SUBJECT: Bond requirement: 3 Appaloosa Lane-Water Main, on site Water
Hydrant and Hydrant connections (Zoning Case No. 757)
Dear Mr. and Mrs. Fozoonmehr:
As you are aware, the L.A. County Fire Department, on behalf of the City of Rolling
Hills, is requiring construction of a fire hydrant near the proposed residence and a
water main to connect to an existing fire hydrant off site. Normally, these
improvements would have to be in place prior to issuance of building permit.
City staff is aware that you're diligently working with the appropriate property owners
and the Rolling Hills Community Association to obtain easements for placement of the
water line and that you would like to start on the construction of the foundation for the
residence before the easements are obtained. We also understand that you have all of
the necessary approvals to start the construction of the fire hydrant and the water line,
but for the easements.
Therefore, in order for you to obtain a building permit and commence construction of
the foundation only, the City of Rolling Hills is requiring a placement of a financial
obligation in the amount of the estimate of the construction of the improvements-
$49,400 plus 20% City's administrative cost, for a total of$59,280.
This obligation will be refunded to you upon completion of construction of the
necessary improvements.
Please do not hesitate to contact me, should you or your agent have any questions.

Dear Dr. Fozoonmehr,
This letter is to remind you that you are required to complete certain items on your
property at 3 Appaloosa Lane to ready it for the rainy season and to meet the
requirements for a final rough grading. Per the walk through and inspection of April 14,
2014 and a follow up email (enclosed)from Lisa Naslund,the County's Grading and
Drainage Engineer certain actions must be taken immediately. Due to the fact that you
have not obtained a building permit and the property is not an active construction site,
you are required to complete the items listed in the last paragraph of the email.
1. Contact the Biologist who prepared the original biological assessment study for
your property, (SWCA Environmental Consultants), or other City approved biologist to
review the originally prepared report on the impact of the grading on vegetation and
animal habitat and advise you how to implement the recommendations.
2. Repair the rip-rap, including extending the lower rip rap pad
3. Remove construction fencing
4. The last two items on the list require that you address the BMPs and provide
permanent solution for sediment control. One of the requirements includes vegetating
the slopes.
Please complete the above mentioned items by October 15, 2014. With the rainy season
upon us and since construction is not immediately planned it is of the outmost
importance that you protect your lot and leave it aesthetically pleasing and safe for your
neighbors.
If you have any questions, please don't hesitate to call me at 310 377-1521 or Lisa

SUBJECT: ZONING CASE NO. 757Modificaiton.
Dear Dr. and Mrs. Fozoonmehr:
The Planning Commission adopted a resolution on December 21, 2010 granting a
modification in Zoning Case No. 757. That action, accompanied by the record of the
proceedings before the Commission will be reported to the City Council on January 10,
2011, at their regular meeting beginning at 7:30 PM. You should attend this
meeting, in case the council members have any questions.
Please note that at the meeting the Planning Commission added a condition that the
property line in the area of the caissons be staked throughout the grading and
construction of the project, and that no encroachment onto adjacent properties is
allowed.
The Planning Commission's decision in this matter shall become effective thirty days
after the adoption of the resolution by the Commission, unless an appeal has been filed
or the City Council takes jurisdiction of the case within that thirty (30) day appeal period.
(Section 17.54.010(B) of the Rolling Hills Municipal Code). Should there be an appeal,
the Commission's decision will be stayed until the Council completes its proceedings in
accordance with the provisions of the Municipal Code. You or anyone else, upon
submittal of a letter and payment of a fee may appeal the Planning Commission
decision to the City Council.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's resolution, the Planning Commission's action will become final and you
will be required to cause to be recorded an Affidavit of Acceptance Form together with
the subject resolution in the Office of the County Recorder before the Commission's
action takes effect.
A copy of the Resolution with the amendment as recommended by the Planning
Commission is enclosed for your review. After the City Council's action, I will mail to you
instructions for recordation of the Affidavit Of Acceptance Form and the Resolutions.

