2500 Planning - Consideration of Planning Commission Terms of AppointmentCONSIDERATION OF RE -APPOINTMENTS TO THE PLANNING COMMISSION.
Mayor Heinsheimer announced the item and called for a motion. Councilmember Hill moved
that the City Council re -appoint Arvel Witte and Loren DeRoy to three-year terms on the
Planning Commission, which will expire on January 1, 2008. Mayor, Pro Tem Pemell seconded
the motion.
In response to Councilmember Black, City Manager Nealis explained the State law regulating
vacancies on City Commissions• and Committees. He also explained the advertisement
procedures for vacancies and the process of receiving letters of interest and the Personnel
Subcommittee interview process that results in a recommendation for the City Council to
appoint new commissioners used in the past. He indicated that traditionally, the City Council
has re -appointed standing commissioners when terms expire. He reported that
correspondence had been previously forwarded to members of the City's Commissions and
Committees whose terms wouldexpire on January 1, 2005 to determine their level of interest
regarding re -appointment.
In response to Councilmember Black, Mayor Pro Tem Pemell stated that traditionally the
Commissioners and Committee Members have been re -appointed but that if the City Council
elects to do so, that this would be the time to re-evaluate an appointment of a Commissioner
or Committee Member who ha not demonstrated an involvement or has acted in an
inappropriate manner.
Councilmember Black inquired as to what the process would be if a Councilmember had
concern about the viewpoint of one of the Planning Commissioners and would prefer to see
other applicants. Councilmember Lay indicated that he feels that if a Councilmember had a
concern with a Commission or Committee Member that it should be brought to the attention
of the City Council Personnel Subcommittee. Councilmembers discussed the current
procedure and timeliness of the current re -appointments. City Manager Nealis explained that
correspondence had been forwarded to members of the City's Commissions and Committees
whose terms would expire on January 1, 2005 in the fall inquiring as to whether they wished
to be re -appointed. He indicated that this correspondence was copied to the Members of the
City Council and noted in the Weekly Memorandum.
Further discussion ensued regarding the current appointments to the Planning Commission.
Mayor Heinsheimer asked if Councilmember Black had a concern with one or both
appointments. Councilmember Black indicated that he had a concern with one. The City
Council discussed the procedure of appointments and determined that they would consider
the two appointments separately. Councilmember Hill withdrew his original motion and
Mayor Pro Tem Pemell withdrew his second.
Councilmember Black moved that the City Council re -appoint Arvel Witte to a three-year
term on the Planning Commission, which will expire on January; 1, 2008. Councilmember Hill
seconded the motion, which carried unanimously.
Councilmember Lay moved that the City Council re -appoint Loren DeRoy to a three-year
term on the Planning Commission, which will expire on January 1, 2008. Mayor Pro Tem
Pernell seconded the motion.
Councilmember Black commented on the guidelines that are given to Commissioners at the
time they are appointed and indicated that he understands that people would have their own
personal opinions regarding what is or is not a character or nature of what we wish to have in
the City. He expressed that he is concerned about the concerns expressed by Commissioner
DeRoy during the Commission's review of a recent zoning case that was taken under

