Sergeant Osburn presented the monthly supplemental traffic enforcement statistics. He reported the
following traffic statistics for the month of August 2018: 1) Total of 65 hours worked; 2) Total of 67
citations issued, of which 23 citations were issued to residents and 44 citations were issued to non-
residents. Sergeant Osburn noted that a vehicle was cited for speeding at 56 miles per hour on
Portuguese Bend Road at Poppy Trail.
In response to Commissioner Hawkins' question, Sergeant Osburn stated that the Rolling Hills
Municipal Code (RHIVIC) is used to enforce traffic regulations in the City of Rolling Hills (City).

6. NEW BUSINESS
A. CONSIDERATION OF A PROPOSED REQUEST FOR A DRIVEWAY WITH TWO
APRONS AND A STABLE SERVICE DRIVEWAY WITH APRON AT 8
MIDDLERIDGE LANE SOUTH.
Planning Director Schwartz presented a summary of the project at 8 Middleridge Lane South. She
indicated that the property is a vacant lot and construction of a home will be proposed following a
review of the driveway approach. She stated the request is for consideration of a circular driveway
necessitating two aprons and a stable service driveway with one apron. Planning Director Schwartz
stated that Traffic Engineer Munoz reviewed the request and will present the staff report.
Traffic Engineer Munoz stated that the site has three proposed driveways aprons, two of them will
form a loop into the property and one is for equestrian deliveries. Traffic Engineer Munoz provided
the history of the street and stated that there is a power pole at the edge of the. top driveway that has
been hit at least once during the time she has been the Traffic Engineer due to vehicles speeding as
they approach the bend. She indicated that the looped driveway proposal is to meet the fire
department's requirements. She expressed concern with the sight distance of the proposed driveway
because the property is located in the s -shape of the roadway. She stated that the proposed driveway
does not meet the minimum site distance requirement of 155 feet and, depending on the slope of the
street, the site distance requirement could go up to 170 feet. She expressed concern with vehicles
exiting the driveway. Traffic Engineer Munoz stated that she does not recommend the driveways be
accepted per the proposed layout because the sight distance minimum requirement is not met.
In response to Chair Wilson's question, Planning Director Schwartz stated that a circular driveway is
allowed with a Conditional Use Permit.
Chair Wilson opened the item to public comment.
Mike Joly, 10 Middleridge Lane South, commented that he submitted a letter to the Traffic
Commission (TC). Mr. Joly expressed concern regarding the size of the proposed residence and the
two driveway aprons. Mr. Joly indicated that the architect, Criss Gunderson, discussed the proposed
driveway with him. Mr. Joly stated that he believes his view will be affected by the construction of the
home.

Criss Gunderson, Architect, 8 Middleridge Lane South, commented that the size and height of the
proposed project are not under the TC's purview. Mr. Gunderson stated that he met with Mr. Joly to
discuss his concerns. Mr. Gunderson explained the proposed driveway plans as follows: 1) The
circular driveway is not due to the request of his client; 2) Mr. Gunderson's clients would like a safe
exit and entrance, and a place for theirguests to park; 3) Due to difficulties with the shape of the lot,
the configuration of the existing topography and the limitations of grading, Mr. Gunderson is
proposing a circular driveway; and 4) Mr. Gunderson has worked with the fire department and this is
the concept that the fire department can approve to meet the fire code. He discussed the maximum
distance requirement for fire department access. Mr. Gunderson discussed the proposed widths of the
driveways for the main residence and the stable access road.
No further comments were received from the public. Chair Wilson closed public comments.
Discussion followed among the TC and staff concerning the proposed circular driveway, sight distance
requirements and scheduling a site visit.
Commissioner Virtue commented that additional information on the allowance of a circular driveway
is needed.
Commissioner Margeta commented that the proposed circular driveway should be redesigned.
Commissioners Hawkins and Raine both indicated that they were not in support of the circular
driveway.
The TC discussed the' scheduling of a site visit to review a revised plan as suggested by Mr.
Gunderson.
Commissioner Margeta moved that the Traffic Commission meeting be adjourned to a site visit and a
future regular meeting, thereafter, to consider a revised request for a driveway at 8 Middleridge Lane
South. Commissioner Raine seconded the motion, which carried without objection by a voice vote as
follows:

Planning Director Schwartz presented the staff report and stated that this matter was brought back for
discussion from the previous (TC) meeting due to a clerical error on the September 27, 2018 TC
Agenda pertaining to the RHMC chapter. She indicated that the proposed amendment to the RHMC in
regard to yielding to horseback riders and animals was requested by Commissioner Hawkins. Planning
Director Schwartz reviewed the current RHMC Section 10.36.050 and stated that Commissioner
Hawkins would like the TC to consider adding two municipal code sections as follows:
Proposed 10.36.050.D:
The driver of any vehicle approaching any animal being ridden, or led, livestock, or horse drawn
vehicle, shall exercise proper control of the vehicle being driven and shall (a) not engage in any
conduct that may startle, frighten or injure the animal or livestock, and (b) reduce the vehicle's speed
or stop, as may appear necessary or as signaled or otherwise requested by any person riding, leading,
driving, or in charge of the animal or livestock, to minimize the risk of injury to the animal or livestock
and/or any person riding, leading, driving or in charge of the animal or livestock.
Proposed 10.36.050.E:
The driver of any. vehicle, approaching any animal shall exercise proper control of the vehicle being
driven and shall reduce the vehicle's speed or stop, as may be necessary, to minimize the risk of
startling, frightening or injuring the animal and safeguarding any person that may be leading or
otherwise in charge of the animal.
Commissioner Margeta commented that she has seen dogs lying in the middle of the street, and that
she hopes drivers can see them and stop.
Chair Wilson opened the item to public comment.
Clint Patterson, 22 Georgeff Road, indicated support of any efforts to increase safety for dogs and cats,
in addition to horses.
No further comments were received from the public. Chair Wilson closed public comments.
Separate and apart from the item of discussion, Commissioner Hawkins questioned why there were
two signs, one referencing the California Vehicle Code and one referencing the RHMC, posted in the
City outside the Crest Road West gate entrance and the service road portion of Crest Road leading to
the school district property.
Discussion followed concerning the addition of language to the proposed RHMC Chapter 10.36.050.D.
The TC agreed that the proposed paragraph E would be merged into paragraph D.
Commissioner Raine moved that the proposed Rolling Hills Municipal Code Chapter 10.36.050.D be
considered for adoption by the City Council as follows: A. 10.36.050.D. The driver of any vehicle
approaching any animal, including any animal being ridden, or led, livestock, or horse drawn vehicle,

Separate and apart from the item of discussion, Commissioner Hawkins suggested that incidents such
as a hit and run due to driving under the influence be placed in the City's newsletter.
Separate and apart from the item of discussion, Chair Wilson introduced the new City Manager Elaine
Jeng to the TC. The TC welcomed City Manager Jeng to the City.
Separate and apart from- the item of discussion, Chair Wilson inquired about the two signs that
Commissioner Hawkins mentioned under Item 8 of the agenda.
City Manager Jeng stated that she would research the two signs posted in the City outside the Crest
Road West gate entrance and the service road portion of Crest Road and follow up with the TC.
Commissioner Margeta left the meeting at 9:47 p.m.
9. MATTERS FROM STAFF
A. CONSIDERATION OF AN ALTERNATE DATE FOR THE NOVEMBER MEETING
OF THE TRAFFIC COMMISSION (ORAL REPORT).
The TC discussed alternate dates for the November TC meeting.
By consensus, .the Traffic Commission scheduled a site visit on October 18, 2018 at 8:30 a.m. at 8
Middleridge Lane South.
By consensus, the Traffic Commission rescheduled their next regular meeting to November 15, 2018 at
8:30 a.m.
ADJOURNMENT
Hearing no further business before the Traffic Commission, Chair Wilson adjourned the meeting at
9:51 a.m. to a field visit on October 18, 2018 at 8:30 a.m. at 8 Middleridge Lane South. The next
meeting of the Traffic Commission . is scheduled to be held on Thursday, November 15, 2018

