Attached to this Staff Report is correspondence from the City
Attorney's Office relative to specific concerns expressed by the
Rolling Hills Traffic Commission regarding the Ordinance under
consideration. This item was continued from the regular meeting
held January 18, 1991 so that further information could be obtained
from the Traffic Engineer and City Attorney's Office.
Deputy Traffic Engineer Tom Sorrentino is prepared to address this
matter.

B. When establishing the conditions of
operation, the City shall consider the requirements of
the applicant and the recommendations of the City
Traffic Engineer.
10.70.060 [Required Warning Devices.
A. Any vehicle operating under the author-
ity of a permit issued in accordance with the provi-
sions of this ordinance shall be required to display or
provide the following warning devices:
1. (Red Flag; -- All permitted vehicles
shall display a square red flag or square cloth not
less than 16" at the extreme left -front and left -rear
of the vehicle or equipment.
2. Flashing Warning Lights -{ All per-
mitted vehicles shall be equipped with -flashing amber
warning lights to the front, sides, or rear of the
vehicle or equipment and shall display such lights when
engaged in the movement described in the permit.
3. rPtrot Car -- All permitted vehicles
engaged in the movement -described in the permit shall
be preceded by a pilot car equipped with flashing amber
warning lights. The pilot car shall display neat,
clean, and legible signs containing the words "OVER-
rSIZE;"""OVERSIZE-LOAD"`OR""WIDE-LOAD."
10.70.070 Authority to Issue Permits. All per-
mits issued pursuant to the provisions of this ordi-
nance shall be at the discretion of the City Manager.
The decision of the City Manager may be appealed to the
City Council within 10 days by submitting a letter to
the City Clerk stating the grounds for appeal. If no
timely appeal is filed, the City Manager's decision
shall be final. The City Council's decision on appeal
is final.
10.70.080 Fees. Fees shall be established by
resolution of the City Council adopted after notice
and hearing, and shall be based on the estimated total
cost to the City for issuing permits.

10.70.090 Penalties. Any vehicle operating on
streets within the City in violation of the provisions
of this ordinance shall be subject to a fine of $100."

CITY OF ROLLING HILLS
At their January 18, 1991 meeting, the Rolling Hills Traffic Commission reviewed the
proposed ordinance regulating the operation of certain vehicles on City streets.
Several questions and concerns were raised regarding this issue. They are as follows:
1. What types of vehicles would be classified as "Special Mobile Equipment," as
used in Subsection B of Section 10.70.030? Please provide a sample list.
2. What are the restrictions in terms of length and loads of commercial vehicles?
Can a section(s) be added, which addresses the restrictions and exemptions
for these elements, in addition to width?
3. What are the restrictions regarding dual trailers (combinations)? Can the
ordinance be amended to include regulation of these vehicles?
4. Does the "width" of the vehicles, as used in this ordinance, include the load
on the vehicle?
5. The Commission expressed concern that a fine of $100 for a violation of the
ordinance would be ineffective. What are the limitations on the amount that
can be set as a fine and what is the maximum allowable penalty?
Please provide a response to these questions and concerns and revise the draft
ordinance as appropriate. The next meeting of the Traffic Commission is scheduled
for Friday, February 15, 1991. Your response prior to that date would be greatly
appreciated.

We have revised and enclose the proposed ordinance
regulating vehicle width to include provisions regulating the
length of vehicles and combinations of vehicles. You will note
that we have clarified the width of vehicles by adding the words
"including its load."
In your letter of January 23rd you asked what types of
vehicles would be classified as "Special Mobile Equipment" as
used in the proposed ordinance. Section 575 of the Vehicle Code
defines special mobile equipment as follows:
" 'Special mobile equipment' is a vehicle,
not self propelled, not designed or used
primarily for the transportation of persons
or property, and only incidentally operated
or moved over a highway, excepting implements
of husbandry."
One example would be a large truck crane used primarily in
construction work. Another example would be a portabledraw
works. A compressor or a trailer might be classified as special
mobile equipment.
The Appellate Court concluded in the case of Nobileasg
Corn, v..ounty of Orange, 42 CA.3d 461 (1974), that:

"Special mobile equipment simply means some
type of apparatus or equipment mounted or
bolted to a trailer chassis."
For your information, special mobile equipment is
exempt from registration by the Department of Motor Vehicles.
You state that the Traffic Commission has concerns that
the penalty is inadequate. We, too, question the effectiveness
of a $100 fine. However, the Vehicle Code establishes the
penalty for violations of the provisions of this ordinance.
However, we have amended Section 10.70.110 of the ordinance to
include the statutory fines for second and third violations in
the same year.
Please give me a call if you have further questions or
concerns.

