Project Description: The applicants propose to conduct substantial grading, approximately 150,000 cubic yards (cut and fill) total soil to accommodate a new building pad for the construction of a single family residence and accessory structures consisting of total of 12,736 square feet of structures on an existing 9.2 acre (gross) vacant residential lot (LACA Map 60, Lot 246, 3 Appaloosa Lane). Approximately 32% of the Appaloosa Lane site will be disturbed. The area affected by the grading comprises approximately 2.89 acres (126,000 square feet) total on three lots. The areas to be graded on the adjoining lots include 13,680 square feet on 17 Buggy Whip Drive and 2,520 square feet on 19 Buggy Whip Drive. The grading for the portion of the project associated with the proposed building pad on the main site will involve 9,240 cubic yards of cut and fill (balanced on site), and 140,580 cubic yards of cut and fill will be graded for the slope remediation portion of the project. The project also proposes construction of various drainage structures, including three cross-slope concrete swales (approx. 3,400 sq ft), approx. 400 lineal feet of retaining walls along the western and southern perimeter of Initial Study/Mitigated Negative Declaration 2 ZC. No. 757, 3 Appaloosa :'7 ( { • i • the proposed building pad (5 feet maximum in height from finished grade-in compliance with City zoning standards) and appurtenant catch basins, drains and outfall conveyances. B. Description of the Project Site: (Describe the project site as it exists at the present time, including information on topography, and any cultural, historical or scenic aspects. Describe any existing structures on the site, and use of the structures.) The project site consists of three lots comprising 12.8 gross acres (Lot 246-LACA MAP, Lot 6, Tract 27124, Lot 5, Tract 29383). The main development site is a residentially zoned vacant lot. It is irregular in shape, approximately 1,400 feet in length and approximately 350 feet at its widest point. Its existing topography consists of non-graded natural slopes situated in a steep natural gully sloping down from south to north (from approximately elev. 900 to elev. 760) and from west to east (from approximately elev. 960 to elev. 830) in the project area. The main project site is vegetated with native plants, including native and non-native grasses and shrubs and several species of trees including an avocado grove. The adjoining lot at 17 Buggy Whip contains 79,280 square feet (1.82 acres gross). It is somewhat rectangle in shape, approximately 223 feet by 372 feet, and is developed with a single family home and a swimming pool. The portion of the lot in the project area has a down-slope west to east from approximately elev. 970 to elev. 930. The adjoining lot at 19 Buggy Whip contains 79,500 square feet (1.82 acres gross) and is similarly shaped, approximately 225 feet by 352 feet, and is also developed with a single family home and swimming pool. The portion of the project on this lot has a down-slope west to east from approximately elev. 840 to elev. 820. The grading on both of the adjoining lots will involve excavation and re-compaction, for stabilization since these areas have been identified as being in a landslide area. The remaining areas of the two adjoining lots contain vegetation similar to the one on the 3 Appaloosa site. As part of the mitigation measures a biological assessment study was conducted to determine precise biota on the properties. From the subject sites there is a view of other canyons within the City, and of distant city lights outside the City. The sites are located in a canyon and are visible only to their immediate neighbors. C. No. 757, 3 Appaloosa • • AMENDED MITIGATION MEASURES 8/11/08 ENVIRONMENTAL IMPACTS AND MITIGATION MEASURES The following analysis is a description of the findings contained in the Evaluation of Environmental Impacts Issues Checklist Form, which preceded this page. Included is a detailed discussion of all-potential environmental impacts checked "Potentially Significant Impact," "Potentially Significant Unless Mitigation Incorporated," and "Less Than Significant Impact" is provided, along with appropriate mitigation measures. Item I. AESTHETICS. a - d LESS THAN SIGNIFICANT The affected area is not officially designated in the City's General Plan as a scenic vista, nor are there any designated historically significant structures or scenic highways located in the project area. The area is mainly in a canyon visible from only neighboring private properties and from the "Glory" equestrian trail located at the ridge above the main development site and canyon. The disruption of the canyon vista will be temporary and will be restored after the slope repair is completed. The trail will be repaired and functional after the project is completed. The Rolling Hills Community Association will oversee the repair to the trail. Failure to promptly repair the slope would lengthen the time of temporary impact. Rock outcroppings may be temporarily impacted, but the site will be safer after grading is completed. The site will be restored to its prior condition after remediation is completed which is expected to take approximately six months. The affected areas will be re-vegetated