OLD BUSINESS
A. CONSIDERATION OF A REVISED REQUEST FOR A NEW DRIVEWAY AT 8
MIDDLERIDGE LANE SOUTH
Planning Director Schwartz presented a driveway request from Criss Gunderson, architect, for property
owner at 8 Middleridge Lane South. She stated that the Traffic Commission considered an application
for a circular driveway for this property at their September 27, 2018 meeting, which was not
recommended for approval by the Traffic Engineer. The Commissioners directed the applicant to work
with staff to come up with an acceptable design. Planning Director Schwartz stated that the applicant
worked with staff and revised the driveway by eliminating the circular driveway and is now proposing
one driveway approach. He also moved the approach 226' feet in easterly direction from the first
proposal.
Traffic Engineer Munoz stated that from a safety perspective the proposed driveway, as staked in the
field meets the engineering standards for a driveway and she would recommend approval.

Mrs. Becker stated that she and her neighbors are opposed to the location of the driveway, as it is in the
middle of two driveways on the opposite side of the street, and she thinks it would be very dangerous
to exit the other two properties. Mr. Cheng agreed with Mrs. Becker. Mrs. Becker suggested that the
driveway be moved close to the westerly property line.
Dr. Weinstein stated that moving the driveway to any other place would be dangerous due to the
curved nature of the lot. All present walked to the westerly property line of the lot. Dr. Weinstein
stated that this is not a good location as there is history with cars loosing control and hitting the pole at
that location. The Traffic Engineer agreed that this location is not safe. Dr. Weinstein and
Commissioner Raine suggested that the driveway be located further down the street near the easterly
property line.
Following a lengthy discussion, all present walked to the easterly boundary of the lot and discussed a
possible location where previously a stable access was proposed, which was still staked.
The Traffic Engineer stated that this location would be acceptable from an engineering safety standard.
The architect stated that this location would require much more grading and that the driveway would
need to be very long and parallel the street. He stated that the Planning Commission may have issues
with such a long driveway and the grading required for the driveway. Planning Director Schwartz also
expressed concern with such a long driveway.
Chairman Wilson stated that the role of the Traffic Commission is to assure safety on the road and not
design, and therefore, if all agreed and the Traffic Engineer is in favor of the location of the driveway,
the architect should work with staff to submit a revised plan to staff showing the driveway in that
location.
There being no further discussion he closed the public comment portion of the meeting. Commissioner
Raine made a motion to recommend approval of the driveway in the location near the easterly' property
line where a stable access was previously proposed, and to place a condition that the driveway be
screened from Middleridge Lane South with vegetation. Commissioner Virtue seconded the motion.
ADJOURNMENT
Hearing no further business before the Traffic Commission, Chair Wilson adjourned the meeting at
9:25 a.m. The next meeting of the Traffic, Commission is scheduled to be held on Thursday,

RECOMMENDATION
It is recommended that members of the Traffic Commission discuss the enforcement of the
proposed amendment to the Rolling Hills Municipal Code (RHMC) regarding maintaining the
safety and yielding to all animals and horseback riders.
BACKGROUND/DISCUSSION
Several months ago, Commissioner Hawkins indicated that the Rolling Hills Municipal Code
(RHMC) is inconsistent with the California Vehicle Code (CVC) in regard to yielding to
horseback riders and to other equestrian vehicles and livestock. He expressed concern that there
is no provision in the RHMC requiring that vehicles exercise proper measures when animals are
in the road. Attached to this report is the existing provision of Section 10.36.050, and
Commissioner Hawkins' proposed additional language. Commissioner Hawkins recommends
that two new paragraphs (D & E) be added to Section 10.36.050; that paragraph "D" would be
consistent with the CVC, but that paragraph "E" does not have an equivalent provision in the
CVC. However, given the City's rural and equestrian nature it is a desirable provision. The
City's existing ordinance requires vehicles to yield to horseback riders in designated crossings,
(designated with signs), but does not include other animals and animals not in designated