Dear Dr. and Mrs. Fozoonmehr:
The Planning Commission voted at their regular meeting on November 16, 2010 to direct
staff to prepare a resolution to approve your request in Zoning Case No. 757Mod. and
shall be confirmed in the draft resolution that is being prepared. The Planning
Commission will review and consider the draft resolution, together with conditions of
approval, at an upcoming meeting on December 21, 2010 and make its final decision on
your application at that meeting. The meeting starts at 6:30 PM.
The findings and conditions of approval of the draft resolution will be forwarded to you
before the Planning Commission meeting.
As you heard at the meeting, the Planning Commission requires that any changes to the
approved plan before or during construction, regardless of how minor they appear,
whether necessary due to field conditions or owners' requests be brought to the
attention of staff. Also, although they waived the condition to require a third party project
manager, they expect that you will have a "superintendent" on the site at all times. You
can assign someone from your General contractor's crew to be available for questions
and be a point person for resolving issues.
The decision shall become effective thirty days after the adoption of the Planning
Commission's resolution unless an appeal has been filed or the City Council takes
jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of
the Rolling Hills Municipal Code). Should there be an appeal, the Commission's decision
will be stayed until the Council completes its proceedings in accordance with the
provisions of the Municipal Code.
Planning Commission action, accompanied by the record of the proceedings before the
Commission, is tentatively scheduled to be placed as a report item on the City Council's
agenda at the Council's regular meeting on Monday, January 10, 2011.

Dear Dr. and Mrs. Fozoonmehr:
Pursuant to state law the City's staff has completed a preliminary review of the
application noted above and finds that it is sufficient to be placed on the November 16,
2010 Planning Commission meeting.
I would suggest that in order to refresh.the Planning Commissions memory about the

You may also request that no field trip be scheduled as no changes to the residence are
proposed and the grading would be less than previously approved. (No guarantee is
given that the Planning Commission will agree).
Also be advised that during the review process the City and/or other agencies may
require additional information.
The Planning Commission meeting will be held on November 16, 2010 at 6:30 p.m. in

Dear Dr. and Mrs. Fozoonmehr:
This letter shall serve as a notification that a two-year time extension was
APPROVED by the Planning Commission at their regular meeting on September

Case no. 757)
This is a request to extend the E. pproval for grading and construction of zoning
case no. 757— reso 21008 — 1`i
July 27, 2010
Dear Sirs:
In October of 2008, the plannilg commission approved grading and construction
at #3 Appaloosa Lane. The aperoval included grading on the adjacent properties
(#17 Buggy Whip Drive and #19 Buggy Whip Drive).
After the plans were processe: with the County of LA, one of the owners of those
adjacent properties to #3 Appaloosa Lane decided not to let us do the grading on
their property.
The plan had to be revised. As ;3 result, it took the engineers and the county more
time to review it.
The revised plan included some caissons on the boundary between the Appaloosa
Lane and Buggy Whip Drive properties.
•
Soon, the county permit will b , granted. It is at this time we are requesting that
the approval be extended for TWO more years.
Sincerely,

SUBJECT: Expiration Notice: 3 Appaloosa Ln. Grading / New Home (Zoning Case
No. 757)
Dear Mr. and Mrs. Fozoonmehr:
This is a reminder that your approval for the development of a vacant lot at the
referenced address, to include grading, slope stabilization and construction of an 8,990
square foot home (Zoning Case No. 757, Reso. 2008-15) will expire on OCTOBER 17,
2010 unless construction commences on or prior to the expiration date.
You can request an extension of the approval for up to two additional year(s) if you
apply to the Planning Commission in writing prior to OCTOBER 17,2010. In your
request letter please indicate the reason for the extension. Pursuant to the municipal
code, the Commission may extend the expiration if findings can be made that the
expiration would constitute an undue hardship upon the property owner and that the
continuation of the approval would not be materially detrimental to the health, safety
and general welfare of the public.
The filing fee for a time extension is $200 payable to the City of Rolling Hills and must
accompany the extension request. The Planning Commission meets monthly on the
third Tuesday. The request for extension must be submitted to staff at least two weeks
prior to the Commission meeting.
IF YOUR APPROVAL EXPIRES, THE ASSOCIATED ZONING CASE BECOMES NULL
AND VOID, AND ANY FUTURE CONSTRUCTION, SAME OR SIMILAR, WILL
REQUIRE A NEW PLANNING APPROVAL PROCESS, INCLUDING NEW FEES.
FURTHER,SHOULD THERE BE ANY CHANGES IN THE ZONING ORDINANCE, A
NEW APPLICATION WILL BE EVALUATED UNDER THE ZONING CODE IN EFFECT

