CALL TO ORDER
An adjourned regular meeting of the City Council of the City of Rolling Hills was called to order by
Mayor Dieringer at 7:01 p.m. in the City Council Chamber at City Hall, 2 Portuguese Bend Road, Rolling
Hills, California.

Councilmembers Absent: Pieper (excused).

RESOLUTION NO. 1201 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROLLING HILLS, CALIFORNIA PROVIDING FOR THE APPOINTMENT TO THE OFFICES
OF THIS CITY THAT WERE TO BE ELECTED ON TUESDAY, MARCH 7, 2017 AND
CANCELLING SAID ELECTION.
Mayor Dieringer introduced the item and asked if there were any questions on the staff report or on the
Resolution presented for consideration. Hearing none and seeing no members of the public present to
comment on the matter, she called for a motion.
Mayor Pro Tem Black moved that the City Council adopt Resolution No. 1201 appointing Bea Dieringer
and Jeff Pieper to the Rolling Hills City Council and cancelling the election scheduled for March 7, 2017.
Councilmember Mirsch seconded the motion, which carried without objection.
MATTERS FROM THE CITY COUNCIL AND MEETING ATTENDANCE REPORTS
Councilmember Mirsch asked the City Council to retum the City Manager Evaluation forms that were
distributed to the City Council in November to her by Tuesday, January 17, 2017.
MATTERS FROM STAFF
City Manager Cruz reported that the old controller box for the traffic signal at Palos Verdes Drive North
and Rolling Hills Road/Portuguese Bend Road was removed and work at the intersection is nearing
completion. �

ADJOURNMENT
Hearing no further business before the City Council, Mayor Dieringer adjourned the meeting at 7:04 p.m.
The next regular meeting of the City Council is scheduled to be held on Monday, January 9, 2017
beginning at 7:00 p.m. in the City Council Chamber at City Hall, 2 Portuguese Bend Road, Rolling Hills,
California.

BACKGROUND
On October 24, 2016, the City Council adopted Resolution No. 1192 calling for the holding
of General Municipal Election in the City of Rolling Hills on March 7, 2017 to elect two
Members of the City Council. A notice of the election and advising of the nomination
process was published in the Palos Verdes Peninsula News and posted at City Hall and on
the City's web site on November 3, 2016. Furthermore, a notice advising of the nomination
process was included in the Citywide newsletters mailed to all residents in October and
November.
As of the close of the nomination period on December 9, 2016 at 5:00 p.m., only the
incumbents, Mayor Bea Dieringer and Councilmember Jeff Pieper qualified as candidates
for City Council. Furthermore, they were also the only two candidates to express an
interest in running for City Council and to pull nomination papers.
When there are no more candidates nominated than offices to be elected, § 10229 of the
Elections Code allows one of the following courses of action to be taken by the City
Council, upon proper notice to the electorate:

1. Appoint to the office the persons who have been nominated;
2. Appoint to the office any eligible voter if no one has been nominated; or
3. Hold the election if either no one or only one person has been nominated.
The City Council has previously expressed its intent to appoint the persons nominated
and cancel the election if such a situation arose. As required by § 10229 of the Elections
Code, a notice advising that there are not more candidates than offices to be elected
(attached) was posted at City Hall and published in the Daily Breeze on Wednesday,
December 14, 2016.
RECOMMENDATION
It is recommended that the City Council consider and adopt Resolution No. 1201
appointing Bea Dieringer and Jeff Pieper to the offices for which they were nominated and
cancelling the election scheduled to be held on Tuesday, March 7, 2017.

NOTICE IS HEREBY GIVEN that pursuant to § 10229 of the Elections Code of
the State of California relating to the General Municipal Election in the City Rolling of
Hills to be held on Tuesday, March 7, 2017: ,.,, -`

If, by the 75th day before the municipal election, no person has been
appointed to the offices pursuant to (1) or (2) above, the election shall be held.
If the City Council makes an appointment pursuant to § 10229 of the Elections
Code, the City Clerk shall not accept for filing any statement of write-in candidacy
which is submitted after the appointment is made.

APPOINTMENT TO THE OFFICES OF THIS CITY THAT WERE TO

WHEREAS, pursuant to § 10229 of the Elections Code of the State of California, as of the
close of the nomination period on December 9, 2016, there are not more candidates than offices to be
elected and that § 10229 of the Elections Code allows one of the following courses of action to be taken
by the City Council:
1. Appoint to the office the person who has been nominated.
2. Appoint to the office any eligible voter if no one has been nominated.
3. Hold the election if either no one or only one person has been nominated.
WHEREAS, a notice was published on December 14, 2016 in a newspaper of general
circulation pursuant to law.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROLLING HILLS,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
= SECTION 1. That pursuant to § 10229 of the Elections Code of the State of California, the
following action is being taken:
The following persons are being appointed to the offices to which they were nominated, and
are considered to be the same as being elected, pursuant to § 10229(a)(3) of the Elections Code:

SECTION 2. The election scheduled to be held on Tuesday, March 7, 2017, is now
canceled.
SECTION 3. The person(s) appointed, if any, shall qualify and take office and serve
exactly as if elected at a municipal election for the office.
SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution
and enter it into the book of original resolutions.
