FINDINGS AND FORMAL REPORT
The application of Paul Toma and Catherine Toma, 5 Crest
Road West, Rolling Hills for a RA-S Zone Use Variance, came on for
hearing on the 28th day of December, 1965 at the hour of 8:00 P.M.
at the City Hall of the City of Rolling Hills, California, and the
applicants having submitted evidence in support of, their appli-
cation, the Planning Commission, being advised, now makes its
Findings and Formal Report as required by the Ordinances of the
City of Rolling Hills, California.
I.
The Commission finds that the applicants, Paul Toma and
Catherine Toma, are the owners of that certain real property
described as Lot 55-B, Miscellaneous Parcels, located in the City
of Rolling Hills, California, and that notice of the public hear-
ing in connection with said application was given as required by
Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling
Hills, California.
II.
The Commission further finds that no person appeared at
said public hearing in opposition to the application for a variance
and that no evidence was received by the Commission in opposition
thereto.
III.
The Commission further finds that a new residence recently
was constructed on said Lot 55-B-MS and that there is an older,
smaller residence on the said lot which the applicants propose
to use as servants' quarters with kitchen facilities, and further
finds that the variance should be granted to the applicants in
order to preserve substantial property rights possessed by other
property in the same vicinity and zone, and that the granting of
such variance will not be materially detrimental to the public
welfare or injurious to property or improvements in such vicinity
and zone in which applicant's property is located.
Iv.
From the foregoing it is concluded that a variance should
be granted by the Planning Commission of the City of Rolling Hills
to Paul Toma and Catherine Toma of Lot 55-B, Miscellaneous Parcels,
in accordance with the Plot Plan marked Exhibit I on file in these
proceedings on the following conditions,and upon the acknowledgment
and acceptance by the applicants of these condition, it is so
ordered:
1. The accessory building described in the application
shall be occupied by servants only.
2. The variance shall exist only so long as the appli-
cants, Paul Toma and Catherine Toma, or either of
them, are the owners of the fee title to said
property, and shall terminate when said applicants
or either of them shall convey or lease their
interest in said property to a new owner or Lessee.

3. Said applicants or either of them shall give
ten days' notice in writing to the Planning
Commission of the City of Rolling Hills prior
to the sale or lease of said property, of
their intention to so sell or lease, and shall
prior to the transfer of said property remove
all kitchen facilities now or hereafter con-
structed in said accessory building.
4. That the real property for which this variance
is requested by applicants is described as
Lot 55-B of Miscellaneous Parcels, known by
street number as 5 Crest Road West, Rolling
Hills; and that applicants agree that there
shall never be located on said described
property more than one single family residence
or occupied by more than one family except in
accordance with conditions set forth in the
granting of this variance.
