ORDINANCE NO. 232 AN ORDINANCE OF THE CITY OF ROLLING HILLS REQUIRING A BALANCED CUT AND FILL SOILS RATIO FOR DEVELOPMENT PROJECTS AND READOPTING AND ADDING CERTAIN AMENDMENTS TO THE COUNTY OF LOS ANGELES BUILDING CODE RELATING TO GRADING STANDARDS, AND AMENDING THE ROLLING HILLS MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Purpose. The purpose of this Ordinance is to amend the City's adopted version of the County of Los Angeles 1990 Building Code to. require a balanced cut and fill soils ratio for development projects. The Ordinance also rewords the existing provisions regarding maximum cut and fill slopes and updates certain references in the Municipal Code to revised section numbers and paragraph lettering contained in the County of Los Angeles 1990 Building Code. Section 2. Findings of Local Conditions. Pursuant to California Health and Safety Code Sections 17958.5, 17958.7 and 18941.5(c), the City Council of the City of Rolling Hills hereby finds that the modifications and changes set forth in this Ordinance to certain grading standards set forth in the County of Los Angeles Building Code are reasonably necessary because of local climatic, geological and topographic conditions. The City of Rolling Hills contains areas of steephillside terrain, portions of which are unstable due to active landslides. These conditions make it reasonably necessary to impose stricter grading standards than are presently contained in the County of Los Angeles Building Code, specifically with regard to the regulation of import and export of soil and the maximum height of cut and fill slopes. Section 3. Section 15.04.110 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.110. Section 7015(al amended. Paragraph (a) of Section 7015 of the County of Los Angeles Building Code, entitled "MAXIMUM SLOPE," is amended to read: "Section 7015(a). MAXIMUM SLOPE. Cuts shall not be steeper in slope than two horizontal to one verti- cal, or exceed a vertical height of thirty (30') feet, unless the owner receives a variance for a steeper or higher vertical height slope from the Planning Commission of the City of Rolling Hills, pursuant to the provisions of Title 17 of the Municipal Code of the City. In applying for a variance to the provisions of this paragraph, the owner shall submit soil test data and engineering calculations and shall provide in writing any specific safety and/or stability problems that presently exist on the property, or may exist if the requested variance is granted and the proposed grading plans are approved." ,Section 4. Section 15.04.120 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.120. ,Section 7015(c) added. Section 7015 of the County of Los Angeles Building Code, entitled "Excavations" is hereby amended to add paragraph (c) to read: "Section 7015(c). DRIVEWAYS. Driveways which provide access from any lot or parcel of land to any of the private roads in the City of Rolling Hills which are constructed and maintained by the Rolling Hills Community Association shall be so constructed that the first twenty feet of said driveway, measured from the edge of the paved portion of said private road, shall not be steeper in grade than seven (7%) percent." Section 5. Section 15.04.130 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.130. Section 7015(d). Section 7015 of the County of Los Angeles Building Code, entitled "Excavations" is hereby amended to add paragraph (d) to read: "Section 7015(d) BALANCED CUT AND FILL RATIO. 1. No export or import of soil shall be permitted from or to any lot in the City. 2. No grading plan for which a permit is required shall be approved unless the amount of soil to be cut from the site equals the amount of soil to be filled on the site. 3. The City Manager may grant an exception to the requirements of parts 1 and 2 of this paragraph (d) to allow for the import or export of soil not to exceed 500 cubic yards if he or she finds, based upon written reports and other information submitted, that all of the following conditions are present: (a) construction of a structure on the lot or parcel has commenced, (b) that the need to import or export the soil could not have been foreseen prior to commencement of construction, and (c) that either the structure cannot be completed without the requested import of export of soil or that an emergency condition exists due to the threat of land subsidence or other imminent danger." Section 6. Section 15.04.140 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read: 15.04.140. ,Section 7016(c) amended. Paragraph (c) of Section 7016 of the County of Los Angeles Building Code, entitled "Fill Slope," is hereby amended to read: "Section 7016(c). FILL SLOPE. Fill slopes shall not exceed a steepness of two horizontal to one vertical, or exceed a vertical height of thirty (30') feet, unless the owner receives a variance for a steeper or higher vertical height fill slope from the Planning Commission of the City of Rolling Hills., pur- suant to the provisions of Title 17 of the Municipal Code of the City. In applying for a variance to the provisions of this paragraph, the owner shall submit soil test data and engineering calculations and shall provide in writing any specific safety and/or stability problems on the property that presently exist or may exist if the requested variance is granted and the pro- posed grading plans are approved." Section 7. Section 15.04.141 is hereby added to Title 15 of the Rolling Hills Municipal Code to read as follows: 15.04.141. Section 7016(i) added. Section 7016 of the County of Los Angeles Building Code, entitled "Fills," is amended to add a new paragraph (i) to read: "Section 7016(i). BALANCED CUT AND FILL RATIO. 