with native plants in accordance with an approved plan. The project will accommodate the development of a single story home on a new pad below the adjacent residences and therefore due to this location and low density type of permanent development, it is not expected that any new types or amounts of light sources would result in glare to surrounding properties or impair nighttime views. Item II. AGRICULTURE a-c NO IMPACT The proposed project is located on privately owned property that is not zoned for agricultural purposes, and there are no commercial agricultural resources present on the subject site. No further analysis is required. Item III. AIR QUALITY a LESS THAN SIGNIFICNANT IMPACT The proposed project site is within the South Coast Air Basin (SCAB), which is in the jurisdiction of the South Coast air Quality Management District (SCAQMD). The SCQMD establishes the Air Quality Management Plan (AQMP) for the SCAB, which sets forth a comprehensive program that lead the SCAB into compliance with all Federal and State air quality standards, which the applicant will have to comply with. The proposed project involves earthwork with cut and fill balanced on the site, within an existing urbanized area and is consistent with the local land use plans. The project will accommodate a net increase of one dwelling unit on an existing vacant subdivided lot and therefore the project is not growth-inducing. Therefore impacts would be minimal and no further analysis would be required. b-e. LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATION The proposed project will not violate any air quality standard or contribute substantially to an existing or projected air quality violation, will not contribute to a cumulatively considerable net increase of any criteria pollutant, expose sensitive receptors to substantial pollutant concentrations, or create objectionable odors affecting a substantial number of people and will have a less than significant impact on the existing environment with the incorporation of mitigation measures. Initial Study/Mitigated Negative Declaration 15 .2c) ZC. No. 757, 3 Appaloosa • • • During construction, dust and objectionable odors will be created. However, this will be a temporary impact. Standard grading dust control measures will be implemented into the grading plan. The impact on air quality as a result of the proposed grading is less than significant with the incorporation of appropriate mitigation measures as follows. A similar project of slope stabilization was completed in 2005 in the vicinity of this project site. Between 2007 and recently a large (7,700 sq.ft. residence with 5,200 s.f. basement) which included 7,000 c.y of grading was constructed in the vicinity. Currently, there is a single family residence under construction in the vicinity and there is a possibility for a potential project consisting of reconstruction of an existing residence, and grading in the near future. (Scope of that project is not known yet). After reviewing and discussing the proposed project and the past and future projects with AQMD Staff, and after applying criteria, thresholds and regulations pursuant to CEQA guidelines, City staff concluded that with the proposed mitigation measures, the proposed project will be less than significant in affecting the air quality, either singly or with the other projects. Staff has not conducted any technical analysis to back this analysis. Mitigation Measures 1. The property owners shall be required to conform with South Coast Air Quality Management District, Los Angeles County and local ordinances and engineering practices during construction by using dust control measures to stabilize the soil from wind erosion and reduce dust generated by construction activities. Fugitive Dust a. A Comprehensive Fugitive Dust Control Program shall be developed and implemented before commencement of grading activities, subject to review and approval of the City Planning Department and the South Coast Air Quality Management District (SCAQMD). This Plan, at minimum,shall address compliance with SCAQMD Rule 403, including: - Regular site watering -Application of soil stabilizers to inactive graded areas - Covering and/or washing of transport trucks leaving the site - Periodic street cleaning of public roads adjacent to the site b. A High Wind Response Plan in accordance with Rule 403 of the SCAQMD shall be developed and implemented at times when wind speeds exceed 25 mph to reduce emissions. The High Wind Response Plan shall be developed and implemented before commencement of grading activities,subject to review and approval of the City Planning Department and the SCAQMD. c. Stockpiles of soil, sand and similar materials shall be stabilized by being covered, watered a minimum of twice daily, or with application of non-toxic soil binders. Construction Equipment Exhaust d. Heavy construction equipment shall be properly tuned and maintained to reduce emissions. Construction equipment shall be fitted with the most modern emission control devices. The construction manager shall monitor compliance with this measure and is subject to periodic inspections by City Building Inspectors. e. The project shall comply with Rule 461, which establishes requirements for vapor control from the transfer