CALL TO ORDER
A regular meeting of the Traffic Commission of the City of Rolling Hills was called to
order by Chair Hill at 8:30 a.m., on Thursday, May 23, 1996, in the City Council Chambers,
at City Hall, 2 Portuguese Bend Road, Rolling Hills, California.
ROLL CALL

Hill.

APPROVAL OF MINUTES
MINUTES OF SPECIAL MEETING OF APRIL 11, 1996.
Commissioner Henke moved that the Traffic Commission approve the minutes of a
special meeting of the Traffic Commission held on 'fhursday, April 11, 1996.
Commissioner Margeta seconded the motion which carried by the following vote:
AYES: Commissioners Henke, Margeta and Chair Hill.
NOES: None.
ABSENT: Commissioner Virtue.
ABSTAIN: Commissioner Perkins.
SPECIAL PRESENTATION

SHERIFF'S DEPARTMENT, LOMITA STATION, ON QUARTERLY TRAFFIC
STATISTICS FOR THE CITY OF ROLLING HILLS. '
Sgt. Dennis Graff presented the traffic statistics for the first quarter of 1996 highlighting that
there were no automobile accidents during that period. He reported that the majority of
the hazardous citations issued in the City were for speeding or failure to stop at a stop sign.
Sgt. Graff presented an explanation of the plot map depicting the locations of accidents and
the issuance of citations so that the Department is aware of problem areas and can direct
patrols to that area.
The Commission discussed the various points highlighted in the report and expressed that
they appreciate being kept up to date on these matters.

CONSIDERATION OF FY 1996-97 BID SPECIFICATIONS AND REQUEST FOR
PROPOSAL FOR STRIPING AND MARKING OF VARIOUS ROADWAYS
WITHIN IN THE CITY.
City Manager Nealis presented the staff report. Commissioner Henke stated that he has
noticed various crosswalks/equestrian crossings seem to be inconsistent. City Manager
Nealis stated that he would inspect the areas to ensure that the striping work done is
consistent.
Hearing no objection, Chair Hill directed that staff present the FY 1996-97 Bid Specifications
and Request for Proposal for Striping and Marking of Various Roadways within the City to
the City Council.
CONSIDERATION OF REPORT FROM THE TRAFFIC ENGINEER' REGARDING
USE OF ROADWAY MARKING DELINEATORS IN THE CITY OF ROLLING
HILLS.
Commissioners discussed the written report prepared by the Traffic Engineer. In response
to Commissioner Henke, City Manager Nealis reported that the Rolling Hills Community
Association does not maintain delineators in the City. He further reported that in some
cases the Association has placed reflective material on the gate arms or fencing where the
Traffic Engineer has indicated its placement for traffic safety. City Manager Nealis
explained the City's policy of replacing roadway marking delineators. Commissioner
Henke commented that delineators should be consistent throughout the City.
Discussion ensued regarding the white delineator that was placed at 24 Portuguese Bend
Road by the RHCA to warn of an obstruction in the easement. Hearing no further
discussion, staff was directed to replace the white delineator with yellow at 24 Portuguese
Bend Road.
CONSIDERATION OF A NEW DRIVEWAY TO REPLACE AN EXISTING
DRIVEWAY AT 50 EASTFIELD DRIVE (LOT 99-EF), MR. & MRS. RAY FERRIS.
City Manager Nealis presented the staff report outlining the applicants' request. Mr.
Thomas Blair, Architect, stated that the driveway has been staked and invited the
Commission to review it in the field.

recommended it for approval in its proposed configuration

CONSIDERATION OF A REQUEST FROM THE PLANNING COMMISSION TO
REVIEW THE FEASIBILITY OF A DRIVEWAY ON PORTUGUESE BEND ROAD IN
CONJUNCTION WITH A PROPOSED SUBDIVISION AT 17 PORTUGUESE BEND
ROAD (MARSHALL).
City Manager Nealis presented the staff report providing a brief background on the
subdivision request and outlining the Planning Commission's request for Traffic
Commission review of the feasibility of a driveway on Portuguese Bend Road in the
vicinity of 17 Portuguese Bend Road. He also explained the various elements that the
Planning Commission must review relative to subdivisions.
Chair Hill noted the arrival of Commissioner Virtue and brought her up to date on
previous discussions regarding this case.
Dr. Marshall also provided a brief history on his subdivision request. He reported that his
engineering representative has staked the proposed driveway location for field review by
the Traffic Commission.
Commissioners briefly discussed the proposed driveway location, the existing driveway to
this property and the grade of the roadway in that approximate location. City Manger
Nealis pointed out on the plans the locations of other driveways in the area.
Commissioners concurred that a review in the field is necessary.

