The Commission finds that the applicant requests the conditional use permit for construction of a swimming pool in a legal location on the property, which consists of 2.355 acres in the RAS-2 zone. The Commission finds that a conditional use permit should be granted in order to preserve substantial property rights • • possessed by other property in the same vicinity and zone, and that the granting of such conditional use permit would not be materially detrimental to the public welfare nor injurious to property in the same vicinity and zone. From the foregoing it is concluded that a conditional use permit should be granted under Section 3.01, Paragraph 3 (c) of Ordinance No. 112 for construction of a swimming pool to Mr. Joseph McLaughlin, Lot 69C-3-MS, and it is, therefore, so ordered. /s/ Forrest Riegel Chairman, Planning Commission dte44.44.4.., ry, 'lanni Commis sion
