As you know, the City's sole jurisdiction with respect to the streets within its territorial boundaries relates to traffic safety. Hence, the City may permissibly enact non- discriminatory traffic safety regulations designed to protect the various competing users of streets. The City may not, however, dictate who may or may not travel on the streets; in view of the fact that the streets are controlled by the Community Association, the request probably should be directed to the Board. 1 Jenki MJ:alr 0561870 --c-a3 CONSIDERATION OF REQUEST RELATING TO USE OF BICYCLES WITHIN THE CITY City Manager Nealis summarized correspondence received from Mr. Ron Sipes requesting that the City consider adoption of an Ordinance restricting the use of bicycles in the City by persons other than residents. He stated that the City Attorney's office had indicated that Traffic Commission Minutes September 20, 1991 _q_ the City does not have the authority to enforce such a restriction. Following brief discussion regarding access it was determined that legal opinion dictates that no action be taken. We appreciate you expressing your desire to prohibit non-resident bicycle use of private roadways within the City. Prohibition of access and control .of entrance falls, however, under the purview of the Rolling Hills Community Association. Of course, traffic safety issues as they relate to bicycle usage will continue to be enforced by representatives of the Los Angeles County Sheriff's Department. NEALIS, CITY MANAGER SUBJECT: CONSIDERATION OF REQUEST RELATING TO USE OF BICYCLES WITHIN THE CITY DATE: SEPTEMBER 20, 1991 Attached to this Staff Report is correspondence from Rolling Hills resident Ron Sipes requesting that the City consider the adoption of an Ordinance restricting the use of bicycles in the City by persons other than residents. In a recent meeting with Mr. Sipes, he indicates that he has had several near accidents with bicyclists and would support a Municipal Code amendment which would prohibit non-residents from operating bicycles within the City. Currently, Municipal Code Section 10.64.211 prohibits the use of bicycles on bridle trails. A copy of that applicable section of the Code is attached to this Staff Report. A copy of this Staff Report has been forwarded to the City Attorney's office for comment. Additionally, a copy has been forwarded to Los Angeles County Sheriffs Department Captain William Mangan for the purpose of review and to alert his staff to the unsafe bicycle riding practices as described in the correspondence submitted by Mr. Sipes. This report is presented today for Commission consideration. It would be in order to discuss the merits of Mr. Sipes' request and direct staff to take appropriate action. CN:ds 1 4.190--10.64.211 If the vehicle used in any violation of this section is registered to such person under the age of twenty-one years, the vehicle may be impounded at the owner's expense for not less than one nor more than thirty days. (Ord. 116 523124, 1973). 10.64.190 Motor vehicles on riding and hiking trails. No person shall operate any motorcycle or motor vehicle on any hiking trail, horseback riding trail or bridle path or trail within the City, whether the trail or path is marked or unmarked, without written permission of the City Manager. Anyone who violates this section is guilty of a misdemeanor. This section does not apply to authorized emergency vehicles or to trail maintenance vehicles. For the purposes of this section, a hiking trail, horseback riding trail, bridle path or trail is any area, way, or place off of the paved and main travelled portion of the road which is by custom or ordinance used for such purposes. This section shall apply to all such trails or paths within the City, whether on public or private property. (Ord. 116 523125, 1973). 10.64.200 Disturbing vehicles. No person shall operate a motor vehicle anywhere within the City, whether on private or public property, so as to disturb the peace and quiet of any person or neighborhood by noise, dust, smoke or fumes caused by such motor vehicle. (Ord. 116 523126, 1973). 10.64.210 'Use of horseback riding and bridle trails. No person shall ride, walk, lead, or draw any horse on any trail, path, or way in the City which is maintained, intended or by custom used for equestrian traffic unless he then has in his immediate possession a permit issued to him by the Rolling Hills Community Association authorizing his use of such trail, path or way. Any person riding, walking, leading or drawing a horse on any trail, path or way shall present his authorization permit and satisfactory identi- fication upon demand of any Deputy Sheriff or other City official designated to enforce this section. (Ord. 116 523127, 1973). 10.64.211 Use of bicycles on horseback riding and bridle trails. No person shall ride or walk a bicycle or permit any bicycle to be ridden or walked, on any trail, path or way which is maintained, intended or by custom used for equestrian traffic within the boundary of the City of Rolling Hills. The City Manager shall cause signs to be erected at the juncture of all equestrian trails and the City limits which will inform the public of the prohibition contained in this section. I appreciate your listening to an issue some might think low in priority. The use of bicycles on our roadways, as I explained, has become dangerous. In recent months I have had several incidents which, quite seriously, scared me greatly. On one occasion I was forced on to a hillside by two bike riders on Eastfield who passed me on a dangerous curve. On another occaison I came close to hitting a group of 10-15 bike riders who failed to stop for the stop sign at Southfield and Ringbit. I believe that the city should do something to stop the use of our roads by bike riders from outside our city. I would appreciate the review of any applicable County or outside cities Municipal Ordinances restricting the use of Bicycles in a city by persons other than residents. I have observed numerous persons avoiding the locked gate at Crest Road East by entering the property at 92 Crest. They also avoid the West Crest gate by entering the school property and walking their bikes up the steps to Crest Road. I do not believe that persons riding any wheeled vehicle should be allowed to enter our city without specific permission from the city. Allowing bicycles could lead to a successful challenge to our exclusion of non-resident automobiles. Any assistance you could give in this matter would be appreciated.
