UNGAR, PRINCIPAL PLANNER SUBJECT: HOUSING ELEMENT COMPLIANCE BACKGROUND SB 2037, a bill authored by Senator Boatwright at the request of cities, was vetoed by the governor last year. In an effort to bring cities' Housing Elements into compliance, the bill would have enabled cities to combine resources in order to produce affordable housing and allow local governments to enter into agreements to pool resources such as in lieu fees, infrastructure, planning staff time, and land. The allocation of sites for housing produced pursuant to such agreements would be credited in proportion to the resources contributed among the various participants. The bill included language which ensured that the total units which must be produced in a given region remain constant and that a given jurisdiction cannot receive credit for more than 20% of their fair share allocation. These requirements were intended to ensure that this method would be only one of many tools available to local government to produce housing and to be used only in exceptional circumstances. This year, because of the governor's Growth Management Plan, the League of California Cities will be reintroducing the bill. Currently, there is no sponsor and no bill number. We will continue to monitor this situation and provide reports as necessary. RECOMMENDATION It is recommended that, the City Council receive and file this memorandum. s: Printed on Recycled Paper.
