230 - Establishing Min. Size for Stable & Corrals F-33ORDINANCE NO. 230 AN ORDINANCE OF THE CITY OF ROLLING HILLS ESTABLISHING A MINIMUM SIZE FOR STABLES AND CORRALS AND AMENDING THE MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 17.16.120 of Chapter 17.16 of Title 17 of the Rolling Hills Municipal Code is hereby amended by adding a new paragraph G to read: G. Every lot or parcel developed with a single family home for which a site plan review is approved or extended after the 27th day of February. 1991 shall have an area designated for a stable of no less than 450 sq.ft. and a contiguous corral area of no less than 550 sq.ft. The combined minimum area for a stable and a corral shall be 1,000 sq.ft., or an area shall be designated on the lot or parcel for future use which shall be sufficient to allow for the construction of such minimum size structures. The stable and corral shall be located only on a portion of the lot having a slope of no greater than 4:1, and the area designated for the stable shall be included for purposes of calculating the structural coverage of the lot. The motion was seconded by Councilwoman Swanson and passed unanimously. c, CovsCIL I II 1[ 5 • X33 OPEN AGENDA Mrs. Dixie Duston, 2215 Via Anacapa, Palos Verdes Estates, inquired about the status of Resolution No. 90-43. Mayor Heinsheimer replied that the Council was not required to take action on this Resolution (denying a request to modify the terms of a Conditional Use Permit for a tennis court in Zoning Case 348). He advised that if anyone wished to appeal the decision of the Planning Commission to the City Council, this could be done. City Manager Nealis added that correspondence will be sent to the applicants advising them of the procedures for appeal. Mrs. Carole Hoffman, 3 Hillside Lane, expressed her opinion that the. minimum size- for stables and corrals, which was just increased by Ordinance No. 230, is still too small. Mayor Heinsheimer pointed out that the size of the covered area is the critical measurement because it is deducted from the maximum allowable building area. The Mayor added that this is an evolving process and can be changed in the future. Councilwoman Swanson stated she wished Mrs. Hoffman had been working with the Caballeros when they were preparing their recommendation to the Planning Commission. Mayor Pro Tem Pernell said that information regarding adequate care of horses should be made available to residents when they are considering building horsekeeping facilities. He suggested Mrs. Hoffman might work with the Caballeros to put this information _in writing to present to new and existing residents. Mr. Roger Hawkins, 37 Crest Road West, who is the incoming President of the Caballeros,. expressed his agreement.. with Mrs. Hoffman on the minimum size of horsekeeping facilities. He asked why the Council had rejected the Caballeros' recommendation of increasing the minimum facility size as the lot size increases. —. Mayor' Heinsheimer replied that the Councilwas concerned with providing a reasonable amount of space for keeping two horses, and they felt the new ordinance would be a major improvement over the old one. He suggested that the Caballeros "critique" the new ordinance and provide input and recommendations for further amendments. Mayor Pro Tem Pernell added that some examples of large lots developed with small horse facilities should be «included. Councilwoman Swanson suggested to Mr. Hawkins that the Caballeros organization should be promoted to residents who are. not current members. Mr. Joseph Johnson, 1 Ranchero Road, asked what is going on at 54 Portuguese Bend Road. He said there are many horse trailers, boats, campers, and construction equipment on the property and a new driveway is going in as well as a tremendous amount of grading work. City Manager Nealis promised to investigate the matter and report back to the City Council at their next meeting. A resident asked if he could address Agenda Item 4.B. (re: Zoning Case No. 414). Mayor Heinsheimer notified him that this item would be discussed in closed session and placed on the agenda for public hearing at the February 11, 1991 Council meeting. Assistant City Attorney Ennis advised that any testimony given at tonight's meeting would be outside of the recommended public hearing, and suggested that the resident send a letter if he could not be present at the next Council meeting. PUBLIC HEARINGS (CONTINUED) C. ORDINANCE NO. 230: INTRODUCTION AND FIRST READING OF AN ORDINANCE ESTABLISHING A MINIMUM SIZE FOR STABLES AND CORRALS AND AMENDING THE MUNICIPAL CODE. City Manager Nealis reported that current zoning requirements mandate a minimum stable size of 200 square feet be constructed or an area maintained on a property for future stable use. The Planning Commission, in reviewing recent projects, wished to consider the need to increase this area for future projects. Research was done at the Planning Commission level and a recommendation was arrived at to require 400 square feet as a minimum size for stables and a 600 square feet contiguous corral area, for a minimum total of 1,000 square feet. Mayor Pro Tem Pernell moved introduction of Ordinance No. 230, waiving reading in full. The motion was seconded by Councilwoman Leeuwenburgh. Mrs. Cathy Manning, 14 Crest Road, spoke in favor of the proposed ordinance. She testified that as new residents of Rolling Hills who were unfamiliar with horses, the fact that there was a stable requirement encouraged them to buy horses and they have learned to enjoy them. They have since learned how important sufficient space is to the maintenance of horses and the safety of riders. Mr. Chris Manning, 14 Crest Road, also favored the ordinance, stating that it is better to have two horses than one, and sufficient space is an important consideration. He mentioned the market value importance of maintaining the equestrian atmosphere of Rolling Hills. Mr. Doug McHattie of South Bay Engineering stated that there are some lots in the RAS-1 zone that are on sloping lots and not suitable for horses or facilities of this size, especially corrals. He suggested a more fair way of approaching the ordinance would be to differentiate between RAS-1 and RAS-2 zoning. Ms. Betsy Raine, 71 Portuguese Bend Road, spoke for the ordinance, stating that if the hillside lots are developed to the maximum and less than 1,000 square feet is left for stables and corrals, it negates the possibility of having horses on them and people who are looking for an equestrian community will have to (ovNc L t\o-k\°k\ look someplace o+-hor than Rolling Hills. She agreed that space for two horses shoull e provided, and 1,000 squi feet is the minimum practical amount. Councilwoman Swanson urged an increase in the suggested square footage, and the possibility of having larger requirements for the larger lots. Councilwoman Murdock favored increasing the minimum requirement but suggested tying the number of horses into it, allowing a certain number of square feet for each horse. She also suggested looking at the adequacy of the current requirement for a minimum distance of 35 feet from a stable to the neighboring residence. Major Heinsheimer advised this should be done as a separate item through the Planning Commission process. Mayor Pro Tem Pernell suggested limiting the number of horses to be allowed on a property depending on the size of the facilities provided. Councilwoman Swanson said this is a very sensitive issue, and suggested the Council should not try to limit the number of animals allowed. In response to a query from Mayor Pro Tem Pernell, it was stated that if the ordinance is passed, the 400 square feet required for a stable will be calculated as part of the hardscape/lot coverage area whether it is actually built or not. The corral area will reserved but will not be part of the lot coverage area. Mayor Pro Tem Pernell expressed his appreciation for horses and bridal trail easements and their importance in making Rolling Hills the beautiful community that it is. It was noted that service access to horse facilities is required. City Attorney Jenkins advised that the ordinance should have a triggering mechanism, to indicate whether it would apply to any property for which the site plan was approved after the effective date of the ordinance, whether it would apply to developments which are not completed in a certain period of time, etc. A clause could be added stating that "every lot or parcel developed for a single family home for which site plan approval is given or extended after (insert effective date of the ordinance) shall have an area ." This would cover any new site plan approval after the effective date and any site plan review extension applications. This suggestion was discussed and it was stated that current policy is that when an applicant comes in for a Site Plan Review he is subject to the ordinances existing at that time. Under the Site Plan Review ordinance, if construction is not commenced within one year after Planning Commission approval, or if work is suspended or abandoned for a period of 180 days or