2500 Planning - Consideration of a Report Regarding Subterranean GaragesCouncilmembers discussed the municipal code prohibition of subterranean garages and
structures that have the appearance of a 2 -story building. It was suggested that the Planning
Commission review the configuration of structures that may have the appearance of two-
story buildings and how far a residential structure may be out of grade..
Councilmember Heinsheimer suggested further exhibits relating to Zoning'. Cases not be
accepted after the Planning Commission has completed their review unless the Council takes
the case under their jurisdiction.

objection, he closed the public hearing and called for a motion.
Councilmember Murdock moved that the City Council waive further reading and
reintroduce Ordinance 269 as amended. Mayor Pro Tem Hill seconded the motion which
carried unanimously. Mayor Lay continued the public hearing to Monday, July 14, 1997, at
7:30 p.m., in the City Council Chambers, at City Hall, 2 Portuguese Bend Road, Rolling
Hills for consideration of seconded reading and adoption.

Discussion ensued regarding Section 9, Paragraph B of the draft Ordinance relating to the
date at which subterranean garages would be prohibited and the legal status of existing
subterranean garages, or those pending construction, but already approved.
Councilmember Heinsheimer requested that this language be clarified at the next meeting.
Following discussion, Councilmember Murdock moved that the City Council waive
. further reading and introduce Ordinance No. 269 as presented and that staff be directed to
review and clarify the language in Section 9, Paragraph B of the draft ordinance with the
City Attorney. Councilmember Pernell seconded the motion which carried unanimously.
Hearing no further discussion, Mayor Lay continued the public hearing to the next regular
City Council meeting to be held on Monday, June 23, 1997 for consideration of second
reading and adoption of Ordinance No. 269.

AN ORDINANCE OF THE CITY OF ROLLING HILLS REQUIRING
GARAGES TO BE CONSTRUCTED ABOVE GROUND, PROHIBITING THE
CONSTRUCTION OF NEW SUBTERRANEAN GARAGES, AND
AMENDING TITLE 17 (ZONING) OF THE ROLLING HILLS MUNICIPAL
CODE.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. On March 18, 1997, the Planning Commission requested that staff
prepare an ordinance that would require that garages be constructed above ground and that
new subterranean garages be prohibited. This action followed a discussion regarding
subterranean garages at a joint study session of the City Council and Planning Commission
held Monday, February 3, 1997.
Section 2. On May 20, 1997, the Planning Commission held a public hearing
regarding the proposed ordinance regarding the prohibition of new subterranean garages.
The Commission adopted Resolution No. 97-12, recommending that the definitions of
"Building pad coverage," "lot coverage," Paragraph (A)(1) of Section 17.16.070 (Maximum
level of site development permitted), Paragraph (B)(1) of Section 17.16.080 (Height
Limitation), and Paragraph (B) of Section 17.16.160 (Access and parking) be amended to
prohibit the construction of new subterranean garages in the Zoning Ordinance.
Section 3. On June 9, 1997, the City Council held a public hearing regarding the
proposed ordinance to prohibit new subterranean garages.
Section 4. The Planning Department staff prepared an initial study by which it
was determined that the proposed Ordinance would not have a significant effect on the
environment. Based on this finding, staff prepared a Negative Declaration. The City
Council has reviewed the proposed Negative Declaration and finds that it represents the
independent judgment of the City and that it was prepared in compliance with CEQA.
Based upon these findings, the City Council hereby adopts the Negative Declaration in
accordance with the California Environmental Quality Act.
Section 5. The definition of "Building pad coverage" contained in Section
17.12.020 of Chapter 17.12 (Definitions) of Title 17 (Zoning) of the Rolling Hills Municipal
Code is amended to read as follows:
"'Building pad coverage' means that area of a graded building pad developed with
the following improvements: primary residence, garages, accessory buildings, recreational
game courts, pools, stables, and subterranean structures other than basements. Building
pad coverage requirements are generally expressed in maximum allowable percent
coverage."
Section 6. The definition of "Lot coverage" contained in Section 17.12.120"of
Chapter 17.12 (Definitions) of Title 17 (Zoning) of the Rolling Hills Municipal Code is
amended to read as follows:
"'Lot coverage' means that area of the net lot area developed with the following
improvements: primary residence, garages, accessory buildings, recreational game courts,
pools, stables, subterranean structures other than basements, corrals, driveways, parking
areas, walks, patios, decks, and asphaltic or concrete paving not maintained by the Rolling
Hills Community Association. Lot coverage requirements are expressed in maximum
allowable percent coverage."
Section 7. Paragraph j(A)(1) of Section 17.16.070 (Maximum level of site
development permitted) of Chapter 17.16 (Residential Agriculture-Surburban (RA -S)
Zone) of Title 17 (Zoning) of the Rolling Hills Municipal Code is amended to read as
follows: .
"1. Coverage by Structures. All structures on a lot shall not cover more than
twenty percent of the net lot area. For the purpose of this section, "structures" include the
primary residence, garages, all accessory buildings, recreational game courts, swimming