crossings. Commissioner Hawkins' proposal would address vehicles yielding to animals not in
designated crossings and include all animals including horses.
At the September 27, 2018 Traffic Commission meeting, the Traffic Commission recommended
a Municipal Code amendment regarding right of way of all animals and to require that vehicles
exercise proper measures when animals are in the road.
Following the meeting, staff reached out to the Sheriffs Department to inquire about the
enforcement of the proposed amendment.
Attached is a memorandum from Michael White of the Sheriffs Department, stating in part, that
this ordinance would be difficult to enforce as the Penal Code provides for enforcement of traffic
related violations when witnessed by a deputy, and that it is very unlikely that deputies would
witness such an offense in the City. In addition, he states that enactment of additional provisions
related to drivers of motor vehicles approaching domestic animals would be a duplication of
California Vehicle Code section 21759, with only few minor additions.
NOTIFICATION
President of Caballeros and the Rolling Hills Community Association have been notified that the
Traffic Commission will be considering this matter by being sent a copy of this staff report.
CONCLUSION
Should the Traffic Commission members concur with the Sheriffs conclusion, nofurther action
will be taken; otherwise, the proposed amendment will be agendized at a future City Council
meeting for Council's consideration.

Good morning Yolanta,
I will accompany Sergeant Osburn to the November 15th Traffic Commission
meeting. After some discussion, our general opinion is the proposal and
enactment of new ordinances (10.36.050.D and 10.36.050.E), related to drivers
of motor vehicles approaching domestic animals or horse drawn vehicles, would
only be a duplication of California Vehicle section 21759, with only a few minor
additions.
A violation of section 21759, of the California Vehicle Code, or the proposed
ordinance would be an infraction. Penal Code section 836 provides that
warrantless arrests or citation for a traffic -related misdemeanor or infraction
applies to offenses that occur in the officer's presence. What this means is,
Lomita Station deputies would have to witness the actual violation in order to cite
the offender. If a Rolling Hills resident were to witness a violation and contact the
station, the responding deputy could advise the offender (if located), but they
would not be allowed to issue a citation. In all honesty, the likelihood of deputies
witnessing and citing for this offense is slim. Please feel free to call me if you

EXCERPT FROM THE ROLLING HILLS MUNICIPAL CODE (RHMC)
CHAPTER 10.36 RIGHT OF WAY
Section 10.36.050 Equestrian crossings.
A. The City Manager may designate any intersection of a road as a bridle path or equestrian
crossing by erecting appropriate signs. The signs shall be erected on the road at or near the
approach to the intersection, and shall be of a -type approved by the State Department of
Transportation. The signs shall indicate the crossing and any crossmarks, safety devices, or
signals the City Manager deem necessary to safeguard vehicular and equestrian traffic at
the intersection.
B. The driver of any vehicle shall yield the right-of-way to any horseback rider who is crossing
the road at any designated equestrian crossing which is marked by signs as prescribed in
subsection A of this section.
C. Subsection B of this section does not relieve any horseback rider from the duty of using due
care for his or her own safety. No horseback rider shall leave a curb or other place of safety
and proceed suddenly into the path of a vehicle which is close enough to constitute an
immediate hazard. .

