A. RESOLUTION NO. TC-91-2: A RESOLUTION OF THE ROLLING HILLS
TRAFFIC COMMISSION ENCOURAGING THE MAINTENANCE OF THE
EQUESTRIAN EASEMENT ADJACENT TO 3 EASTFIELD DRIVE, ROLLING
HILLS, CALIFORNIA.
City Manager Nealis explained that this Resolution
memorializes an unwritten agreement reached by the Traffic
Commission at their meeting of January 17, 1992. The property
owner, Mrs. Cherie Bennett, indicated her agreement with the terms
of the Resolution. The City Council concurred and Resolution No.
TC-91-2 was accepted.

B. CONSIDERATION OF TRAFFIC COMMISSION RECOMMENDATION RELATIVE TO
A STOP SIGN TO BE PLACED AT PORTUGUESE BEND ROAD ADJACENT TO
THE MAIN GATE EXIT.
City Manager Nealis reported that the proposed stop sign is
for the purpose of providing increased pedestrian and vehicular
traffic safety in the area of the main gate. The gate is scheduled
to be modified to operate the same as the other gates; i.e., it
will not have to return to a fully closed position each time a
vehicle exits. The Community Association will be asked to maintain
the gate and keep it operative at all times.
In response to a query from Mayor Pernell regarding the
willingness of the Community Association to undertake this
responsibility, the City Manager said there was no indication at
the last Traffic Commission meeting that the suggestion would not
be well received.
Mr. Tom Boyd, 7 S. Middleridge, stated that the Community
Association has tried to maintain safety without inconvenience to
the residents, and he feels at this time the stop sign is the only
way to slow the traffic down.
Ms. Marge Schmit, 2 Buggy Whip, also expressed her belief that
the plan. will be acceptable to the Community Association.
Mayor Pro Tem Swanson moved approval of the Traffic Commission
recommendation that a stop sign be placed at Portuguese Bend Road
adjacent to the main gate exit. Councilmember Murdock seconded and
the motion passed without objection.

A field trip was conducted to 3 Eastfield Drive for consideration of Resolution No. TC-91-2.
Further instructions to clear the equestrian/pedestrian easement area to a minimum of ten
vertical feet was directed to the property owner. Staff was directed to inspect this area
following completion of clearance by the property owner, and to prepare an appropriate
report for Traffic Commission review at the next regularly scheduled meeting.
There being no further discussion Chairwoman Leeuwenburgh adjourned the meeting at
10:05 a.m.

EASTFIELD AND ORDERING THE REMOVAL OF FOLIAGE WHICH
CONSTITUTES A TRAFFIC HAZARD.
City Manager Nealis introduced the subject Resolution stating that an application from Mr.
John Bennett requesting the removal of a "no parking" sign adjacent to his property at 3
Eastfield had been reviewed at the meeting of August 16, 1991. He stated that the subject
Resolution calling for the removal of unsafe foliage from the easement and establishing the
"no parking" zone in front of 3 Eastfield.
Commissioner Weiner moved approval of Resolution No. TC-91-2. Commissioner
Welbourn seconded the motion.
Mr. John Bennett, 3 Eastfield requested to address the Commission. He expressed
dissatisfaction with the City's notification procedures, and the content and intent of the
subject Resolution. He felt that to expect all parking to be on a residents property was
unreasonable. The Commissioners commented individually with regard to safety, trail and
storm drain damage, and parking obstruction.
Following discussion of safety issues, including sight line impairment, it was determined that
Resolution shall be amended to identify specific plants to be cleared.
Commission Wiener moved to hold over Resolution No. TC-91-2 to the meeting of October
18 pending modification. Commissioner Welbourn seconded the motion which carried
unanimously.