1. Section 6. Section 15.04.140 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read: 15.04.140. Section 7016(c) amended. Paragraph (c) of Section 7016 of the County of Los Angeles Building Code, entitled "Fill Slope," is hereby amended to read: "Section 7016(c). FILL SLOPE. Fill slopes shall not exceed a steepness of two horizontal to one vertical, or exceed a vertical height of thirty (30') feet, unless the owner receives a variance for a steeper or higher vertical height fill slope from the Planning Commission of the City of Rolling Hills, pur- suant to the provisions of Title 17 of the Municipal Code of the City. In applying for a variance to the provisions of this paragraph, the owner shall submit soil test data and engineering calculations and shall provide in writing any specific safety and/or stability problems on the property that presently exist or may exist if the requested variance is granted and the pro- posed grading plans are approved." Section 7. Section 15.04.141 is hereby added to Title 15 of the Rolling Hills Municipal Code to read as follows: 15.04.141. Section 7016(i) added. Section 7016 of the County of Los Angeles Building Code, entitled "Fills," is amended to add a new paragraph (i) to read: "Section 7016(i). BALANCED CUT AND FILL RATIO. 1. No export or import of soil shall be permitted from or to any lot in the City. 2. No grading plan for which a permit is required shall be approved unless the amount of soil to be cut from the site equals the amount of soil to be filled on the site. 3. The City Manager may grant an exception to the requirements of parts 1 and 2 of this paragraph (d) to allow for the import or export of soil not to exceed 500 cubic yards if he or she finds, based upon written reports and other information submitted, that all of the following conditions are present: (a) construction of a structure on the lot or parcel has commenced, (b) that the need to import or export the soil could not have been foreseen prior to commencement of construction, and (c) that either the structure cannot be completed without the requested import of export of soil or that an emergency condition exists due to the threat of land subsidence or other imminent danger." Section 8. The City Clerk shall file a copy of this Ordinance with the California Department of Housing and Community Development, as required by California Health and Safety Code Section 17958.7. CASH FLOW: When Dan Walker sets out to raise campaign cash, he doesn't spare expense. The Torrance city councilman shelled out nearly 89.000 of his campaign money for a fund -raising . dinner at the Bistro restaurant in Beverly Hills. In a finance statement covering the first six months of the year. he also reports paying 8518 in campaign funds for a stay at Seattle's Four Seasons I lotel. On the Seattle trip, he says, he visited a longtime contributor who was staying in that city • temporarily —and netted a 82.000 contribution. Said Walker: "I'll spend 8500 to get 82,000 every day." He says dinner at Bistro, although expensive. is extremely effective at getting supporters to open • their checkbooks. The diners, he says, paid 8500 per plate. Principal Planner Ungar reviewed the concerns raised by Councilmembers at the first reading of proposed Ordinance No. 232 at the July 22, 1991 City Council meeting. Staff conducted a survey of the other Peninsula cities to determine their policies and the results of the survey were presented by Ms. Ungar, as well as the pros and cons of a balanced cut and fill ordinance. The requirement for City Manager approval of the import or export of soil not to exceed 500 cubic yards was discussed_ at length. City Manager Nealis stated that contractors will be notified of the existence and terms of the new ordinance when new projects begin and indicated that any contractor who does not notify him of unforeseen circumstances requiring additional grading would be in violation of the Municipal Code and would be subject to a fine as well as loss of building permit approval. Mayor Pernell directed Staff to investigate and come up with an inspection process. Councilwoman Leeuwenburgh said she was interested in the requirement of Palos Verdes Estates for Planning Commission approval of grading over 250 cubic yards and suggested that the City of Rolling Hills consider adopting this measurement rather than 500 cubic yards. Asked how many field changes occur on projects in the City, the City Manager estimated two or three per year. 2 Rolling Hills City Council Meeting - 8/12/91 Mayor Pro Tem Swanson noted her concern regarding the 30 foot maximum vertical slope height specified in the ordinance. She also said it is difficult after grading has been done to remember what the property originally looked like, and asked how the City can determine if the work has been done according to the approved plans. Principal Planner Ungar suggested the City might photograph the site before and after grading. She also advised that the County Building Inspector insures that the work has been done according to the plans. Mr. Roy Campbell, 3 Running Brand, explained that in most cities after grading is accomplished the natural topography map which was submitted with the grading plan is compared by a surveyor with the as -graded topography map. Before the final building inspection, the surveyor must certify that the as -graded topography is substantially as shown on the plan. Tom Boyd, Rolling Hills Community Association Board member, said he felt slope requirements should be discussed further, as well as the possibility of bringing in soil with better compactibility when unstable soil is removed. He said that many cities require that a soils engineer be present to take test borings to determine the quality of the soil, and asked whether Staff had addressed the R -rating of soil, as a measure of its compactibility. Drainage onto adjoining properties was another potential problem when cut and fill operations are conducted. Councilman Heinsheimer said he felt the intention was not to allow any import or export of soil in the City without review, and suggested that the wording of Section 7015(d) be modified so the first sentence of Paragraph 1 stands alone and the second sentence becomes Paragraph 2, with