DATE: JULY 26, 2018 ATTACHMENTS: Current Sec. 10.36.050 of the RHMC Proposed Amendment (Hawkins) RECOMMENDATION It is recommended that members of the Traffic Commission review and consider the proposal from Commissioner Hawkins to amend the Rolling Hills Municipal Code (RHMC) regarding yielding to horseback riders and animals, including livestock, and for animal safety and provide direction to staff. BACKGROUND/DISCUSSION Commissioner Hawkins feels that the Rolling Hills Municipal Code (RHMC) is inconsistent with the California Vehicle Code (CVC) in regards to yielding to horseback riders and to other equestrian vehicles and livestock. He has also expressed concern that there is no provision in the RHMC requiring that vehicles exercise proper measures when animals are in the road. Attached to this report is the existing provision of Section 10.36.050, and Commissioner Hawkins' proposed additional language. Commissioner Hawkins recommends that two new paragraphs (D & E) be added to Section 10.36.050. He states that paragraph "D" would be consistent with the CVC, but that paragraph "E" does not have an equivalent provision in the CVC. However, given the City's rural and equestrian nature it is a desirable provision. The City Traffic Engineer reviewed the proposed provisions and has no objections to this proposed language regarding equestrian and animal right of way. Commissioner Hawkins' proposal is almost the same as the CVC Section 21759 but with minor word changes. The City's existing ordinance requires vehicles to yield to horseback riders in designated crossings, (designated with signs), but does not include other animals and animals not in designated crossings. Commissioner Hawkins' proposal would .address vehicles yielding to animals not in designated crossings and include all animals, not just horses. Should the Traffic Commission recommend the changes, the title of Section 10.36.050 of the RHMC would also need to be changed from "Equestrian crossings" to possibly "Animal crossings"; or a new section added addressing .other, animals when not in designated crossings. Staff would need to study the existing and proposed language in more detail and prepare appropriate amendments. NOTIFICATION President of Caballeros and the Rolling Hills Community Association have been notified that the Traffic Commission will be considering this matter by being sent a copy of this staff report. CONCLUSION Should the Traffic Commission members concur with Commissioner Hawkins and recommend to the City Council that the RHMC be amended, this matter would be agendized at a future date for a public hearing before the City Council. YS:yh v EXCERPT FROM THE ROLLING HILLS MUNICIPAL CODE (RHMC) CHAPTER 10.36 RIGHT OF WAY Section 10.36.050 Equestrian crossings. A. The City Manager may designate any intersection of a road as a bridle path or equestrian crossing by erecting appropriate signs. The signs shall be erected on the road at or near the approach to the intersection, and shall be of a type approved by the State Department of Transportation. The signs shall indicate the crossing and any crossmarks, safety devices, or signals the City Manager deem necessary to safeguard vehicular and equestrian traffic at the intersection. B. The driver of any vehicle shall yield the right-of-way to any horseback rider who is crossing the road at any designated equestrian crossing which is marked by signs as prescribed in subsection A of this section. C. Subsection B of this section does not relieve any horseback rider from the duty of using due care for his orher own safety. No horseback rider shall leave a curb or other place of safety and proceed suddenly into the path of a vehicle which is close enough to constitute an immediate hazard. PROPOSED ORDINANCES FOR ENACTMENT INTO THE ROLLING HILLS MUNICIPAL ORDINANCE AGENDA ITEMS FOR DISCUSSION AT THE JULY 26, 2018 TRAFFIC COMMISSION MEETING A. (DRAFT) Proposed 10.36.050.D (Consistent with CVC § 21759): The driverof any vehicle approaching any animal being ridden, or led, livestock, or horse drawn vehicle, shall exercise proper control of the vehicle beingdriven and shall (a) not engage in any conduct that may startle, frighten or injure the animal or livestock, and (b) reduce the vehicle's speed or stop, as may appear necessary or as signaled or otherwise requested by any person riding, leading, driving, or in charge of the animal or livestock, to minimize the risk of injury to the animal or livestock and/or any person riding, leading, driving or in charge of the animal or livestock. The