more, the site plan expires. The applicant can apply to extend it but a public hearing must be held and approval granted. The Mayor suggested a general clause be put in the ordinance stating that any time you come in for an extension you have to meet the ordinance as it exists at that time. City Attorney Jenkins noted that a new zoning ordinance will be brought to the Council ultimately, and this clause can be considered at that time. He suggested that the proposed ordinance under discussion should state that the new minimum size for stables and corrals will be in force on the effective date of the ordinance, 30 days after second reading and adoption. Councilmembers discussed the need to make sure the application is very clear as to all the requirements. City Attorney Jenkins suggested an addition to Section 1, Paragraph G, to read as follows: G. Further discussion was held regarding the Caballeros' recommendation of requiring 432 sq. ft. for a stable. It was decided that a minimum area of 450 sq. ft. would be an easier figure to work with. The total requirement of 1,000 square feet for the combined stable and corral is to remain. Mayor Pro Tem Pernell amended his original motion to approve Ordinance No. 230, to change the area designated for a stable to read no less than 450 square feet and the contiguous corral area to read 550 square feet. The amended motion was seconded by Councilwoman Leeuwenburgh and passed unanimously. The proposed ordi- nance would increase the min- imum stable and tack room space to 450 square -feet and require adjacent corral space of 550 square -feet. The ordinance will affect, prop- erties that come before the city's site review committee for consid- eration of grading permits for new structures or expansions, or per- mits to increase structure size more than 25 percent in a 36 - month period of time. If approved at the Jan. 28 City Council meeting, the ordinance will go into effect 30 days later, affecting property owners who then apply for site reviews. The increase was supported by several residents and Planning Commissioner Betsey Raines, who spoke of the need to foster ownership of horses within the city. Chris and Cathy Manning, recent Rolling Hills residents and horse owners said they they have learned it is much better horses and safer for owners if more than one horse is housed in a facility. The minimum sized stable prescribed by the previous stan- dards is insufficient for residents desiring to have more than one horse, said Chris Manning. The initial public hearing for this item was held at the October 16, 1990 Planning Commission meeting. Staff was directed to conduct a study of corral and stable sizes, and Commissioner Raine agreed to contact the "Caballeros" to receive their input on corral and stable sizes. Staff collected the ordinances from seven cities and has complied a cursory analysis in the attached survey. It can be noted that in the majority of the ordinances, there is a lot area per horse minimum. The Caballeros horse club offered the following stable sizes based on lot sizes: 432 sq. ft. 1,000 sq. ft. 1,100 sq. ft. 1,200 sq. ft. 1,300 sq. ft. EVALUATION minimum for a stable for 2 acres or less for 3 acres for 4 acres for 5 acres In Rolling Hills there are several parcels that are just barely one acre. In addition, the topography of many lots are such that they barely lend themselves to a building pad of 40% without grading. It is questionable, therefore, as to whether or not a 1,000 sq. ft. stable could be constructed on a parcel "2 acres or less" as suggested by the Caballeros. It may be feasible if this square footage is devoted to primarily a corral area, however, percentage of slope should be a consideration. It is recommended that a lot area per horse be established and that a percentage of slope be worked into the formula as outlined in the City of Portola Ordinance. Section 17.16.120 of Chapter 17.16 of Title 17 of the Rolling Hills Municipal Code is hereby amended by adding a new paragraph G to read: G. Every lot or parcel developed with a single family home shall have an area designated for a stable of no less than 400 sq.ft. and a contiguous corral area of no less than 600 sq.ft. The combined minimum area for a stable and a corral shall be 1,000 sq.ft., or an area shall be designated on the lot or parcel for future use which shall be sufficient to allow for the construction of such minimum size structures. The stable and corral shall be located only on a portion of the lot having a slope of no greater than 4:1, and the area designated for the stable shall be included for purposes of calculating the structural coverage of the lot. The initial public hearing for this item was held at the October 16, 1990'Planning Commission meeting. Staff was directed to conduct a study -of corral and stable sizes, and Commissioner Raine agreed to contact the "Caballeros" to receive their input on corral and stable sizes. Staff collected the ordinances from seven cities and has complied a cursory analysis in the attached survey. It can be noted that in the majority of the ordinances, there is a lot area per horse minimum. " for 4 acres 1,300 sq. ft. " for 5 acres EVALUATION In Rolling Hills there are several parcels that are just barely one acre. In addition, the topography of many lots are such that they barely lend themselves to a building pad of 40% without grading. It is questionable, therefore, as to whether or not a 1,000 sq. ft. stable could be constructed on a parcel "2 acres or less" as suggested by the Caballeros. It may be feasible if this square footage is devoted to primarily a corral area, however, percentage of slope should be a consideration. It is recommended that a lot areaper horse be established and that a percentage of slope be worked into the formula as outlined in the City of Portola Ordinance. She advised that the majority of the Caballeros members spoke in favor of 1,000 square feet, stable and corral space, and that some members noted that 800 square feet would be acceptable. Garages are not permitted in the front yard. On a corner lot, the Committee shall determine the orientation of the garage doors. Car ports are not acceptable. 7) No new residence or addition to an existing residence shall be constructed with a building height in excess of 24' as measured from the nearest exterior grade level to the top of the roof ridge. Where a structure is constructed on a split level, such height limitation shall be construed in a vertical plane, considering only that portion of the structure which is on the same level. Exception: Where the established setback in a given area is other than fifty (50) feet, the new residence shall conform to the setback established in said given area. The equestrian overlay district (Q) provides regulations for the keeping of horses and other large domestic animals as pets or for the personal use (not for com- mercial purposes) of property owners and/or lessees, where clearly accessory to the primary designated use of the land. Such regulations and standards presume a reasonable effort on the part of the animal owner to recognize the rights of the surrounding neighbors by maintaining and controlling his animals in a safe, sanitary, and healthy manner at a reason- able location, and neither authorize nor legalize the mainte- nance of any private or public nuisance. (Ord.‘75-78(part), 1975). 17.12.020 Uses permitted. Property in a Q overlay dis- trict may be used for the keeping of horses and other large domestic animals (cows, goats, and sheep) subject to this code and the following conditions: A. On each developed lot or parcel having an area of fifteen thousand square feet or more, one large domestic ani- mal may be kept or maintained for each five thousand square feet of area, but not to exceed a total of six large domestic animals, B. On each vacant lot or parcel of at least five thou- sand square feet or more, two large domestic animals may be kept or maintained. One additional large domestic animal may be kept or maintained for_each_additional_ five thousand square feet, but not t eceed_a_total of six large domestic animals A lot or parcel on which the structures consist solely of barns or stables not used for human habitation shall, for pur- poses of this subsection, be deemed vacant. C. Except as specifically provided in this chapter, all animals kept or maintained shall be for the personal use of members of the family of the owner or lessee of the property. 1. Property owners may permit -other persons to keep or maintain horses on such owner's property, provided that 241 17.12.030 such owner does not directly or indirectly receive payment other than expenses for such use; 2. Incidental sales of animals, not constituting a commercial activity or the conduct of a business is permitted; 3. Animals may be raised for sale by members of 4-H Clubs, Future Farmers of America, or similar organizations as part of a regular youth project. (Ord. 75-78(part), 1975). 