The City of Rolling Hills Planning staff has determined that the following conditions or changes in the project are necessary in order to assure that there will be no substantial evidence that the proposed project may have a significant effect on the environment. Please read the conditions and sign the attached form, agreeing to accept these conditions and return the form to me prior to the July 15, 2008 meeting. AIR QUALITY Mitigation Measures 1. The property owners shall be required to conform with South Coast Air Quality Management District, Los Angeles County and local ordinances and engineering practices during construction by using dust control measures to stabilize the soil from wind erosion and reduce dust generated by construction activities. Fugitive Dust a. A Comprehensive Fugitive Dust Control Program shall be developed and implemented before commencement of grading activities, subject to review and approval of the City Planning Department and the South Coast Air Quality Management District (SCAQMD). This Plan, at minimum, shall address compliance with SCAQMD Rule 403, including: -Regular site watering -Application of soil stabilizers to inactive graded areas -Covering and/or washing of transport trucks leaving the site - Periodic street cleaning of roads adjacent to the site b. A High Wind Response Plan in accordance with Rule 403 of the SCAQMD shall be developed and implemented at times when wind speeds exceed 25 mph to reduce emissions. The High Wind Response Plan shall be ®Printed on Recycled Paper • Y ' • developed and implemented before commencement of grading activities, subject to review and approval of the City Planning Department and the SCAQMD. c. Stockpiles of soil, sand and similar materials shall be stabilized by being covered, watered a minimum of twice daily, or with application of non-toxic soil binders. Construction Equipment Exhaust d. Heavy construction equipment shall be properly tuned and maintained to reduce emissions. Construction equipment shall be fitted with the most modern emission control devices. The construction manager shall monitor compliance with this measure and is subject to periodic inspections by City Building Inspectors. e. The project shall comply with Rule 461, which establishes requirements for vapor control from the transfer of fuel from the fuel truck to vehicles both during construction and subsequent operations. BIOLOGICAL RESOURCES Mitigation Measures 1. The applicant shall be required to prepare a biological assessment in the form of a Biological Resources Assessment Study. Said study shall contain minimally the following tasks: 1) Search of database and literature, including the review of sensitive biological resource occurrence records contained within the California Natural Diversity Database (CNDDB) and the California Native Plant Community Society (CNPS) rare plant inventory. The purpose of this task will be to compile a list of special status species occurrences within and immediately adjacent to the project area, and also to assist in assessing the occurrence potential for other special-status species known from within the vicinity of the project area. 2) Field Survey of project area to perform vegetation mapping, and to assess wildlife habitat(s). Habitats to be assessed for potential to support special-status species. Species list to be compiled of all plant and wildlife species observed on and directly adjacent to project site; visual scan to be performed of adjacent areas for identifying habitats of special —status species within 500 feet of project boundaries. Vegetation results to be used to evaluate the need for conducting focused surveys, mitigation measures for special —status species, and re- vegetation recommendations. 3) Biological Resources Assessment Technical Report to include: Introduction with environmental setting and description of project location; Methods description for literature review, database search, field surveys and assessments for special-status species occurrence, Description of results of databases and mapping; Discussion of distribution of biological features within project area; Assessment of potential project impacts to biological resources; and Recommendations for mitigation. The Study shall be reviewed, evaluated and acted upon by the Planning Commission as part of the environmental assessment and prior to a decision on the project Site Plan Review during the public hearing process. The applicant shall incur ' • the cost for preparation of the biological assessment study and shall be required to comply with all mitigation measures recommended in the biological assessment as approved by the City. 2. During the plan review process, the applicant will be required to submit plans to the Los Angeles County Fire Department for determination of Fuel Modification Zone and related re-vegetation requirements. The remainder of no-structure areas outside of the designated Fuel Modification Zone will be planted in accordance with recommendations of the Vegetation Survey. 