As you are no doubt aware, members of the Rolling Hills
Traffic Commission have been investigating concerns relative
to the establishment of a "No Parking Zone" in equestrian
easement uses adjacent to No. 3 Eastfield Drive.
At the last regular meeting of the Commission, the property
owner, Mr. John Bennett, was instructed to provide ten
foot vertical clearance for equestrian easements adjacent
to his driveway. Commission members directed me to inspect
this location and, upon completion of the clearance, order
the removal of the "No Parking" sign and prepare the
appropriate report for consideration by the Traffic
Commission at their January 17, 1992 meeting.
I inspected the property on the morning of Monday, November
25. Mr. Bennett has provided the ten foot clearance as
directed by the Commission.
Please have Roger Vink, or appropriate personnel, move
the "No Parking" sign.
Should you wish to erect "No Parking" signs in the future,
please feel free to contact this office prior to
establishment of a "No Parking Zone". As you know, the
Traffic Commission must recommend, and the City Council
must approve, a no parking zone for Sheriff's Department
personnel to enforce the regulation.
I stand ready to assist you with whatever parking
recommendations you may desire to discuss. Your cooperation
will be appreciated.

Attached to this Staff Report is a Resolution which was approved by members of the Traffic
Commission at their regular meeting held January 17, 1992. This Resolution was adopted
by the Commission following consideration of a "no parking" zone at that location. The
property owner has complied with the request of the City to trim growth in the area to
provide adequate equestrian travel in conjunction with vehicular parking.
RECOMMENDATION
It would be in order for the City Council to concur with members of the Traffic Commission
relative to this matter.

create a safe environment for vehicles, equestrians and pedestrians.

NOW, THEREFORE, be it resolved by members of the Rolling Hills Traffic
Commission as follows:
SECTION 1. That a "no parking zone" is hereby established adjacent to 3
Eastfield extending easterly on the north side of the street for seventy feet (70') east of the
easterly edge of the driveway at that location.
SECTION 2. That the City Manager is directed to cause a "no parking" sign
to be erected at that location.
SECTION 3. That members of the Traffic Commission hereby concur with
the recommendations of the Rolling Hills Community Association and support the following:
o Raise and cut back branches from trees immediately adjacent to both sides of
driveway entrance.
o Move rocks back from trails at driveway entrance.

WHEREAS, members of the Traffic Conunission on August 16, 1991 and
October 18, 1991 inspected the equestrian easement located adjacent to the driveway at 3
Eastfield Drive, Rolling Hills; and
WHEREAS, this item was presented to the Traffic Commission for their
review of equestrian and vehicular parking safety adjacent to the driveway at 3 Eastfield
Drive; and
WHEREAS, the property owner, Mr. John Bennett, has complied with the
request of the Traffic Commission to remove the foliage in the equestrian easement
adjacent to the driveway entrance at 3 Eastfield maintaining a minimum height distance of
ten feet (10'); and
WHEREAS, members of the Rolling Hills Community Association have
installed protective devices for the drain in the area which was damaged by vehicles parking
at the 3 Eastfield location; and
WHEREAS, all work has been inspected by interested parties to this matter.
NOW, THEREFORE, be it resolved by members of the Rolling Hills Traffic
Commission as follows:
SECTION 1. Members of the Rolling Hills Traffic Commission hereby
support the efforts of the property owner, Mr. John Bennett, resident at 3 Eastfield Drive
for his removal of foliage and improvement of the equestrian easement at that location.
SECTION 2. Members of the Rolling Hills Traffic Commission urge the
property owner at 3 Eastfield to maintain the equestrian access in a free and clear manner
to a minimum vertical distance of ten feet (10') in order to avoid the necessity for
consideration of a "no parking” zone at that location.

Eastfield Drive.
Community Association Representative Roger Vink has installed an additional delineator
adjacent to the storm drain to help protect the structure from damage caused by vehicles
parking in the area. We understand that you will be trimming the trees adjacent to your
driveway to provide for safe equestrian access as described on October 18.
Members of the Traffic Commission will schedule a field trip to your location on Friday,
November 15, 1991. At that time consideration regarding the status of the proposed "no
parking" at your location and the adequacy of the trimming and delineators will be
discussed.