17.12.030 Establishment of Q districts. In addition to general zone change procedures, pursuant to Chapter 17.64, the following provisions shall apply to all applications for the establishment of an equestrian overlay district (Q): A. A Q district may be established where the proposed district contains not less than five acres and is separated by a buffer area of not less than twenty-five feet from any lot or parcel of land which is used for residential purposes or located in a residential zone and which is not within the Q district. Such buffer area must be permanently established and may consist of either a public or private easement, a public street, highway, riding trail, or any other appropriate topographical separation which will provide an equivalent buf- fer area in keeping with the intent of this chapter. B. A petition for the establishment of a Q district shall be signed by a majority of the property owners within the area under consideration as shown on the latest available assessment roll of the county. With each petition, the applicant(s) shall also file: 1. A map drawn to a scale specified by the director of planning, showing the location of all highways, streets, alleys, and the dimensions of all lots or parcels of land within the proposed district and within five hundred feet from the exterior boundaries of the property under consideration; 2. A list of the names and addresses of all persons who are shown on the latest available assessment roll of the county as owners of the property within the proposed district and as owning property within a distance of five hundred feet from the exterior boundaries of the proposed district; 3. Such other information as the director of planning may require. The accuracy of all information, maps, and lists submitted shall be the responsibility of the applicant(s). C. The planning commission shall hold a public hearing on, the petition. The planning commission shall cause notice of such hearing to be sent by first class mail, postage pre- paid, to all persons listed on the petition. D. The planning commission shall recommend approval of a petition requesting the establishment of a Q district to the city council for amendment to this title where the infor- mation submitted by the applicant(s) and/or presented at pub- lic hearing substantiates the following findings: 1. That horses and_other large domestic animals kept or maintained within the proposed district will not 242 17.12.040 jeopardize, endanger, or otherwise be detrimental to the. public health, safety, or general welfare; 2. That -the keeping or maintaining of horses and other large domestic animals within the proposed district• will not be a material detriment to the use, enjoyment, or valuation of property of other persons in the vicinity of the proposed district; and • 3. That the lots or parcels within the .proposed dis- trict are adequate in size and shape to accommodate horses and other large domestic animals. • E. The planning commission shall deny the application. where the information submitted by the applicant(s) and/or presented at public hearing fails to substantiate such find- ings to the satisfaction of the planning commission. F.. The planning commission in recommending approval of the establishment of a Q district may impose such conditions it deems necessary to insure that animals permitted in such .district will be kept or maintained in accord with the find- ings required by subsection D of this section. Conditions imposed by the planning commission may involve any pertinent factors affecting the establishment, operation, and mainte- nance of the requested use, including but not limited to:. 1. The number and location of animals; . 2. The type and construction of corrals, stables, or other structures used for the housing of such animals; 3. Fencing requirements; 4. Required setbacks; 5. The inclusion of riding areas and/or bridle trails within the proposed district. (Ord. 75-78(part), 1975). 17.12.040 Development standards.• A. For goats or sheep, the minimum area specified above may be reduced by one-half. 3. Stables and barns shall be constructed and main- tained in accordance with the building code of the city. 4. All fences and gates used for the enclosure of horses or other large domestic animals shall be of such de- sign, materials, and construction•as are sufficient to pre- vent the escape of the animal or animals enclosed. Fences enclosing horses or cows shall be not less than four feet in height and. shall be.of the equivalent strength of a wood 243 17.12.050 fence with four -by -four -inch posts, no more than ten feet apart, with three two -by -six-inch rails. Electrically charged wires shall be used only to supplement other fences, and shall meet Underwriter's standards for electric fences. Barbed wire fences and, except as provided in this section, electric fences, are prohibited. B. In addition to all applicable health and safety regulations provided in any other statute or ordinance, the following provisions shall apply: 1. Each property owner or lessee is responsible for the continuous maintenance of sanitary conditions which in- cludes, but is not limited to, the cleaning o.f corrals, sta- bles, barns and other areas to which animals have access, and for the disposal of manure, offal, soiled straw, and other refuse as required. Animal waste shall not be allowed to accumulate, runoff, or leach so as to create a nuisance or be offensive to other persons in the vicinity. Manure may be disposed of by removal, fertilizing, or composting. If waste is to be composted, proper composting procedures must be used to control insects and to minimize offensive odors. 2. Each lot and structure shall be maintained so that there is no standing surface water or ponding within areas in which large domestic animals are kept. 3. All buildings used for the keeping of animals and all corral or enclosure fences shall'be constructed and main- tained in a neat and orderly condition and kept in good re- pair. Landscaping'or other screening techniques shall be pro- vided as appropriate to assist in screening of stables, barns, corrals, and stored hay. 4. Property owners or lessees who keep large domestic animals on their property will carry out.a positive program of fly control (i.e., through the use of traps, pesticides, etc.) when necessary to control the fly population. 5. No structure or enclosure for the keeping of large domestic animals shall be constructed or maintained in any regular, intermittent, or seasonal watercourse. 6. There shall be displayed on or in the vicinity of any barn, stable enclosure, or other area in which large dom- estic animals are kept some form of weatherproof notice set- ting forth the name of the person(s) responsible for such animals and a phone number(s) to be called in the event of an emergency. (Ord. 75-78(part), 1975). 17.12.050 Animal advisory committee. The planning com- mission shall appoint an animal advisory committee consisting of persons knowledgeable in the keeping and maintaining of large domestic animals. Such committee shall advice the plan- ning director and the planning commission on technical matters pertaining to the implementation and enforcement of this chap- ter. The committee may form such subcommittees as it deems 244 1'x.12.060--17.12.070 appropriate. Members of the animal advisory committee shall serve at the pleasure of the planning commission. (Ord. 75-78 (part), 1975). 17.12.060 Special animal permit --Purpose. The special animal permit is established to permit: A. The keeping or maintaining of large domestic animals on lots or parcels not located within a Q district; • B. The keeping or maintaining of wild animals, as de- fined in Section 6.04.230, or large domestic animals not specifically authorized elsewhere; C. Variation from the terms and requirements of this chapter, including but not limited to numbers of animals per- mitted, lot or parcel size, dimensions or locations of fences, enclosures, corrals, barns, and other structures. (Ord. 175 §11, 1983; Ord. 75-78 (part), 1975). 