the following paragraph renumbered as Paragraph 3. Other minor wording changes were suggested. City Attorney Jenkins clarified that this ordinance states that if an application is received that requires import or export of soil, it would have to go to the Planning Commission for a variance; i.e., no plan can be approved unless it shows a balanced cut and fill. Roy Campbell advised that in construction operations there is always material going out and coming in, of necessity (e.g., when large boulders are removed and fill comes in, and other materials such as concrete, sand, gravel, topsoil which are necessary to complete the project). He commented that the City of Palos Verdes Estates is now allowing large amounts of export, which permits construction of a house into the cut of a project. He recommended that the City of Rolling Hills attempt to keep their projects somewhere between all cut and balanced cut and fill. 3 Rolling Hills City Council Meeting - 8/12/91 City Manager Nealis agreed that with larger projects export of soil could allow the construction to blend into the topography but noted that the City's direction has been retention of the natural topography through minimized project size, with encouragement of balanced cut and fill. Mayor Pernell enumerated three issues to be addressed: (1) the necessity for certification of as -graded plans by a surveyor; (2) potential instability of the fill; and (3) whether a post - grading survey needs to be included in the ordinance. Councilman Heinsheimer contended that the purpose of the ordinance was not to change the current practices but to codify them. He suggested the ordinance should be adopted and the other matters could be handled by administrative action or by Planning Commission review and subsequent modifications if desired. BACKGROUND Staff was directed to prepare an Ordinance requiring balanced cut and fill for residential construction within the City following at a joint meeting of the City Council and the Planning Commission. There was also instruction to include emergency procedures for unintended or unforeseeable unbalanced cut and fill situations. Questions arose at the regular City Council meeting held July 22, 1991, when the first reading of Ordinance No. 232 occurred. These questions included: 1. Whether neighboring cities prohibit a dimensioned vertical cut or fill. 2. Whether field changes can be made once the project has begun on the site itself. 3. The pros and cons of the proposed Ordinance. 4. The purpose of amending Section 7016(c).FILL SLOPE. Staff further surveyed neighboring cities concerning their grading policies and found the following: 1. Although our code presently prohibits cuts that exceed a vertical height of 30 feet, none of the cities or the County make any reference to the prohibition of cuts that exceed a vertical height of any amount. All of these cities require, per local policy, that all grading be as balanced as possible. PROPOSED ORDINANCE NO. 232 PAGE 3 Responses to Council queries 3. and 4. above: 3. The Assistant City Attorney remarked that he amended Section 7016(c) to make it clearer and only reworded the paragraph. Attached is the proposed Ordinance and the Negative Declaration to amend Title 15 (Building Standards and Uniform Codes) of the Rolling Hills Municipal Code to require a balanced cut and fill grading requirement which was recommended for adoption by the Planning Commission at their regular meeting on June 25, 1991. PROPOSED ORDINANCE NO. 232 PAGE 2 2. Field changes can only be made per the Resolutions relating to the specific cases that have gone before the Planning Commission or City Council for each City. Administrative decisions can be made only on cases that do not exceed the maximum cubic yards. Further results of this survey show: Palos Verdes Estates Maximum slope of 2 horizontal to 1 vertical (same as Rolling Hills). Over 250 cubic yards requires Planning Commission approval (grading ordinance). Rancho Palos Verdes Rolling Hills Estates Maximum slope of 35% or more requires Planning Commission approval. Balanced cut & fill of 1,000 cubic yards or more must be reviewed by the Planning Commission (grading ordinance). They combine the cut and the fill for the total cubic yards to determine whether the Planning Commission needs to review as opposed to a 1:1 ratio. They are currently updating their Ordinance and considering lowering to 500 to 800 cubic yards for balanced cut and fill. No specific figure for maximum slope. Major grading can be restricted by the Administration under the neighborhood compatibility section of the municipal code explaining that grading is too massive for the surrounding area. Ten cubic yards or more (cumulative or by itself) must have City Council approval. Anything below that can be approved by Administrative Staff. Purpose. The purpose of this Ordinance is to amend the City's adopted version of the County of Los Angeles 1990 Building Code to require a balanced cut and fill soils ratio for development projects. The Ordinance also rewords the existing provisions regarding maximum cut and fill slopes and updates certain references in the Municipal Code to revised section numbers and paragraph lettering contained in the County of Los Angeles•1990 Building Code. Section 2. Findings of Local Conditions. Pursuant to California Health and Safety Code Sections 17958.5, 17958.7 and 18941.5(c), the City Council of the City of Rolling Hills hereby finds that the modifications and changes set forth in this Ordinance to certain grading standards set forth in the County of Los Angeles Building Code are reasonably necessary because of local climatic, geological and topographic conditions. The City of Rolling Hills contains areas of steep hillside terrain, portions of which are unstable due to active landslides. These conditions make it reasonably necessary to impose stricter grading standards than are presently contained in the County of Los Angeles Building