driver of any vehicle approaching any horse drawn vehicle, any ridden animal, or any livestock shall exercise proper control of his vehicle and shall reduce speed or stop as may appear necessary or as may be signalled or otherwise requested by any person driving, riding or' in charge of the animal or livestock in order to avoid frightening and to safeguard the animal or livestock and to insure the safety of any person driving or ridirjg the animal or in charge of the livestock. Date: 07/26/18 A regular meeting of the Traffic Commission of the City of Rolling Hills was called to order by Chair Wilson at 8:30 a.m. on Thursday, May 24, 2018, in the. City Council Chamber, at City Hall, 2 Portuguese Bend Road, Rolling Hills, California. Vanessa Munoz, Traffic Engineer. Sgt. Ricky Osburn, Los Angeles County Sheriff's Dept. APPROVAL OF MINUTES MINUTES OF MARCH 22, 2018. Commissioner Raine moved that the Traffic Commission (TC) approve the minutes of the regular meeting of the Traffic Commission held on March 22, 2018. Commissioner Margeta seconded the motion, which carried without objection. PRESENTATION PRESENTATION BY REPRESENTATIVES OF THE LOS ANGELES COUNTY SHERIFF'S DEPARTMENT, LOMITA STATION ON TRAFFIC STATISTICS FOR THE CITY OF ROLLING HILLS. Sgt. Osburn presented the monthly traffic enforcement statistics. Discussion ensued concerning the issuance of warnings to residents before a citation is issued. Chair Wilson requested that the second page of the March 2018 Traffic Enforcement Report be provided as it was missing in the handout from Sgt. Osburn. OLD BUSINESS 2018 CITY OF ROLLING HILLS ENGINEERING & TRAFFIC SURVEY UPDATE. Traffic Engineer Munoz presented a summary of the 2018 Engineering and Traffic (E&T) Survey and staff report. She stated that at the previous TC meeting, the TC directed staff to research whether the two street segments of Eastfield Drive and Saddleback Road could be maintained at 25 MPH and be -1- 1 supported by the California Vehicle Code (CVC). She stated that the justification would be that these streets qualify as residential segments and that is the reason for the 25 MPH speed limit. Discussion ensued concerning warning signs on curved streets, passing of vehicles, tailgating and the use of radar. Discussion ensued concerning maintaining the speed limit at 25 MPH on Eastfield Drive and Saddleback Road. Commissioner Raine moved that the Traffic Commission recommend that the City Council not accept the increase in speed limits as recommended by Traffic Engineer Munoz, based on the 2018 E&T Survey, as follows: 1) Eastfield Drive from Chuckwagon Road to Palos Verdes Drive East - posted speed limit: 25 MPH, recommended speed limit: 30 MPH; and 2) Saddleback Road from Poppy Trail to Portuguese Bend Road - posted speed limit: 25 MPH, recommended speed limit: 30 MPH; and maintain the speed limits as currently posted on Eastfield Drive from Chuckwagon Road to Palos Verdes Drive East and Saddleback Road from Poppy Trail to Portuguese Bend Road; and recommend that the City Council adopt the remainder of the 2018 Engineering and Traffic Survey's recommended speed limits along the following six specified segments of roadway to remain the same: 1) Crest Road West from west City limit to Portuguese Bend Road, posted speed limit: 30 miles per hour (MPH), recommended speed limit: 30 MPH; 2) Crest Road East from Portuguese Bend Road to Eastfield Drive, posted speed limit: 30 MPH, recommended speed limit: 30 MPH; 3) Eastfield Drive from Crest . Road East to Chuckwagon Road, posted speed limit: 25 MPH, recommended speed limit: 25 MPH; 4) Portuguese Bend Road from Crest Road East/West to Poppy Trail, posted speed limit: 30 MPH, recommended speed limit: 30 MPH; 5) Portuguese Bend Road from Poppy Trail to Saddleback Road, posted speed limit: 30 MPH, recommended speed limit: 30 MPH; and 6) Southfield Drive from Crest Road East to Packsaddle Road, posted speed limit: 25 MPH; recommended speed limit: 25 MPH. Commissioner Margeta seconded the motion, which carried without objection. Commissioner Hawkins questioned the calibration data of the device used on the last page of the E&T Survey report. Traffic Engineer Munoz stated that she would verify the calibration of the device and whether it was a tuning fork or gun device. Commissioner Hawkins commented that the speed limit for commercial trucks should be lowered. Chair Wilson indicated that there is a cost to conduct a study and that the results may not be favorable to the City. NEW BUSINESS DISCUSSION AND CONSIDERATION OF FY 2018-19 SUPPLEMENTAL