Sergeant Osburn presented the monthly supplemental traffic enforcement statistics. He reported the
following traffic statistics for the month of August 2018: 1) Total of 65 hours worked; 2) Total of 67
citations issued, of which 23 citations were issued to residents and 44 citations were issued to non-
residents. Sergeant Osburn noted that a vehicle was cited for speeding at 56 miles per hour on
Portuguese Bend Road at Poppy Trail.
In response to Commissioner Hawkins' question, Sergeant Osburn stated that the Rolling Hills
Municipal Code (RHMC) is used to enforce traffic regulations in the City of Rolling Hills (City).

A. CONSIDERATION OF A PROPOSED REQUEST FOR A DRIVEWAY WITH TWO
APRONS AND A STABLE SERVICE DRIVEWAY WITH APRON AT 8
MIDDLERIDGE LANE SOUTH.
Planning Director Schwartz presented a summary of the project at 8 Middleridge Lane South. She
indicated that the property is a vacant lot and construction of a home will be proposed following a
review of the driveway approach. She stated the request is for consideration of a circular driveway
necessitating two aprons and a stable service driveway with one apron. Planning Director Schwartz
stated that Traffic Engineer Munoz reviewed the request and will present the staff report.
Traffic Engineer Munoz stated that the site has three proposed driveways aprons, two of them will
form a loop into the property and one is for equestrian deliveries. Traffic Engineer Munoz provided
the history of the street and stated that there is a power pole at the edge of the. top driveway that has
been hit at least once during the time she has been the Traffic Engineer due to vehicles speeding as
they approach the bend. She indicated that the looped driveway proposal is to meet the fire
department's requirements. She expressed concern with the sight distance of the proposed driveway
because the property is located in the s -shape of the roadway. She stated that the proposed driveway
does not meet the minimum site distance requirement of 155 feet and, depending on the slope of the
street, the site distance requirement could go up to 170 feet. She expressed concern with vehicles
exiting the driveway. Traffic Engineer Munoz stated that she does not recommend the driveways be
accepted per the proposed layout because the sight distance minimum requirement is not met.
In response to Chair Wilson's question, Planning Director Schwartz stated that a circular driveway is
allowed with a Conditional Use Permit.
Chair Wilson opened the item to public comment.
Mike Joly, 10 Middleridge Lane South, commented that he submitted a letter to the Traffic
Commission (TC). Mr. Joly expressed concern regarding the size of the proposed residence and the
two driveway aprons. Mr. Joly indicated that the architect, Criss Gunderson, discussed the proposed
driveway with him. Mr. Joly stated that he believes his view will be affected by the construction of the
home.

Criss Gunderson, Architect, 8 Middleridge Lane South, commented that the size and height of the
proposed project are not under the TC's purview. Mr. Gunderson stated that he met with Mr. Joly to
discuss his concerns. Mr. Gunderson explained the proposed driveway plans as follows: 1) The
circular driveway is not due to the request of his client; 2) Mr. Gunderson's clients would like a safe
exit and entrance, and a place for theirguests to park; 3) Due to difficulties with the shape of the lot,
the configuration of the existing topography and the limitations of grading, Mr. Gunderson is
proposing a circular driveway; and 4) Mr. Gunderson has worked with the fire department and this is
the concept that the fire department can approve to meet the fire code. He discussed the maximum
distance requirement for fire department access. Mr. Gunderson discussed the proposed widths of the
driveways for the main residence and the stable access road.
No further comments were received from the public. Chair Wilson closed public comments.
Discussion followed among the TC and staff concerning the proposed circular driveway, sight distance
requirements and scheduling a site visit.
Commissioner Virtue commented that additional information on the .allowance of a circular driveway
is needed.
Commissioner Margeta commented that the proposed circular driveway should be redesigned.
Commissioners Hawkins and Raine both indicated that they were not in support of the circular
driveway.
The TC discussed the scheduling of a site visit .to review a revised plan as suggested by Mr.
Gunderson.