Site Plan Review for slope stabilization and grading and construction of a new
single-family residence on a vacant lot.
Dear Dr. and Mrs. Fozoonmehr:
This is to inform you that the City Council at their October 13, 2008 meeting
received and filed the Planning Commission's decision in your application.
PLEASE NOTE THE CONDITIONS OF APPROVAL IN THE RESOLUTION,
In addition, the City Council requested that for the agreement to hire a project
manager to monitor the project, the cost for such a person be deposited by the
applicant with the City up-front and the City would then draw the funds from
that account to reimburse the project manager; that any temporary toilet facility
brought to the construction site not be visible from the road; and that City
coordinate with the County for sufficient grading bond to assure that if work is
not completed and/or abandoned there are funds, with contingencies, to
complete the grading. The County only collects grading bond for remediation of
hazardous conditions if the project is not completed not a "completion of grading
bond. Therefore, the City will require a "completion grading" bond.
The approval of this case is valid for two years, with the opportunity to request
an up to two-year extension. The approval becomes null and void if work has
not commenced within the specified period of time.
Enclosed is a copy of RESOLUTION NO. 2008-15, specifying the conditions of
approval set forth by the Planning Commission. The approval will not become
effective until you complete the enclosed AFFIDAVIT OF ACCEPTANCE

yards of cut and 150,000 cubic yards of fill of soil) over an 126,000 square foot area, (2.89
acres), to achieve slope stabilization on a vacant lot located at 3 Appaloosa Lane and on
hvo adjacent lots, developed with single family residences each, at 17 Buggy Whip

a Biological Resources Assessment Study. Said study shall contain minimally
the following tasks: 1) Search of database and literature, including the review of
sensitive biological resource occurrence records contained within the California
Natural Diversity Database (CNDDB) and the California Native Plant Community
Society (CNPS) rare plant inventory. The purpose of this task will be to compile
a list of special status species occurrences within and immediately adjacent to
the project area, and also to assist in assessing the occurrence potential for other
special-status species known from within the vicinity of the project area. 2) Field
Survey of project area to perform vegetation mapping, and to assess wildlife
habitat(s). Habitats to be assessed for potential to support special-status
species. Species list to be compiled of all plant and wildlife species observed on
and directly adjacent to project site; visual scan to be performed of adjacent
areas for identifying habitats of special —status species within 500 feet of project
boundaries. Vegetation results to be used to evaluate the need for conducting
focused surveys, mitigation measures for special —status species, and re-
vegetation recommendations. 3) Biological Resources Assessment Technical
Report to include: Introduction with environmental setting and description of
project location; Methods description for literature review, database search, field
surveys and assessments for special-status species occurrence, Description of
results of databases and mapping; Discussion of distribution of biological
features within project area; Assessment of potential project impacts to biological
resources; and Recommendations for mitigation.
The Study shall be reviewed, evaluated and acted upon by the Planning
Commission as part of the environmental assessment and prior to a decision on the

include the following conditions with respect to mitigation for loss of mature
native vegetation in protected areas:
a. Any grading for remediation of the slopes shall be returned to the existing
topography, flora, and natural features to the greatest extent possible. In
order to minimize impacts to the hillsides and canyon areas on this
property, the graded slopes shall be designed and developed in a manner
that retains and restores native drought-tolerant plant life and preserves
the existing contiguous topography, flora, and natural features of that
area to the greatest extent possible. Mitigation by re-vegetation shall be
at a minimum of 2:1, or as otherwise recommended in the biological
study.
b. To prevent construction equipment from going beyond the limits of the
site, contractors shall use fencing or other barriers to the greatest extent
possible. Contractors shall be informed that work on the site shall not
encroach into natural vegetation areas except as specified on the
approved Site Plan to the greatest extent possible.
c. No grading, development, or removal of live mature vegetation shall be
permitted in areas not approved for remediation. In the event removal or
thinning of mature natural vegetation is required to comply with Fire
Department Regulations, the least invasive technique shall be utilized.
d. Prior to the issuance of any grading permit, a biologist or native plant
specialist approved by the City shall meet with the general contractor and
grading contractor to explain the boundaries of the project, the
boundaries of those areas permitted to be removed by an approved Site