3. Site Plan Review for this project by the Planning Commission, if approved, shall include the following conditions with respect to mitigation for loss of mature native vegetation in protected areas: a. Any grading for remediation of the slopes shall be returned to the existing topography, flora, and natural features to the greatest extent possible. In order to minimize impacts to the hillsides and canyon areas on this property, the graded slopes shall be designed and developed in a manner that retains and restores native drought-tolerant plant life and preserves the existing contiguous topography, flora, and natural features of that area to the greatest extent possible. Mitigation by re-vegetation shall be at a minimum of 2:1, or as otherwise recommended in the biological study. b. To prevent construction equipment from going beyond the limits of the site, contractors shall use fencing or other barriers to the greatest extent possible. Contractors shall be informed that work on the site shall not encroach into natural vegetation areas except as specified on the approved Site Plan to the greatest extent possible. c. No grading, development, or removal of live mature vegetation shall be permitted in areas not approved for remediation. In the event removal or thinning of mature natural vegetation is required to comply with Fire Department Regulations, the least invasive technique shall be utilized. d. Prior to the issuance of any grading permit, a biologist or native plant specialist approved by the City shall meet with the general contractor and grading contractor to explain the boundaries of the project, the boundaries of those areas permitted to be removed by an approved Site Plan, and the restrictions contained in this condition. e. No contractor, operator of a bulldozer or other equipment or other construction worker on the site shall allow equipment, supplies or soil to encroach into the area not being remediated. f. No chemicals, including but not limited to fertilizers, pesticides, herbicides, detergents, chlorine or pool chemicals, shall be used, disposed of, or allowed to drain into adjacent areas, except fertilizers approved by a City approved biologist. • � • • g. The actual size of the mitigation area shall be based upon acreage of areas that are disturbed, or are planned to be disturbed in connection with the slope repair. Nothing contained in this condition shall limit the authority of the City to require additional areas or greater areas of the parcel to be re-vegetated with native and drought tolerant plants to mitigate additional impacts, if any. h. Mitigation areas shall be planted with native and drought tolerant plants as specified in the required biological study, unless otherwise required by the Planning Commission or the City Council. All requirements of the Regional Water Quality Control Board, U.S. Department of Fish and Game as well as other agencies reviewing this project shall be met. A bond in the amount of the cost estimate of the implementation of a re- vegetation and landscape plan plus 15%, shall be required to be posted prior to issuance of a grading and building permit and shall be retained with the City for not less than two years after landscape installation. The retained bond will be released not sooner than two years after the initial plantings, after the City determined that landscaping was installed pursuant to the landscape plan as approved, and that such landscaping is properly established and in good condition. In the event that another agency such as the U.S. Department of Fish and Game, after reviewing this Initial Study and mitigation measures, determines that additional study, replanting or other measures must be taken, pursuant to State Law, the applicant shall be required to implement such measures. j. Following the initial plantings, a biologist or native plant specialist shall prepare a report for the City of Rolling Hills on the progress of re- vegetation on the site along with recommended remedial measures, if needed, prior to the City reimbursing the landscaping bond funds. k. The applicant shall comply with the report to be prepared by the biologist, including the re-vegetation of specified type of plants, planting schedule, soil treatment procedures and establishment of a soil ecosystem, irrigation, time for recovery, care and maintenance, and monitoring. GEOLOGY AND SOILS Mitigation Measures 1. An Erosion Control Plan containing the elements set forth in the County of Los Angeles Uniform Building Code shall be prepared to minimize erosion and to protect slopes and channels to control stormwater pollution as required by the County of Los Angeles. 2. The applicant shall submit a geotechnical report for review and approval by the County of Los Angeles Geologist prior to issuance of a grading permit. Prior to the submittal of an applicable final grading plan to the County of Los Angeles for plan check, a detailed grading and drainage plan with related geology, soils and hydrology reports must be submitted to the Rolling Hills Planning Department staff for their review. Cut and fill slopes shall not exceed a steepness of a 2 to 1 slope ratio. • � i 3. Intensive geotechnical review and supervision shall be required throughout the time the project is ongoing. 4. As part of the soils and geology report, location for a future septic tank to serve the new single family residence will be established. All applicable State and County requirements pertaining to septic tanks construction and maintenance shall be complied with. HYDROLOGY AND WATER QUALITY Mitigation Measures 1. The applicant shall submit and obtain approval of a drainage report from the Los Angeles County Building Official, prior to issuance of any grading permits and/or a building permit for new construction. 2. The applicant shall submit and obtain approval of a Local Stormwater Pollution Prevention Plan (SWPPP) to the City of Rolling Hills and Los Angeles County Building Official, prior to issuance of any grading permits and/or a building permit for new construction. 3. The applicant shall submit and obtain approval of a Standard Urban Stormwater Mitigation Plan (SUSMP) to the City of Rolling Hills and Los Angeles County Building Official, prior to issuance of any grading permits and/or a building permit for new construction. 4. The applicant shall submit a Notice of Intent to the State Water Resource Control Board under the General Construction Activity Storm Water Permit for grading of one acre or more of land area. SEPTIC TANK Mitigation Measures 1. The property owners shall be required to conform to County Health Department requirements for the installation and maintenance of septic tanks. 