future regular meeting, thereafter, to consider a revised request for a driveway at 8 Middleridge Lane

discussion from the previous (TC) meeting due to a clerical error on the September 27, 2018 TC
Agenda pertaining to the RHMC chapter. She indicated that the proposed amendment to the RHMC in
regard to yielding to horseback riders and animals was requested by Commissioner Hawkins. Planning
Director Schwartz reviewed the current RHMC Section 10.36.050 and stated that Commissioner
Hawkins would like the TC to consider adding two municipal code sections as follows:
Proposed 10.36.050.D:
The driver of any vehicle approaching any animal being ridden, or led, livestock, or horse drawn
vehicle, shall exercise proper control of the vehicle being driven and shall (a) not engage in any
conduct that may startle, frighten or injure the animal or livestock, and (b) reduce the vehicle's speed
or stop, as may appear necessary or as signaled or otherwise requested by any person riding, leading,
driving, or in charge of the animal or livestock, to minimize the risk of injury to the animal or livestock
and/or any person riding, leading, driving or in charge of the animal or livestock.
Proposed 10.36.050.E:
The driver of any vehicle, approaching any animal shall exercise proper control of the vehicle being
driven and shall reduce the vehicle's speed or stop, as may be necessary, to minimize the risk of
startling, frightening or injuring the animal and safeguarding any person that may be leading or
otherwise in charge of the animal.
Commissioner Margeta commented that she has seen dogs lying in the middle of the street, and that
she hopes drivers can see them and stop.
Chair Wilson opened the item to public comment.
Clint Patterson, 22 Georgeff Road, indicated support of any efforts to increase safety for dogs and cats,
in addition to horses.
No further comments were received from the public. Chair Wilson closed public comments.
Separate and apart from the item of discussion, Commissioner Hawkins questioned why there were
two signs, one referencing the California Vehicle Code and one referencing the RHMC, posted in the
City outside the Crest Road West gate entrance and the service road portion of Crest Road leading to
the school district property.
Discussion followed concerning the addition of language to the proposed RHMC Chapter 10.36.050.D.
The TC agreed that the proposed paragraph E would be merged into paragraph D.
Commissioner Raine moved that the proposed Rolling Hills Municipal Code Chapter 10.36.050.D be
considered for adoption by the City Council as follows: A. 10.36.050.D. The driver of any vehicle
approaching any animal, including any animal being ridden, or led, livestock, or horse drawn vehicle,

City Manager Jeng stated that she would research the two signs posted in the City outside the Crest
Road West gate entrance and the service road portion of Crest Road and follow up with the TC.

A. CONSIDERATION OF AN ALTERNATE DATE FOR THE NOVEMBER MEETING
OF THE TRAFFIC COMMISSION (ORAL REPORT).
The TC discussed alternate dates for the November TC meeting.
By consensus, the Traffic Commission scheduled a site visit on October 18, 2018 at 8:30 a.m. at 8
Middleridge Lane South.
By consensus, the Traffic Commission rescheduled their next regular meeting to November 15, 2018 at
8:30 a.m.
ADJOURNMENT
Hearing no further business before the Traffic Commission, Chair Wilson adjourned the meeting at
9:51 a.m. to a field visit on October 18, 2018 at 8:30 a.m. at 8 Middleridge Lane South. The next

An adjourned regular meeting of the Traffic Commission of the City of Rolling Hills was called to
order by Chair Wilson at 8:30 a.m. on Thursday, October 18, 2018, at a property at 8 Middleridge
Lane South, Rolling Hills, California.

A. CONSIDERATION OF A REVISED REQUEST FOR A NEW DRIVEWAY AT 8
MIDDLERIDGE LANE SOUTH
Planning Director Schwartz presented a driveway request from Criss Gunderson, architect, for property •
owner at 8 Middleridge Lane South. She stated that the Traffic Commission considered an application
for a circular driveway for this property at their September 27, 2018 meeting, which was not
recommended for approval by the Traffic Engineer. The Commissioners directed the applicant to work
with staff to come up with an acceptable design. Planning Director Schwartz stated that the applicant
worked with staff and revised the driveway by eliminating the circular driveway and is now proposing
one driveway approach. He also moved the approach 226' feet in easterly direction from the first
proposal.
Traffic Engineer Munoz stated that from a safety perspective the proposed driveway, as staked in the
field meets the engineering standards for a driveway and she would recommend approval.