jurisdiction by the City Council. He also commented on Commissioner DeRoy's involvement
with the Committee on Trees and Views and expressed that he felt that it was Commissioner
DeRoy's involvement that led to the Committee's solution to the view impairment case that
has been appealed to the City Council. He stated that neither of the solutions in these cases, in
his viewpoint; are consistent with what is his view for the City and interpretation of the City
rules and that he feels that Commissioner DeRoy should be given some redirection or advise
as to the goals of the City. Councilmember Black indicated that he understands that these
goals may be different for everyone.
Mayor Heinsheimer stated that it is expected that Commissions and Committees may have a
spectrum of views and opinions when reviewing land use issues. He stated that if the
Commission and Committee Members conform to the overall policy guidelines• of the City
then he feels that there is no problem and indicated that there would be a concern if a
Commission or Committee Member acted inappropriately or in an unprofessional manner
and that it would be grounds for their removal. In response to Mayor Heinsheimer,
Councilmember Black indicated that there were twelve applicants the last time there was a"
vacancy on the Planning Commission.
Mayor Pro Tem Pernell explained that a good indication that there are problems with
members of a Commission or Committee would be if one member consistently voted
contrary to the other members. Councilmember Lay stated that he credits Commissioner
DeRoy for her concerns with the zoning case that Councilmember Black cited previously
regarding the mass of the project and the way it was oriented on the lot. He stated that in his
view Commissioner DeRoy has added a component to the Planning Commission that is quite
valuable in terms of a sense of land planning due to her experience. Councilmember Black
commented that he felt that the mass of the home in the previous zoning case was within the
City's rules and guidelines. Councilmember Lay explained that prior to Site Plan Review the
City did not have the control over the size of a house versus pad and that this was the basis of
Commissioner DeRoy's objection. Councilmember Black further commented the history of
this zoning case as it went through Planning Commission review and expressed concern that
the resident, had to go through the process again.
Councilmember Black also commented on the view case and stated that he felt that
Commissioner DeRoy was the impetus to the current resolution of this case. In response to
Councilmember Lay, City Manager Nealis stated that the vote from the Committee on Trees
and View was unanimous in this case.
Hearing no further discussion, Mayor Heinsheimercalled for a roll call vote on the re-
appointment of Commissioner Deroy.

CONSIDERATION OF RE -APPOINTMENTS TO THE PLANNING COMMISSION.
City Manager Nealis presented the staff report and letters from Commissioners Hankins and
Margeta-indicating that they both wish to be re -appointed. In response to Mayor Hill, City
Manager explained that the expiration of terms had been posted pursuant to the Maddy Act
and that there had not been any response to this posting.
Councilmember Pernell moved that the City Council re -appoint Evie Hankins and John
Margeta to three year terms on the Planning Commission which will expire on January 1,
2007. Mayor Pro Tem Heinsheimer seconded the motion, which carried unanimously.

NEW BUSINESS

City Manager Nealis presented the staff report indicating the desire of Planning
Commissioners Allan Roberts and Arvel Witte to continue to serve on the Commission.
Hearing no objection, Mayor Murdock called for a motion.
Councilmember Heinsheimer moved that the City Council reappoint Allan Roberts and Arvel
Witte to three year terms on the Planning Commission which will expire on January 1, 2005.

CONSIDERATION OF PLANNING COMMISSION TERMS OF APPOINTMENT.
Mayor Heinsheimer referred the Council to the chart provided by staff which indicates the
original appointment dates of the Planning Commissioners and City Manager Nealis
presented the staff report.
Councilmember/Personnel Subcommittee Member Jody Murdock suggested that the
assignment of terms be made according to an alphabetical formula. Hearing no objection,
Mayor Heinsheimer called for a motion.
Councilmember Murdock moved that the City Council approve the recommendation of
the Personnel Subcommittee that Commissioners be appointed to the Planning
Commission according to a 2-2-1 distribution serving three year terms beginning on
January 1, 1996, that the Commissioners be appointed for the respective terms provided for
under an alphabetical formula as follows: Commissioner Frost, 1 year; Commissioner
Hankins, 2 years; Commissioner Raine, 2 years; Chair Roberts 3 years; and Commissioner
Witte, 3 years, and that all subsequent Planning Commission Appointments shall be for 3
year terms. Councilmember Lay seconded the motion which carried unanimously.

RECOMMENDATION
It is recommended that members of the Planning Commission consider reorganization
of the Planning Commission and the Committee on Trees and Views.
A. PLANNING COMMISSION
Pursuant to Section 2.20.060 of the Rolling Hills Municipal Code, the "Planning
Commission shall elect a Chairperson and Vice Chairperson from among its members,
who shall serve for a term of one year and until the successor of each is appointed".
With Mr. Pieper joining the City Council in April 2013 the Planning Commission re-
organized in April 2013, selecting Brad Chelf as the Chairman and Jill Smith as Vice -
Chairperson and decided that the annual reorganization should take place in April of
each year.