RECESS
Chair Hill recessed the meeting at 8:40 a.m. to 17 Portuguese Bend Road for the purpose of
conducting a field review of the feasibility of a driveway on Portuguese Bend Road in
conjunction with a proposed subdivision at that location.
FIELD TRIP
The Commission reconvened the meeting at 8:45 a.m. in the vicinity of a proposed
driveway just north of 17 Portuguese Bend Road. Following discussion and review by the
Traffic Engineer, the Commission directed staff to communicate to the Planning
Commission that they do not see any problems with the driveway at the proposed
location either in terms of its proximity to existing driveways or site distance for traffic on
Portuguese Bend Road. The Commission reserved the right to review the driveway again
if the subdivision is approved and the lot is proposed for the development ofr a single
family residence.
ADJOURNMENT
Hearing no further business before the Traffic Commission, Chair Hill adjourned the
meeting at 8:30 a.m. to Thursday, May 23, 1996, beginning at 8:30 a.m. in the City, Council

Lieutenant Dennis Graff of the Sheriff's Department is in attendance to provide a
comprehensive report regarding traffic activity in the City of Rolling Hills.

It is recommended that members of the Traffic Commission receive and file this

Each year, the City of Rolling Hills stripes various roadways within the community.
On every other year, the entire City is striped. However, on off -years, only the
major thoroughfares of Crest Road, Eastfield Drive, Portuguese Bend Road and
Saddleback Road are restriped.
Attached to this staff report is the City of Rolling Hills Replacement of Traffic
Striping and Pavement Markings for FY 96-97. This year's proposal only addresses
restriping of major thoroughfares in the City.
As in previous years, the Request for Proposal includes the advisement that Rolling
Hills is a no smoking community and that work crews are prohibited from smoking
while conducting work, in or outside of vehicles.
As directed by the Traffic Commission in November, 1995, we have added a test area
for thermoplastic striping on Portuguese Bend Road from Palos Verdes Drive North
to the intersection of Saddleback Road due to its heavy vehicular travel.
We have also added complete remarking of the City Hall/RHCA parking lot.
RECOMMENDATION
It is recommended that the Traffic Commission approve the attached Request for
Proposal and authorize staff to present it to the City Council for formal -
consideration.

IN THE CITY OF ROLLING HILLS
PUBLIC NOTICE IS HEREBY GIVEN that the City of Rolling Hills as AGENCY, invites
sealed bids for the above stated project and will receive such bids in the office of the City
Clerk, City of Rolling Hills, 2 Portuguese Bend Road, Rolling Hills, California 90274 up to
the hour of 11:00 a.m. on the_ day of , 1996 at which time they will be
publicly opened.
Copies of the Plans, Specifications, and Contract Documents are available from the City of
Rolling Hills, 2 Portuguese Bend Road, Rolling Hills, California 90274 upon payment of a
$20.00 non-refundable fee if picked up, or payment of a $30.00 non-refundable fee if mailed.
Any contract entered into pursuant to this notice will incorporate the provisions of the
State Labor Code. Compliance with the prevailing rate of wages and apprenticeship
employment standards established by the State Director of Industrial Relations will be
required.
Affirmative action to ensure against discrimination in employment practices on the basis
of race, color, national origin, ancestry, sex or religion will also be required.
The AGENCY hereby affirmatively ensures that all business enterprises will be afforded
full opportunity to submit bids in response to this notice and will not be discriminated
against on the basis of race, color, national origin, ancestry, sex, or religion in any
consideration leading to the award of contract.
In entering into a public works contract, or a sub -contract, to supply goods, services, or
materials pursuant to a public works contract, the Contractor, or sub -contractor, offers and
agrees to assign to the awarding body all rights, title and interest in, and to, all causes of
action it may have under Section 4 of the Clayton Act (15 U.S.C. Section 15) or under the
Cartwright Act (Chapter 2 (commencing with Section 16700) of Part 2 of Division 7 of the
Business and Professions Code), arising from purchases of goods, services, or materials
pursuant to the public works contract or the sub -contract. This assignment shall be made
and become effective at the time the awarding body tenders final payment to the

The bid must be accompanied by certified or cashier's check, or bidder's bond, made
payable to the AGENCY for an amount no less than ten percent of the amount bid.
The contract will not be awarded to a Contractor who is not licensed in accordance with the
provisions of the Business and Professions Code.
The AGENCY reserves the right to reject any or all bids, to waive any irregularity, and to
take all bids under advisement for a period of forty-five (45) days.