Mrs. Becker stated that she and her neighbors are opposed to the location of the driveway, as it is in the
middle of two driveways on the opposite side of the street, and she thinks it would be very dangerous
to exit the other two properties. Mr. Cheng agreed with Mrs. Becker. Mrs. Becker suggested that the
driveway be moved close to the westerly property line.
Dr. Weinstein stated that moving the driveway to any other place would be dangerous due to the
curved nature of the lot. All present walked to the westerly property line of the lot. Dr. Weinstein
stated that this is not a good location as there is history with cars loosing control and hitting the pole at
that location. The Traffic Engineer agreed that this location is not safe. Dr. Weinstein and
Commissioner Raine suggested that the driveway be located further down the street near the easterly
property line.
Following a lengthy discussion, all present walked to the easterly boundary of the lot and discussed a
possible location where previously a stable access was proposed, which was still staked.
The Traffic Engineer stated that this location would be acceptable from an engineering safety standard.
The architect stated that this location would require much more grading and that the driveway would
need to be very long and parallel the street. He stated that the Planning Commission may have issues
with such a long driveway and the grading required for the driveway. Planning Director Schwartz also
expressed concern with such a long driveway.
Chairman Wilson stated that the role of the Traffic Commission is to assure safety on the road and not
design, and therefore, if all agreed and the Traffic Engineer is in favor of the location of the driveway,
the architect should work with staff to submit a revised plan to staff showing the driveway in that
location.
There being no further discussion he closed the public comment portion of the meeting. Commissioner
Raine made a motion to recommend approval of the driveway in the location near the easterly property
line where a stable access was previously proposed, and to place a condition that the driveway be
screened from Middleridge Lane South with vegetation. Commissioner Virtue seconded the motion.

Hearing no further business before the Traffic Commission, Chair Wilson adjourned the meeting at
9:25 a.m. The next meeting of the Traffic Commission is scheduled to be held on Thursday,

RECOMMENDATION
It is recommended that members of the Traffic Commission discuss the enforcement of the
proposed amendment to the Rolling Hills Municipal Code (RHMC) regarding maintaining the
safety and yielding to all animals and horseback riders.
BACKGROUND/DISCUSSION
Several months ago, Commissioner Hawkins indicated that the Rolling Hills Municipal Code
(RHMC) is inconsistent with the California Vehicle Code (CVC) in regard to yielding to
horseback riders and to other equestrian vehicles and livestock. He expressed concern that there
is no provision in the RHMC requiring that vehicles exercise proper measures when animals are
in the road. Attached to this report is the existing provision of Section 10.36.050, and
Commissioner Hawkins' proposed additional language. Commissioner Hawkins recommends
that two new paragraphs (D & E) be added to Section 10.36.050; that paragraph "D" would be
consistent with the CVC, but that paragraph "E" does not have an equivalent provision in the
CVC. However, given the City's rural and equestrian nature it is a desirable provision. The
City's existing ordinance requires vehicles to yield to horseback riders in designated crossings,
(designated with signs), but does not include other animals and animals not in designated