Code, specifically with regard to the regulation of import and export of soil and the maximum height of cut and fill slopes. Section 3. Section 15.04.110 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.110. Section 7015(a) amended. Paragraph (a) of Section 7015 of the County of Los Angeles Building Code, entitled "MAXIMUM SLOPE," is amended to read: "Section 7015(a). MAXIMUM SLOPE. Cuts shall not be steeper in slope than two horizontal to one verti- cal, or exceed a vertical height of thirty (30') feet, unless the owner receives a variance for a steeper or higher vertical height slope from the Planning Commission of the City of Rolling Hills, pursuant to the provisions of Title 17 of the Municipal Code of the City. In applying for a variance to the provisions of this paragraph, the owner shall submit soil test data and engineering calculations and shall provide in writing any specific safety and/or stability problems that presently exist on the property, or may exist if the requested variance is granted and the proposed grading plans are approved." Section 4. . Section 15.04.120 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.120. Section 7015(c) added. Section 7015 of the County of Los Angeles Building Code, entitled "Excavations" is hereby amended to add paragraph (c) to read: "Section 7015(c). DRIVEWAYS. Driveways which provide access from any lot or parcel of land to any of the private roads in the City of Rolling Hills which are constructed and maintained by the Rolling Hills Community Association shall be so constructed that the first twenty feet of said driveway, measured from the edge of the paved portion of said private road, shall not be steeper in grade than seven (7%) percent." Section 5. Section 15.04.130 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.130. Section 7015(d). Section 7015 of the County of Los Angeles Building Code, entitled "Excavations" is hereby amended to add paragraph (d) to read: "Section 7015(d) BALANCED CUT AND FILL RATIO. 1. No export or import of soil shall be permitted from or to any lot in the City. No grading plan for which a permit is required shall be approved unless the amount of soil to be cut from the site equals the amount of soil to be filled on the site. 2. The City Manager may grant an exception to the requirements of part 1 of this paragraph (d) to allow for the import or export of soil not to exceed 500 cubic yards if he or she finds, based upon written reports and other information submitted, that all of the following conditions are present: (a) construction of a structure on the lot or parcel has commenced, (b) that the need to import or export the soil could not have been foreseen prior to commencement of construction, and (c) that either the structure cannot be completed without the requested import of export of soil or than an emergency condition exists due to the threat of land subsidence or other imminent danger." Section 6. Section 15.04.140 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read: 15.04.140. Section 7016(c) amended. Paragraph (c) of Section 7016 of the County of Los Angeles Building Code, entitled "Fill Slope," is hereby amended to read: "Section 7016(c). FILL SLOPE. Fill slopes shall not exceed a steepness of two horizontal to one vertical, or exceed a vertical height of thirty (30') feet, unless the owner receives a variance for a steeper or higher vertical height fill slope from the Planning Commission of the City of Rolling Hills, pur- suant to the provisions of Title 17 of the Municipal Code of the City. In applying for a variance to the provisions of this paragraph, the owner shall submit soil test data and engineering calculations and shall provide in writing any specific safety and/or stability problems on the property that presently exist or may exist if the requested variance is granted and the pro- posed grading plans are approved." Section 7. Section 15.04.141 is hereby added to Title 15 of the Rolling Hills Municipal Code to read as follows: 15.04.141. Section 7016(i) added. Section 7016 of the County of Los Angeles Building Code, entitled "Fills," is amended to add a new paragraph (i) to read: "Section 7016(i). BALANCED CUT AND FILL RATIO. 1. The following analysis is a description of the findings contained in the Environmental Information and Checklist Form which preceded this page. A detailed discussion of all potential environmental impacts checked "Yes" or "Maybe" is provided, along with appropriate mitigation measures. ENVIRONMENTAL IMPACTS The City of Rolling Hills is a residential community with single family dwellings on estate -size lots. However, geologic hazards have greatly affected properties within Rolling Hills and have forced the City to examine development policies within the community. As a result, a Site Plan Review procedure was incorporated into the Zoning Code in November, 1988 whereby no building or structure and no expansion, addition, alteration or repair to existing buildings or structures which involve changes to grading or increasing the size of a building by more than 25% in any 36 month period in the RAS (Residential Agriculture -Suburban) zone must first receive site plan review approval. The only other zone in the City is the C -L (Commercial -Limited) zone where not more than 50% of the lot or parcel may be occupied by structures. Currently, the City of Rolling Hills and the Community Association are housed in offices at the City Administration Building in the C -L zone. Item 22. Earth. a -d. Although approval of the subject ordinance will not result in unstable earth conditions or in changes in geologic substructures, it should be noted that portions of the City exhibit unstable earth PAGE 2 conditions, including active landslides and soil creep. The Land Use Element of the General Plan establishes a Landslide Hazard Overlay to carefully regulate development in unstable areas. Grading, excessive irrigation, and/or increased septic tank discharge in unstable