AN ORDINANCE OF THE CITY OF ROLLING HILLS,
ESTABLISHING THE AUTHORITY TO ISSUE PERMITS
REGULATING THE OPERATION OF VEHICLES
EXCEEDING MAXIMUM ALLOWABLE SIZES ON
STREETS WITHIN THE CITY AND AMENDING THE
ROLLING HILLS MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Title 10 of the Rolling Hills Municipal
Code is amended by adding Chapter 10.70 to Title 10 to read as
follows:
"CHAPTER 10.70
OVER SIZE VEHICLES
10.70.010 Findings. The City Council finds that
there is a need to regulate the operation of vehicles
exceeding maximum allowable widths, lengths and loads
on streets within the City. The regulation of such
vehicles is deemed necessary for the protection of
vehicular and pedestrian traffic due to the unusually
narrow, winding and steep character of streets in the
City.
10,70.02Q Authority. The California Vehicle Code
establishes regulations pertaining to the maximum size,
weight, and load of vehicles operated on streets and
highways. Section 35780 of the California Vehicle Code
grants the City the authority, at its discretion upon
written application and if good cause appears, to issue
a permit authorizing the applicant to operate or move a
vehicle of a size, weight, or load exceeding the speci-
fied maximums. This is a traffic control and safety
measure.
10.70.030 Vehicle Width.
A. With the exception of the vehicles
listed in subsection B, vehicles exceeding 102" in
width, including its load, shall be prohibited from
operating on streets within the City, unless authorized
by a valid permit issued by the City.
B. The following vehicles are exempt from
the permit requirement of Paragraph A of this Section

if 120" or less in width; any such vehicles exceeding
120" in width shall be prohibited from operating on
streets within the City, unless authorized by a valid
permit issued by the City:
1. Special mobile equipment.
2. Special construction or highway
maintenance equipment.
3. Motor vehicles designed for, and
used exclusively to haul feed for livestock that are
exempted from registration by the california vehicle
Code Section 36102(c), except when operated on a
highway during darkness.
10.70.040 Vehicle Length.
A. With the exception of the vehicles
listed in Subsection B, vehicles exceeding 40 feet in
length shall be prohibited from operating on streets
within the City.
B. The following vehicles in excess of 40
feet in length are prohibited from operating on streets
within the City unless authorized by a valid permit
issued by the City:
1. A vehicle used in a combination of
vehicles when the excess length is caused by auxiliary
parts, equipment, or machinery not used as space to
carry any part of the load, except that the combination
of vehicles shall not exceed the length provided for
combination vehicles.
2. A vehicle when the excess length is
caused by any parts necessary to comply with the
fender and mudguard regulations of this code.
3. An articulated bus or articulated
trolley coach which does not exceed a length of 60
feet.
4. A semitrailer while being towed by
a motor truck or truck tractor, if the distance from
the kingpin to the rearmost axle of the semitrailer
does not exceed 40 feet for semitrailers having two or
more axles, or 38 feet for semitrailers having one axle
if the semitrailer does not, exclusive of attachments,
extend forward of the rear of the cab of the motor
truck or truck tractor.