crossings. Commissioner Hawkins' proposal would address vehicles yielding to animals not in
designated crossings and include all animals including horses.
At the September 27, 2018 Traffic Commission meeting, the Traffic Commission recommended
a Municipal Code amendment regarding right of way of all animals and to require that vehicles
exercise proper measures when animals are in the road.
Following the meeting, staff reached out to the Sheriff's Department to inquire about the
enforcement of the proposed amendment.
Attached is a memorandum from Michael White of the Sheriff .s Department, stating in part, that
this ordinance would be difficult to enforce as the Penal Code provides for enforcement of traffic
related violations when witnessed by a deputy, and that it is very unlikely that deputies would
witness such an offense in the City. In addition, he states that enactment of additional provisions
related to drivers of motor vehicles approaching domestic animals would be a duplication of
California Vehicle Code section 21759, with only few minor additions.
NOTIFICATION
President of Caballeros and the Rolling Hills Community Association have been notified that the
Traffic Commission will be considering this matter by being sent a copy of this staff report.
CONCLUSION
Should the Traffic Commission members concur with the Sheriff's conclusion, no further action
will be taken; otherwise, the proposed amendment will be agendized at a future City Council
meeting for Council's consideration.

I will accompany Sergeant Osburn to the November 15th Traffic Commission
meeting. After some discussion, our general opinion is the proposal and
enactment of new ordinances (10.36.050.D and 10.36.050.E), related to drivers
of motor vehicles approaching domestic animals or horse drawn vehicles, would
only be a duplication of California Vehicle section 21759, with only a few minor
additions..
A violation of section 21759, of the California Vehicle Code, or the proposed
ordinance would be an infraction. Penal Code section 836 provides that
warrantless arrests or citation for a traffic -related misdemeanor or infraction
applies to offenses that occur in the officer's presence. What this means is,
Lomita Station deputies would have to witness the actual violation in order to cite
the offender. If a Rolling Hills resident were to witness a violation and contact the
station, the responding deputy could advise the offender (if located), but they
would not be allowed to issue a citation. In all honesty, the likelihood of deputies
witnessing and citing for this offense is slim. Please feel free to call me if you

CHAPTER 10.36 RIGHT OF WAY
Section 10.36.050 Equestrian crossings.
A. The City Manager may designate any intersection of a road as a bridle path or equestrian
crossing by erecting appropriate signs. The signs shall be erected on the road at or near the
approach to the intersection, and shall be of a -type approved by the State Department of
Transportation. The signs shall indicate the crossing and any crossmarks, safety devices, or
signals the City Manager deem necessary to safeguard vehicular and equestrian traffic at
the intersection.
B. The driver of any vehicle shall yield the right-of-way to any horseback rider who is crossing
the road at any designated equestrian crossing which is marked by signs as prescribed in
subsection A of this section.
C. Subsection B of this section does not relieve any horseback rider from the duty of using due
care for his or her own safety. No horseback rider shall leave a curb or other place of safety
and proceed suddenly into the path of a vehicle which is close enough to constitute an
immediate hazard.

On October 18, 2018 the Traffic Commission met on site, in which they did not support
the location of the new driveway apron requested by you at 8 Middleridge Lane South.
They approved a revised location of the driveway apron approximately 40' south of the
northerly property line of subject property, in the general location where the stable
access was originally proposed, subject to the following conditions:
1. Planning Commission review and approval is required.
2. Rolling Hills Community Association review and approval is required.
3. The new driveway apron shall be in compliance with the submitted plan on file
at City Hall and stamp dated November 14, 2018.
4. The first 20 feet of the driveway apron shall have a maximum slope of 7%.
5. The driveway apron shall be roughened.
6. The driveway itself, to a maximum extend practicable shall be screened from the
road in a manner as to not to obstruct the sight distance and visibility from the
driveway apron. Following Planning Commission review and submittal of a
landscaping plan for the development, the Traffic Engineer will review the
location and height of the proposed landscaping along the driveway to
determine if acceptable from traffic engineering safety standards.
The City Council will consider the matter in conjunction with the Planning
Commissions action relative to the proposed development at a future time. You will be
informed of that date after the Planning Commission takes action. You will be required
to re -stake the proposed apron and driveway for the Planning Commission
consideration and maintain the staking until after the City Council considers the matter
and takes final action.