areas may trigger additional slope failure. Because the City is located in seismically active southern California, additional development will be exposed to potential groundshaking in the event of an earthquake. The Palos Verdes fault, considered potentially active, is located approximately one mile northeast of the City. Although approval of the subject ordinance will not result in disruptions, displacements, compaction, or overcrowding of the soil, during future construction these will occur in order to prepare sites for construction. The displacement and recompaction of the soil will be required to conform with local ordinances and engineering practices requiring balanced cut and fill and should not cause a significant environmental impact. e -g. Also, during future construction, there will be removal of natural vegetative cover, potentially causing an increase in soil erosion by wind action or storm runoff. This reduction of vegetative cover and the increased runoff associated with development may cause a slight increase in the soil deposition, siltation, or erosion in or near the ocean. As additional development is limited on the large estate size lots permitted in the City, related erosion impacts will be less than significant. Item 23. Air a -c. The proposed ordinance echoes the Housing Element of the General Plan which provides for a total net increase in development of 40 single-family dwelling units. While increased development will generate slight increases in vehicle trips during and after construction and, objectionable odors during construction, the resultant impact on air quality will be less than significant. Item 24. Water a. Future development of 40 residential units on one acre minimum parcels will not alter fresh or marine water currents. b. The proposed ordinance will not alter drainage patterns, but, future development may increase surface runoff and reduce water absorption by the placement of structures, the introduction of impervious surface materials and irrigation systems. However, due to the nominal increase in development possible and permitted by the General Plan, the impacts are not expected to be substantial. c. No major floodplains exist in the City. Flood waters generally flow through the canyon areas. The General Plan does not permit PAGE 3 development in the canyons, and so changes in the course or flow of floodwaters is. not anticipated. d. No water bodies are located in the City. Future development is not expected to result in change in the amount of any water bodies located in the vicinity. e. The majority of Rolling Hills residences are on septic tank systems. As septic tank leach field effluent percolate into the watershed, some discharge into surface waters downstream may occur. The impact generated from an increase of up to 40 additional dwelling units, however, will be less than significant. i. No major floodplains exist in the City, and development is not permitted in the canyon areas most likely to be affected by flooding. No open bodies of water occur within the City, thus no seiche hazard exists. The subdivision is located high enough and far enough away from the ocean that tsunami hazards do not exist. Item 25. Plant Life a -d. Additional development within the City will reduce the amount of native vegetation which will be replaced, in some instances, by non-native species. Due to the limited growth proposed, this impact will be less than significant. In addition, the General Plan and Zoning Code set forth policies which encourage the retention and use of native drought tolerant vegetation• in landscaping. No known rare and endangered species of plants exist in the City. Item 26. Animal Life a. As further development occurs in Rolling Hills, the natural habitat of the area will be slightly reduced. However, this impact is expected to be less than significant. b. Large lot, estate density development in the City is controlled by Site Plan Review which provides the opportunity to retain substantial amounts of existing habitat. c. Potential development can be expected to introduce additional household pets to the area (dogs, cats, birds, etc.), including horses and farm animals. Residential development is not expected to result in a barrier to species migration. d. Some minor disruption of existing wildlife could occur when future development occurs. Large lot, estate density development proposed provides the opportunity to retain substantial amounts of existing habitat. PAGE 4 Item 27. Noise a. The future development of up to 40 residences will not result in a significant increase in ambient noise levels. Construction noise may, however, reach high levels in the short term. Item 28. Light and Glare Residential building materials are carefully regulated by the Zoning Ordinance and the Community Association. Buildings are limited to one story in height. Light and glare impacts are therefore expected to be less than significant. Item 41. Cultural Resources a -d. Future development under the proposed ordinance will not disrupt any known prehistoric or historic archaeological site, or property of historic or cultural significance. City Manager Nealis reported that the proposed ordinance was recommended for adoption by the Planning Commission at their meeting of June 25, 1991. Current laws in the Municipal Code require balanced cut and fill only when construction of a tennis court is authorized. Mayor Pernell declared the public hearing open. There being nopublic testimony offered or taken, Mayor Pernell declared the public hearing continued to the next regular meeting of August 12, 1991. Councilwoman Murdock moved introduction of Ordinance No. 232, and Mayor Pro Tem Swanson seconded the motion. City Attorney Jenkins distributed revised copies of Ordinance No. 232 which had a few words deleted, noting that no substantive changes had been made. Mayor Pro Tem Swanson questioned the necessity for the 30 foot maximum slope height allowed in Section 7015(a). City