STABLE INTO A GARAGE; AND VARIANCES FOR
ENCROACHMENT WITH THE STRUCTURES INTO THE FRONT
AND SIDE YARD SETBACKS AT AN EXISTING SINGLE-FAMILY
RESIDENCE IN ZONING CASE NO. 749 AT 1 ACACIA LANE, LOT
25-B-RH, (LIEB). PROJECT HAS BEEN DETERMINED TO BE
EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. and Mrs. Tom Lieb with
respect to real property located at 1 Acacia Lane, Rolling Hills (Lot 25-B-RH)
requesting a two-year time extension for previously approved Conditional Use
Permit, Variances and Site Plan Review for grading of 311 cubic yards of cut and 311
cubic yards of fill to construct a 1,038 square foot stable to be located up to 2 feet in the
side yard setback and a wall to be located up to 8 feet into the 10—foot required
setback; to convert the existing 2,250 square foot stable into a garage and to add 1,200
square feet to the existing 2,250 square foot stable, (to be converted to garage) for a
total of 3,450 square foot detached garage for storage of antique cars. 368 square feet
of the new addition would encroach into the front setback. Currently, 690 square feet
of the existing structure encroaches into the front yard setback.
Section 2. The applicants have constructed the new stable and the wall for
the stable and moved their animals into the new stable. In their request they state that
the second phase of the project is to convert the old stable into a garage and to
construct the addition.
Section 3. The Commission considered this item at a meeting on July 20,
2010 at which time information was presented indicating that additional time is
needed to commence processing of the second phase of the project.
Section 4. Based upon information and evidence submitted, the Planning
Commission does hereby amend Paragraph A, of Section 11 of Resolution No. 2008-05
to read as follows:
A. The Site Plan Review, Variances and Conditional Use Permit approvals
shall expire within four years from the effective date of approval as defined in
Sections 17.38.070(A), 17.42.070(A) and 17.46.080(A) of the Zoning Ordinance.

No further extension to commence the second phase of the project shall be
granted.
Section 5. Except as herein amended, the provisions and conditions of
Resolution No. 2008-05 shall continue to be in full force and effect.

As you know approval of this project was given. It was to be performed in
two stages, first to construct the new barn so that our horses had a place to
go while we build the garage. The second phase is of course to convert the
old barn to a garage. The first stage is complete and the horses are moved.
Unfortunately, for many reasons, the construction of the new barn took
much longer than anticipated. As a result we are respectfully requesting an
extension of two years to start the second phase of the project.

DATE: April 29, 2010
Following receipt of plans, Planning Commission review and approval and the City
Council's "receive and file" for construction of a barn at 1 Acacia Lane (Lieb),
construction permits were obtained from Willdan Engineering. The permits included
an approved variance for a 5-foot wall in the side yard setback on the westside of the
project abutting Acacia Road.
Over the ensuing months of construction, it became apparent to the Building Inspector
that a portion of the westside wall was going to exceed 5 feet. Notices were provided to
the contractor to address this situation and a meeting about the concern was with staff
and the contractor at the property. Concurrently, the property owner also received
authorization from the Building Inspector to grout the wall suggesting to him that the
wall could be completed without modification.
At the conclusion of the project, the property owner contacted the City for a final
certificate of completion at which time it was necessary to address the wall height.
The property owner provided information to the City to explain that it was a field
condition that resulted in the higher wall. He pointed to inaccurate elevations at the
beginning of the project that forced the outcome.
Staff investigated the situation talking and meeting several times with the engineer of
record (Bolton Engineering), talking and obtaining documents from the Building
Inspector, and discussing the issue with the property owner. From the investigation, it
appeared that there were a variety of faults among all the parties involved starting with
the field condition of at least one inaccurate elevation. While it is one parties' word
against another parties' word, the faults included poor.initial staking of the stable,
inaccurate/incomplete benchmarks at the beginning of the project, allowing the
•
grouting of the wall, the contractor's failure to stop working to address the situation
before the project was completed, and inconsistent detail on the approved plan.
Noting that the property owner obtained a variance and went through the plan review
and permitting process as was required (in other words, followed the process rather
than skirt around requirements) and specifically because it was the field conditions that
resulted in the higher wall, I authorized the final certificate of completion. Moreover,
reducing the portion of the wall exceeding 5 feet is not practical or feasible.

There is not mention of the walls or any three-rail fencing in the minutes. There is
correspondence regarding fencing and it reads as follows:
An undated letter to the Planning Commission from Beth Howell states:
"... I suggest asking the Lieb family to move back their fence on the Acacia side of that
corner to allow a 8 foot wide area for walking and riding next to the pavement. ..."
A letter dated August 11, 1975 to the owners of that time from Teena Clifton Assn
Manager:
"With regard to the fence location located to the south of the old tennis court
approximately 3' into the 15' easement the Board of Directors of the Community
Association has approved its location as you requested provided that your engineer
supply the legal description of the portion of the easement to be used."