INSTRUCTIONS TO BIDDERS
PROPOSAL FORMS
Bids shall be submitted in writing on the Proposal forms attached herein. All information
requested therein must be clearly and legibly set forth in the manner and form indicated.
The AGENCY will not consider any proposal not meeting these requirements.
PROPOSAL GUARANTEE
Proposals must be accompanied by a proposal guarantee consisting of a certified or
cashier's check or bid bond payable to the AGENCY in the amount not less than ten
percent of the total amount bid. Any proposal not accompanied by such a guarantee will
not be considered. If a bidder to whom a contract is awarded fails or refuses to execute the
contract documents, the proposal guarantee shall be forfeited to the AGENCY. The
proposal guarantees of all bidders will be held until the successful bidder has properly
executed all contract documents.
DELIVERY OF PROPOSAL
Proposals shall be enclosed in a sealed envelope plainly marked on the outside, "SEALED
BID FOR FY 1996-97 REPLACEMENT OF TRAFFIC STRIPING AND PAVEMENT
MARKINGS IN THE CITY OF ROLLING HILLS. DO NOT OPEN WITH REGULAR
MAIL." Proposals may be mailed or delivered by messenger. However, it is the bidder's
responsibility alone to ensure deliver of the proposal to the hands of the AGENCY's
designated official prior to the bid opening hour stipulated in the Notice Inviting Sealed
Bids. Late proposals will not be considered.
WITHDRAWAL OF PROPOSALS
A proposal may be withdrawn by a written request signed by the bidder. Such requests
must be delivered to the AGENCY's designated official prior to the bid opening hour
stipulated in the Notice Inviting Sealed Bids. Proposals may not be withdrawn after said
hour without forfeiture of the proposal guarantee. The withdrawal of a proposal will not

IRREGULAR PROPOSALS .
Unauthorized conditions, limitations, or provisions attached to a proposal will render it
irregular and may cause its rejection. The completed Proposal forms shall be without
interlineation, alterations, or erasures. Alternative proposals will not be considered unless

specifically requested. No oral, telegraphic, or telephonic proposal, modification, or
withdrawal will be considered.
TAXES
No mention shall be made in the proposal of Sales Tax, Use Tax, or any other tax, as all
amounts bid will be deemed and held to include any such taxes which may be applicable.
DISOUALIFICATION OF BIDDERS
In the event that any bidder acting as a prime Contractor has an interest in more than one
proposal, all such proposals will be rejected, and the bidder will be disqualified. This
restriction does not apply to subcontractors or suppliers who may submit quotations to
more than one bidder, and while doing so, may also submit a formal proposal as a prime
Contractor.
No proposal will be accepted from a bidder who has not been licensed in accordance with
the provisions of the State Business and Professions Code.
DISCREPANCIES AND MISUNDERSTANDINGS
Bidders must satisfy themselves by personal examination of the work site, Plans,
Specifications, and other contract documents, and by any other means as they may believe
necessary, as to the actual physical conditions, requirements and difficulties under which
the work must be performed. No bidder shall at any time after submission of a proposal
make any claim or assertion that there was any misunderstanding or lack of information
regarding the nature or amount of work necessary for the satisfactory completion of the
job. Any errors, omissions, or discrepancies found in the Plans, Specifications, or other
contract documents shall be called to the attention of the AGENCY and clarified prior to
the submission of proposals.
EQUIVALENT MATERIALS
Approval of equipment and materials offered as equivalents to those specified must be
obtained in writing from the AGENCY. Request for consideration of equivalents must be
submitted in writing allowing sufficient time for complete consideration of all
specification, samples, references, tests, and other details to the full satisfaction of the
AGENCY. Requests for substitution of equipment and materials and submission of
substantiating data must be submitted in writing no later than thirty-five (35) days after
award of the contract.

