A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING A TWO-YEAR TIME EXTENSION FOR A
PREVIOUSLY APPROVED ZONING CASE NO. 24-017 FOR A
CONDITIONAL USE PERMIT FOR A DETACHED PERGOLA THAT
EXCEEDS 200 SQUARE FEET, AND VARIANCES FOR A NEW
SWIMING POOL AND PERGOLA TO ENCROACH INTO THE FRONT
YARD AND POOL EQUIPMENT TO ENCROACH INTO THE SIDE YARD
SETBACK, AND FINDING THE PROJECT CATEGORICALLY EXEMPT
FROM CEQA FOR 9 OUTRIDER ROAD (LOT 92-B-EF) (SONSTEIN)
THE PLANNING COMMISSION DOES HEREBY FIND, RESOLVE AND ORDER AS
FOLLOWS:
Section 1. On June 18, 2024, the Planning Commission adopted Resolution No.
2024-10, approving Zoning Case No. 2024-017 for a Conditional Use Permit for a
detached pergola greater than 200 square feet and Variances to allow a new swimming
pool and detached pergola to encroach into the side yard setback at 9 Outrider Road.
The project includes a new 450-square-foot swimming pool, pool equipment and 85 cubic
yards of exempt grading export as well as an as-built 330-square-foot pergola.
Section 2. Pursuant to Sections 17.38.070(A) and 17.42.070(A) of the Rolling
Hills Municipal Code (“RHMC”), the approved Conditional Use Permit and Variances in
Resolution No. 2024-10 would expire within two years of the effective date of approval,
unless otherwise extended pursuant to the requirements of the RHMC.
Section 3. On June 15, 2026, an application was duly filed by property owner
Greg Sonstein requesting a two-year time extension to comply with the requirements of
Resolution No. 2024-10 to complete permitting.
Section 4. Based upon information and evidence submitted, the Planning
Commission grants a two-year time extension to the approved Conditional Use Permit
and Variance, and does hereby amend Paragrah A of Section 8 of Planning Commission
Resolution No. 2024-10, dated June 18, 2024, to read as follows:
A. The approval shall expire within four years from the effective date of approval
of Resolution No. 2024-10. No further extension shall be granted as required
by Section 17.46.080 of the RHMC.
Section 5. Except as herein amended, the provisions and conditions of
Resolution No. 2024-10 shall continue to be in full force and effect.
