93, Construct a stable within fron, Resolutions & Approval Conditions• • BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Mr. William B. Stringfellow Lot 69C-1-MS ZONING CASE NO. 93 FINDING AND FORMAL REPORT The application of Mr. William B. Stringfellow, Lot 69C-1-MS, Miscellaneous Tract, for a variance of front yard requirements under Article III, Section 3.06 of Ordinance No. 33 came on for hearing on the 21st day of October, 1969 at the hour of 8:00 P.M. at the Adminis- tration Building of the City of Rolling Hills, California, and the applicant, having submitted evidence in support of his application, the Planning Commission, being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. William,B. String- feloow, is the owner of that certain real property described as Lot 69-C-1-MS, Miscellaneous Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II. The Commission further finds that no person appeared at said public hearing in opposition to the application for a variance, and that no evidence was received by the Commission in opposition thereto. III. The Commission further finds that although Crest Road borders the property on the north side, the residence is oriented toward the south, with lawn and formal landscaped area on the south side, and the property, as well as neighboring property is deed restricted with regard to stable locations. The owner stated that the location in the front yard on which he wishes to build a stable is the only nearly level terrain available r r • for the purpose, is 18 feet above road grade at Crest Road, would not be visible from the road or from a future residence to be built on another lot owned by Mr. Stringfellow. Further, it would be in the same area as a stable on other property similarly deed restricted. The Commission finds, therefore, that the variance of front yard requirements to allow construction of a stable in the front yard should be granted to the appli- cant in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detrimental to the public welfare, nor injurious to property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance of front yard requirements should be granted by the Planning Commission of the City of Rolling Hills to Mr. William B. Stringfellow, Lot 69C-1MS, Miscellaneous Tract, in accordance with the plot plan marked Exhibit I on file in these proceedings, and it is, therefore, so ordered.