17.12.070 Special animal permit --Procedure. A. Persons desiring a special animal permit shall file a written applica- tion with the director of planning, except that no application shall be filed or accepted if final action has been taken within one year prior thereto on an application requesting the same or substantially the same permit. An application for a special animal permit shall contain the following information: 1. The name and address of the applicant and of all persons owning any or all of the property proposed to be used. (If applicant does not own the subject property, written per- mission from the owner or owners to make such application must be included with the application); 2. The address of the subject property; 3. The legal description of the subject property; 4. The variation requested, e.g., type and number of animals, lot size, dimensions or location, etc.; 5. A sketch indicating the area and dimensions of the building or enclosure wherein the animal or animals are to be kept or maintained and the location and the dimensions of all other structures on the subject and adjacent properties, pro- vided, however, such sketch shall not be required if the sub- ject of the application involves only the height of fences; 6. A list of the names and addresses of all persons who are shown on the latest available assessment roll of the county as owning property: a. Adjacent to the exterior boundaries of the sub- ject lot or parcel when located within a Q district and the variation requested includes only minor changes, such as di- mensions or location of fences, enclosures, corrals, barns, or other structures, or b. Within five hundred feet from the exterior boundaries of the subject lot or parcel, when located within a Q district and the variation requested includes increase in number of animals allowed or lot size requirements, or 245 (Rancho Palos Verdes 1/84) 17.12.070 c. Within five hundred feet from the exterior boundaries of the subject lot or parcel if located outside of a Q district; 7. A fee, as established by resolution of the city council from time to time; 8. Other appropriate information, as the director of planning may require. B. In all cases where an application for a special ani- mal permit is filed, the director of planning shall cause a notice to be forwarded by first class mail to all property owners who are shown on the application. The notice shall state location of the subject property, the intent of the ap- plication, and the right to oppose the granting of such a permit. All opposition to the granting of a permit must be submitted in writing to the director of planning, within ten days after mailing of such notice. C. Not sooner than fifteen calendar days after the noti- fication, nor later than thirty days after receipt of the ap- plication, the director shall either grant, deny or grant with conditions the special animal permit. Notice of the decision shall be sent to all of the property owners listed in the application. D. The applicant or any interested party may appeal the director's decision to the planning commission by filing a written request, together with a fee as established by resolu- tion of the city council, within fifteen calendar days after the decision is made. E. The planning commission shall approve an application for a special animal permit where the information presented at public hearing substantiates the following findings: 1. That the requested animal or animals, at the loca- tion proposed, will not jeopardize, endanger, or otherwise be detrimental to the public health, safety, or general welfare; and 2. That the proposed site is adequate in size and shape to accommodate the animal or animals requested without material detriment to the use, enjoyment, or valuation of property of other persons located in the vicinity of the site, and the keeping of animals as requested is an appropriate use of the site; and 3. That any other variance from the terms or require- ments of this title will not be materially detrimental to the use, enjoyment, or valuation of property of other persons lo- cated in the vicinity and will not jeopardize, endanger, or otherwise be detrimental to the public health, safety, or general welfare. F. The director of planning or the planning commission in approving an application for a special animal permit may impose such conditions as are deemed necessary to insure that such animals will be kept or maintained in accordance with the provisions of this chapter. (Rancho Palos Verdes 1/84) 246 17.12.080 G. The planning commission shall deny the application where the information presented at public hearing fails to substantiate'such findings to the satisfaction of the commission. H. The decision of the planning commission may be ap- pealed to the city council. Any appeal must be made in writ- ing within fifteen days of the decision, together with a fee, as established by resolution of the city council. I. Each permit shall be permanent unless a shorter per- iod is specified by the director or the commission. The per- mit may be terminated upon the occurrence of the following conditions: 1. Whenever the subject lot or parcel is subdivided, reduced in size, or is combined with one or more other lots or parcels; or 2. Violation of any of the conditions upon which the permit was granted. J. The director shall cause each special animal permit issued to be recorded with the county recorder, so as to pro- vide notice to subsequent purchasers of the property of any conditions imposed or expiration date (if any). (Ord. 90 §2 (part), 1977; Ord. 75-78(part), 1975). 17.12.080 Nonconformities.. Except as provided in this section, all existing buildings, structures, fences, enclo- sures, and uses of land which do not conform to the provisions of this chapter, but were existing on July 1, 1975, shall com- ply herewith twelve months after the effective date of the ordinance codified in this chapter. In the event of any nonconformance within a Q district existing on July 1, 1975, the owner of a parcel so affected may within ninety days of the effective date of the ordinance codified in this chapter, file a request for waiver with the director of planning. A. The waiver, if granted, shall permit the nonconform- ing condition to continue until the lot or parcel is sold or transferred, except to the extent that the waiver shall be permanent for the following conditions: 1. A permanent. structure may continue for the life of the structure; 2. Lot size waivers shall be permanent. B. A request for waiver shall be accompanied by a writ- ten statement including: 1. The ownership of the lot or parcel; 2. The conditions for which the waiver is requested; 3. A fee, as established by resolution of the city council; 4. Any additional information, as required by the director of planning. C. The director shall, with the recommendation of the animal adivisory committee, issue such waiver upon the finding 247 (Rancho Palos Verdes 9/82) 17.14.010--17.14.020 that such waiver will not jeopardize, endanger, or otherwise constitute a menace to the public health, safety, or general welfare. D. The director shall cause each waiver issued to be recorded with the county recorder. (Ord. 90 §2(part), 1977; Ord. 75-78 (part) , 1975) . Chapter 17.14 HOMEOWNERS' ASSOCIATION OR SIMILAR ORGANIZATION Sections: 17.14.010 17.14.020 Purpose. Standards. 17.14.010 Purpose. This chapter establishes supplemen- tal requirements which all homeowners' associations with ju- risdiction over commonly —owned lands and facilities must im- plement in order to provide protection for the members of the association and the city. (Ord. 75-78(part), 1975). 17.14.020 Standards. The following standards shall be supplemental requirements necessary to establish and maintain any new homeowners' association, or similar organization, in addition to standards and provisions set by other applicable codes, ordinances and laws. A declaration of covenants, conditions and restrictions relating to the management of common areas and common facili- ties shall be required. The declaration shall provide for the following provisions and shall not be amended, modified, or changed without the consent of the city council. A.. Right of Public Entry to Common Area. The city, the county, the state, and the Government of the United States, and any department, bureau, or agency thereof, shall have the right of immediate access to all'portions of common areas not assigned for the exclusive use of the owner of a particular unit at all times, for the purpose of preserving the public health, safety and welfare, except in those instances where a common area is accessible only through a private unit. Notice of such right of governmental agency access shall be prominently displayed in common areas. B. Maintenance. The declaration shall contain a provi- sion establishing the obligation and duty of the governing body to maintain the common areas in good condition. C. Enforcement. The declaration shall contain a provi- sion insuring the right of any association member to enforce the terms of the declaration.