Manager Nealis offered to survey the surrounding communities and report back to the Council on the degree of cut permitted by other cities. Mayor Pro Tem Swanson also questioned the provisions of paragraph 2 under Section 7015(d), suggesting that the import or export of 500 cubic yards of soil may be excessive and that perhaps the City Council rather than the City Manager should grant exceptions to the requirements of part 1 of Section 7015(d). Mayor Pernell asked staff to investigate whether the other Peninsula cities address the issue of field changes in their Codes and at what point a special permit is required. BACKGROUND Following discussion, at the joint City Council/Planning Commission meeting held on February 13, 1991, Staff was directed to prepare an Ordinance requiring balanced cut and fill for residential construction within the City. Further instruction, was that the Ordinance shall contain emergency procedures for unintended or unforeseeable unbalanced cut and fill situations. Section 17.16.012, subsection E, Paragraph 7 of the Rolling Hills Municipal Code requires a balanced cut and fill of soil for tennis courts. Also, there has been a policy for .many years of requiring a balance of cut and fill for residential construction as a part of the Site Plan Review process but a formal Ordinance has never been adopted. Staff surveyed neighboring cities concerning their grading policies and found the following: Rolling Hills Estates 10 cubic yards or more (cumulative or by itself) must have City Council approval. Rancho Palos Verdes 1,000 cubic yards or more must be reviewed by the Planning Commission (grading ordinance). Attached is the proposed Ordinance to amend Title 15 (Building Standards and Uniform Codes) of the Rolling Hills Municipal Code to require a balanced cut and fill grading requirement. Purpose. The purpose of this Ordinance is to amend the City's adopted version of the County of Los Angeles 1990 Building Code to require a balanced cut and fill soils ratio for development projects and to require a grading permit for exploratory excavations and geological testing. The Ordinance also rewords the existing provisions regarding maximum cut and fill slopes and updates certain references in the Municipal Code to revised section numbers and paragraph lettering contained in the County of Los Angeles 1990 Building Code. Section 2. Findings of Local Conditions. Pursuant to California Health and Safety Code Sections 17958.5, 17958.7 and 18941.5(c), the City Council of the City of Rolling Hills hereby finds that the modifications and changes set forth in this Ordinance to certain grading standards set forth in the County of Los Angeles Building Code are reasonably necessary because of local climatic, geological and topographic conditions. The City of Rolling Hills contains areas of steep hillside terrain, portions of which are unstable due to active landslides. These conditions make it reasonably necessary to impose stricter grading standards than are presently contained in the County of Los Angeles Building Code, specifically with regard to the regulation of import and export of soil, the maximum height of cut and fill slopes and the necessity to regulate exploratory excavations. Section 3. Section 15.04.110 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.110. Section 7015(a) amended. Paragraph (a) of Section 7015 of the County of Los Angeles Building Code, entitled "MAXIMUM SLOPE," is amended to read: "Section 7015(a). MAXIMUM SLOPE. Cuts shall not be steeper in slope than two horizontal to one verti- cal, or exceed a vertical height of thirty (30') feet, unless the owner receives a variance for a steeper or higher vertical height slope from the Planning Commission of the City of Rolling Hills, pursuant to the provisions of Title 17 of the Municipal Code of the City. In applying for a variance to the provisions of this paragraph, the owner shall submit soil test data and engineering calculations and shall provide in writing any specific safety and/or stability problems that presently exist on the property, or may exist if the requested variance is granted and the proposed grading plans are approved." Section 4. Section 15.04.120 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.120. Section 7015(c) added. Section 7015 of the County of Los Angeles Building Code, entitled "Excavations" is hereby amended to add paragraph (c) to read: "Section 7015(c). DRIVEWAYS. Driveways which provide access from any lot or parcel of land to any of the private roads in the City of Rolling Hills which are constructed and maintained by the Rolling Hills Community Association shall be so constructed that the first twenty feet of said driveway, measured from the edge of the paved portion of said private road, shall not be steeper in grade than seven (7%) percent." Section 5. Section 15.04.130 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.130. Section 7015(d). Section 7015 of the County of Los Angeles Building Code, entitled "Excavations" is hereby amended to add paragraph (d) to read: "Section 7015(d) BALANCED CUT AND FILL RATIO. 