Municipal Code is amended to read as follows:
"1. A one-story space shall be permitted over a basement."
Section 9. Paragraph (B) of Section 17.16.160 (Access and parking) of Chapter 17.16
(Residential Agriculture-Surburban (RA -S) Zone) of Title 17 (Zoning Ordinance) is
amended to read as follows:
"B. Parking requirements. Every single-family dwelling, including manufactured
homes used as a primary residence, shall have an above ground garage with a minimum
capacity of two cars with direct paved access to a maintained roadway. No new
subterranean garage shall be constructed after Aucrust 13 , 1997. Any
subterranean garage lawfully existing as of August 13 , 1997 shall be permitted
to remain in accordance with the provisions of Chapter 17.24 of this Title."
Section 10. The City Clerk shall enter the effective date of this Ordinance into the
blank spaces in Section 9 above.

BACKGROUND
At the June 23, 1997 meeting, the City Council introduced the attached draft ordinance

new subterranean garages, and allowing lawfully existing subterranean garages to
remain. The purpose of the ordinance is to discourage excessive grading and to avoid
the appearance of a two-story building.
RECOMMENDATION
It is recommended that the City Council, open the continued public hearing, review the

PLANNING COMMISSION REGARDING A PROPOSED
ORDINANCE: AN ORDINANCE OF THE CITY OF ROLLING HILLS
REQUIRING GARAGES TO BE CONSTRUCTED ABOVE GROUND,
PROHIBITING THE CONSTRUCTION OF NEW SUBTERRANEAN
GARAGES, AND AMENDING TITLE 17 (ZONING) OF THE ROLLING
HILLS MUNICIPAL CODE.
BACKGROUND
Planning Commission Resolution No. 97-12, dated May 20, 1997, is attached
recommending to the City Council that subterranean garages be prohibited. A draft
Ordinance and Changes to the Zoning Code, Sections 5 through 10 of the draft, are
also attached showing additions underlined and deletions shown by a
strikethreugh.
On March 18, 1997, the Planning Commission requested that staff prepare an
Ordinance that would require that garages be constructed above ground and that
subterranean garages be prohibited. This action followed a discussion regarding
subterranean garages at a joint study session of the City Council and Planning
Commission held Monday, February 3, 1997.
Currently, subterranean garages are a permitted use. The square footage of
subterranean garages are included in calculations as structural coverage for net lot
area, total lot area and coverage on the building pad.

NEIGHBORING CITIES
The neighboring cities of Rolling Hills Estates and Palos Verdes Estates each review
cases that include subterranean garages under their Neighborhood Compatibility
Ordinances. Subterranean garages are permitted in these cities. Rancho Palos
Verdes permits subterranean garages and requires a grading permit.
After reviewing the initial study for the Ordinance, staff has determined that this
Ordinance will not have a significant effect on the environment. Accordingly, a
Negative Declaration has been prepared.
RECOMMENDATION
It is recommended that the City Council review the proposed Ordinance and
Negative Declaration, open the public hearing, take public testimony, and introduce •
Ordinance No. 269.

