RECOMMENDATION
To consider options that would supplement the City's code enforcement services.
BACKGROUND
During the FY 2015/16 budget preparation process, Councilmember Dieringer asked
that the Finance/Budget/Audit Committee consider supplementing the City's code
enforcement services by providing it assistance via the hiring of a consulting firm or
independent contractor.. Although the Budget Committee recommended a full time
Principal Planner to assist with code enforcement, Councilmember Dieringer believes
that this position's time could be served better doing other planning activities and it
would be better to keep City staff away from being in adversarial role that many code
enforcement cases can lead to with residents.
Although the Budget Committee did not make a recommendation on the supplemental
code enforcement services proposal during its deliberations on the budget, they
referred the item in order for it receive consideration at the June 8th City Council
meeting when discussing the adoption of the FY 201546 Budget. The City Council

discussed the item at the meeting, but continued the item for any decision until its July
13, 2015 meeting.
BACKGROUND
The City of Rolling Hills has a long history of providing code enforcement on a
complaint driven basis. City staff responds in a very resident friendly non -threatening
manner where "compliance" is the objective over "enforcement". Although the City
Council over a year ago appropriated funding for a part time Assistant Planner to assist
the Planning Director with all the development projects in the City, unfortunately more
of this position's time has been dominated with code enforcement issues. Over the last
six months, the City has seen a significant rise in code enforcement complaints that
helped staff justify that a full time position was needed. However, there is a concern
that if this trend continues, code enforcement could possibly take the majority of this
full time positions time.
Another area where code enforcement assistance is needed concerns the increasing
investigating of "as built" construction. This need includes having a staff member to
perform spot checks on active permits for illegal as built construction or when
construction is underway and the City receives inquiries about whether permits were
pulled on'a construction project. Again, this problem was another reason for the need
of a full time Principal Planner, but a contracted code enforcement officer could
supplement this work.
Mayor Pro Tem Dieringer within this request is also seeking to augment the code
enforcement protocol by performing "pro active" inspections. This direction would
have staff go out and do "windshield" inspections of properties to see if there are code
enforcement violations without receiving a formal complaint. This would be an
expansion of the City's present code enforcement practice and would definitely need an
expansion of resources beyond the Principal Planner either in more staff or contract
assistance.
FISCAL IMPACT
To augment the code enforcement program, this can be done by a part time employee
(similar to what we have now), an independent contractor or by consulting firm that
provides this service. Staff received a number of proposals from consulting firms that
provided quotes for various options of providing code enforcement services. These
quotes range between $50 and $85 an hour and are enclosed.
The City that operates similar to ours is Rolling Hills Estates and they utilize a retired
County employee. The City hired this employee at $29 an hour up to $30,000. Rolling
Hills Estates officials indicated they have utilized all three options (employee,
independent contractor and consultant firm) and found hiring an employee has worked
the best. However, due to all the construction activities and increase in code
enforcement cases recently, Rolling Hills Estates as part of its FY 15/16 budget will be
hiring full time Code Enforcement official.

The City could also contract with the County of Los Angeles as part of the City's
General Services Agreement. However, the City could contract with them for only full
time code enforcement officers at $7,600 a month that equates to $91,200 a year.
CONCLUSION
Staff believes it will now have more resources to handle code enforcement cases by
hiring a new full time Principal Planner. Staff however believes that if the trend
continues with more code enforcement complaints and increased construction, too
much of this person's time will be spent on code enforcement. Thus, it would be
helpful to receive additional assistance so the Principal Planner could deal more with
development projects and long range planning efforts. Furthermore, if the City Council
decides it wants a proactive code enforcement program, more code enforcement
resources will definitely be needed.

compliance officer, building inspectors, and community to 1) develop fair solutions for citizens; 2)
implement a positive approach and flexible solutions; and 3) provide clear and concise information to
citizens.
HR Green, inc. was founded in 1913, has maintained California operations since 2004, and in 2012
established a separate California corporate entity, HR Green California, Inc, The firm has roughly 375
employees and 15 offices throughout the United States, including a Southern California office in Orange.
HR Green California, Inc. exclusively serves public agencies, providing building and safety, code
compliance, plan check, inspection, engineering, program management, construction management, and