1. No export or import of soil shall be permitted from or to any lot in the City. No grading plan for which a permit is required shall be approved unless the amount of soil to be cut from the site equals the amount of soil to be filled on the site. 2. The City Manager may grant an exception to the requirements of part 1 of this paragraph (d) to allow for the import or export of soil not to exceed 500 cubic yards if he or she finds, based upon written reports and other information submitted, that all of the following conditions are present: (a) construction of a structure on the lot or parcel has commenced, (b) that the need to import or export the soil could not have been foreseen prior to commencement of construction, and (c) that either the structure cannot be completed without the requested import of export of soil or than an emergency condition exists due to the threat of land subsidence or other imminent danger." Section 6. Section 15.04.140 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read: 15.04.140. Section 7016(c) amended. Pursuant to California Health and Safety Code Sections 17958.5, 17958.7 and 18941.5(c), the City Council of the City of Rolling Hills hereby finds that the modifications and changes set forth in this Ordinance to certain grading standards set forth in the County of Los Angeles Building Code are reasonably necessary because of local climatic, geological and topographic conditions. The City of Rolling Hills contains areas of steep hillside terrain, portions of which are unstable due to active landslides. These conditions make it reasonably necessary to impose stricter grading standards than are presently contained in the County of Los Angeles Building Code, specifically with regard to the regulation of import and export of soil, the maximum height of cut and fill slopes and the necessity to regulate exploratory excavations. Section 3. Section 15.04.100 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.100. Section 7003 amended. Section 7003 of, the County of Los Angeles Building Code is amended to read: "Section 7003. An excavation and/or fill or a combination thereof which is less than 3 feet in depth below the existing ground surface, provided that said excavation and/or fill or combination thereof which is less than 3 feet in depth does not cover more than 2,000 square feet of existing ground surface." The purpose of this Ordinance is to amend the City's adopted version of the County of Los Angeles 1990 Building Code to require a balanced cut and fill soils ratio for development projects and to require a grading permit for exploratory excavations and geological testing. The Ordinance also rewords the existing provisions regarding maximum cut and fill slopes and updates certain references in the Municipal Code to revised section numbers and paragraph lettering contained in the County of Los Angeles 1990 Building Code. Section 2. Findings of Local Conditions. Pursuant to California Health and Safety Code Sections 17958.5, 17958.7 and 18941.5(c), the City Council of the City of Rolling Hills hereby finds that the modifications and changes set forth in this Ordinance to certain grading standards set forth in the County of Los Angeles Building Code are reasonably necessary because of local climatic, geological and topographic conditions. The City of Rolling Hills contains areas of steep hillside terrain, portions of which are unstable due to active landslides. These conditions make it reasonably necessary to impose stricter grading standards than are presently contained in the County of Los Angeles Building Code, specifically with regard to the regulation of import and export of soil, the maximum height of cut and fill slopes and the necessity to regulate exploratory excavations. Section 3. Section 15.04.100 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.100. Section 7003 amended. Section 7003 of the County of Los Angeles Building Code is amended to read: "Section 7003. A person shall not perform any grading, including but not limited to 910415 ba 1680496 (1) (OLD 1680501 / (NEW) 1680496 • • 4 (9KgFt oQ Ic4g-G exploratory excavations for geologic testing whether or not the excavation is under the direction of a soils engineer of engineering geologist, without first obtaining a grading permit to do so from the building official. A separate permit shall be obtained for each site." Exception 1 of Section 7003 of the County of Los Angeles Building Code, is amended to read: "1. An excavation and/or fill or a combination thereof which is less than 3 feet in depth below the existing ground surface, provided that said excavation and/or fill or combination thereof which is less than 3 feet in depth does not cover more than 2,000 square feet of existing ground surface." Exception 11 of Section 7003 of the County of Los Angeles Building Code regarding exploratory excavations under the direction of a soils engineer or engineering geologist is hereby deleted. Section 4. Section 15.04.110 of Title 15 of the`, Rolling Hills Municipal Code is hereby amended to readFas follows: 15.04.110. Section 7015(a) amended. Paragraph (a) of Section 7015 of the County of Los Angeles Building Code, entitled "MAXIMUM SLOPE," is amended to read: "Section 7015(a). MAXIMUM SLOPE. Cuts shall not be steeper in slope than two horizontal to one verti- cal, or exceed a vertical height of thirty (30') feet, unless the owner receives a variance for a steeper or higher vertical height slope from the Planning Commission of the City of Rolling Hills, pursuant to the provisions of Title 17 of the Municipal Code of the City. In applying for a variance to the provisions of this paragraph, the owner shall submit soil test data and engineering calculations and shall provide in writing any specific safety and/or stability problems that presently exist on the property, or may exist if the requested variance is granted and the proposed grading plans are approved." 910415 ba 1680496 (1) -2 - (OLD 1680501 / (NEW) 1680496 Section 5. Section 15.04.120 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.120. Section 7015(c) added. Section 7015 of the County of Los Angeles Building Code, entitled "Excavations" is hereby amended to add paragraph (c) to read: "Section 7015(c). DRIVEWAYS. Driveways which provide access from any lot or parcel of land to any of the private roads in the City of Rolling Hills which are constructed and maintained by the Rolling Hills Community Association shall be so constructed that the first twenty feet of said driveway, measured from the edge of the paved portion of said private road, shall not be steeper in grade than seven (7%) percent." Section 6. Section 15.04.130 of Title 15 of the Rolling Hills Municipal Code is hereby amended to read as follows: 15.04.130. Section 7015(d). Section 7015 of the County of Los Angeles Building Code, entitled "Excavations" is hereby amended to add paragraph (d) to read: "Section 7015(d) BALANCED CUT AND FILL RATIO. 