LEGAL RESPONSIBILITIES
All proposals must be submitted, filed, made, and executed in accordance with State and
Federal laws relating to bids for contracts of this nature whether the same or expressly
referred to herein or not.
Any bidder submitting a proposal shall by such action thereby agree to each and all of the
terms, conditions, provisions, and requirements set forth, contemplated, and referred to in
the Plans, Specifications, and other contract documents, and to full compliance therewith.
AWARD OF CONTRACT
The award of contract, if made, will be to the lowest responsible bidder as determined
solely by the AGENCY. Additionally, the AGENCY reserves the right to reject any or all
proposals, to waive any irregularity, and to take the bids under advisement for a period of
forty-five (45) days, all as may be required to provide the best interests of the AGENCY. In
no event will an award be made until all necessary investigations aft made as to the

In accordance with the AGENCY'S Notice Inviting Sealed Bids, the undersigned BIDDER
hereby proposes to furnish all materials, equipment, tools, labor, and incidentals required
for the above stated project as set forth in the Plans, Specifications, and contract documents
therefore, and to perform all work in the manner and time prescribed therein.
BIDDER declares that this proposal is based upon careful examination of the work site,
Plans, Specifications, Instructions to Bidders, and all other contract documents. If this
proposal is accepted for award, BIDDER agrees to enter into a contract with AGENCY at the

understands that failure to enter into a contract in the manner and time prescribed will

ARTICLE 1
The contract documents for the aforesaid project shall consist of the Notice Inviting Sealed
Bids, Instructions to Bidders, Proposal, Standard Specifications, Special Provisions, and all
referenced specifications, details, standard drawings, and appendices; together with three
(3) signed copies of the Contract Agreement, three (3) signed copies of required bonds, one
(1) copy of the insurance certificates, permits, notices, and affidavits; and also including any
and all addenda or supplemental agreements clarifying, amending, or extending the work
contemplated as may be required to insure its completion in an acceptable manner. All of
the provisions of said contract documents are made a part hereof as though fully set forth

ARTICLE II
For and in consideration of the payments and agreements to be made and performed by
AGENCY, CONTRACTOR agrees to furnish all materials and perform all work required
for the above stated project, and to fulfill all other obligations as set forth in the aforesaid
contract documents.
ARTICLE III
CONTRACTOR agrees to receive and accept the prices set forth in the Proposal as full
compensation for furnishing all materials, performing all work, and fulfilling all
obligations hereunder. Said compensation shall cover all expenses, losses, damages, and
consequences arising out of the nature of the work during its progress or prior to its
acceptance including those for well and faithfully completing the work and the whole
thereof in the manner and time specified in the aforesaid contract documents; and also
including those arising from actions of the elements, unforeseen difficulties or

obstructions encountered in the prosecution of the work, suspension or discontinuance of

ARTICLE IV
AGENCY hereby promises and agrees to employ, and does hereby employ, CONTRACTOR
to provide the materials, do the work, and fulfill the obligations according to the terms and
conditions herein contained and referred to, for the prices aforesaid, and hereby contracts
to pay the same at the time, in the manner, and upon the conditions set forth in the
contract documents.
ARTICLE V
CONTRACTOR acknowledges that this contract is subject to the provisions of Division 2,
Part 7, Chapter 1 (commencing the Section 1720) of the California Labor Code relating to
public works and public agencies and agrees to be bound by all the provisions thereof as
though set forth in full herein.
CONTRACT agrees to comply with the provisions of California Labor Code Section 1775
concerning penalties for failure to pay prevailing wages. The Contract shall, as a penalty to
the AGENCY, forfeit not more than fifty dollars ($50) for each calendar day, or portion
thereof, for each worker paid less than the prevailing rates as determined by the Director of
Industrial Relations for the work or craft in which the work is employed for any public
work done under the contract by CONTRACTOR or by any subcontractor.
CONTRACTOR agrees to comply with the provisions of California Labor Code Section
1777.5 concerning the employment of apprentices on public works projects, and further
agrees that CONTRACTOR is responsible for compliance with Section 1777.5 by all of its
subcontractors.
CONTRACTOR agrees to comply with the provisions of California Labor Code Section
1813 concerning penalties for workers who work excess hours. The CONTRACTOR shall,
as a penalty to the AGENCY, forfeit twenty-five dollars ($25) for each worker employed in
the execution of the contract by the CONTRACTOR or by any subcontractor for each
calendar day during which such worker is required or permitted to work more than 8
hours in any one calendar day and 40 hours in any one calendar week in violation of the
provisions of Division 2, Part 7, Chapter 1, Article 3 of the California Labor Code.
In accordance with California Labor Code Section 1860 and 3700, every Contractor will be
required to secure the payment of compensation to its employees. In accordance with the
provisions of California Labor Code Section 1861, CONTRACTOR, by signing this contract
certifies as follows: "I am aware of the provisions of Section 3700 of the Labor Code which
require every employer to be insured against liability for worker's compensation or to
undertake self-insurance in accordance with the provisions of that code, and I will comply
with such provisions before commencing the performance of the work of this contract."