Should the Commission wish to continue to rotate the Chair and Vice Chair positions
on annualbasis by year of appointment to the Commission and rotations to date,
Commissioner Smith would be next in line for the Chairperson's position and

may select other rotation or retain the current officers.
B. COMMITTEE ON TREES AND VIEWS
Pursuant to Section 17.26.20 of the Municipal Code, "the Committee on Trees
and Views is composed of three members of the Planning Commission appointed by
the Commission annually at the same time as the Commission selects its officers, or
whenever a vacancy occurs."
Commissioners Chelf, Smith and Mirsch currently serve on this committee, with
Committee member Chelf serving as the Chairperson and Committee member Smith as
Vice -Chairperson. Commissioner Gray is substituting in one case for Committee
member Mirsch.
The Commission may consider re -organization of its members, to the Committee.
However, due to the fact.that there are several active view impairment cases before the
Committee, it is recommended that the Committee retain current officers.

Commissioner Re -appointment Process
BACKGROUND
In April, the City Council appointed an Ad Hoc Committee of Council Members
Heinsheimer and Lay to address the reappointment process for Commissioners. The
goal of the Committee was to develop recommendations that provided residents with
the opportunity to be selected for a Commission when Commissioner terms expired.
The Ad Hoc Committee met on several occasions and their recommendations were
shared with the City Council through meeting notes included on the City Council
agendas of July 9, 2007 and July 23, 2007.
DISCUSSION
The Ad Hoc Committee recommends extending the terms of the Planning Commission
and Traffic Commission to four (4) years so within a Commissioner's term there is time
to effectively contribute to the City. By extending the term, it is the Ad Hoc
Committee's perspective that a second, third or fourth term may not be necessary for
the full experience when there are qualified residents interested in participating on the
Commission. The extension of terms to 4 years will make all City Commission terms
the same.
For the reappointment process, the Ad Hoc Committee recommends following the
procedures for a new appointment when a Commission seat is vacant. The
recommendation, however, is to extend the process in order to provide residents with
sufficient time to submit an application.

the opportunity to be selected for a Commission when Commissioner terms expired.
The Ad Hoc Committee met on several occasions and their recommendations were
shared with the City Council through meeting notes included on the City Council
agendas of July 9, 2007 and July 23, 2007.
DISCUSSION
The Ad Hoc Committee recommends extending the terms of the Planning Commission
and Traffic Commission to four (4) years so within a Commissioner's term there is time
to effectively contribute to the City. By extending the term, it is the Ad Hoc
Committee's perspective that a second, third or fourth term may not be necessary for
the full experience when there are qualified residents interested in participating on the
Commission. The extension of terms to 4 years will make all City Commission terms
the same.
For the reappointment process, the Ad Hoc Committee recommends following the
procedures for a new appointment when a Commission seat is vacant. The
recommendation, however, is to extend the process in order to provide residents with
sufficient time to submit an application.

THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES ORDAIN AS
FOLLOWS:
Section 1. Title 2, Chapter 2.20, of the Rolling Hills Municipal Code is
amended by amending Section 2.20.020 to read as follows:
2.20.020. Appointment of members, terms of office and selection.
The Planning Commission shall consist of five members who shall be residents
of the City, appointed by vote of not fewer than three members of the City
Council. The Term of office of the members of the Planning Commission shall
be three years. Following expiration of the term of office, each Commissioner
shall serve until a successor is appointed and qualified.
Section 2. For the purpose of staggering the terms of the Planning
commission, of the members appointed following adoption of this Ordinance, one member
shall serve for a term of one year, two members shall serve for terms of two years and two
members shall serve for terms of three years. Thereafter, all appointments shall be for three
year terms. The members of the Commission and the assignment of their initial terms shall
be determined by the City Council.

the attached Ordinance. This Ordinance has been prepared by our City Attorney's
office and establishes terms for members of the Planning Commission at 3 years
each. Pursuant to the appointment schedule, terms will be staggered.
RECOMMENDATION
It is recommended that members of the City Council waive further reading and
introduce Ordinance No. 253.