maximum allowable percent coverage."
Section 6. The definition of "Lot coverage" contained in Section 17.12.120
of Chapter 17.12 (Definitions) of Title 17 (Zoning) of the Rolling Hills Municipal
Code is amended to read as follows:
"'Lot coverage' means that area of the net lot area developed with the
following improvements: primary residence, pin accessory buildings,
recreational game courts, pools, stables, subterranean structures other than
basements, corrals, driveways, parking areas, walks, patios, decks, and asphaltic or
concrete paving not maintained by the Rolling Hills Community Association. Lot
coverage requirements are- expressed -in- maximum allowable percent coverage."
Section 7. Paragraph (A)(1) of Section 17.16.070 (Maximum level of site
development permitted) of Chapter 17.16 (Residential Agriculture-Surburban (RA -
S) Zone) of Title 17 (Zoning) of the Rolling Hills Municipal Code is amended to read
as follows:
"1. Coverage by Structures. All structures on a lot shall not cover more
than twenty percent of the net lot area. For the purpose of this section, "structures"
include the primary residence, garlgel all accessory buildings, recreational game
courts, swimming pools and similar facilities, existing stables, combination stable
and corral sites required by Section 17.16.170, and subterranean structures other than
basements."
Section 8. Paragraph (B)(1) of Section 17.16.080 (Height Limitation) of
Chapter 17.16 (Residential Agriculture-Surburban (RA -S) Zone) of Title 17 (Zoning)
of the Rolling Hills Municipal Code is amended to read as follows:

Section 10, The City Clerk shall enter the effective date of this Ordinance

AN ORDINANCE OF THE CITY OF ROLLING HILLS REQUIRING
GARAGES TO BE CONSTRUCTED ABOVE GROUND, PROHIBITING
THE CONSTRUCTION OF NEW SUBTERRANEAN GARAGES, AND
AMENDING TITLE 17 (ZONING) OF THE ROLLING HILLS
MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1, On March 18, 1997, the Planning Commission requested that
staff prepare an ordinance that would require that garages be constructed above
ground and that new subterranean garages be prohibited. This action followed a
discussion regarding subterranean garages at a joint study session of the City Council
and Planning Commission held Monday, February 3, 1997.
Section 2. On May 20, 1997, the Planning Commission held a public
hearing regarding the proposed ordinance regarding the prohibition of new
subterranean garages. The Commission adopted Resolution No. 97-12,
recommending that the definitions of "Building pad coverage," "lot coverage,"
Paragraph (A)(1) of Section 17.16.070 (Maximum level of site development
permitted), Paragraph (B)(1) of Section 17.16.080 (Height Limitation), and Paragraph
(B) of Section 17.16.160 (Access and parking) be amended to prohibit the construction
of new subterranean garages in the Zoning Ordinance.
Section 3. On June 9, 1997, the City Council held a public hearing regarding
the proposed ordinance to prohibit new subterranean garages.
Section 4. The Planning Department staff prepared an initial study by
which it was determined that the proposed Ordinance would not have a significant
effect on the environment. Based on this finding, staff prepared a Negative
Declaration. The City Council has reviewed the proposed Negative Declaration and
finds that it represents the independent judgment of the City and that it was
prepared in compliance with CEQA. Based upon these findings, the City Council
hereby adopts the Negative Declaration in accordance with the California
Environmental Quality Act.
Section 5. The definition of "Building pad coverage" contained in Section
17.12.020 of Chapter 17.12 (Definitions) of Title 17 (Zoning) of the Rolling Hills
Municipal Code is amended to read as follows:

NOTICE IS HEREBY GIVEN, that the Planning Commission of the City of Rolling Hills will
hold a Public Hearing at 7:30 PM on Tuesday, May 20, 1997 in the Council Chambers of City
Hall, 2 Portuguese Bend Road, Rolling Hills, CA for the purpose of receiving public input
regarding the following:
Consideration of a proposed ordinance of the City of Rolling Hills requiring that all garages be

The request is briefly described as a proposed ordinance to modify and amend the Zoning Code to
establish revised standards for garages for property development in the residential zones.
Pursuant to the authority and criteria contained in the California Environmental Quality Act (CEQA)
and the CEQA Guidelines of the City of Rolling Hills, the Lead Agency has analyzed the project
and determined that the project will no have a significant impact on the environment. Based on this
finding, the Lead Agency prepared this NEGATIVE DECLARATION.