ARTICLE VI
With respect to performance of work under this contract, CONTRACTOR shall maintain
and shall require all of its subcontractors to maintain insurance as required in the Standard
Specifications of the Project Specifications.
ARTICLE VII
CONTRACT agrees to indemnify and hold harmless AGENCY and all of its officers and
agents from any claims, demands, or causes or action, including related expenses,
attorney's fees, and costs, based on, arising out of, or in any way related to the work
undertaken by CONTRACTOR hereunder as set forth in the Standard Specifications.
ARTICLE VIII
This contract is not assignable nor the performance of either party's duties delegable
without the prior written consent of the other party. Any attempted or purported
assignment or delegation of any of the rights of obligations of either party without the
prior written consent of the other shall be void and of not force and effect.
ARTICLE IX
In any action brought to declare the rights granted herein or to enforce any of the terms of
this contract, the prevailing party shall be entitled to an award of reasonable attorney's fees
in an amount determined by the court.
ARTICLE X
CONTRACT is and shall at all times remain as to the AGENCY, a wholly independent
Contractor. Neither the AGENCY nor any of its agents shall have control of the conduct of
CONTRACTOR or any of the Contractor's employees, except as herein set forth.
CONTRACTOR shall not at any time or in any manner represent that it or any of its agents
or employees are in any manner agents or employees of AGENCY.
ARTICLE XI
The CONTRACTOR is responsible for paying all retail, sales and use, transportation,
export, import, special, or other taxes and duties applicable to, and assessable against any
work, materials, equipment, services, processes and operations incidental to or involved

The City, it officers, employees and agents, shall be named as additional insured on all
such policies. Each policy of insurance shall contain a clause prohibiting cancellation,
modification or lapse without (30) days prior written notice having been given to the City.
All insurance policies shall be subject to approval by the City Attorney and certificates
evidencing such policies shall be provided to the City concurrently with the filing of all
required bonds.
A combined single limit policy with aggregate limits in the amount of $3,000,000 will be
considered equivalent to the required minimum limits.
In addition, Contractor shall take and assume all responsibility for the work as stated
herein and/or shown on the plans and specifications.
The Contractor shall bear all losses and damages directly or indirectly resulting to him, to
the Agency, its officers, employees, and agents, or to others on account of the performance
or character of the work, unforeseen difficulties, accidents or any other causes whatsoever.
The Contractor shall assume the defense of and indemnify and save harmless the Agency,
it officers, employees, and agents, from and against any and all claims, losses, damage,
expenses and liability of every kind, nature, and description, directly or indirectly arising
from the performance of the contract or work, regardless of responsibility for negligence,
and from any and all claims, losses, damage, expenses, and liability, howsoever the same
may be caused, resulting directly or indirectly from the nature of the work covered by the
contract, regardless of responsibility for negligence, to the fullest extent permitted by law.
In accordance with Civil Code Section 2782, nothing in this section or in the Standard
Specification shall require defense or indemnification for death, bodily injury, injury to
property, or any other loss, damage or expense arising from the sole negligence or wilful
misconduct of the Agency, or its agents, servants or independent contractors who are
directly responsible to the Agency, or for defects in design furnished by such persons.
Moreover, nothing in this section or in any other section, shall release the Agency, or its
officers, employees or agents, who are directly responsible to the Agency from liability for
active negligence of the Agency, its officers, employees and agents who are directly
responsible to the Agency. The Agency does not, and shall not, waive any rights against
the Contractor which it may have by reason of the aforesaid hold harmless agreements
because of the acceptance by the Agency, or deposit with Agency by Contractor, of any
insurance policies hereinafter described in the Standard Specifications. The aforesaid hold
harmless agreement by Contractor shall apply to all damages and claims for damages of
every kind suffered, or alleged to have been suffered by reasons of any of the aforesaid
operations of Contractor, or any subcontractor, regardless of whether or not such insurance
policies are determined to be applicable to any of such damages or claims for damages.
No act by the Agency, or its representatives in processing or accepting any plans, in
releasing any bond, in inspecting or accepting any work, or of any other nature, shall in
any respect relieve the Contractor or anyone else from any legal responsibility, obligation
or liability he might otherwise have.