Homeowners Harry and Linda Prodromedes attended the meeting. The Committee reviewed
photos of the existing redwood deck and a sample of the travertine-like porcelain tile the
homeowner would like to use to resurface the deck area. The Committee felt that the tile was
appropriate for the style of the house,but needed to see a railing design and materials,fascia
detail, and the current footprint of deck located on a site plan. Please resubmit at the next
meeting.

(approximately 6 feet 8 inches) exceeds the prescribed and approved height limit of 5 feet.
As was discussed with you and your contractor, City staff has no authority to approve an over-
height wall. Your options in resolving this situation are to either comply with the code by
reducing the height of the wall to 5 feet, as originally approved, or to pursue a Variance from
the Planning Commission through the public hearing process. Because the wall relates to
your stable application, final approval of the stable is being withheld until this matter is
resolved.
It is requested that you respond by January 25, 2010 as to your plans to legalize the wall. If this
matter is not resolved, it will be referred to the City Attorney for further action.

This letter shall serve to notify you that the Planning Commission adopted a resolution
on April 15, 2008, granting approval of your request. That action accompanied by the
record of the proceedings before the Commission will be reported to the City Council on
Monday, April 28, 2008. You or your representative must be present to answer any
questions the Council may have.
The Planning Commission's decision in this matter shall become effective thirty days
after the adoption of the resolution by the Commission, unless an appeal has been filed
or the City Council takes jurisdiction of the case within that thirty (30) day appeal period.
(Section 17.54.010(B) of the Rolling Hills Municipal Code). Should there be an appeal,
the Commission's decision will be stayed until the Council completes its proceedings in
accordance with the provisions of the Municipal Code.

Dear Commission Members,
Upon viewing the Lieb property with the proposed changes in mind, I feel
converting the stable to a garage and relocating the stable next to the riding ring
is a wise use of the property and will further enhance the beauty of the home.
Because it is closest property to the Main Gate on the West side, the garage will
be the first thing you see as you enter the City. I suggest asking the Lieb family
to relocate the hedge behind the fence next to the new garage. It would shield the
garage from view while opening up the roadside easement on Portuguese
Bend Road to better match the size and uses of the corresponding easement
on the opposite side of the road.
In addition I suggest asking the Lieb family to move back their fence on the
Acacia side of that corner to allow a 8 foot wide area for walking and riding
next to the pavement. The current equestrian crossing would then be safer
and more functional. I realize the small roadside easements on Acacia do not
now require the Lieb family to move their fence back from the pavement, but
doing so would improve the safety and rural appearance of the first intersection
seen as we enter the Main Gate of our City.
In addition I ask the City to consider moving the mailboxes to a safer location,
so the residents do not have to stand in a busy traffic lane to retrieve their mail.
The Libe family has always been community minded and willing to use their
recourses for the benefit of the residents of our City. I hold them in the highest
regard.

Dear Mr. and Mrs. Lieb,
Due to your request to relocate the proposed stable into the side setback, the Planning
Commission at their February 19, 2008 meeting, set another field trip to your property on
Tuesday, March 18, 2008, between 5:00-6:00 PM. I will notify you of the exact time as it
gets closer to the meeting date. Please stake the new stable and wall, and delineate the
setback and roadway easement line along Acacia Road, so that the Commission may get an
accurate picture of where the stable/wall are proposed in relationship to the roadway. The
Commission also requested that the ridgeline of the proposed garage be staked.
As you heard at the meeting, the Commissioners were concerned about the size of the
proposed garage and the proximity of the stable to the riding ring.
Just to clarify the setbacks on the side of your property for corner lots. Your property line is
somewhere midway on Acacia Road. You must check with your civil engineer to accurately
depict that location. The roadway easement from the property line is 15 feet towards your
property. The setback for development purposes is 10 feet east of that easement line. Any
encroachment into a setback requires a Variance. As you can see, corner lots have a lesser
side setback than lots that abut another property, (20-feet). Placing a stable into that 10 foot
setback would be more visible to the neighbors and passerby's and may look overcrowded,
so close to the street.
Should you decide to proceed with the application to locate the stable and/or wall in the
setback, please submit an application for a Variance and a fee of $1,250. If the
encroachment is five feet or less into the side setback, then the fee would be $750.00. Also
submit 8 sets of plans for the new project. This information must be submitted to the City
no later than March 3, 2008, as notices have to be provided for the revised project. I
would recommend that you speak to your neighbors and get their support to locate the
stable in the setback.
After the field trip the Planning Commission will hold their regular meeting on the same
night, March 18 starting at 6:30 PM and will consider your project at that meeting as well.

SILHOUETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber,wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/2 -3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process,when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.