To consider options that would supplement the City's code enforcement services.
BACKGROUND
Councilmennber Dieringer has asked that the Finance/Budget/Audit Committee
consider supplementing the City's code enforcement services by providing it assistance
via the hiring of a consulting firm or independent contractor.. Although the Budget
Committee is recommending a full time Assistant Planner to assist with code
enforcement, Councilxnennber Dieringer believes that this position's time could be
served better doing other plaruling activities and it would be better to keep City staff
away from being in adversarial role that many code enforcement cases can lead to with
residents.
BACKGROUND
The City of Rolling Hills has a long history of providing code enforcement on a
complaint driven basis. City staff responds in a very resident friendly non -threatening
-t
manner where "compliance" is the objective over "enforcement°. Although the City
Council over a year ago appropriated funding for a part time Assistant Planner to assist
the Planning Director with all the development projects in the City, unfortunately more
of this position's time has been dominated with code enforcement issues. Over the last
six months, the City has seen a significant rise in code enforcement complaints that
helped staff justify that a full time position is needed. However, there is a concern that
if this trend continues, code enforcement could possibly take the majority of this full
time positions time.
Another area where code enforcement assistance is needed concerns the increasing
investigating of "as built" construction. This need includes having a staff member to
perform spot checks on active permits for illegal as built construction or when
construction is underway and the City receives inquiries about whether permits were
pulled on a construction project. Again, this problem was another reason for the need
of a full time Assistant Planner, but a contracted code enforcement officer could
supplement this work
Councilmember Dieringer within this request is also seeking to augment the code
enforcement protocol by performing "pro active' inspections. This direction would
have staff go out and do "windshield" inspections of properties to see if there are code
enforcement violations without receiving a complaint. This would be an expansion of
the City's present code enforcement practice and would definitely need an expansion of
resources either in more staff or contract assistance.
FISCAL IMPACT
To augment the code enforcement program, this can be done by a part time employee
(similar to what we have now), an independent contractor or by consulting firm that
provides this service. At the time of this report, staff was waiting for proposals from
consulting firms to provide quotes for various options of providing code enforcement
services. Staff anticipates they will have some quotes to provide the. Committee
members the night of the meeting.
The City that operates similar to ours is Rolling Hills Estates and they utilize a retired
County employee. The City hired this employee at $29 an hour up to $30,000. Rolling
Hills Estates officials indicated they have utilized all three options (employee,
independent contractor and consultant firm) and found hiring an employee has worked
the best. During a recent conversation with RHE Planning Director, staff learned that
due to all the construction activities RHE is considering hiring a full time Code
Enforcement official.
The County of Los Angeles as part of the City's General Services Agreement could
contract with them for only full time code enforcement officers at $7,600 a month that
equates to $91,200 a year.
CONCLUSION
Staff believes it will now have more resources to handle code enforcement cases by
hiring a new full time Assistant Planner. Staff however believes that if the trend
continues with more code enforcement complaints and increased construction, too
much of this person's time will be . spent on . code enforcement. Thus, it would be
helpful to receive additional assistance so the Assistant Planner could deal more with
development projects and long range planning efforts. Furthermore, if the City Council
decides it wants a . proactive code enforcement program, more code enforcement
resources will definitely be needed.

implement a positive approach and flexible solutions; and 3) provide clear and concise information to
citizens.
HR Green, Inc. was founded in 1913, has maintained California operations since 2004, and in 2012
established a separate California corporate entity, HR Green California, Inc. The firm has roughly 375
employees and 15 offices throughout the United States, including a Southern California office in Orange.

Regarding your question about Contract Code Enforcement Services, I know of multiple cities —
including San Mateo, Half Moon Bay, Pacifica, Redwood City, Atherton, Monte Sereno, Los
Gatos, Los Altos Hills, Sunnyvale, Cupertino, Millbrae, Marina, San Rafael, Fremont etc. etc. —
that have used, or are currently using Contract Code Enforcement Services for: augmentation,
temporary fill-in, long-term assignments, pilot programs, special projects, part-time services &
full-time coverage.
One of the great things about contract services is that experimentation, innovation, and fresh -
perspectives on stale cases tend to help energize existing staff; and cities have the easy option
of deciding if they want to continue with the new ideas or go in other directions.
Oftentimes, cities will use the salary savings from vacant positions to fund 6 -month contracts
with consulting firms like CSG Consultants, Inc.

The City of San Dimas has their own CEO's.
The only City that I know of that contracts is La Puente.

Hi My Name is Berenice Arteaga, Senior Code Enforcement Officer for the City of Brentwood.
Yes we contract out for 1 code enforcement officer through Interwest, City of Antioch does too
We began doing this when our staff was cut from 4 fulltime to 2 fulltime. Until we can get more
fulltime employees hired we will continue to use Interwest services.

My city of residence, population 3,500, contracts with Coastland for building permit and Code
Enforcement services, as we are not big enough to justify a full-time permanent staff day-to-
day. Coastland services about 15 -20 other municipalities of similar size in the north state.