IN THE CITY OF ROLLING HILLS
SCOPE OF WORK
The work to be done consists of furnishing all materials, equipment, tools labor, and
incidentals as required by the plans, specifications, and contract documents. The general
items of work include painting and repainting of traffic striping and pavement markings,
replacement of missing markers, the installation of new reflective pavement
markers/markers, and the removal of obsolete and/or unnecessary striping and pavement
markings. Work shall include the cleaning of soil and debris from areas to be striped prior
to actual striping.
Rolling Hills is a forested area and at no time shall any employees of contractor smoke
inside or outside of vehicles while in the City of Rolling Hills.
LOCATION OF WORK
The general locations and limits of the work are as follows:

STANDARD SPECIFICATIONS
The Standard Specifications of the Agency are contained in the 1985 Edition of the
Standard Specifications for Public Works Construction including 1986 and 1987
supplements as written and promulgated by the Joint Cooperative Committee of the
Southern California Chapter of the American Public Works Association and the Southern
California District of the Associated General Contractors of California. Copies of these
Standard Specifications are available from the publisher, Building News, Incorporated,
3055 Overland Avenue, Los Angeles, California 90034, telephone (213) 202-7775.
The Standard Specifications set forth above will control the general provisions,
construction materials, and construction methods for this contract except as amended by
the plans, the paragraphs set forth below, or other contract documents. The following
paragraphs are supplementary and in addition to the provisions of the Standard
Specifications unless otherwise noted and the section numbers referred to in the following
paragraphs coincide with those of the said Standard Specifications. Only those sections
requiring elaborations, amendments, specifying of options, or additions are called out.

TIME FOR COMPLETION
The Contractor shall complete all work in every detail within thirty (30) working days after
the date in the Notice to Proceed, exclusive of maintenance periods, except or otherwise
agreed upon due to already scheduled road resurfacing.
CONSTRUCTION, SCHEDULE AND COMMENCEMENT OF WORK
At least one week prior to the start of work, the Contractor shall furnish to the City
Manager a schedule of work showing the Contractor's planned sequence of operations.
The Schedule shall show the manner of traffic control planned for the complete project,
such as complete road closure, partial closures, flagmen, and detouring details. The list
showing lane closures shall be prepared for each day.
Such schedule shall be subject to the review and approval of City Manager. No work shall
be done until the City Manager and Contractor have agreed to the schedule to be followed
by the Contractor.
Prior to issuing the Notice to Proceed, the City Manager will schedule and conduct a
preconstruction meeting with the Contractor to review the proposed construction
schedule and delivery dates and clarify inspection procedures.
ORDER OF WORK
Unless directed otherwise by the City Manager, the order of the various work activities
shall be completed at the discretion of the Contractor.
PROSECUTION OF WORK
The Contractor shall submit weekly progress reports to the City Manager. The report shall
include updated construction schedule. Any deviations from the original schedule shall
be explained.
EXTENSION OF TIME
Requests for an extension of time must be delivered to the City Manager within five
consecutive calendar days following the date of the occurrence which caused the delay.
The request must be submitted in writing and must state the cause of the delay, the date of
the occurrence causing the delay, and the amount of additional time requested. This shall
be included as part of the construction schedule required above. Requests for extensions of

time shall be supported by all evidence reasonably available or known to the Contractor
which would support the extension of time requested. Requests for extensions of time
which are not received within the time specified above shall result in the forfeiture of the
Contractor's right to receive any extension of time requested.
If the Contractor is requesting an extension of time because of weather, he shall supply
daily written reports to the City Manager describing such weather, and the work which
could not be performed that day because of such weather or conditions resulting therefrom
and which he otherwise would have performed.
WORKING DAY
The Contractor's activities shall be confined to the hours between 7:00 a.m. and 6:00 p.m.
Monday through Friday, excluding holidays. Deviation from these hours will not be
permitted without the prior consent of the City Manager except in emergencies involving
immediate hazard to persons or property. In the event of either a requested or emergency
deviation, inspection service fees will be charged against the Contractor. The service fees
will be calculated at overtime rates including benefits, overhead, and travel time. The
service fees will be deducted from any amounts due the Contractor.
FORFEITURE DUE TO DELAY
The Contractor shall complete all or any designated portion of the workcalled for under
the contract within the time set forth in the Section entitled Time for Completion.
In accordance with Government Code Section 53069.85, Contractor agrees to forfeit and pay
Agency the amount of Two Hundred and Fifty Dollars ($250.00) per day for each and every
day of unauthorized delay beyond the completion date, which shall be deducted from any
monies due the Contractor.
Failure of the Contractor to perform any covenant or condition contained in the contract
documents within the timer period specified shall constitute a material breach of this
contract entitling the Agency to terminate the contract unless the Contractor applies for,
and receives, an extension of time in accordance with the procedures set forth in Section
entitled Extension of Time.
Failure of the Agency to insist upon the performance of any covenant or conditions within
the time period specified in the contract documents shall not constitute a waiver of the
Contractor's duty to complete performance within the designated periods unless the
waiver is in writing.
The Agency's agreement to waive a specific time provision or to extend the time for
performance shall not constitute a waiver of any other time provisions contained in the
contract documents.