of fuel from the fuel truck to vehicles both during construction and subsequent operations. THE FOLLOWING COMMENTS WERE RECEIVED FROM THE AIR QUALITY MANAGEMENT DISTRICT AND ARE INCORPORATED INTO THIS DOCUMENT; Initial Study/Mitigated Negative Declaration 16 ( �/ ZC. No. 757, 3 Appaloosa • The following changes are recommended for Mitigation Measure 1.a. to reduce fugitive dust: • Regular site watering (at least twice daily) • Periodic Street cleaning of roads at the end of the day if visible soil is carried onto paved roads adjacent to the site (recommend water sweepers with reclaimed water). • Recommended additions: FUGITIVE DUST: • Install wheel washers where vehicles enter and exit the construction site onto paved roads or wash off trucks and any equipment leaving the site each trip; • Appoint a construction relations officer to act as a community liaison concerning on-site construction activity including resolution of issues related to PM10 generation; • Replace ground cover in disturbed areas as quickly as possible; • All trucks hauling dirt, sand, soil, or other loose materials are to be covered; • Traffic speeds on all unpaved roads to be reduced to 15 mph or less; and Recommended additions to reduce equipment exhaust: Construction Equipment Exhaust • Provide temporary traffic controls such as a flag person, during the delivery of heavy equipment or building materials to maintain smooth traffic flow. • Use electricity from power poles rather than temporary diesel or gasoline power generators; • Reroute construction haul trucks away from congested streets or sensitive receptor areas;and • Prohibit all vehicles from idling in excess of five minutes, both on-site and off-site. Item IV. BIOLOGICAL RESOURCES LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATION a, d-f The main project site will be developed with a new single family home upon completion of the proposed earthwork and building pad, in compliance with all applicable zoning and development standards. No additional development (other than remedial grading) is proposed for either of the adjoining sites - the existing houses, garages and swimming pools will remain in their existing condition. The affected area consists of approximately 2.89 total acres out of a total of 12.8 gross acres. The large lot, estate density single-family development that will occur provides the opportunity to retain substantial amounts of existing habitat. The General Plan and Zoning Code of the City of Rolling Hills set forth requirements that single-family structural development on a lot be limited to a maximum of 20% of the net lot area; that total development of structural and flatwork (paved) development on a lot be limited to a maximum of 35% of the net lot area, and that the maximum disturbed area including graded areas be limited to a maximum of 40% of the net lot area. City policies also encourage the retention, use, and maintenance of native drought-tolerant vegetation in landscaping. Mitigation Measures 1. The applicant shall be required to prepare a biological assessment in the form of a Biological Resources Assessment Study. Said study shall contain minimally the following tasks: 1) Search of database and literature, including the review of sensitive biological resource occurrence records contained within the California Natural Diversity Database (CNDDB) and the California Native Plant Community Society (CNPS) rare plant inventory. The purpose of this task will be to compile a list of special status species occurrences within and immediately adjacent to the project area, and also to assist in assessing the occurrence potential for other special-status species known from within the Initial Study/Mitigated Negative Declaration 17 ZC. No. 757, 3 Appaloosa 7 • • • vicinity of the project area. 2) Field Survey of project area to perform vegetation mapping, and to assess wildlife habitat(s). Habitats to be assessed for potential to support special-status species. Species list to be compiled of all plant and wildlife species observed on and directly adjacent to project site; visual scan to be performed of adjacent areas for identifying habitats of special —status species within 500 feet of project boundaries. Vegetation results to be used to evaluate the need for conducting focused surveys, mitigation measures for special —status species, and re-vegetation recommendations. 3) Biological Resources Assessment Technical Report to include: Introduction with environmental setting and description of project location; Methods description for literature review, database search, field surveys and assessments for special-status species occurrence, Description of results of databases and mapping; Discussion of distribution of biological features within project area; Assessment of potential project impacts to biological resources; and Recommendations for mitigation. The Study shall be reviewed, evaluated and acted upon by the Planning Commission as part of the environmental assessment and prior to a decision on the project site Plan Review during the public hearing process. The applicant shall incur the cost for preparation of the biological assessment study and shall be required to comply with all mitigation measures recommended in the biological assessment as approved by the City. 2. During the plan review process, the applicant will be required to submit plans to the Los Angeles County Fire Department for determination of Fuel Modification Zone and related re-vegetation requirements. The remainder of no-structure areas outside of the designated Fuel Modification Zone will be planted in accordance with recommendations of the Vegetation Survey. 3. Site Plan Review for this project by the Planning Commission, if approved, shall include the following conditions with respect to mitigation for loss of mature native vegetation in protected areas: a. Any grading shall be returned to the existing topography, flora, and natural features to the greatest extent possible. In order to minimize impacts to the hillsides and canyon areas on this property, the graded slopes shall be designed and developed in a manner that retains and restores native drought-tolerant plant life and preserves the existing contiguous topography, flora, and natural features of that area to the greatest extent possible. Mitigation by re-vegetation shall be at a minimum of 2:1, or as otherwise recommended in the biological study. Grading and all other activities in the easements shall be reviewed and approved by the Rolling Hills Community Association. b. To prevent construction equipment from going beyond the limits of the site, contractors shall use fencing or other barriers to the greatest extent possible. Contractors shall be informed that work on the site shall not encroach into natural vegetation areas except as specified on the approved Site Plan to the greatest extent possible. c. No grading, development, or removal of live mature vegetation shall be permitted in areas not approved for remediation. In the event removal or thinning of mature natural vegetation is required to comply with Fire Department Regulations, the least invasive technique shall be utilized. d. Prior to the issuance of any grading permit, a licensed biologist or native plant specialist approved by the City shall meet with the general contractor and grading contractor to explain the boundaries of the project, the boundaries of those areas permitted to be removed by an approved Site Plan, and the restrictions contained in this condition. e. No contractor, operator of a bulldozer or other equipment or other construction worker on the site shall allow equipment, supplies or soil to encroach into the area not being remediated. f. No chemicals, including but not limited to fertilizers, pesticides, herbicides, detergents, chlorine or pool chemicals, shall be used, disposed of, or allowed to drain into adjacent areas, except fertilizers approved by a City approved licensed biologist. Initial Study/Mitigated Negative Declaration 18 ZC. No. 757, 3 Appaloosa • g. The actual size of the mitigation area shall be based upon acreage of areas that are disturbed, or are planned to be disturbed in connection with the slope repair. Nothing contained in this condition shall limit the authority of the City to require additional areas or greater areas of the parcel to be re-vegetated with native and drought tolerant plants to mitigate additional impacts, if any. h. Mitigation areas shall be planted with native and drought tolerant plants as specified in the required biological study, unless otherwise required by the Planning Commission or the City Council. All requirements of the Regional Water Quality Control Board, U.S. Department of Fish and Game as well as other agencies reviewing this project shall be met. A bond in the amount of the cost estimate of the implementation of a re-vegetation and landscape plan plus 15%, shall be required to be posted prior to issuance of a grading and building permit and shall be retained with the City for not less than two years after landscape installation. The retained bond will be released not sooner than two years after the initial plantings, after the City determined that landscaping was installed pursuant to the landscape plan as approved, and that such landscaping is properly established and in good condition. In the event that another agency such as the U.S. Department of Fish and Game, after reviewing this Initial Study and mitigation measures, determines that additional study, replanting or other measures must be taken, pursuant to State Law, the applicant shall be required to implement such measures. j. Following the initial plantings, a licensed biologist or native plant specialist shall prepare a report for the City of Rolling Hills on the progress of re-vegetation on the site along with recommended remedial measures, if needed, prior to the City reimbursing the landscaping bond funds. k. The applicant shall comply with the report to be prepared by the licensed biologist, including the re-vegetation of specified type of plants, planting schedule, soil treatment procedures and establishment of a soil ecosystem, irrigation, time for recovery, care and maintenance, and monitoring. b,c. NO IMPACT The site does not contain any areas defined as federally protected wetlands (per Section 404 of the Clean Water Act) nor is located in a riparian community of plans and animals, therefore no further analysis is required. Item V. CULTURAL RESOURCES a-d. NO IMPACT No known resources exist on site per Section 15064.5 of the State CEQA Guidelines and the project is located in a fully developed neighborhood. At such it is very unlikely that the presence of unique paleontological resources exist. No formal cemeteries are known to have occupied the proposed project area. However, should any unique artifacts or human remains be found during the grading and construction process, the contractor shall be required to stop all work and the applicant will be required to consult an archeologist, pursuant to the California Public Resources Code, Section 5097. Therefore, there is no impact and no further analysis is required. Item VI. GEOLOGY AND SOILS a(i)(ii)(iii) NO IMPACT. The project is not located within the Alquist-Priolo special study zone. Therefore, there is no impact and no further analysis is required. a(iv)b,c,d,e LESS THAN SIGNIFICANT WITH MITIGATION MEASURES/LESS THAN SIGNIFICANT Although approval of the grading and fill of this project is not expected to result in creation of new unstable earth conditions or in changes in geologic substructures, portions of the City exhibit unstable earth conditions, including active slope failure and soil creep on subject property. Initial Study/Mitigated Negative Declaration 19 ZC. No. 757, 3 Appaloosa , / • • • The Land Use Element of the General Plan establishes a Landslide Hazard Overlay to carefully regulate development in unstable areas. Grading, excessive irrigation, and/or increased septic tank discharge in unstable areas may trigger slope failure. Because the City is located in seismically active southern California, additional development will be exposed to potential ground shaking in the event of an earthquake, but not as a result of this project. The Palos Verdes fault, considered potentially active, is located approximately one mile northeast of the City limits. The entire City of Rolling Hills, including this site, is underlain by expansive soil that requires soils and geology reports for any new building structures. An ancient landslide area has been found in this location. The goal of the applicant is to create a • building pad on the vacant lot portion (Lot 246). The proposed slope stabilization involving removal and re-compaction of the soil is expected to conform to local ordinances and engineering practices requiring balanced cut and fill and could be potentially significant unless mitigation is incorporated. However, the project is to correct a slope failure condition and the lots will be more stable after the grading activity than before. A septic tank system will be required to be constructed as part of the development, as there is no sewer system in this part of the City. During slope remediation and grading tests for septic system location will be performed. A preliminary location for the system has been established previously. Also, during the grading, it is expected that removal of natural vegetative cover, may potentially cause an increase in soil erosion by wind action or storm runoff. This reduction of vegetative cover and the increased runoff associated with development may cause a slight increase in the soil deposition, siltation, or erosion in or near the ocean. However, this will be a temporary condition and the site is several miles away from the ocean, and precautions will be taken to prevent any soil erosion or slippage during the repair. The site will be re-vegetated and the effect will be less than significant with mitigation incorporation. Mitigation Measures 1. An Erosion Control Plan containing the elements set forth in the County of Los Angeles Uniform Building Code shall be prepared to minimize erosion and to protect slopes and channels to control stormwater pollution as required by the County of Los Angeles. 2. The applicant shall submit a geotechnical report for review and approval by the County of Los Angeles Geologist prior to issuance of a grading permit. Prior to the submittal of an applicable final grading plan to the County of Los Angeles for plan check, a detailed grading and drainage plan with related geology, soils and hydrology reports must be submitted to the Rolling Hills Planning Department staff for their review. Cut and fill slopes shall not exceed a steepness of a 2 to 1 slope ratio. 3. Intensive geotechnical review and supervision shall be required throughout the time the project is ongoing. 4. As part of the soils and geology report, location for a future septic tank to serve the new single family residence will be established. All applicable State and County requirements pertaining to septic tanks construction and maintenance shall be complied with. 5. Comply with LA County requirements relative to submitting grading and construction plans on a bi- weekly basis. Item VII. HAZARDS AND HAZARDOUS MATERIALS a-h. NO IMPACT The City's Building & Construction Ordinance, the Zoning Ordinance, and the Rolling Hills Community Association carefully regulate grading and compaction activities and construction. No. 757, 3 Appaloosa i J • ' materials have been identified on site and none will be transported or used in the remediation of this site. Therefore, there is no impact and no further analysis is required. Item VIII. HYDROLOGY AND WATER QUALITY a. LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATION The proposed project includes the grading of 150,000 total cubic yards of earth for the purpose of constructing a building pad for a future single family home, and to stabilize the canyon slopes on two contiguous properties (all grading balancing cut and fill on site). The project will be required to be in compliance with existing National Pollutant Discharge Elimination System (NPDES) requirements, provide Best Management Practices for the construction process and submit a drainage report for review and approval of the Los Angeles County Building Official. In order to ensure that the proposed project will be in compliance with water quality standards and wastewater discharge requirements during and after construction, the following mitigation measures will be added: Mitigation Measures 1. The applicant shall submit and obtain approval of a drainage report from the Los Angeles County Building Official, prior to issuance of any Grading Permits and/or a Building Permit for new construction. 2. The applicant shall submit and obtain approval of a Local Stormwater Pollution Prevention Plan (SWPPP) to the City of Rolling Hills and Los Angeles County Building Official, prior to issuance of any Grading Permits and/or a Building Permit for new construction. 3. The applicant shall submit and obtain approval of a Standard Urban Stormwater Mitigation Plan (SUSMP) to the City of Rolling Hills and Los Angeles County Building Official, prior to issuance of any Grading Permits and/or a Building Permit for new construction. 4. The applicant shall submit a Notice of Intent to the State Water Resource Control Board under the General Construction Activity Storm Water Permit for grading of one acre or more of land area. b,f,g,h,i,j, NO IMPACT The proposed project does not involve the construction of any facility, which would require the use of groundwater supplies. Although the project involves the construction of one single family residence, in terms of flooding, according to the revised flood maps prepared by FEMA, the site does not fall within flood hazard area. The project is not located within a dam inundation area and is not subject to a seiche or tsunami due to its distance from the ocean. c,d,e. LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATION The proposed project may alter drainage patterns, increase runoff and reduce water absorption. However, such effect will be temporary in nature.As the area is re-filled, compacted and re-vegetated drainage patterns will be restored to current standards. A septic tank system will be installed in the future for the residence accommodated by the grading work. This installation shall be in accordance with all applicable permits and regulations of the City of Rolling Hills and Los Angeles County. Mitigation Measures 1. The property owners shall be required to conform to County Health Department requirements for the installation and maintenance of septic tanks. 2. An Erosion Control Plan per County of Los Angeles Uniform Building Code requirements shall be prepared to minimize erosion and to protect slopes and channels to control stormwater pollution as required by the County of Los Angeles. r Initial Study/Mitigated Negative Declaration 21 C'I / ZC. No. 757,3 Appaloosa 0 • 3. Prior to the submittal of an applicable final grading plan to the County of Los Angeles for plan check, a detailed grading and drainage plan with related geology, soils and hydrology reports must be submitted to the Rolling Hills Planning Department staff for their review. Item IX. LAND USE AND PLANNING. a-b. NO IMPACT The Land Use Element of the General Plan establishes the maintenance of strict grading practices to preserve the community's natural terrain and the Building & Construction and Zoning Ordinances require a balanced cut and fill ratio. No export or import of soil is proposed for this project. The project is subject to approval by the Planning Commission and City Council. The proposed cut and fill quantities of 150,000 cubic yards of soil each will require the approval of a Site Plan Review through a public hearing process. Therefore, there is no impact and no further analysis is required. c. LESS THAN SIGNIFICANT IMPACT While the project will not conflict with the Open Space and Conservation Element of the Rolling Hills General Plan, a biological assessment shall be required and the project shall comply with mitigation measures recommended in the biological assessment as approved by the City.Any conflict with State Plans for habitat and natural community conservation will be temporary. Therefore, the project will be less than significant because mitigation measures will be incorporated. Mitigation Measures 1. A biological study shall be prepared and it will be required that all recommendations are adhered to. If other local or state agencies impose additional mitigation measure, the applicant shall be required to comply with those recommendations as well. Item X. MINERAL RESOURCES a-b NO IMPACT There are no known mineral resources present within the community. Further, the General Plan does not delineate the sites a locally important mineral resource recovery sites. Therefore, there is no impact and no further analysis is required. Item XI. NOISE a,b,d LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATION The goal of the City of Rolling Hills' Noise Element is to preserve and enhance Rolling Hills' quiet rural atmosphere and promotes the use of landscaping to obscure noise production from roadways and adjacent properties. As stated previously, there will be intermittent loud noise levels during grading operation that will be temporary or periodic in nature. Mitigation Measures 1. Although approval of the project will result in intermittent loud noise levels during grading operation, and construction the noise will be temporary. During construction, the property owners shall be required to schedule and regulate construction activities including related traffic, and therefore limit noise throughout the day between the hours of 7 AM and 6 PM, Monday through Saturday only, when construction and mechanical equipment noise is permitted so as not to interfere with the quiet residential environment and normal flow of traffic of the City of Rolling Hills. 2. The contractor shall be required to install on all vehicles and construction equipment properly maintained and operating mufflers and other state required noise attenuation devices. 3. During grading and construction operations, trucks shall not park, queue and/or idle at the project site or in the adjoining right-of-way before or after the permitted hours of operations. 4. There shall be no staging of equipment or accumulation of vehicles on Appaloosa Lane. All staging and parking shall be on the subject site. c,e,f NO IMPACT Initial Study/Mitigated Negative Declaration 22 ( C L ZC. No. 757,3 Appaloosa • • , The proposed project is not located within an airport land use plan or within two miles of a public airport. The project is not located in the vicinity of a private airstrip. Therefore, there is no impact and no further analysis is required. Item XII. POPULATION AND HOUSING a-c. NO IMPACT The proposed project will not induce a substantial amount of population growth in the area. The project consists of construction of a single family residence, therefore, adding one family to the city population. The project will not displace any housing and there is no impact, and therefore no additional assessment is required. Item XIII. PUBLIC SERVICES a. NO IMPACT With the addition of single family residence, there will be no impact on parks, police or fire resources. The residence will incorporate interior fire suppression devices required by the Los Angeles County Fire Department and will be constructed in accordance with applicable building codes. The level of use with one single family residence is not expected to impact police, fire and other services. There is no impact, and therefore no additional assessment is required. Item XIV. RECREATION a,b. LESS THAN SIGNIFICANT The impact on neighborhood and regional parks and recreational facilities of the proposed project is expected to be less than significant. The goals of the Open Space and Conservation Element of the General Plan that include continuing the City's program of acquisition and development of strategically located recreation centers, encouraging the maintenance and improvement of the system of hiking and equestrian trails in Rolling Hills through the Community Association, encouraging the continued upkeep of all City-owned recreation facilities within Rolling Hills, and providing expanded recreational opportunities for children do not conflict with the goals of the subject project. Although the existing equestrian trail (Glory Trail) in the project area will be affected during the grading operation, this is a temporary condition (lasting approximately six months), and the applicant will be required to restore and improve the equestrian trail after grading to the satisfaction of the Rolling Hills Community Association. Item XV. TRANSPORTATION/TRAFFIC a. LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATION Approval of the project will result in increased truck and construction vehicles traffic only during the project grading and construction. The grading and related operations will be conducted within the approved City work hours. The time frame for this project is approximately 6 months for grading, after which time landscaping vehicle and equipment will traverse the City to access the site to implement the requirements of the re-vegetation plan and construction of the residence. The effect on circulation within the City during construction of the project could be potentially significant unless mitigation is incorporated. Mitigation Measures 1. During construction, the property owners shall be required to schedule and regulate truck traffic throughout the day between the hours of 7 AM and 6 PM Monday through Saturday only so as not to interfere with the normal flow of traffic within the City of Rolling Hills. 2. The contractor is to encourage his employees to car-pool into the City. 3. During grading and construction operations, trucks shall not park, queue and/or idle at the project site or in the adjoining right-of-way before or after the permitted hours of operations. 4. There shall be no staging of equipment or accumulation of vehicles on Appaloosa Lane. All staging and parking shall be on the subject site. Initial Study/Mitigated Negative Declaration 23 ZC. Construction activities shall be organized so as not to interfere significantly with peak- hour traffic and minimize obstruction of traffic lanes and if necessary, a flag person shall be retained to maintain safety adjacent to the existing roadways. 