PLANNING COMMISSION REGARDING A PROPOSED
ORDINANCE: AN ORDINANCE OF THE CITY OF ROLLING HILLS
REQUIRING GARAGES TO BE CONSTRUCTED ABOVE GROUND,
PROHIBITING THE CONSTRUCTION OF NEW SUBTERRANEAN
GARAGES, AND AMENDING TITLE 17 (ZONING) OF THE ROLLING
HILLS MUNICIPAL CODE.
BACKGROUND
At the June 9, 1997 City Council meeting, during the first reading of the proposed
ordinance, Councilmembers approved the wording of Section 9 and 10 with
direction to City Attorney Michael Jenkins to review these sections so that
existing subterranean garages may lawfully exist.
City Attorney Jenkins and Assistant City Attorney Kevin Ennis propose the
wording as follows to clarify that existing subterranean garages would not
become illegal upon the adoption of the ordinance:
Section 9. Paragraph (B) of Section 17.16.160 (Access and parking) of
Chapter 17.16 (Residential Agriculture-Surburban (RA -S) Zone) of Title 17
(Zoning Ordinance) is amended to read as follows:
"B. Parking requirements. Every single-family dwelling, including
manufactured homes used as a primary residence, shall have an above
ground garage with a minimum capacity of two cars with direct paved access
to a maintained roadway. No new subterranean garage shall be constructed
after 1997. Any subterranean garage lawfully existing as of

1997 shall be permitted to remain in accordance with the
provisions of Chapter 17.24 of this Title."
Section 10. The City Clerk shall enter the effective date of this Ordinance
into the blank spaces in Section 9 above.
Planning Commission Resolution No. 97-12, dated May 20, 1997, is attached
recommending to the City Council that garages be required to be constructed above
ground and that subterranean garages be prohibited. The purpose of the ordinance is
to discourage excessive grading and to avoid the appearance of a two-story building.
This action followed a discussion regarding subterranean garages at a joint study
session of the City Council and Planning Commission held Monday, February 3,
1997.
Currently, subterranean garages are a permitted use. The square footage of
subterranean garages are included in calculations as structural coverage for net lot
area, total lot area and coverage on the building pad.
NEIGHBORING C1'1'1ES
The neighboring cities of Rolling Hills Estates and Palos Verdes Estates each review
cases that include subterranean garages under their Neighborhood Compatibility
Ordinances. Subterranean garages are permitted in these cities. Rancho Palos
Verdes permits subterranean garages and requires a grading permit.
After reviewing the initial study for the Ordinance, staff has determined that this
Ordinance will not have a significant effect on the environment. Accordingly, a
Negative Declaration has been prepared.
RECOMMENDATION
It is recommended that the City Council review the proposed Ordinance and
Negative Declaration, open the continued public hearing, take public testimony, and
if necessary reintroduce Ordinance No. 269.

THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY

basements. Building pad coverage requirements are generally expressed in
maximum allowable percent coverage."
Section 2. The Planning Commission recommends that the definition of
"Lot coverage" of Section 17.12.120 of Chapter 17.12 (Definitions) be amended to read
as follows:
"'Lot coverage' means that area of the net lot area developed with the
following improvements: primary residence, garages, accessory buildings,
recreational game courts, pools, stables, subterranean structures other than
basements, corrals, driveways, parking areas, walks, patios, decks, and asphaltic or
concrete paving not maintained by the Rolling Hills Community Association. Lot
coverage requirements are expressed in maximum allowable percent coverage."

THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. On March 18, 1997, the Planning Commission requested that
staff prepare an ordinance that would require that garages be constructed above
ground and that new subterranean garages be prohibited. This action followed a
discussion regarding subterranean garages at a joint study session of the City Council
and Planning Commission held Monday, February 3, 1997.
Section 2. On May 20, 1997, the Planning Commission held a public
hearing regarding the proposed ordinance regarding the prohibition of new
subterranean garages. The Commission adopted Resolution No. 97-12,
recommending that the definitions of "Building pad coverage," "lot coverage,"
Paragraph (A)(1) of Section 17.16.070 (Maximum level of site development
permitted), Paragraph (B)(1) of Section 17.16.080 (Height Limitation), and Paragraph
(B) of Section 17.16.160 (Access and parking) be amended to prohibit the construction
of new subterranean garages in the Zoning Ordinance.
Section 3. On June 9, 1997, the City Council held a public hearing regarding
the proposed ordinance to prohibit new subterranean garages.
Section 4. The Planning Department staff prepared an initial study by
which it was determined that the proposed Ordinance would not have a significant
effect on the environment. Based on this finding, staff prepared a Negative
Declaration. The City Council has reviewed the proposed Negative Declaration and
finds that it represents the independent judgment of the City and that it was
prepared in compliance with CEQA. Based upon these findings, the City Council
hereby adopts the Negative Declaration in accordance with the California
Environmental Quality Act.
Section 5. The definition of "Building pad coverage" contained in Section
17.12.020 of Chapter 17.12 (Definitions) of Title 17 (Zoning) of the Rolling Hills
Municipal Code is amended to read as follows:

PROHIBITING THE CONSTRUCTION OF NEW SUBTERRANEAN
GARAGES, AND AMENDING UTLE 17 (ZONING) OF THE ROLLING
HILLS MUNICIPAL CODE.
BACKGROUND
Planning Commission Resolution No. 97-12, dated May 20, 1997, is attached
recommending to the City Council that subterranean garages be prohibited. A draft
Ordinance and Changes to the Zoning Code, Sections 5 through 10 of the draft, are
also attached showing additions underlined and deletions shown by a

On March 18, 1997, the Planning Commission requested that staff prepare an
Ordinance that would require that garages be constructed above ground and that
subterranean garages be prohibited. This action followed a discussion regarding
subterranean garages at a joint study session of the City Council and Planning
Commission held Monday, February 3, 1997.
Currently, subterranean garages are a permitted use. The square footage of
subterranean garages are included in calculations as structural coverage for net lot
area, total lot area and coverage on the building pad.

NEIGHBORING CITIES
The neighboring cities of Rolling Hills Estates and Palos Verdes Estates each review
cases that include subterranean garages under their Neighborhood Compatibility
Ordinances. Subterranean garages are permitted in these cities. Rancho Palos
Verdes permits subterranean garages and requires a grading permit.
After reviewing the initial study for the Ordinance, staff has determined that this
Ordinance will not have a significant effect on the environment. Accordingly, a
Negative Declaration has been prepared.
RECOMMENDATION
It is recommended that the City Council review the proposed Ordinance and
Negative Declaration, open the public hearing, take public testimony, and introduce
Ordinance No. 269.

basements, corrals, driveways, parking areas, walks, patios, decks, and asphaltic or
concrete paving not maintained by the Rolling Hills Community Association. Lot

THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. On March 18, 1997, the Planning Commission requested that

Section 3. On June 9, 1997, the City Council held a public hearing regarding
the proposed ordinance to prohibit new subterranean garages.
Section 4. The Planning Department staff prepared an initial study by
which it was determined that the proposed Ordinance would not have a significant
effect on the environment. Based on this finding, staff prepared a Negative
Declaration. The City Council has reviewed the proposed Negative Declaration and
finds that it represents the independent judgment of the City and that it was
prepared in compliance with CEQA. Based upon these findings, the City Council
hereby adopts the Negative Declaration in accordance with the California
Environmental Quality Act.