TRAFFIC ENFORCEMENT PROPOSAL. Acting Planning Director Stewart presented the staff report. In response to Chair Wilson's question, Acting Planning Director Stewart clarified that the supplemental traffic enforcement hours were 350 hours in fiscal years 2011-12, 2012-13, 2013-14 and 2014-15, then in fiscal year 2015-16 the hours were reduced to 175, then raised mid -year to 275 hours, which remained the same in FY 2017-18. Minutes 05-24-18 Traffic Commission Meeting -2- Commissioner Raine moved that the Traffic Commission recommend adoption of the FY 2018-19 Supplemental Traffic Enforcement proposal in the amount of 275 hours, as presented, to the City Council. Commissioner Margeta seconded the motion, which carried without objection. OPEN AGENDA - COMMENTS FROM PUBLIC ON ITEMS NOT ON THE AGENDA None. MATTERS FROM MEMBERS OF THE TRAFFIC COMMISSION The following items were discussed by the TC: 1) Commissioner Raine commented on flashing lights by drivers to warn other drivers of the presence of Sheriff's Deputies enforcing traffic laws; 2) Commissioner Hawkins commented on a speed limit sign at Crest Road West, fairly close to the Fire Station, behind a bush and that the bush is obscuring the sign. He suggested that that sign be moved in front of the bush; 3) Chair Wilson requested that staff check on the timing of the City of Rancho Palos Verdes' parking study, specifically when will it start; 4) Commissioner Hawkins commented on the City's municipal code. He stated that it was outdated with respect to the right of way for equestrians. He stated that horses only have the right-of-way at trail crossings. He stated that the California Vehicle Code states that livestock and horses in the roadway have the right of way. Commissioner Hawkins commented that the municipal code needs be updated to add a requirement that vehicles must yield to horses in the roadway; 5) Commissioner Hawkins commented that the municipal code makes reference to traffic signals in the City; however, there are none, except on Portuguese Bend Road; and 6) Commissioner Hawkins commented on the working hours in the City. He stated the hours of 8:00 a.m. to 5:00 p.m. are not followed. DATE: JULY 26, 2018 ATTACHMENTS: June 11, 2018 request letter from Mr. Don Croker on behalf of the Palos Verdes Art Center RECOMMENDATION It is recommended that the members of the Traffic Commission review and consider the Palos Verdes Art Center's request to include the artist studios at 14 Cinchring Road and 15 Eastfield Drive in the Palos Verdes Art Center's Artist Studio Tour scheduled for October 6 and 7, 2018 between the hours of 9 a.m. and 5 p.m. BACKGROUND/DISCUSSION Attached to this staff report is correspondence from Mr. Don Crocker representing the Palos Verdes Art Center requesting approval to include the artist studios at 14 Cinchring Road and 15 Eastfield Drive in the Palos Verdes Art Center's Artist Studio Tour scheduled for October 6 and 7, 2018 between the hours of 9 a.m. and 5 p.m. Historically, the Traffic Commission has reviewed requests for these types of tours to determine if there are any issues of traffic safety that need to be addressed. Final approval would be subject to the following: • The event will be held on Saturday, October 6, 2018 and Sunday, October 7, 2018 at 15.Eastfield Drive and 14 Cinchring Road between the hours of 9 a.m. and 5 p.m. each day and the addresses shall not appear on the event ticket or in advertisements. • An insurance certificate/endorsement showing the City of Rolling Hills as additionally insured on the Palos Verdes Art Center's Liability Insurance Policy shall be presented at least 15 days prior to the scheduled date of this event. NOTIFICATION Mr. Crocker and Mr. Gordon and the Rolling Hills Community Association have been notified that the Traffic Commission will be considering this matter by being sent a copy of this staff report. CONCLUSION The Traffic Commission recommendation will be forwarded to the City Council for approval. This years tour will be on the weekend of Oct. 6-7, 2018 from 9-5pm involving 10 venues. The studios of Errol Gordon, 15 Eastfield Rd and Don Crocker at 14 Cinchring Rd in our City have been asked to participate pending Rolling Hills City and Association approval. No problems have been known to have occurred re past Studio Tours and we greatly appreciate your past approvals and request a permit for this year and that our addresses would be considered `'open gate" for these two days only. We understand the necessity of insurance coverage and will supply same as in the past.