2. An Erosion Control Plan per County of Los Angeles Uniform Building Code requirements shall be prepared to minimize erosion and to protect slopes and channels to control stormwater pollution as required by the County of Los Angeles. NOISE Mitigation Measures 1. Although approval of the project will result in intermittent loud noise levels during grading operation, and construction the noise will be temporary. During construction, the property owners shall be required to schedule and regulate construction activities including related traffic, and therefore limit noise throughout the day between the hours of 7 AM and 6 PM, Monday through Saturday only, when construction and mechanical equipment noise is permitted i s so as not to interfere with the quiet residential environment and normal flow of traffic of the City of Rolling Hills. 2. The contractor shall be required to install on all vehicles and construction equipment properly maintained and operating mufflers and other state required noise attenuation devices. 3. During grading and construction operations, trucks shall not park, queue and/or idle at the project site or in the adjoining right-of-way before or after the permitted hours of operations. 4. There shall be no staging of equipment or accumulation of vehicles on Appaloosa Lane. All staging and parking shall be on the subject site. RECREATION Mitigation Measures 1. The applicant shall be required to restore and improve the equestrian trail after grading to the satisfaction of the Rolling Hills Community Association. TRANSPORTATION Mitigation Measures 1. During construction, the property owners shall be required to schedule and regulate truck traffic throughout the day between the hours of 7 AM and 6 PM Monday through Saturday only so as not to interfere with the normal flow of traffic within the City of Rolling Hills. 2. The contractor is to encourage his employees to car-pool into the City. 3. During grading and construction operations, trucks shall not park, queue and/or idle at the project site or in the adjoining right-of-way before or after the permitted hours of operations. 4. There shall be no staging of equipment or accumulation of vehicles on Appaloosa Lane. All staging and parking shall be on the subject site. 5. During grading/construction proper construction signs shall be installed along the street warning drivers of the construction. 6. The contractor shall ensure that there is no unnecessary delay of traffic along off site access roads by heavy equipment blocking traffic. 7. Construction activities shall be organized so as not to interfere significantly with peak-hour traffic and minimize obstruction of traffic lanes and if necessary, a flag person shall be retained to maintain safety adjacent to the existing roadways. UTILITIES AND SERVICES Mitigation Measures 1. The property owners shall be required to conform with the Regional Water Quality Control Board and County Building Department requirements for the installation and maintenance of stormwater drainage facilities, if additional facilities are required as a result of the restoration of the equestrian trail. • - i 2. The property owners shall be required to conform with the Regional Water Quality Control Board and County Public Works Department Best Management Practices (BMP's) related to solid waste. 3. The property owners shall be required to comply with the requirements of the Rolling Hills Community Association and the Los Angeles County Public Works Department for the construction of a culvert, if required, at the equestrian trail. 4. The property owner shall be required to provide adequate site drainage and comply with NPDES standards and requirements. OTHER 1. Grading and all other activities conducted in the easements on subject property or across property lines on adjacent properties shall be reviewed and approved by the Rolling Hills Community Association. 2. The property owner shall be required to comply with the requirement that 50% of all construction materials and debris be diverted and recycled. Verification of compliance shall be submitted to staff. 3. Utility lines to the new residence and accessory structures shall be placed underground. 4. The applicant shall be required to comply with the City's requirements for Class "A" roof material and construction, requirements of the lighting ordinance, and all other City and County of Los Angeles construction requirements. Please note that during the project review process the Planning Commission, City Council, Rolling Hills Community Association and other local and state agencies may require that additional measures and conditions be implemented. (Submit immediately) • Exact amount of dirt movement. Separate the quantities for the residential building pad, for the future stable area, and for the remediation of the slopes on each affected property. In addition the stable building pad is shown as having 100% coverage. Please show grading and the pad for the stable. • As discussed with Dr. Fozoonmehr, a natural resources study for this project will be required, showing the existing conditions on the lot and on the adjacent affected lots; how the proposed project will affect the existing flora and fauna; and recommendations for replacement and remediation. You should undertake this study immediately. (See enclosed list of companies) • A licensed professional must stamp all plans. • Prior to obtaining a grading permit, you will be required to comply with the NPDES (National Pollution Discharge Elimination Systems) Act and its many requirements, including preparation and implementation of the Standard Urban Stormwater Mitigation Plan (SUSMP) and the Local Stormwater Pollution Prevention Plan (SWPPP). • Prior to obtaining a grading permit you will also be required to file with the Regional Water Quality Control Board (RWQCB) a Notice of Intent (NOI) for disturbance of more than one acre of land.