BACKGROUND
Attached to this staff report is a memorandum from Principal Planner Lola Ungar
describing the current Municipal Code provisions regarding subterranean garages.
This item is presented at the request of the Planning Commission. Currently, a
subterranean garage is included in the pad and net lot calculation as if the structure
were located above ground. The rationale for calculating subterranean garages as if
they were above ground is that all homes are required to have a two car garage
(Municipal Code Section 17.16.160, B).
RECOMMENDATION
It is recommended that members of the City Council and Planning Commission
discuss this matter and provide appropriate direction to staff.

BACKGROUND
On February 13, 1991, the City Council and Planning Commission held a joint
meeting to discuss mutual concerns. One of those concerns was subterranean
construction.
The participants discussed the inclusion of subterranean garage construction
in building pad coverage and square footage calculations, and aesthetic
impact. Examples of then current proposals (i.e., 6 Eastfield Drive and 16
Crest Road West) were reviewed. These projects included semi -subterranean
garage construction square footage in building pad coverage, structural lot
coverage and total lot coverage calculations. The Zoning Code prohibits any
habitable space over any other habitable space that includes lofts, mezzanines
and storage areas but, it excludes and permits a one-story interior habitable
space over basements and subterranean garages (Section 17.16.080).
In 1991, the consensus of the City Council regarding subterranean garage
construction was that each proposal before the Planning Commission should
be considered on an individual basis utilizing the findings outlined in the
Site Plan Review section of the Zoning Code (Section 17.46.050).
Attached are pertinent definitions from the Zoning Code for "building pad
coverage" (Section 17.12.020), "Maximum Lot Coverage" [Section 17.16.070
(A)(1)&(2)], "Height limitation" [Section 17.16.080(B)(1)], and "Parking
Requirements" [Section 17.16.160 (B)] from the Zoning Code.

Square footage of subterranean garages are included in calculations as
structural coverage for net lot area, total lot area and coverage on the building
pad.
Applicants sometimes become discouraged when considering the inclusion of
a semi -subterranean garage because any such use is counted as additional
structural and total lot coverage.

Building, Primary. Primary building' means a build-
ing in which the principal use on the lot is conducted.
1[0 *Building pad coverage means that area of a graded
building pad developed with the following improvements:
primary residence, accessory buildings, subterranean garag-
es, recreational game courts, pools and stables. Building
pad coverage requirements are generally expressed in maxi-
mum allowable percent coverage.
'Building official means that person charged with the
responsibility of administering the building code for the
city.
Building Pad, Graded. *Graded building pad means
that area (or those areas) of a lot which has been dis-
turbed by human activity for the purpose of creating suit-
able sites for establishment of a primary building, acces-
sory building, a stable/corral, swimming pool, subterranean
structure, recreational game court, deck or similar im-
provements, but shall not include driveways. (Ord. 239
§11(part), 1993).
17.12.030 'C' words, terms and phrases. 'Cabana'
means an accessory structure enclosed on not more than
three sides which is generally associated with a swimming
pool, whirlpool or similar facility and which is intended
to be used as a clothes changing room. Cabanas shall not
contain sleeping or indoor cooking facilities.
Caretaker's Residence. See 'guest house.'
Cellar. See 'basement.'
' City' means the incorporated City of Rolling Hills.
'City Council or Council' means the City Council of
the City of Rolling Hills.
' Civic center' means the administrative offices of the
City and of nonprofit community associations.
' Commission or Planning Commission' means the Planning
Commission of the City of Rolling Hills.
' Conditional use permit' means an approval which may
be granted by the Planning Commission which is required for
a conditional use to be permitted in a district or zone.
' Conditional use' means a use permitted in a particu-
lar zoning district only upon showing that such use in a
specified location will comply with all the conditions and
standards for the location or operation of such use as
specified in the development code and authorized by the
Planning Commission.
' Corral' means a pen or enclosure, constructed of
split rail or similar open fencing materials, used for
confining horses or other permitted domestic animals.
Coverage, Building Pad. See 'building pad coverage.'
Coverage, Lot. See 'lot coverage.' (Ord. 239
§11(part), 1993).