• (Rancho Palos Verdes 248 9/82) APPLICATION PROCEDURES FOR FARM ANIMALS OR POULTRY PERMITS The following permit procedures have been established by the City of Thousand Oaks to allow the keeping of farm animals or poultry in the various residential zones. The filing fee for this application is $20.00. To qualify, an applicant must: (1) Own or have permission of the owner of the property upon which the animal or fowl is to be maintained and the property shall be of sufficient size (as indicated below) to accommodate the animals or fowl. a. Poultry and rabbits only when the lot area per family is not less than 7,000 square feet or more than 10,000 square feet but not to exceed twelve (12) birds and six (6) rabbits. b. Poultry and rabbits only when there is not less than 10,000 square feet but not to exceed twenty-four (24) birds and twelve (12) rabbits. c. One calf, pig .or goat when the lot area per family is not less than 10,000 square feet. d. Two (2) horses, bovines, goats or sheep when the lot area per family is not less than 20,000 square feet; provided , however, there shall be not more than one horse or bovine and either two (2) sheep or goats for each additional one-half (I) acre. (2) The applicant shall be a member of the 4-H or, other organized group that is a self -policing organization and the animals must be raised as a project. (3) A plot, in duplicate and drawn to scale, showing the applicant's property and each adjacent property, the residences on each- and the area and structures to be devoted to animal or fowl use. Such plot plan shall show compliance with the requirement that no animal or fowl, except dogs and cats kept as domestic pet, shall be housed, stabled, lodged, maintained or confined within forty feet (40') of any school, church, hospital, public place, business, residence, dwelling house or other building used for human habitation, other than the personal dwelling or residence of the owner or keeper. (4) A list of all the property owners or residents adjacent to the subject property with an affirmative showing of evidence by means of a signed petition of consent of all adjacent property owners, or notice as per the sample letter attached, sent to all adjacent property owners; with a post office certification or registration showing that the letter was actually received, together with a statement that each owner or resident has been notified as to the types and numbers of animals requested. Such list shall also contain the address, telephone number and a statement as to whether the resident is the legal owner of the property. The Director of Planning and Community Development shall issue the requested permit within thirty (30) days if no complaint is received. (5) Cnly an original of the petition and application will be accepted. Photocopied documents shall be limited to the plot plan and proof of organized group membership. (Signature of Applicant) (Date) Section 6-1 .108 Livestock Care and Maintenance No livestock shall be housed, kept or confined within the City except under the following conditions: (a) No livestock shall be housed, kept or confined within forty (40') feet of any habitable dwelling, church, school or other place of human habitation except the dwelling of the owner thereof. (b) The following minimum lot area shall be provided per animal in addition to ' the area of any structure: (1) Fifty (50) square feet of pen for each sheep, goat, pig or other small animal; and (2) Two hundred (200) square feet of corral for each horse, bovine, pony, colt or other large animal, with a maximum of 600 square feet required. (c) Any area used to stable, harbor or confine livestock shall be fenced so as to prevent such livestock from ranging onto adjacent property. Stallions over two and one-half (2}) years of age and horses at stud shall be confined to an area fenced to a minimum height of five feet (5') and of construction suitable to contain the animal. (d) Any area used to stable, harbor, confine, or corral livestock shall be kept reasonable free of dust, litter and the accumulation of weeds and debris. the stable, pen or corral shall be periodically sprinkled with water in order to keep dust from blowing onto adjacent property. (e) No livestock shall be stabled, harbored, kept or confined in any stable, corral, yard or enclosure in which the droppings and other waste matter have not been removed at least once every seven (7) days, except where such livestock is confined to an area of at least five (5) acres. If, however, in the opinion of the enforcing authority, an area of any size is in need of a cleaning of this type of waste matter, the owner shall remove such waste matter• within three (3) days of a notice ordering him to do so. (f) Corrals, stables and pens shall be plowed under or sprinkled with chemicals so as to eliminate the "fly" breeding characteristics in the areas. (g) Offensive odors emanating from livestock shall be controlled to the extent that such odors will not unreasonably disturb the comfort of any residents of the neighborhood. (h) If, in the opinion of the enforcement officer, an animal is obviously in need of medical attention, such officer shall inspect and provide for the treatment of such animal by a veterinarian. The cost of the treatment, regardless of the final disposition of the animal, shall be borne by the owner thereof. (i) Any animal which is found to be repeatedly mistreated by the lack of food, water or sanitary conditions by beatings or other forms of cruelty shall be impounded. Section 6-6.203. Definitions. It is the intention and direction of the Council that the interpretation and application of the provisions of this article shall be held to be the minimum requirements, except where it is expressly stated that maximum requirements shall prevail. The provisions of this article are not intended to impair or interfere with any private restrictions placed upon property by covenant or deed; however, where the provisions of this article impose a greater restriction upon such property, the provisions of this article shall control. Where the provisions of this article impose regulations or requirements which are different from or in conflict with those of any other law of the Town, the law establishing the more restrictive requirements shall prevail. Section 6-6.205. Conformance with provisions. It shall be unlawful for any person to keep or maintain, or cause to be maintained, any horse in the Town except in conformance with the provisions of this article. Stable Permits - Required Fees; Renewal. No horse shall be kept for more than thirty (30) consecutive days without obtaining a stable permit therefor pursuant to the provisions of this article. The fees for such permits shall be fixed by resolution of the Council. Section 6-6.207. Stable Permits - Applications; Inspections; Issuance or Denial; Appeals; Transferability. (a) Stable Permit Applications: Applications shall be made to the Town Clerk on a form provided by the Town for such purpose and shall be accompanied by the required fee_ (b) All applications shall include the written consent of the owner of the property. (d) Issuance or Denial. If the Town staff finds that the proposed use will be in conformity with the provisions of this article, the Town Staff shall issue the Stable Permit but otherwise shall deny such permit. .(e) Appeals. All appeals from the issuance or denial of a Stable Permit shag be made to the Town Council in accordance with the appeals procedures in the Zoning Ordinance. (f) Conditions. Each stable permit issued shall state the number of horses permitted, the activities and facilities permitted, and any special conditions or requirements to be met. (g) Transferability. All Commercial and Private Class "A" Stable Permits and Conditional Use Permits issued under this Article shall not run with the land and may not be transferred or assigned. (h) Stable Permits for commercial stables shall be reviewed annually by the Livestock Committee and the Planning Commission. (a) Commercial stables shall be permitted only on sites where a conditional use permit has been granted by the Planning Commission pursuant to the zoning laws of the Town. In acting on any conditional use permit for a commercial stable, -the Planning Commission may impose such conditions as are necessary to secure the objectives of this article, including but not limited to the alteration, demolition, or ..reconstruction of existing structures within the time �;m7Ts established by the Planning Commission, giving .consideration to the purposes of the article. (10) Waste Disposal: Regular removal of waste and maintenance of clean, sanitary conditions shall be required. An insect and dust control plan shall be required and implemented. (11) Drainage: A Drainage 'plan shall be required as a condition of use permit demonstrating adequate site drainage and maintenance •of drainage system. (12) Structures: Plans for new construction of a. -1=structures=for-which=-°a building -=permit-------- is required shall be reviewed and approved by the Architectural Site Review Board. All new stables shall be built in conformance with the Building Code of the Town. Where existing buildings and structures constructed in compliance with regulations in force at the time of construction constitute a threat to the health, safety, or general welfare, specific corrections may be required within stated time periods as a condition of permit. (15) Parking: Parking adequate for the use and the site shall be set by the Planning Commission, as a condition of the use permit. (16) Lighting: No exterior lighting other than needed for safe passage around buildings unless specifically authorized by the Planning Commission in its review of the Use Permit. (17). Fences: Al corrals and pastures shall be enclosed by an adequate fence, in accordance with Town aeouirements. (15) Stallions: Fencing shall be six (6) `ft._ in height; signs shall be posted stall doors, corral gates, and fences adjacent to trails indicating a stallion is kept therein. Private Class "A"Stables - Conditional Use Permits. *(a) Private Class "A" Stables shall be, permitted only on sites where a conditional use permit has been granted by the Planning Commission pursuant to Municipal Code section 9-2.1005 , in the same manner as for a Commercial