I would like to thank Craig Nealis, the City Manager, for his letter of September 23,
1991, inviting me to attend the meeting of October 18 at 8:30 a.m. I most assuredly
plan to attend.
In preparation for that meeting, I would like to outline several key points which
might help to resolve this matter more favorably to all concerned.
1. I would like to cooperate with the City where at all possible to achieve
valid safety concerns. However, I believe that a "No Parking Zone" estab-
lished exclusively for 70 feet of 3 Eastfield Drive will not effectively
achieve this purpose.
2. The effect of this "zone" is to create a safety hazard further east down the
hill and further west up the hill where cars will be forced to park. This
will never achieve the legitimate safety concern which we seek to avoid
and only restricts safe parking next to our house, creating an eyesore
which to us is obtrusive and personally offensive.
3. If one of the legitimate goals of the City is to protect the wood covering the
drain east of our driveway, we would be very happy to see it effectively
protected without being obtrusive to the eye and restricting our legitimate
right to park next to our home. (Perhaps the City would like to see what
Rolling Hills Estates has done at 27961 Palos Verdes Drive East, for
example).
4. In an effort to show the City our concern for the safety of ourselves and
others, we will transplant the starless bush just east of the driveway and
trim the oleanders west of the driveway to provide safe passage for pedes-
trians and equestrians, however few.

5. We disagree that the trimming of the Cypress trees around the driveway
and other bushes giving visibility to the driveway will increase safety. We
have lived here for 33 years and have never experienced an accident at the
driveway. To the contrary, we believe that increased visibility to drivers
traveling Eastfield will only serve to effect an increase in the speed the
cars travel up and down Eastfield, thereby creating a greater safety
hazard and greatly endangering the lives of those the City wishes to
protect.

At the regular meeting of the Traffic Commission held August 16, 1991, Mr. John Bennett
presented a request for the removal of a "no parking" sign which had been placed at the
location by the Community Association adjacent to his property at 3 Eastfield. Members
of the Traffic Commission conducted a field trip to the location on the same date to discuss
and visualize the concerns expressed by Mr. John Bennett.
While inspecting the property, it became evident that the combined equestrian/pedestrian
use of the easement was incompatible given the existing trees and shrubs growing in the
easement. Due to the impending traffic hazard of forcing a pedestrian or equestrian to
venture into the roadway at this location, the attached Resolution was ordered prepared for
presentation at today's meeting. Should members of the Traffic Commission concur, it
would be in order to adopt the attached Resolution ordering the removal of unsafe foliage
from the easement and establishing the "no parking" zone in front of 3 Eastfield.

A RESOLUTION OF THE ROLLING HILLS TRAFFIC COMMISSION
ESTABLISHING A "NO PARKING ZONE" AT 3 EASTFIELD AND
ORDERING THE REMOVAL OF FOLIAGE WHICH CONSTITUTES A
TRAFFIC HAZARD.
WHEREAS, members of the Traffic Commission conducted a field trip to 3
Eastfield Drive on Friday, August 16, 1991; and
WHEREAS, members of the Traffic Commission concur with the
recommendation of the Rolling Hills Community Association to establish a "no parking
zone" in front of 3 Eastfield; and
WHEREAS, members of the Traffic Commission concur with the
recommendation of the Rolling Hills Community Association that the foliage adjacent to
3 Eastfield forces pedestrians and equestrians into the roadway; and
WHEREAS, it is the intent of the Traffic Commission to, as much as possible,
create a safe environment for vehicles, equestrians and pedestrians.
NOW, THEREFORE, be it resolved by members of the Rolling Hills Traffic
Commission as follows:
SECTION 1. That a "no parking zone" is hereby established adjacent to 3
Eastfield extending easterly on the north side of the street for seventy feet (70') east of the
easterly edge of the driveway at that location.
SECTION 2. That the City Manager is directed to cause a "no parking" sign
to be erected at that location.
SECTION 3. That members of the Traffic Commission hereby concur with
the recommendations of the Rolling Hills Community Association and support the removal
of the Eucalyptus tree located approximately seventy feet (70') east of the driveway entrance
at the subject location. Further, that the Traffic Commission supports the removal of the
Oleander bushes located around the Eucalyptus tree and the trimming of the trees located
at the entrance to the driveway and the trimming of the Oleander bushes located to the west
of the driveway. This action is supported to ensure the safe passing of pedestrians,
equestrians and vehicular traffic.