5. A bus when the excess length is
caused by the projection of a front safety bumper or a
rear safety bumper, or both. The safety bumper shall
not cause the length of the vehicle to exceed the
maximum legal limit by more then one foot in the front
and one foot in the rear. For the purposes of this
chapter, "safety bumper" means any device which is
fitted on an existing bumper or which replaces the
bumper and is constructed, treated, or manufactured to
absorb energy upon impact.
20.70.050 Combinations of Vehiclea.
A. Except as provided in subsection 8, no
combination of vehicles coupled together, including any
attachments, shall exceed a total length of 65 feet.
B. The following combination of vehicles
coupled together, including any attachments, in excess
of 65 feet in length, are prohibited from operating on
streets within the City unless authorized by a valid
permit issued by the city:
1. A combination of vehicles coupled
together, including any attachments, which consists of
a truck tractor, a semitrailer, and a trailer,
exceeding a total length of 75 feet, provided that the
length of neither the semitrailer nor the trailer in
the combination of vehicles exceeds 28 feet 6 inches.
2. A tow truck in combination with any
of the following vehicles when operating under a valid
annual transportation permit and within a 100 mile
radius of the location specified in the permit:
a. A disabled vehicle.
b. An abandoned vehicle.
c. A disabled or abandoned
combination of vehicles.
A tow truck in combination with the above vehicles may
exceed the 100 -mile radius restriction if a single trip
permit is obtained from the Department of
Transportation.

vehicle will be operated (i.e., number of hours per
day, days per month, etc.).
B. The City may suspend the application
requirements in cases of emergency.

City Manager Nealis presented the following proposed Ordinance:
ORDINANCE NO.
AN ORDINANCE OF THE CITY OF ROLLING HILLS ESTABLISHING THE
AUTHORITY TO ISSUE PERMITS REGULATING THE OPERATION OF
VEHICLES EXCEEDING MAXIMUM ALLOWABLE WIDTHS ON STREETS WITHIN
THE CITY.
In response to Chairwoman Leeuwenburgh, Deputy Traffic Engineer
Sorrentino stated that the definition of Special Mobile Equipment
(10.70.030-B.2) was anything other than a standard or typical
vehicle.
COMMISSIONER WELBOURN expressed concern that vehicle length had not

City Manager Nealis introduced the subject proposed Ordinance
entitled:
ORDINANCE NO.
AN ORDINANCE OF THE CITY OF ROLLING HILLS ESTABLISHING
THE AUTHORITY TO ISSUE PERMITS REGULATING THE OPERATION
OF VEHICLES EXCEEDING MAXIMUM ALLOWABLE SIZES ON STREETS
WITHIN THE CITY AND AMENDING THE ROLLING HILLS MUNICIPAL
CODE.
He further stated that correspondence had been received from the
City Attorney defining "Special Mobile Equipment". This
correspondence was in response to specific concerns expressed by
Traffic Commission

MOTION: COMMISSIONER WIENER moved that the subject Ordinance be
recommended for approval. COMMISSIONER WELBOURN seconded the
motion which carried unanimously.

Deputy Traffic Engineer Sorrentino explained that the Draft
Ordinance is before the Commission in response to direction given
at the last Traffic Commission meeting. He explained that the
Ordinance establishes the authority for the City Manager to issue
permits regulating the operation of wide loads on City streets.
He stated that the City Attorney had approved the content of the
Ordinance but the format is still awaiting approval.
COMMISSIONER WIENER considered the amount of the fine ($100) to be
inadequate given the time and effort involved in enforcing the
penalty. CHAIRWOMAN LEEUWENBURGH pointed out that the fees and
penalties would be established by the City Council.
COMMISSIONER VIRTUE felt that an additional warning in the rear of
a vehicle may be desirable. Discussion followed regarding the
relative merits of various warning devices.
There being no objection CHAIRWOMAN LEEUWENBURGH directed that this
item be held over to the December Traffic Commission meeting.

Mr. Tom Sorrentino, Deputy Traffic Engineer, addressed the
Commission stating that, upon direction from the City Attorney's
office, it was determined that the Community Association does not
have the authority to regulate vehicles which have legitimate
business within the City. Therefore, it is proposed that the
Traffic Commission recommend to City Council that an Ordinance be
adopted which would grant authority for the issuance of permits to
the City Manager.
The consensus of the Commission was that Staff be directed to
prepare a Draft Ordinance. This Ordinance will be presented to the
Traffic Commission for review and further discussion of conditions
and regulations at its next meeting.
There being no objection this was so ordered by CHAIRWOMAN
LEEUWENBURG.