Stable under Section .6-6.208(a). Applicants shall pay one-half the Commercial Stable use permit fee.. (b) Prior to issuance of .a Private Class "A" --Stable iae -permit:,- -the--application--.shal-l==be reviewed, and the site inspected by the Livestock Committee. The Livestock Committee shall make a report rand recommendation to the Planning Commission. Section 6-6.211. Stable Permits: Suspension and Revocation. Any stable permit granted pursuant to the provisions of this article shall be subject to suspension or revocation by the Council for failure to comply with the material provisions of this article or Woodside Municipal Code. Such notice shall require him to report or appear before the Council at a date and hour specified, to show cause at such time and place why the permit should not be suspended or revoked. At such time and place the person holding such permit shall have the right 'to appear in person or by counsel and to introduce such evidence as he may desire, and the Council shall confront the permit holder with any charges that the Council may have against him. After the conclusion of the hearing, the Council may, if it makes a finding that the permit holder has violated the material terms of this article or the terms of his permit, revoke or suspend the permit, or set conditions for its continuance. Section 6-6.212. Exceptions: Hearinzs . The Council shall have the right to modify the strict application of the provisions of,this article where there are extraordinary conditions affecting the property of the applicant. Section 6-6.213. The Town Attorney shall, upon the order of the Council, commence an action or proceedings for the abatement, removal, and enjoinment thereof in the manner provided by law and shall take such other steps and shall.apply to such courts as may have jurisdiction to grant such relief as will abate and remove such building or structure and restrain and enjoin any person from setting up, erecting, building, maintaining, or using any such building or structure or using property contrary to the provisions of this article. The remedies provided for in this article shall be cumulative and not exclusive. All costs and attorneys' fees relating to the enforcement of the provisions of this article shall be borne by and recoverable from the persons in violation thereof. Section.6-6.214. Violations - Penalties: It shall be unlawful for any person to operate a commercial or private stable within the Town in violation of the provisions of this article. It shall be unlawful for any person to violate any of the provisions of this article. SECTION 3: If any section, subsection, subdivision, paragraph, sentence, clause, or phrase of this Ordinance or any part thereof is for any reason held to be unconstitutional or invalid, or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part thereof. This Ordinance is adopted to establish licensing requirements for the keeping of horses and to regulate the keeping and main- tenance thereof. In particular the ordinance is intended to minimize water pollution and the erosion due to overgrazing, compaction of soils and dis- charge or runoff from corrals,.pastures and stables. 7700.1 'DEFINITIONS. For the purpose of this ordinance certain words and phrases are defined as follows, and certain provisions shall be construed as herein set forth: CORRAL. A fenced area confining a horse. HORSE. Any member of the gorse family, including donkeys and mules. PASTURE. A fenced and managed grazing area with a continuing ground cover of grasses, legumes and other forage plants. STABLE, HORSE. A roofed structure, or portion thereof, designed or used for the housing or feeding of horses. 7700.2 CONFORMITY REQUIRED. It shall be unlawful for any person to keep or maintain or cause to be maintained in the Town of Portola Valley any horse except in conformance with the provisions of this ordinance, Ordinance No. 1967-80, the Zoning Ordinance, and other applicable Town ordinances. The breeding of horses is prohibited except within an area approved by the Animal Regulation Commission. 7700.3 PERMITS REQUIRED. A horse keeping permit shall be required for the maintenance of horses within the Town of Portola Valley. 7700.4 APPLICATION FOR PERMIT. Each application for a new horsekeeping permit or modification of an existing horsekeeping permit shall be made by the parcel owner or lessee or the operator of a boarding or community stable, to the Town Clerk, on a form provided by the Animal Regulation Commission for such purpose. Such application shall be accompanied by an accurate plot plan showing: A. The layout of the existing or proposed stable, corral or pasture, and other structures on the same parcel. B. Drawings of proposed building and fence construction. The latter must not violate trail easements and rights -of -way. • • • • • . Topographic information adequate to establish the average percent of grade of the corral area and to indicate the general topography of the entire portion of the parcel devoted to horses. The source of topographic information shall be given on the plot plan. D. Location of sewage disposal system if within the area to be devoted to horses. E. Scale of the drawing. F. Name, address and telephone number of person who prepared the drawings. G. Distance from corral to nearest neighboring house. In addition, such other information as may be required by the Animal • Regulation Commission shall be submitted with the application. Transfer of a permit to a new occupant of the premises shall be considered a modification of an existing horsekeeping permit. If a plot plan is available from a previous owner's application, it may be used by the new occupant after being brought up to date with respect to any changes in the stable or fences. In the event a new plot plan must be prepared, because of lack of a previous plan, items C and D above will not be required. 7700.6 RENEWAL OF PERMIT. A horse keeping permit may be renewed upon application by the holder thereof to the Town Clerk, payment of required fees and the finding by the Town Clerk that the applicant is still complying with the previously issued permit. 7700.7 APPEAL OF TOWN CLERK DECISION. In case the Town Clerk denies a permit applied for under the terms of this ordinance, the applicant may appeal said decision to the Animal Regulation Commission, with a further right of appeal to the Town Council. Appeals shall be made on forms prescribed by the Town Council and shall be filed at least two weeks prior to the meeting at which they are to be considered. 7700.8 ANNUAL PERMIT AND. INSPECTION FEE. The annual fee for a permit to maintain horses for private use and the annual fee for boarding and community stables for each stall and corral shall be established by the Town Council by resolution. All fees collected pursuant to this section shall be used by the Town to enforce this ordinance and to provide and maintain horse trails in the Town. Nothing in this ordinance or in any resolution adopted pursuant hereto shall be construed as requiring the payment of a fee for the stabling or main— tenance of horses actually used in commercial farming operations on the parcel of land upon which the stable is located, provided said parcel consists of five or more acres of land. 7700.10 LOCATION AND AREA REQUIREMENTS. Horses may be maintained only in zoning districts where the keeping of horses is listed as a permitted or conditionally permitted use subject to the following general requirements: e. • e. A. The minimum parcel area upon which any horse may be kept shall be one acre, and two horses may be kept on such a parcel. One 'additional horse may be kept on each one-half (1/2) acre in addition to the one acre minimum. B. A corral shall be maintained on each parcel for which a horse keeping permit is issued. C. For each horse there shall be 4571737,77-61-400 squ.are_feetl of corra 1 area with an'average-ground slope_o not-more-than=seven j percent_(? )j D. The maximum size for a single corral shall be 2500 square feet. The total area of corrals on one parcel shall not exceed 4000 square feet unless the parcel is larger than three acres, in which event corral area may be increased in the ratio of 1000 square feet oer each acre in the parcel in excess of three (3) acres. The total area of corrals for a boarding or community stable shall be established by conditional use permit pursuant to the zoning ordinance. E. The minimum distance from a corral to a neighboring property line or street right-of-way shall be twenty (20) feet. F. The minimum distance of a stable from a neighboring house existing at the time of issuance of the original permit shall be one hundred (100) feet. G. The minimum distance of a stable from any neighboring property line shall be forty (40) feet. 11. The minimum distance of the stable from the residence on the same lot shall be forty (40) feet. I. The minimum distance of a stable from any street right-of-way or front property line shall be fifty (50).feet. J. Corrals and/or stable shall not be placed over septic tank drainfields unless approved by the Town Health Officer. K. Horses shall be kept primarily in corrals and stables. They may be kept on pasture when it does not result in excessive compaction of the soil or overgrazing. 7700.11 CONSTRUCTION OF CORRALS AND STABLES AND SMELTERS. A. Construction of stables and shelters shall require a building permit which shall be applied for pursuant to the building code. B. All corrals and pastures shall be enclosed by a fence suffic- iently effective for the intended use. C. All corrals shall have effective drainage facilities as dictated by slope, soil condition and drainage. Runoff shall be handled in such a manner so as not to constitute a nuisance and so it will not increase erosion. • 7700.12 MAINTENANCE. • A. Corrals shall be kept in a clean and sanitary condition. Manure shall be spread to dry, or if gathered for hauling, must be hauled away at least weekly. • B. Stable buildings shall be clean, and shall be treated, as necessary, by appropriate methods of fly and insect control to prevent flies and insects from becoming a nuisance. C. It is hereby declared to be a nuisance and it shall be unlawful to keep any horses on a premises in an unsanitary condition. D. Ilay shall be stored under a shelter and grains .in rodent proof containers. E. Fences and gates must be kept in good repair at all times. Electric fences shall not be used as sole perimeter fences. 7700.15 RIGHT OF WAY FOR INSPECTION. In the case of other stables, corrals or pastures, the right to enter, unless otherwise permitted is limited to: A. An inspection determining whether or not a new horsekeeping permit shall be issued, or B. The annual inspection required for.the renewal of a horse - keeping permit, or C. An inspection requested by the Animal Regulation Commission as a result of a written complaint that the Stable Ordinance is being violated, or D. A second inspection following the annual inspection, and before the issuance of a citation for failure to comply, if the Stable Inspector has determined, during the course of the annual inspection, that the permit holder is not complying with the Stable Ordinance. 7700.16 EXCEPTIONS. The Animal Regulation Commission shall have the right to modify the strict application of this ordinance where there are extraordinary conditions affecting the property of the applicant. In such cases the applicant shall request his hearing before the Animal Regulation Commission and if after such public hearing the Animal:Regulation Commission finds that by following the strict letter of this ordinance unreasonable restrictions, unnecessary and• extraordinary hardships or damage will be imposed upon the applicant, then any of the provisions or regulations hereof may, upon certification that the conditions of Sec. 9623.6 have been met., be modified, in harmony with the general purpose and objectives hereof to the end that the public health, safety and welfare may be secured. Any party aggrieved by the decision of the Animal Regulation Commission may appeal the decision to the Town Council by filing a written notice of appeal stating the grounds therefor With the Town Clerk within ten (10) days after the decision of the Animal Regulation Commission. The Town Council may approve or reverse the decision of the ,\nima1. Regulation Commission upon the record presented to it, or it may hold a hearing deg novo and decide the matter as if no other hearing had been held. Adjoining property owners shall be notified by mail at least ten (]0) days prior to the-Me(ting at which an exception is to be considered by either the Animal Regulation Commission or the Town Council. • 7700.17 PENALTIES A. A penalty equal to the regular fee and in addition thereto shall be levied when a permit is issued under the following circumstances: 1. After revocation of a previously issued permit to accomplish its reinstatement. 2. After horses have been maintained without a permit. 3. After horses have been maintained in excess of the number authorized. 7700.18 NON -CONFORMING USES. Where permits are now held by persons whose horse keeping facilities will not be in full compliance with the provisions of this'ordinance following the effective date hereof, such person must'bake steps toward achieving full compliance with the provisions hereof within one year of the first permit renewal date of his horse keeping permit issued next following the effective date of this ordinance. 7700.19 SHORT TITLE. This ordinance.may be known and cited as the "Stable Ordinance of the Town of Portoia Valley". The title shall not be construed to mean that stables are required on parcels that otherwise meet horsekeeping standards. The R-1 District is intended to accommodate low density projects comprised of quality single-family residences developed in an urban environment with available public services and infrastructure. The R-1 District is not however, intended for hillside development. Section 17.23.020 permitted Uses. Uses permitted in this district shall include those uses listed below when developed in compliance with the purpose and intent of this chapter. Each use shall be evaluated in terms of its design characteristics and specific site location pursuant to the provisions of Chapter 17.82, Design Review. A. Single-family detached dwelling units; one dwelling unit per lot. B. Accessory uses and structures pursuant to Section 17.23.040. C. Small family day care and residential care facilities pursuant to Chapter 17.16. D. Public utility distribution and transmission facilities excluding private radio, television, and paging antenna and towers. E. Government buildings and service facilities. F. Public parks, playgrounds, community centers, recreation buildings, elementary, junior high and high schools. G. Manufactured houses in compliance with the provisions of Section 17.14. r, y t1 • • Section 17.23.030 Uses Subject to A Conditional Use Permit. It is --recognized that certain uses while similar in characteristics to Permitted Uses in Section 17.23.020 may have the potential to impact surrounding properties and therefore require additional approval and consideration. Uses permitted subject to approval of a use permit, pursuant to Chapter 17.74, in the R-1 District shall be as follows: A. Keeping of farm animals such a orses cows, pigs, sheep or goats, birds, poultry (not inclu g roosters), rabbits and similar domesticated animals subject to the following minimum standards: 1. Animals may only be permitted as an accessory use in conjunction with a permitted dwelling. 2. The minimum;1ot_ a whiclimay=be-considered for keeping of_such animals_is_one-half`(1/2) cre=(A21,780--square, (feet)-. 3. The maximum aggregate number of animals which may be maintained on a one-half (1/2) acre lot shall be: a. Two (2) equine, bovine, swine, sheep, or goats. b. Twelve (12) birds or poultry (not including roosters), rabbits, or similar small domesticated animals. For each additional one-half (1/2) acre, an additional aggregate of all the above listed animals may be maintained. 4,. All birds or poultry must be contained within an enclosure. 6. Large family day care homes in compliance with the provisions of Chapter 17.16. s_ s- . C. Second units in compliance with the provisions of Chapter 17.17. D. Keeping of exotic animals or birds, or more than three (3) dogs and/or cats, on the same lot as a permitted dwelling for pets only and not for commercial purposes. The Planning Commission shall impose adequate limitations to assure that the residential character of the property and neighborhood are maintained. E. Churches, located on a site a minimum of one (1) acre in size and located on streets designated as arterial streets or collector streets. Parochial schools shall require a separate use permit. Churches shall not otherwise be permitted in the R-1 District. F. Horticultural uses, including growing of fruit, nuts, vegetables, and ornamental plants for commercial purposes. G. Parochial or private preschools, elementary, junior high or high schools. H. Other uses that the Planning Commission finds by resolution to be in accord with the purpose of this Chapter and having characteristics similar to those listed in this Section. A list of these uses shall be maintained in the Planning Division for future reference. Section 17.23.040 Accessory Uses and Structures. The following accessory buildings and uses may be located on the same lot with a permitted dwelling, provided that they are found to be compatible with the residential character of the neighborhood and that any buildings or structures be harmonious with the architectural style of the main building. With the exception of open trellis -type patio covers and detached garages, all accessory buildings and/or structures shall be located only in rear one half of the lot. A. Uses: 1. Home occupations; subject to the completion and approval of an application for a home occupation issued by the Planning Division and compliance with the provisions of Chapter 17.15. 2. Non-commercial hobbies. 