REPORT ON ORDINANCE NO. 296, ADOPTED BY THE CITY COUNCIL ON
OCTOBER 25, 2004, REGARDING MEETING TIME OF THE PLANNING
COMMISSION.
City Manager Nealis reported on the City Council's adoption of Ordinance No. 296 that will
allow the Planning Commission to set their meeting time and that a Resolution will be
presented to the Commission at their next meeting officially changing the meeting time from
7:30 p.m. to 6:30 p.m.
City Manager Nealis also reported on the City Council's review of the Subdivision and Zoning
Code amendments. He reported that the City Council agreed with all of the amendments
recommended by the Commission, however they choose not to regulate play houses except
those exceeding a 15 ft. height/120 square foot threshold. He indicated that the City Council
also included covered porches in pad coverage calculations, however, due to concerns
expressed by local architects, the City Council directed that staff prepare a report for the
Commission to further review this subject.

AMENDING THE ROLLING HILLS MUNICIPAL CODE.

There being no discussion, Mayor Heinsheimer called for a motion. Councilmember Hill
moved that the City Council waive further reading and adopt Ordinance No. 296.
Councilmember Lay seconded the. motion, which carried unanimously by those
Councilmembers in attendance. (Councilmember Pernell absent)

REGARDING THE . MEETING TIME OF THE PLANNING COMMISSION AND
AMENDING THE ROLLING HILLS MUNICIPAL CODE.
(FIRST READING AND INTRODUCTION)
City Manager Nealis introduced Ordinance No. 296. He indicated that the Planning
Commission had discussed the idea of adjusting their meeting time from 7:30 p.m. to 6:30 p.m.
and that staff prepared this Ordinance because in order' to make this adjustment, an
amendment to the Municipal Code was required. He indicated that the attached Ordinance
would give the Planning Commission the discretion to establish its meeting time by
resolution.
Mayor Pro Tem Pemell requested clarification regarding public notification of this change.
City Attorney Jenkins commented on the posting of Agendas at City Hall. City Manager
Nealis commented on the advertisement of meeting times in the Citywide Newsletter.
Following discussion, a motion was made by Councilmember Lay, which was seconded by
Councilmember Hill; to introduce Ordinance No. 296. Hearing no objections, Mayor
Heinsheimer ordered Ordinance No. 296 introduced and continued this item to the October 25,
2004 City Council meeting for consideration of second reading and adoption.

Chairman Sommer introduced.Resolution No. 2004-25 and called for a motion.
In response to Commissioner Witte, City Manager Nealis explained that' an article would be
placed in the Citywide Newsletter announcing the change in time.
Commissioner Witte moved that the Planning Commission adopt Resolution No. 2004-25.
Commissioner DeRoy seconded the motion, which carried unanimously by those
Commissioners in attendance.

BACKGROUND
1. At the August 17, 2004 Planning Commission meeting, the Commission
voted to establish the meeting time of the Planning Commission's meetings at
6:30 p.m., rather than the current 7:30 p.m.
2. ' The Rolling Hills Municipal Code mandated that Commission meetings
start at 7:30 p.m. Changing the time required the City Council to amend the
Municipal Code. The City Council at their October 25, 2004 regular meeting
adopted Ordinance No. 296 amending the Municipal Code to allow the Planning
Commission to set the meeting time by a Resolution.
3. Attached for your consideration is Resolution No. 2004-25 establishing the
meeting time at 6:30 p.m.
RECOMMENDATION
It is recommended that the Planning Commission consider adopting Resolution

copy of the staff report that was presented to the City Council. on September 27th
is attached for your information.
RECOMMENDATION
It is recommended that the City Council open the continued public hearing, take
public testimony, close the public hearing and consider Ordinance No. 296 for
second reading and adoption.

BACKGROUND
The Planning Commission discussed the possibility of changing its
regular meeting time from 7:30 pm to 6:30 pm. However, the Rolling Hills
Municipal Code establishes the Commission meeting time of 7:30 pm. Changing
it would require the City Council to amend the Municipal Code.
Attached for your consideration is an ordinance amending the Municipal
Code to allow the Planning Commission to set its own meeting time by
Resolution of the Planning Commission.
It is anticipated that if the City Council ultimately adopts this ordinance,
the Planning Commission will act to set its meeting time at 6:30 pm for regular
meetings.
RECOMMENDATION
It is recommended that the City Council introduce and conduct the first reading
of the proposed ordinance.

Municipal Code is amended to read:
"2.20.30 Meeting Time. The Planning Commission will meet at the times
and places established by resolution of the Planning Commission. The Planning
Commission must meet at least once per month, unless its agenda contains no
items of business within the Commission's jurisdiction under this Chapter. If
there are no items of business within the Commission's jurisdiction on the posted
agenda, the Commission will not meet and the meeting may be adjourned by the
City Clerk, or his or her designee, to the next regular meeting date. The Planning
Commission will meet in the City Administration Building (City Hall), No. 2
Portuguese Bend Road, unless otherwise noticed in accordance with State law."

CONSIDERATION OF A PROPOSED ORDINANCE NO. 296.
AN ORDINANCE OF THE CITY OF ROLLING HILLS
REGARDING THE MEETING TIME OF THE PLANNING
COMMISSION AND AMENDING THE ROLLING HILLS
MUNICIPAL CODE.
BACKGROUND
The Planning Commission discussed the possibility of changing its
regular meeting time from 7:30 pm to 6:30 pm. However, the Rolling Hills
Municipal Code establishes the Commission meeting time of 7:30 pm. Changing
it would require the City Council to amend the Municipal Code.
Attached for your consideration is an ordinance amending the Municipal
Code to allow the Planning Commission to set its own meeting time by
Resolution of the Planning Commission.
It is anticipated that if the City Council ultimately adopts this ordinance,
the Planning Commission will act to set its meeting time at 6:30 pm for regular
meetings.
RECOMMENDATION
It is recommended that the City Council introduce and conduct the first reading
of the proposed ordinance.

AN ORDINANCE OF THE CITY OF ROLLING HILLS
REGARDING THE MEETING TIME OF THE PLANNING
COMMISSION AND AMENDING THE ROLLING HILLS
MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES
ORDAIN AS FOLLOWS:
Section 1. Section 2.20.030 of Title 2, Chapter 2.20. of the Rolling Hills
Municipal Code is amended to read:
