As you know, the repair and restoration of the lower portion of your property was
approved by the City Council in July 2011. However, to proceed, a few issues remain
before the Los Angeles County Building and Safety Department can provide a grading
permit.
In order to obtain a grading permit, it is necessary that you:
• Add a note onto the grading plans specifying that the RHCA roadside
curb will be removed,
• Obtain from the City and RHCA a stamp of approval on the grading plans
and submit the approved plans to the County Building and Safety
Department,
• With the County Recorder, record the off -site covenant agreement and
then provide a copy of the recorded agreement to the County Building
and Safety Department and,
• Provide the County Building and Safety Department with the approval
letter you have received from the Department of Fish and Game.
While you have until July 2013 to complete the above noted requirements and
commence with the repair and restoration (without requesting an extension), it is
recommended that you move forward as soon as possible. If you have any

Thank you for obtaining a City of Rolling Hills Construction and Demolition Waste Permit for 2
Appaloosa Lane. With issuance of the permit and your commitment and cooperation, we look forward
to accomplishing the recycling and diversion goals that the permit is intended to achieve.
As noted in the permit application, please be mindful that within thirty (30) calendar days following the
completion of each construction project for which your permit is issued, you are required to submit
documentation to the City of Rolling Hills demonstrating that at least 50% of the construction and
demolition waste generated from the project is not disposed at a landfill. Satisfactory documentation
of compliance is necessary for final inspection of the construction project and, if applicable, the
issuance of a certificate of occupancy. In other words, your failure to comply with the
recycling/diversion requirement will cause the City to withhold from your clients final approval of the
construction project you are servicing.
Enclosed you will find a "Recycling and Waste Reduction Compliance Report" for you to document the
disposal of your construction and demolition waste. The form must be supported and accompanied by
originals or photocopies of receipts, weight tickets, invoices or other records of measurement from
recycling companies, the landfill and/or disposal companies. It is strongly recommended that you
submit this form as frequently as you dispose of construction and demolition waste rather than
wait until the end of a project. This will avoid complications with final inspection of the project and
with you and your client. Additional forms can be obtained at City Hall or on the City's website at
www.Rolling-Hills.org.
Please be aware that your permit will expire on January 14, 2011 at which time a new permit will be
required. If the conditions of the permit are not followed, the permit will not be renewed or could be
revoked mid -year.
Recycling is important not just for extending the usefulness of landfills; it is valuable for sustaining the

SUBJECT: ZONING CASE NO. 763 Request for a Site Plan Review and Minor
Variance to construct a new residence.
This letter shall serve to notify you that the City Council at their meeting on
December 17, 2008 received and filed the Planning Commission's resolution
granting your request in Zoning Case No. 763.
The decision shall become effective thirty days after the adoption of the
resolution by the Planning Commission, unless an appeal has been filed to the
City Council within that thirty (30) day appeal period. (Section 17.54.010(B) of
the Rolling Hills Municipal Code). Should there be an appeal, the Commission's
decision will be stayed until the Council completes its proceedings in accordance
with the provisions of the Municipal Code.
Before this case takes effect you are required to record an Affidavit of Acceptance
Form together with the subject resolution in the Office of the County Recorder.
The approval of this project is valid for two years. Therefore, construction must
commence within that two-year period, unless an extension is requested and
granted by the Planning Commission prior to expiration of this approval.
I have enclosed a copy of RESOLUTION NO. 2008-20 specifying the conditions
of approval set forth by the Planning Commission and the approved
Development Plan to keep for your files. Please complete the enclosed

CONSTRUCTION OF A NEW SINGLE FAMILY RESIDENCE TO REPLACE AN
EXISTING RESIDENCE AND A MINOR VARIANCE TO ENCROACH WITH 20
SQUARE FEET MAXIMUM INTO A SIDE YARD SETBACK IN ZONING CASE
NO. 763, AT 2 APPALOOSA LANE, (LOT 106-C-RI-I), (BLACK).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Drs. James and Karen Black with
respect to real property located at 2 Appaloosa Lane (Lot 106-C-RI-I), Rolling Hills, CA
requesting a Site Plan Review and Minor Variance to permit construction of a new 8,318
square foot residence (no basement), 669 square foot garage; 1,270 square feet attached
trellises, 64 square feet entryway, 1,719 square feet covered porches to replace an
existing residence and garage, and a minor Variance to encroach with 20 square feet of
the new residence up to 4.4 feet into the side yard setback. The applicant does not
propose to modify an existing 1,500 square foot stable or the existing 1,185 square foot
pool with spa. The application is properly filed as a Minor Variance, in that it is a request
to project a portion of the structure no more than five feet into a required setback.
Section 2. The Planning Commission conducted duly noticed public hearings
to consider the application at a regular Planning Commission meeting on October 21 and
November 18,2008 on which date the Planning Commission also conducted a field trip
on the project site and December 9, 2008. The applicants were notified of the public
hearings, including the field trip, in writing by first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal and from members of the
City staff, and the Planning Commission having reviewed, analyzed and studied said
proposal. The applicants' representative was in attendance at the hearings and field trip.
Section 3. The applicants propose to demolish the existing residence and
replace it with a new residence and garage. An existing on -site driveway loop will be
removed and a new motor court paved area constructed. The driveway will retain the
existing access off of Appaloosa Lane.
Section 4. As a result of a concern expressed by the Planning Commission
and a neighbor, the applicants revised their project to reduce the square footage that will
encroach into the side yard setback from 54 square feet to 20 square feet maximum, with
the maximum projection into the setback at 4.4 feet. A concern was also expressed by a
neighbor regarding egress difficulties at the intersection of her driveway with the project
driveway. The applicants addressed this concern by agreeing to widen a portion of the
driveway at this location to improve maneuverability and create a "hammerhead", which
will provide additional space for maneuvering, especially vehicles exiting from the site
and for emergency vehicles.

The Planning Commission will conduct a field inspection of your property to view a
silhouette of the proposed project on Tuesday. November 18, at 2:00 PM.
The owner and/or representative must be present to answer any questions regarding the
proposal.
The site must be prepared according to the enclosed Silhouette Construction Guidelines
and the following requirements:
A. A full-size silhouette in conformance with the
attached guidelines showing the . footprints and
roof ridges indicating heights;
B. Stake the side property line and setback line in
the area closest to the proposed residence;
C. Show the height of the finished floor of the
proposed residence;
D. With a different color ribbon/flags show trellises
and porches and their height;
E. Delineate the residential building pad area with
stakes/ribbons or surface ribbon:
The silhouette must be constructed a minimum of 5-7 days
prior to the field trip, so that neighbors who may be away
during the field trip visit would be able to view the
silhouette and comment to the City prior to or at the
meeting. The silhouette must remain on the property during
the entire review process of this case. including City
Council's review. It is, therefore, imperative that the
construction of the silhouette be sturdy. including the
stakes for the property and setback lines.

SILHOUETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.