3. Keeping of household pets (when no commercial activity is involved). For the purpose of this ordinance, a household pet is an animal clearly considered customary to a residential use, e.g. dogs, cats, birds, and fish. Said pets shall be limited to a maximum of three (3) weaned dogs and/or cats. Birds shall be permitted only inside the main dwelling unit, unless a use permit is obtained. • • B. Structures: 1. Group I Sheds, children's playhouses, and similar enclosures of less than 120 square feet provided they do not exceed a maximum height of six and one-half feet (6 1/2'). Such structures may be located on property line provided the design of the structure complies with the City's Fire and Building Code. 2. Group II. Unenclosed structures such as carports, gazebos, and patio covers (both trellis -type and solid) as well as detached enclosed structures not included in Group I, but containing less than 600 square feet of floor area such as sheds, children's playhouses and workshops, provided they do not exceed a maximum height of fifteen feet (15') and are located no closer than five feet (5') to a side property line, or ten feet (10') to a rear property line. Attached, enclosed structures in this category shall be located no closer to a property line than the setback prescribed for the main dwelling unit. 3. Group III. Garages, enclosed patios, workshops, cabanas, and similar enclosed structures containing 600 or more square feet of floor area provided they are located no closer to a property line than the setback prescribed for the main dwelling unit, except that straight in entry garages may be required a greater setback. 4. Group IV. a. Antennas; subject to compliance with the provisions of Chapter 17.67. b. .Swimming pools, Jacuzzis, .spas, and associated equipment; provided they may be permitted only within rear yard areas or the enclosed portion of a side yard. Pool equipment located within ten feet (10') of a property line shall be separated from the adjacent property by a minimum six-foot (6') high masonry wall. Otherwise there shall be no required setback provided the design and installation complies with the City's Building Codes. c. Open trellis -type patio covers may be located in a front yard area but shall not encroach more than five feet (5') into the required setback. Section 17.23.050 yots, g Record. Existing lots of record as of the date of adoption of this ordinance (August 26, 1986), and lots in existing approved tentative maps which are recorded within two (2) years of initial approval of the map, which do not comply with the required minimum lot standards contained herein may be used as a building site for a permitted use pursuant to the provisions of this Chapter. However, where adjacent parcels of land are under the same ownership, these parcels shall be combined to conform to the minimum required lot area, if any of the parcels are less than sixty-five (65) percent of the required minimum lot area. Section 17.23.060 Lot Area. The minimum lot area for any new lot created in the R-1 District shall be as follows: A. Interior lots: 6,000 square feet, however, the average lot size for any subdivision shall be a minimum of 7,260 square feet. B. Corner lots: 7,700 square feet. C. Exception: Whenever a lot is adjacent to a lower density zoning district or to an existing developed parcel with a larger lot size than required in the R-1 District, a transition or buffer shall be provided between the adjacent property and a new subdivision, which may include, but is not limited to, lot size, lot width, lot depth, increased setbacks, or slopes. The purpose of this transition shall be to minimize the disparity between different densities of development. The adequacy of this transition shall be subject to the review and approval of the Planning Commission and City Council on a case -by -case basis. D. In the implementation of Paragraph C, any change in a lot size which would leave the lot at a size at least seventy- five percent (75%) the size of the largest adjacent developed lot will be presumed appropriate, absent unusual circumstances. Any application to change a lot to a size lower than said seventy-five percent (75%) standard will be permitted only upon a showing of good cause. /t is the intent of this paragraph to set a standard but also to allow flexibility. Section 17.23.070 Street Frontage Width. The minimum street frontage width for any new lot created in the R-1 District shall be as follows: A. Standard Interior lots: B. Corner lots: C. Knuckle or Cul-de-sac lots: Sixty feet (60') Sixty five feet (65') Forty feet (40') ; provided the average width is sixty feet (60'). • D. Flag lots: Twenty five feet (25'); provided the average width of the principle portion of the lot is sixty feet (60') Section 17.23.080 Setbacks. The following minimum setbacks shall apply to all new construction within the R-1 District: A. Front yard: 1. Main dwelling.unit: Twenty feet (20'). 2. Garage: Twenty feet (20'); provided, however, that turn -in entry garages may encroach to within fifteen feet (15') of the front property line. 3. On lots with an overall slope of twenty-five percent (25%) or more from front to back of the lot, the setback for the main dwelling unit and for front -entry garages may be reduced to ten feet (10') provided two (2) paved, open parking spaces are also provided outside the public right-of-way, subject to the approval of the Planning Commission. Alternative paving materials such as turf block may be approved by the Planning Commission. Automatic garage door openers shall be required for front -entry garages with less than twenty -foot (20') setback. B. Side yard: 1. Main dwelling unit: Adjacent to interior lot lines there shall be a minimum side yard of five feet (5'). Adjacent to a public right-of-way the minimum side yard shall be fifteen feet (15') . Exception: On existing, legally non -conforming lots which are substandard .in width, a minimum setback of ten percent (10%) of the lot width may be allowed adjacent to interior lot lines with a minimum of three feet (3'), and a minimum of twenty percent (204) of the lot width may be allowed adjacent to a public right-of-way. 2. Accessory structures: In the rear one-half of the lot, as specified in Section 17.23.040, otherwise the same as required for the main dwelling unit with the exception that where straight -in entry garage gains access via the side yard, the setback shall be twenty feet (20'). C. Rear yard: 1. Main dwelling unit: Twenty feet (20'). 2. Accessory structures: As specified in Section 17.23.040, with the exception that where straight -in entry garage gains access via the rear yard, the setback shall be twenty feet (20'). 3. Finished slopes in excess of five percent (5%) shall not be permitted within fifteen feet (15')- of ,,the main dwelling unit. 4. In lieu of fifteen -foot (15') setback not exceeding five percent (5%) as required above, balconies or decks equal to twenty percent (20%) of the dwelling area and with a minimum dimension of six feet (6') may be permitted subject to the approval of the Planning Commission. Section 17.23.090 Lot Coverage. The maximum lot coverage in the R-1 District shall be fifty percent (50%). Section 17.23.100 Building Height. Except as otherwise provided for accessory structures, the maximum building height in the R-1 District shall be thirty feet (30'). In the case of split levels, no continuous vertical section through the building shall measure more than thirty-two feet (32'). Planning Commission may approve greater heights for subterranean garages. Section 17.23.110 Minimum Dwelling Unit ,Size. The minimum dwelling unit size within the R-1 District shall be 1,000 square feet exclusive of garage area. However, for new tract construction, at least twenty percent (20%) of the total number of units within any phase shall exceed the minimum square footage by fifteen percent (15%). Section 17.23.120 Parking. The provisions of Chapter 17.66 shall be used to determine the required parking for development in the R-1 District. Sect on 17.23.130 Signs. The provisions of Chapter 17.94 shall be used to determine permitted signs in the R-1 District. Section 17.23.140 Design Review. No building permits shall be issued for the construction of any building or structure in the R-1 District until the applicant has obtained Design Review approval pursuant to the provisions of Chapter 17.82, Design Review. The following exemptions shall apply: A. Additions or alterations to an existing structure which do not change the use from one permitted in the District and which does not increase the floor area by more than fifty percent (50%). B. Group I, II, and IV accessory structures. C. Fences and walls. Although, the above exempted structures do not need formal Design Review approval, their proposed location and design must be approved by the Director of Community Development or his designee prior to construction or installation. Section 17.23.150 Design Standards. Chapter 17.14 contains residential development standards applicable to all projects within the City regardless of zoning district. It is therefore important that the provisions of Chapter 17.14 be considered with the regulations contained herein for the R-1 District.