8. No construction or delivery trucks shall utilize Buggy Whip Drive at any time during the stabilization of the slopes, grading or construction of the residence. 9. The applicant shall repair any damage to Appaloosa Lane, which resulted from the project construction. At a minimum, the applicant shall submit pictures of Appaloosa Lane from the top of Blackwater Canyon Road to the site, before the construction commences and after the construction. b. LESS THAN SIGNIFICANT This project will not exceed either individually or cumulatively, a level of service standard established by the county congestion management agency as there are no heavy congestion designated roads or highways within the City of Rolling Hills. c,d,e,f,g. NO IMPACT The proposed project will not result in change in air traffic patterns. A driveway to the site has been previously approved by the City's Traffic Commission and will be constructed to Fire Department requirements. There be no impact and therefore no further analysis is required. Item XVI. UTILITIES AND SERVICE SYSTEMS. a,b,d,e,f,g NO IMPACT With the construction of a single family residence no significant increase in wastewater and water usage will result. No new treatment facilities will need to be constructed to accommodate the development. There be no impact and therefore no further analysis is required. c. LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATION The final restoration design of the equestrian trail may incorporate new culverts at the trail. The County of Los Angeles and the Rolling Hills Community Association will make a determination as to the requirements for new culverts, if any, after the land is stabilized. The result of such construction will not cause significant effect on the environment. In fact it will correct drainage from the slopes into the canyon and eventually onto the equestrian trail. Mitigation Measures 1. The property owners shall be required to conform with the Regional Water Quality Control Board and County Building Department requirements for the installation and maintenance of stormwater drainage facilities, if additional facilities are required as a result of the restoration of the equestrian trail. 2. The property owners shall be required to conform with the Regional Water Quality Control Board and County Public Works Department Best Management Practices (BMP's) related to solid waste. 3. The property owners shall be required to comply with the requirements of the Rolling Hills Community Association and the Los Angeles County Public Works Department for the construction of a culvert, if required, at the equestrian trail. 4. The property owner will be required to provide adequate site drainage and comply with NPDES standards and requirements. 5. The property owner will be required to comply with all applicable state, federal and local statutes and regulations related to solid waste. OTHER Initial Study/Mitigated Negative Declaration 24 ZC. Grading and all other activities conducted in the easements on subject property or across property lines on adjacent properties shall be reviewed and approved by the Rolling Hills Community Association. 2. The applicant shall be required to comply with the City's requirements for Class "A" roof material and construction, requirements of the lighting ordinance, and all other City and County of Los Angeles construction requirements. Item XVII. MANDATORY FINDINGS OF SIGNIFICANCE. a. It is anticipated that the project may have the potential to insignificantly degrade the quality of the environment, non-substantially reduce the habitat of wildlife species, cause wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. However, such impacts will be temporary. Careful grading supervision and re-vegetation as described in a biological report (required during this assessment) will restore the habitat for the plant and animal community. A biological assessment report will be required in accordance with Mitigation Measure for Biological Resources above, and the project shall comply with mitigation measures as recommended in the biological assessment plan. b. The project may have impacts that are individually limited, but cumulatively considerable because the project, as proposed, requires a substantial amount of grading for geological repair and remediation. Proposed grading for the project will require a cut of 150,000 cubic yards of soil and fill of 150,000 cubic yards of soil. This project is one of the largest grading operations undertaken in the City of Rolling Hills. Starting at the southerly end, it will be constructed in small increments. The soil cement will be placed during this part of the operation. The soil cement is shown by formula and per the detail below. After the required depth of soil cement is reached, the remainder of the grading will proceed in the normally accepted manner, that is, with the entire job supervised and inspected per the requirements of the code. After contacting SCAQMD, it is not necessary to obtain a dust control permit from SCAQMD as this project does not require a permit.