1. No export or import of soil shall be permitted from or to any lot in the City. No grading plan for which a permit is required shall be approved unless the amount of soil to be cut from the site equals the amount of soil to be filled on the site. 2. The City Manager may grant an exception to the requirements of part 1 of this paragraph (d) to allow for the import or export of soil not to exceed 500 cubic yards if he or she finds, based upon written reports and other information submitted, that all of the following conditions are present: (a) construction of a structure on the lot or parcel has commenced, (b) that the need to import or export the soil could not have been foreseen prior to commencement of construction, and (c) that either the structure cannot be completed without the requested import of export of soil or that -an emergency condition exists due to the threat of land subsidence or other imminent danger." 910415 ba 1680496 (1) -3 - (OLD 1680501 / (NEW) 1680496 Section 7. Mayor Heinsheimer opened discussion focusing on advantages and disadvantages of'an ordinance regarding the balance of cut and fill for residential construction. Commissioner Lay expressed strong support for an ordinance addressing this issue which is currently handled on a policy basis at the Planning Commission level. Mr. Doug McHattie, South Bay Engineering, indicated that a balance of cut and fill for residential construction is impossible. Further, he emphasized that economic constraints make it too costly to import and export soil. He further indicated that specific geologic conditions can require or cause an unbalanced cut and fill. According to Mr. McHattie, 20% of the lots within the City cannot be developed with a balanced cut and fill. Commissioner Lay expressed concern regarding the relocation of soil and the effect that these trucks have on the roadways within the City. Thoughts were also expressed regarding the 'over -importation of soil to create buildable lots. Councilwoman Swanson indicated that the previous administration of enforcement of unbalanced cut and fill was a Staff and County problem. However, she felt confident that new staff could impose closer control regarding this matter. Mr. Criss Gunderson commented indicating that some subterranean soil problems cannot be accounted for or anticipated in the initial site plan review process. Councilwoman Murdock indicated that this is quite possibly a management issue; however, supported the concept of introducing an ordinance with administrative remedies for certain unbalanced cut and fill requirements. Concerns were raised from Councilwoman Leeuwenburgh regarding the types of penalties that could be imposed. Mayor Pro Tem Pernell suggested possible grading contractor permits issued by the City with licenses to be revoked for violations of grading provisions. .Councilwoman Leeuwenburgh indicated that the Traffic Commission is currently reviewing -an oversized truck ordinance. . Mr. McHattie< indicated that the good quality operators would support the licensing of grading contractors. Following discussion, it was so ordered by Mayor Heinsheimer, without objection, that Staff would prepare an Ordinance requiring balanced cut and fill for residential construction within the City. Although it has been the policy for many years that the City will require a balance of cut and fill on residential construction as a part of the Site Plan Review process, a formal Ordinance has never been adopted. Landscape architects and applicants are required to demonstrate that balanced cut and fill will be part of a proposed residential development. Each case is handled on an individual basis. It is thought that an amendment to the Municipal Code which will require, a balance of cut and fill on proposed residential developments might be in order. Further information describing whether or not this is required in other communities will be presented at Wednesday's meeting. CN:ds 17.16.020 2. The court shall not be located on steep slopes, sides or bottoms of canyons, 3. Courts shall not be located in the front yard, 4. Courts shall not be located within fifty feet of any road or street easement line, 5. Each court must have an area adequate in width on all sides for the maintenance and planting of landscaping, 6. Neithter the court nor the landscaping required by subdivision 5 of this subsection shall interfere with the view of the owners of property in close proximity to the proposed court, 7. If grading is required for the construction of the court, cut and fill must be balanced, 8. An adequate drainage system must be incorporated into the overall plan of the court, which drainage system must be approved by the City Engineer, 9. A permit will be granted for.the construction of a court which requires excessive grading, 10. The construction of the proposed court shall conform to the lot coverage limitations set forth in Section 17.16.040, 11. Retaining walls incorporated as a part of the overall plan of the court shall not be greater than four feet in height; F. Guest and servants quarters, detached, appurtenant to a residence on the same lot or parcel of land provided no kitchen or other cooking facilities are provided; G. Cabanas and recreation rooms, detached, provided no kitchen or cooking facilities are provided; H. Horseback riding rings; I. Parks and playgrounds. J. Additional driveways providing a second means of vehicular access to a maintained road available to residents of the city for general circulation, provided the following findings can be met: 1. The subject property is not developed with a driveway within fifty feet of a roadway intersection; 2. The subject property has frontage on maintained roadway of not less than two hundred fifty feet; 3. A minimum separation of one hundred feet is maintained between driveways on the same property.