Dr. and Mrs. S. Fozoonmehr
28701 Highridge Road
Rancho Palos Verdes, CA 90275
SUBJECT: ZONING CASE NO. 757, 3 Appaloosa Lane. Site Plan Review for
grading and construction of a new single-family residence on a vacant lot.
Dear Dr. and Mrs. Fozoonmehr:
Pursuant to state law the City staff has completed a preliminary review of the
application noted above and finds that the following information must be submitted as
soon as possible in order for the application to be considered by the Planning
Commission at their July 15, 2008 meeting.
• A letter or cooperation agreement between Dr. Schmit, Mr. Gargas and
yourselves allowing grading and the installation of drainage devices on their
properties. (Submit immediately)
• Exact amount of dirt movement. Separate the quantities for the residential
building pad, for the future stable area, and for the remediation of the slopes on
each affected property. Confirm the grading quantities; the quantities in the
application do not match the site plan. (Submit immediately)
• Show slope heights for all graded slopes (Submit immediately)
• Description of methodology for the remediation (slots, or otherwise), estimated
schedule of construction, method of stockpiling dirt, and show on the plans areas
proposed for stockpiling, etc. (Submit immediately)
• Calculations of the Net Lot Area for the neighboring properties that are a part of
this grading project and calculations of the disturbed area on those lots. If the
existing disturbance plus the new disturbance on either of those lots exceed 40%
a request for a Variance to exceed the 40% maximum allowed disturbance will
have to be submitted and approved by the Planning Commission in conjunction
with this project. A variance fee of $1,250 would be required. (Submit
immediately)
• Height and length of retaining walls.
• Width and length of drainage swales, (sq.ft.)
• Square footage/grading quantities of the earth and berm.
• Copy of the soils/geology report approved by LA County.
• Plot plan showing the entire property, including vicinity map. Mark the trails on
the plan, show corral area(not in setback).
®Printed on Recycled Paper
• •
• Pictures of the lot, including the rear portion of the two neighboring lots that will
be part of this project.
• Submit elevation plans for the house, including plans showing location, size and
elevation of basement wells and exit to the exterior.
• Show all solid roof and trellis like porches, entryways, barbeque areas,
patios/trellises and any other structure you think you may want to have in the
future.
• Assure that all of these structures are listed on the application form and
accounted for in the calculations.
• Show cross-sections for the graded areas, house and basement areas.
• The application shows proposed building pad coverage at 35.7%. The maximum
permitted (guideline) is 30%. Since this is a vacant lot and there are no pre-
existing conditions, I would recommend that you try to bring this down to as close
to 30% as possible. In addition the stable building pad is shown as having 100%
coverage. Please show grading and the pad for the stable.
• As discussed with Dr. Fozoonmehr, a natural resources study for this project will
be required, showing the existing conditions on the lot and on the adjacent
affected lots; how the proposed project will affect the existing flora and fauna;
and recommendations for replacement and remediation. You should undertake
this study immediately. (See enclosed list of companies)
• A licensed professional must stamp all plans.
• Prior to obtaining a grading permit, you will be required to comply with the
NPDES (National Pollution Discharge Elimination Systems) Act and its many
requirements, including preparation and implementation of the Standard Urban
Stormwater Mitigation Plan (SUSMP) and the Local Stormwater Pollution
Prevention Plan (SWPPP).
• Prior to obtaining a grading permit you will also be required to file with the
Regional Water Quality Control Board (RWQCB) a Notice of Intent (NOI) for
disturbance of more than one acre of land.
Your engineer and the local Building and Safety Department will advise you on the
content requirements for the last two items above.
Initially we will need 8 copies of the plans (more than one sheet may be submitted), and
later on additional 7 copies will be required.
Please submit the required information by June 30, except for those requested to
be submitted immediately.
Also be advised that in addition to the above, during the review process the City and/or
other agencies may require additional information.
I would like to inform you that since your last submittal several years ago, some City and
State regulations have changed. In addition, the Planning Commission has been
requesting much more detailed information and specifics for each protect. They are
looking very closely at grading, elevations, heights, drainage, coverages, landscaping,
slope heights, and other aspects of development. Therefore, to avoid any delays in the
processing of the application, it is to your benefit to have all requested information
submitted.
Should you be able to submit all of the above by June 30, (except as specified
otherwise), the case will be scheduled at the July 15, 2008 Planning Commission
•