4. For lots fronting at the turn -around end of a
cul-de-sac, the minimum frontage width shall be a function
of the required cul-de-sac radius and the number of lots
fronting the turn -around. No more than two lots shall
front the turn -around, and the turn -around shall have a
minimum radius of thirty-two feet.
5. All lots shall have a depth with a maximum
slope of twenty-nine degrees equal to or greater than the
lot width abutting the front street easement. (Ord. 239
§11(part), 1993).
17.16.070 Maximum level of site development permit-
ted. The following standards for maximum lot coverage and
maximum disturbed area shall apply to all development in
the RA -S zone.
A. Maximum Lot Coverage. Two maximum lot coverage
standards shall apply - maximum coverage by structures and
maximum coverage by impervious surfaces.
1. Coverage by Structures. All structures on a
lot shall not cover more than twenty percent of the net lot
area. For the purpose of this section, 'structures" in-
clude the primary residence, all accessory buildings, rec-
reational game courts, swimming pools and similar facili-
ties, existing stables, combination stable and corral sites
required by Section 17.16.180, and subterranean structures.
2. Impervious Surface Coverage. All structures,
as defined in subsection (A)(1) of this section, and all
other impervious surfaces shall not cover more than thirty-
five percent of the net lot area. For the purposes of this
section, impervious surfaces shall include all driveways,
parking areas, walks, patios, decks and asphaltic or con-
crete paving not maintained by the Association.
B. Maximum Disturbed Area. The natural conditions on
a lot shall be maintained to the greatest degree possible.
Disturbance shall be limited to forty percent of the net
lot area. For purposes of this paragraph, "disturbance"
shall include any remedial grading (temporary disturbance),
any graded slopes and building pad areas, any nongraded
area where impervious surfaces exist.ai-any pfd--land-

1993) .
17.16.080 Height limitation. A. General Limitation.
A building shall have no more than one story, meaning no
interior habitable space shall exist over any other interi-
or habitable space. For the purposes of this section,
"interior habitable space" includes lofts, mezzanines and
storage areas.
B. Exceptions.
1. A one-story space shall be permitted over a
basement or subterranean garage.

D. Walkways, steps, mail boxes, security lighting and
irrigation systems are permitted in any yard area. (Ord.
239 §11(part), 1993).
17.16.160 Access and parking. A. Driveway Require-
ments.
1. Each single-family dwelling is permitted only
one driveway as access to a maintained roadway, except as
otherwise permitted by Section 17.16.040(A).
2. Driveways shall be no wider than twenty feet,
unless otherwise approved by the Planning Commission. All
driveways shall have a roughened concrete driveway apron.
3. No driveway shall exceed a maximum grade of
twelve percent, unless otherwise approved by the Planning
Commission, and the first twenty feet of a driveway shall
have a maximum grade of seven percent.
4. All new driveways shall be reviewed by the
[ Traffic Commission.
B. Parking Requirements. Every single-family dwell-
ing, including manufactured homes used as a primary resi-
dence, shall have a garage with a minimum capacity of two
cars with direct paved access to a maintained roadway.
(Ord. 239 §11(part), 1993).
17.16.170 Stable and corral site required. Every lot
or parcel of the RA -S zone for which site plan review is
required by this title in connection with the construction
of a new single-family residence or the addition to an
existing single-family residence, shall have areas devel-
oped with or set aside for both of the following:
A. A combination'stable and corral area that complies
with the criteria set forth in Section 17.16.200(A); and
B. A vehicular accessway to the stable and corral
area for delivery of feed and removal of waste that does
not exceed a slope of twenty-five percent.
For purposes of this section, 'vehicular accessway'
shall include a driveway, roadway or other accessway that
is traversable by any motorized device capable of deliver-
ing feed and the removal of waste. These accessways need
not be paved. (Ord. 252 §1, 1995: Ord. 239 §11(part),
1993) .
17.16.180 Landscaping requirements. All existing
landscaping shall be maintained in a healthy condition. No
landscape plant materials shall be removed from a planted
area unless the removed materials are replaced with like
landscaping. (Ord. 239 §11(part), 1993).