Failure of the Contractor to complete performance promptly within the additional time
authorized in the waiver or of time agreement shall constitute a material breach of this
contract entitling the Agency to terminate this agreement.
The Contractor shall not be deemed in breach of this contract and no forfeiture due to
delay shall be•made because of any delays in the completion of the work due to
unforeseeable causes beyond the control and without the fault or negligence of the
Contractor provided the Contractor requests an extension of time in accordance with the
procedures set forth in Section entitled Extension of Time. Unforeseeable causes of delay
beyond the control of Contractor shall include acts of God, acts of a public enemy, acts of
the government, acts of the Agency, or acts of another contractor in the performance of a
contract with the Agency, fires, floods, epidemics, quarantine restrictions, strikes, freight
embargoes, and weather, or delays of subcontractors due to such causes, or delays caused by
failure of the owner of a utility to provide for removal or relocation of existing utility
facilities. Delays caused by actions or neglect of Contractor or his agents, servants,
employees, officers, subcontractors, directors, or of any party contracting to perform part or
all of the work or to supply any equipment or materials shall not be excusable delays.
Excusable delays (those beyond the Contractor's control) shall not entitle the Contractor to
any additional compensation. The sole remedy of the Contractor shall be to seek an
extension of time.
TRAFFIC AND ACCESS
The Contractor will be required to maintain at least one lane of traffic in each direction
through the project area at all times in a manner satisfactory to the City Manager. It is the
Contractor's responsibility to provide cones, barricades, lights and any other measures
necessary for regulation of traffic.
STREET CLOSURE, DETOURS, BARRICADES
All traffic control barricades, signs and devices used by the Contractor shall, at a minimum,
conform to the "Manual of Warning Lights and Devices," adopted by and in current use by
the State of California, Department of Transportation. Channelization devices shall be
spaced no greater than 25 feet apart. The Contractor shall take additional precautions as he
may find necessary under the circumstances.
Should Contractor fail to provide adequate traffic control or safety barricades, and in the
event a responsible individual cannot be located or refuses to perform, the Agency will at
its option place needed devices or engage a private firm to place and maintain said
barricades, which will be charged to Contractor directly.
Street closures will not be allowed.

PARTIAL AND FINAL PAYMENT
The closure date for period progress payments will be the twenty-fifth day of each month.
Authorization to pay is commonly received on the second Monday of the following
month. However, payments will be withheld pending receipt of any outstanding reports
required by the contract documents. In addition, the final progress payment will not be
released until the Contractor returns the control set of plans and specifications showing
the as -built conditions.
The full ten percent retention will be deducted from all payments. The final retention will
be authorized for payment thirty-five days after the date of recordation of the Notice of
Completion.
The Contractor may substitute securities for any monies withheld by the Agency to ensure
performance under the contract as provided in Public Contract Code Section 22300.
NOTIFICATION
The Contractor shall notify Willdan Associates and the owners of all utilities and
substructures not less than 40 hours prior to starting construction. The following list of

This responds to your request to identify the typical applications for the white and yellow
delineators.

The white delineators are reflective devices mounted at the side of the roadway, in series,
to indicate the roadway alignment. They are effective aids for night driving and under
conditions of reduced visibility and should be used to guide rather than to warn.
Delineators may be used on long, continuous sections of highway or through short sections
where there are changes in horizontal alignment, particularly where the alignment might
be confusing or not readily apparent. The typical applications for this type of delineator are
on the outside of roadway curves, on embankments higher than 10 feet, on approaches
to narrow sections of roadways, and on sections of roadway with inadequate shoulder
width.
The yellow delineators are reflective devices mounted within or adjacent to the roadbed
to mark obstructions, such as bridge abutments, handrail, culverts, beginning of dike or
curbed edge, guardrails, utility pull boxes, and other obstructions not readily apparent.
The City of Rolling Hills is presently following the above .delineator application
methodology. -

