and garden room. Variances are required for two light wells into the basement. Also a
variance is required for the garden room in that it is positioned in front of the house,
though not in the front yard setback.

Criteria to he satisfied for grant of Variance
Such change is based upon the following described exceptional or extraordinary circumstances or
conditions that do not apply generally to other property in the some vicinity and zone.
Light wells:
The subject property is extremely narrow in comparison to it length. This is an exceptional
condition for the neighborhood. 'rne light wells are required by the building department
for ventilation, natural light and egress.
Garden room:
Due to the nature of the shape of the property, it would be a hardship to locate the garden room
in the rear yard in that the extraordinary view from the rear yard would be blocked from the
house.
Such change will not be materially detrimental to the public welfare nor injurious to the property or
improvements in such vicinity and zone where property is located because
Light wells: The encroachment of the proposed light wells are substantially less in depth,
width and mass than the existing encroachments of the existing residence. It should be noted
that these existing encroachments of the residence were expanded to current conditions when a
variance was granted by the planning commission in 2000. The encroachments are in the side
and will not effect the neighborhood or surrounding properties.
Garden room:
The proposed residence is set back well over 150 feet from the property line at it's closest
point, with the majority of the home setback more than 240 feet. The expansive open space in
the front yard comfortably supports the small (450 sq. ft.) garden room. The narrow nature
of the property places a hardship on locating the garden room in side yards or rear yards.