As you recall, members of the City Council have been considering possible changes
to the Planning Commission terms of appointment. At the regular City Council
meeting held Monday, January 23, 1995, we reappointed four members of the
Planning Commission to interim terms of one year expiring on January 1, 1996.
This action caused all five Planning Commissioner's terms to expire on January 1,
1996.
Based upon our research and deliberation, we have elected to appoint Planning
Commissioners to three year staggered terms effective January 1, 1996. City staff is
preparing the appropriate Ordinance to put this change into motion. Rest assured,
we all fell you are all doing a wonderful job representing the City of Rolling Hills as
Planning Commissioners.
We were still left with the task of determining appropriate terms starting on January
1, 1996. This will allow us to have appointments staggered with at least one
member being considered for reappointment each January, beginning in 1997.
Enclosed is a copy of the staff report which shows the schedule of appointments to
take place on Year 1 (January 1, 1996).
Since you are all doing a fine job, we felt that the choices should be left to
alphabetical science. Therefore, Commissioner Roger Frost will be appointed for a
one year term, Commissioners Evie Hankins and Betsy Raine will be appointed for
two year terms and Commissioners Allan Roberts and Arvel Witte will be
appointed for three year terms. After each terms expiration, reappointment will be
considered for three years each.

Godfrey Pernell and Councilmember Jody Murdock are recommending that the City
Council appoint Planning Commissioners according to a 2-2-1 distribution serving
three year terms as described in the chart below.

BACKGROUND
At the regular City Council meeting held on January 9, 1995, City Councilmembers re-
appointed 4 members of the Planning Commission to interim terms of one year expiring
January 1, 1996. At the request of Mayor Pro Tem Godfrey Pernell staff researched other
options for appointments.
PENINSULA SURVEY
A surveywas conducted of the other cities on the peninsula to determine the manner in
which these cities appoint their planning commissioners.
The City of Rolling Hills Estates reports that their city's seven commissioners are appointed
annually, serving one year terms. Reviews of the performance of the planning
commissioners are done at the same time, and requests for re -instatement on the planning
commission are heard at that time also.
The City of Rancho Palos Verdes reports that their city's seven commissioners are appointed
for two year terms. The expiration of the planning commissioners terms follows a municipal
election for city council members. No attempts are made to stagger the terms, and the
planning commissioners are selected by an at large vote of the newly elected city
councilmembers.
The City of Palos Verdes Estates reports that their city's seven commissioners are appointed
for four year terms. The terms expire in a staggered manner, with the current terms
expiring in the following manner: 2 in 1995, 2in 1996, 1 in 1997, and 2 in 1998.

POSSIBLE OPTIONS
Option One:
The City Council could appoint planning commissioner's according to a 2-2-1 distribution,
serving 3 year terms. These appointments could be made to stagger the Commissioners
term of office. An example is provided below.

Such an appointment process will then have a 3 year staggered term, with at least one
appointment occurring every year.
Option Two:
The City Council could follow the appointment procedure as stated in the Rolling Hills
Municipal Code and appoint members to 4 year terms. The City Council could then appoint
the commissioners in such a manner as to stagger their terms of office. One way to
accomplish this would be to appoint members in a 2-3 fashion so that one year 2 members
terms expire and in two more years 3 members terms expire.
Presently within the City of Rolling Hills the Wildlife Preservation Committee
operates in a similar manner of staggered membership for four year terms.
Option Three:
The City Council could appoint members in a manner similar to the Traffic Commission's
term of office. All members would be appointed to serve two year terms, and appointments
would be done in a 2-3 fashion so that one year 2 members terms expire and the next year
3 members term of office would expire.
Option Four:
Councilmembers could present another alternative, utilizing any combination of
appointments.
RECOMMENDATIONS
Staff awaits further direction from the City Council regarding this matter.