Pursuant to your request, I have completed a field review of the seven locations, we
discussed, to determine if the existing delineator placements are in compliance with
current traffic engineering practice.
The following list identifies recommended changes to be completed at each
location:
1. Remove the existing delineators located across from No. 34 Portugese Bend
Road.
2. Relocate existing delineators closer to the edge of pavement at No. 44
Portugese Bend Road. The minimum spacing between delineators should
be approximately 50 feet. The minimum distance from the edge of
pavement should be 2 feet.
3. Install one yellow delineator at the guard rail located at No. 3 Southfield in
the position we discussed.
4. Install white delineators south of No. 3 Southfield for a distance of
approximately 500 feet (see enclosed sketch). The minimum spacing
between delineators should be approximately 50 feet. The minimum
distance from the edge of pavement should be 1 foot due to heavy
pedestrian and equestrian traffic..
5. Remove four of the five delineators at the guard rail located at No. 18 East
Crest Road and replace the yellow delineator located at guard rail with new
(see enclosed sketch).

Dear Mr. Nealis:
Pursuant to our field review of the existing delineator placement on Portuguese Bend
Road, the four northerly delineators should be relocated adjacent to the edge of
pavement and the three southerly delineators should be removed to accommodate
pedestrian and equestrian traffic. The enclosed sketch illustrates the work to be
performed.

Pursuant to you request, I have completed a review of Poppy Trail to determine the need
for delineators through the "switch -back" curve area approximately 1,000 feet south of
Portuguese Bend Road.
It is my opinion that the installation of five delineators through the "switch -back" curve area
be installed to provide delineation of the roadway edge. Typically, delineators would not
be required on a low -volume street such as Poppy Trail. However, due to the narrowness
of the roadway and lack of shoulder area, this installation will enhance the safety of
vehicles. Additionally, I suggest installing four delineators just north of the curve area to
identify the roadway edge. These proposed improvements are shown on the enclosed
sketch.

Subject: ADDITIONAL DELINEATORS ON SADDLEBACK ROAD
REOUEST
Chairwoman Leeuwenburgh requested that the Traffic Commission review the curve
at 71 Saddleback Road. The Commission reviewed the location during their
September 20, 1991 meeting. The Commission then directed the Deputy Traffic
Engineer to further investigate the location and make any recommendations, if
necessary.
DISCUSSION
Staff has field reviewed the location at 71 Saddleback Road. There is an existing
curve warning sign west of 71 Saddleback Road facing eastbound traffic. An
equestrian trail exists along the easterly of Saddleback Road in the vicinity of 71
Saddleback Road.
Based on the field review, the installation of additional delineators is recommended.
Figure 1 depicts this recommendation.
RECOMMENDATION
It is recommended that additional delineators be installed in the vicinity of 71
Saddleback Road as shown in Figure 1.

SUBJECT: CONSIDERATION OF A NEW DRIVEWAY TO REPLACE AN
EXISTING DRIVEWAY AT 50 EASTFIELD DRIVE (LOT 99-EF), MR. &
MRS. RAY FERRIS.

This request for an amendment to the existing driveway is made in conjunction
with substantial additions to the residential development at the above address. In
conjunction with the proposed improvements, it is proposing to replace an existing
16 foot wide driveway with an approximate 20 foot wide driveway at Eastfield Drive.
Attached to this staff report are plans that show that the proposed driveway will
eclipse portions of the existing driveway .
This case is currently pending before the Planning Commission. The Public Hearing
on this matter was opened on Tuesday, May 21, 1996.
RECOMMENDATION
It is recommended that members of the Traffic Commission review the driveway
entrance as it meets Eastfield Drive and conduct a field trip to receive input from the
Traffic Engineer regarding this request.

your residential property at 50. Eastfield Drive. • A portion of that land development
request is to modify the driveway approach to Eastfield Drive which requires review
by the Rolling Hills Traffic Commission.
Your case has been scheduled to be considered by the Traffic Commission on
Thursday, May 23, beginning at 8:30 a.m. at the Rolling Hills City Council Chambers,
2 Portuguese Bend Road, Rolling Hills. It is anticipated that the Commission will
adjourn this meeting to an immediate field review of the driveway access.
Recommendations of the Traffic Commission will be incorporated into any
Planning Commission Resolution regarding your case.
It is important that you have the proposed driveway apron widths flagged for the
Traffic Commission to review this matter on May 23. If you would like to discuss
