This letter shall serve to inform you that the City Council at their August 25, 2003 meeting received
and filed the information forwarded to them pertaining the Planning Commission's decision in Zoning
Case No. 666.
The Planning Commission's decision in this matter shall become effective thirty days after the
adoption of the resolution by the Commission. Please contact the Los Angeles County Building and
Safety Department in Lomita at 534-3760 to check if building permits are required for the trellis, walls
in the front yard and the reflection pond.
Please also be advised of the lighting requirements of the City of Rolling Hills. I am enclosing the
Lighting Ordinance.
We have enclosed a copy of RESOLUTION NO. 2003-15, specifying the conditions of approval set
forth by the Planning Commission and the approved Exhibit A Development Plan to keep for your
files. Once you have reviewed the Resolution, please complete the enclosed AFFIDAVIT OF

This letter shall serve to notify you that the Planning Commission adopted a resolution on August 19,
2003, granting a Variance to retain previously constructed trellis and walls in the front yard setback
and a reflection pond in the side yard setback at 6 Packsaddle Road, Rolling Hills, CA in Zoning Case
No. 666. That action, accompanied by the record of the proceedings before the Commission will be
reported to the City Council on Auaust 25. 2003. You or your representative should be
present.
The City Council meeting is scheduled at 7:30 p.m on Monday, August 25, 2003 in the Council
Chambers in City Hall.
The Planning Commission's decision in this matter shall become effective thirty days after the
adoption of the resolution by the Commission, unless an appeal has been filed or the City Council
takes jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of the
Rolling Hills Municipal Code). Should there be an appeal, the Commission's decision will be stayed
until the Council completes its proceedings in accordance with the provisions of the Municipal Code.
If no appeals are filed within the thirty (30) day period after adoption of the Planning Commission's
resolution, the Planning Commission's action will become final and you will be required to cause to be
recorded an Affidavit of Acceptance Form together with the subject resolution in the Office of the
County Recorder before the Commission's action takes effect. I will provide you with instructions on
the filing after the City council's meeting.
A staff report together with the Resolution of approval, which will be presented to the City Council, will

Re: A curved concrete and steel retainer wall 5 feet high, @ 15 feet long and is to be
used to provide stability and prevent soil erosion of a side yard slope. This wall is 2
feet lower than our neighbor's lawn, it cannot be seen from his home and he has no
objections as stated during our last Planing Committee Public Hearing. This wall is
an extension of a retainer wall 5 feet high and 70 feet long the City of Rolling Hills
instructed us to build 43 years ago during the original construction of our home.

follow it to the Letter.

John, I spoke to our City Attorney and here is what she recommends, assuming that the applicant is
proposing to move the spa out of the setback and will request re -consideration by the Planning
Commission of the Variance for the wall due to new evidence:
1. The applicant should withdraw in writing the Variance request for the spa and the wall. This
will prevent the Commission from voting at the 8/19/03 meeting to deny that part of the application.
I will have the resolution of approval for the other Variance ready for that meeting. Once the
Commission votes to deny the request for spa & wall, the only option the applicant will have is to
appeal the denial to the City Council.
2. In writing state that you (owners) will move the spa out of the setback.
3. Re -submit an application to ask for a Variance for the wall in the setback only. Provide new
evidence and information of why this wall is necessary. If the Commission denies this request, you
still will have the option to appeal to the City Council. (Additional fee will be required).
4. Since we will have to re -notify to residences within 1000' radius, advertise a new public
hearing and prepare a new report, a fee of 2/3 of the original fee or $833 must be paid. This is the
same amount if you appealed to the City Council.
5. Should you wish to proceed in this manner, let me know ASAP. I will then inform the Planning
Commission chair and make sure that she is comfortable with this process.
6. If the applicant and the Commission chair is willing to proceed as stated above, I will try to do
all this at the 8/19/03 meeting, if you get all the above to me by August 4th, 2003, including 15 sets
of plans showing the spa outside the setback, and a new Variance application, with more reasons
why the Variance should be approved (i.e. drainage, privacy and drainage due to loss of trees and
foliage etc.)

This letter shall serve to notify you that the Planning Commission voted at their regular meeting
on July 15, 2003 to direct staff to prepare a resolution to approve your request to retain the
previously constructed trellis, stairs wall and reflection pond and to deny your request for the
almost completed wall and future spa in the side yard setback. The Planning Commission will
review and consider the draft resolutions, together with conditions of approval/denial at an
upcoming meeting and make its final decision on your application at that meeting.
The findings and conditions of approval/denial of the draft resolutions will be forwarded to you •
before the next Planning Commission meeting.
The decision shall become effective thirty days after the adoption of the Planning Commission's
resolution unless an appeal has been filed or the City Council takes jurisdiction of the case within
that thirty (301 day appeal period. (Section 17.54.010(B) of the Rolling Hills Municipal Code).
Should there be an appeal, the Commission's decision will be stayed until the Council completes
its proceedings in accordance with the provisions of the Municipal Code.
The Planning Commission's action to approve part of the request and to deny part of the
development application is scheduled for Tuesday. August 19, 2003. That action, accompanied
by the record of the proceedings before the Commission, is tentatively scheduled to be placed as
a report item on the City Council's agenda at the Council's regular meeting on Monday, August
25, 2003.

Dr. Murrell has been a patient of mine since 1994. He has a history of left
shoulder rotator cuff problems, arthritis in both thumbs with significant
cartilage loss, weakened wrists and recently, a tom muscle and possible
rotator cuff problem in his right arm. His arms, thumbs and hands
continue to become quite sore. Movement and function is limited and he
requires pain medication daily.
A highly effective and recommended therapy used in orthopedics to lessen
pain, reduce joint and muscle stiffness, increase movement and promote
healing is frequent soaking of the affected areas in warm water combined
with mild exercise. The Jacuzzi type spa is the preferred type of
equipment for most therapy because of ease of use, duration and constancy
of heat, gentle exercise and ease of appendage manipulation due to the
floatation effect and high patient compliance because of convenience and
relative improved comfort level.
I believe frequent warm water soaking combined with mild exercise would
significantly improve the condition of Dr. Murrell's shoulders, arms and
hands and possibly, reduce his medication requirements. It seem the most
sensible way to accomplish this is with a Jacuzzi type spa.