Mr. John Bennett addressed the Commission stating that his request was prompted by
instances of vandalism. He stated that the easement at that point is seventeen feet wide and
therefore provides ample space for equestrians and parked cars.
There followed discussion regarding various instances of vandalism in the area.
In response to a question from Commissioner Schmit, Chairwoman Leeuwenburgh stated
that the sign had been placed in the easement by the Community Association. Mr. Vink
added that the sign had been placed as a temporary measure pending a decision by the
Traffic Commission; drain covers placed in the area were being crushed by vehicles;
complaints had been received from equestrians, and that existing overgrown landscaping
blocked visibility. Chairwoman Leeuwenburgh directed that the item be held over pending
a field inspection.

was to contain provisions calling for the trimming of trees located at the entrance to the
driveway; removal of the Eucalyptus tree approximately seventy-five feet southerly from the
driveway in the easement and surrounding Oleanders; and removal of small bushes at the
entrance to the driveway in an effort to create a safer passing environment for equestrian
and pedestrian uses.

REOUEST
A request was made to the Traffic Commission by Mr. John Bennett, 3 Eastfield
Drive, to remove the "No Parking" sign adjacent to his property. Mr. Bennett
indicated a need for on -street parking for his guests.
DISCUSSION
The Traffic Commission field reviewed this location on August 16, 1991. The
property at 3 Eastfield Drive is fronted by a pedestrian/equestrian easement.
Existing foliage at this location forces pedestrians/equestrians to travel on the
roadway:
The location of the "No Parking" sign is in a clearing in the easement. This location
could provide on -street parking. However, allowing vehicles to park at this location
would again force pedestrians/equestrians into the roadway.
RECOMMENDATION
It is recommended that the "No Parking" sign remain to provide pedestrians/
equestrians a clear easement of travel. It is further recommended that foliage
protruding in the easement be removed to continue a clear easement of travel.

MATTERS FROM THE AUDIENCE
Mr. John Bennett, 3 Eastfield Drive, addressed the Commission
stating that due to damage to a car belonging to a visitor to his
home, he would like to request the removal of the "No Parking" sign
located in the easement adjacent to his property. He added that
was not aware of any other such sign in Rolling Hills.
In response to Acting Commissioner Stringfellow, Mr. -Bennett stated
that due to the narrow width of his driveway visitor parking was
not feasible on his property.
Acting Commissioner Stringfellow pointed out that a considerable
number of Bennett Enterprize Company trucks park in the vicinity.
Chairwoman Leeuwenburgh commented that the Commission was precluded
from taking any action at that time since this item was not
included on the Agenda. There being no objection she directed that
the item be included on the Agenda for the August meeting, and that
the Traffic Engineer shall review the request.

RE: Sign Placed in Association Easement
Letter dated 7/15/91 from John Bennett
CALIFORNIA
Enclosed is a letter received from Mr. Bennett expressing objection
to the Association's placement of a "No Parking" sign in the
Eastfield Road easement.
This sign came about due to continuous guest parking in the very
narrow horse trail alongside Eastfield near a storm drain cover. The
vehicles park on the drain cover which has been replaced every few
months.
Some of the parking appears to be done by the Bennett guests who use
their tennis court.
Mr. Bennett would like the Traffic Commission to investigate this
matter.
The Association staff has concerns about horse trail safety, as well
as liability that could arise in keeping the drain cover from being
damaged by vehicular use.
