANTS: MR. AND MRS. OCCHIPINTI,
34 CREST ROAD EAST
Chairperson Smith introduced the item and asked for stafPs comments.
For the record, Planning Director Schwartz stated that the Planning Commission reorganized at its last
meeting, appointing Commissioners Gray, Mirsch and Smith to serve on the Committee on Trees and Views;
and although Committee Member Gray was not present at the previous meeting concerning the pending view
impairment cases, he has familiarized himself with both cases on tonighYs agenda and listened to the
minutes from the previous meeting so he may participate in consideration of both cases. Commissioner Gray
confirmed.
Planning Director Schwartz stated that the applicant in this case has requested continuance and that
correspondence relating to that request was included in the packet and additional correspondence received
after the packets were delivered has been placed on the dais. She stated that the survey that the Committee
asked to be prepared by the applicant is not ready to be presented and all of the parties have agreed that the
meeting should be continued. She stated that the Occhipinti's aze requesting this case be continued to June
17`h at 5:00 p.m. and Mr. Sherman and his attorney are agreeable to that date.

Following brief discussion, the public hearing on the Occhipinti complaint was continued to Tuesday, June
17, 2014 beginning at 5:00 pm in the Council Chamber at Rolling Hills City Hall, 2 Portuguese Bend Road,
Rolling Hills, CA.
Chairperson Smith stated that public comment on both cases will be taken after the next meeting is
scheduled.

Chairperson Smith introduced the item and asked for stafPs comments. Planning Director Schwartz stated
that the applicant in this case has also requested continuance and that correspondence relating to that request
was included in Yhe packet. She noted that the attorney representing the Occhipintis is also representing the
Fourniers. She commented that the applicant is requesting that the public hearing and field trip be scheduled
in August based on their availability as mentioned in the correspondence.
Discussion ensued concerning the availability of the Committee and the parties with the date of August 19`n
appearing as the only date all are available.
Craig Ekberg, 35 Crest Road East addressed the Committee stating that his attorney is not available on
August 19`h. Chairperson Smith stated that given the fact that Mr. Ekberg is not a party to this complaint at
this time and given the difficulty in coordinating schedules it may not be possible to schedule around his
attorney's availability. Planning Director Schwartz commented that there will be several meetings regarding
this matter and Mr. Ekberg's attorney could listen to the meeting tape if she is not available on the dates the
Committee meets.
In response to Committee Member Gray's inquiry as to whether the Sherman's would prefer that one case be
considered at a time, rather than together; Samantha Lamberg, Mr. Sherman's attorney stated that tbe counsel
for the parties agreed not to have any substantive discussion since all parties are not present, but that the
Sherman's would be okay having the hearings separate.
Following brief discussion, and recognizing that the Committee and oYher parties have limited availability in
August, the public hearing on the Fournier complaint was continued to Tuesday, August 19, 201�} beginning
at 5:00 pm in the Council Chamber at Rolling Hills City Hall, 2 Portuguese Bend Road, Rolling Hills, CA.
The field trip will be scheduled at a later date.
Chairperson Smith called for public comment. Hearing none, consideration of both matters was continued.
PUBLIC COMMENT ON ITEMS NOT ON THE AGENDA
None.
ADJOURNMENT
Chairperson Smith adjourned the meeting at 5:20 p.m. to an adjourned meeting of the Rolling Hills Planning
Commission Committee on Trees and Views scheduled to be held on Wednesday, June 17, 2014, beginning
at 5:00 p.m. in the Council Chamber at Rolling Hills City Hall, 2 PoRuguese Bend Road, Rolling Hills,
California.
