COMPLIANCE FOR LOT LINE ADJUSTMENT FOR 1 CREST ROAD
EAST AND 2 CREST ROAD WEST IN ZONING CASE NO. 541B.
Mr. Paul L. Saffo, III and Dr. Donald L. Leake, 1 Crest Road East and 2
Crest Road West (Irregular Lots 1-FT and 4-C-CH, respectively)
BACKGROUND
1. The Planning Commission approved the subject resolutions on June 18, 1996
at their regular meeting.
2. The applicants are requesting that the lot line between 1 Crest Road East and
(Lot 1-FT) and 4 Cinchring Road (Lot 6-CH) be adjusted so that the dividing
lot line between the two properties will be moved 15 feet east at the north and
295 feet east at the south, thereby transferring a .686 acre triangular wedge-
shaped portion of land from Lot 1-FT to Lot 6-CH.
The applicants are also requesting that the lot line between 1 Crest Road East
(Lot 1-FT) and 2 Crest Road West (Lot 4-C-CH) be adjusted so that the dividing

lot line between the two properties will be moved 11 feet east at the north and
15 feet east at the south, thereby transferring a .051 acre rectangular shaped
portion of land from Lot 1-FT to Lot 4-C-CH. No new lots are being created.
The 80 foot wide "L" shaped private easement shown on the assessor's map
within Lot 1-FT that currently exists on the westerly side of Portuguese Bend
Road will be relocated and decreased in size to a 60 foot easement from the
centerline of Crest Road to southern end of the lot on Portuguese Bend Road.
10 feet of the same 80 foot wide "L" shaped private easement will be relocated
and decreased in size to a 10 foot easement from the centerline of Crest Road
to the centerline of Cinchring Road for Lot 4-C-CH and to the southern end of
the existing. "L" shaped easement on the south on Portuguese Bend Road on
Lot 6-CH.
The area of existing Lot 1-FT is 4.85 acres gross, 2.69 acres net, existing Lot 6-
CH is 1.695 acres gross, 1.30 acres net, and existing Lot 4-C-CH is 2.34 acres
gross, 1.59 acres net. The proposed acreage for Lot 1-FT will be 4.17 acres gross,
2.41 acres net, proposed acreage for Lot 6-CH is 2.38 acres gross, 1.8 acres net
and the proposed acreage for Lot 4-C-CH is 2.39 acres gross and 1.59 acres net.
The net lot area of Lot 4-C-CH will remain the same because the transferred
land will remain an easement and perimeter easements are excluded for the
net lot area calculation.
The full portion of each reconfigured lot will remain in its existing zone by
the clerical adjustment of the zoning boundary to the new lot line
boundaries. No new lots will be created by this proposal.
According to the Subdivision Map Act, the Planning Commission may not
impose conditions or exactions on its approval of a lot line adjustment except
to conform to local zoning and building ordinances. Attached is Section
17.16.060 of the Zoning Ordinance describing lot area and dimensions.
Referring to Section 16.16.010 Lot Size: Each of the three proposed lots is
greater than the minimum acreage for its zone. Lots 6-CH and 4-C-CH are
greater than the one acre net as required in the RA-S-1 Zone and Lot 1-FT is
greater than the two acre net as required in the RA-S-2 Zone.
Referring to Section 16.16.040 Widths and depths of lots, Lots 6-CH and 4-C-
CH are existing lots that will receive additional acreage. Although Lot 1-FT
will be reduced in size, the proposed lot will exceed minimum dimensions.
3. Lot 1-FT contains an existing house and attached garage that was originally
built in 1955, Lot 6-CH contains an existing house and attached garage that
was originally built in 1955, and Lot 4-C-CH contains an existing house and
attached garage that was originally built in 1962.
4. Adjusted Lot 1-FT will have a structural lot coverage of 5.8% (20% maximum
permitted), a total lot coverage of 17.1% (35% maximum permitted), and a

building pad coverage of 19.7% (Planning Commission guideline maximum
of 30%). The disturbed area will be approximately 23% (40% maximum
permitted).
5. No development on any of these lots is currently proposed.
6. The project has been determined to be categorically exempt pursuant to the
California Environmental Quality Act (CEQA).
RECOMMENDATION
It is recommended that the City Council receive and file Resolution Nos. 96-13 and
96-14.

THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. Paul L. Saffo, III and Mr. Lon
R. Clearwaters with respect to real property located at 1 Crest Road East and 4
Cinchring Road (Irregular Lots 1-FT and 6-CH) requesting a Certificate of Compliance
for a Lot Line Adjustment to move the common side lot lines dividing these two
parcels easterly so that a triangular portion of existing Lot 1-FT is placed into Lot 6-
CH.
Section 2. California Government Code Subsection 66412(d) authorizes lot
line adjustments without requiring a tentative map, parcel map or final map if: (A)
The lot line adjustment involves two or more existing adjacent parcels, where land
is proposed to be taken from one parcel and added to an adjacent parcel; (B) A greater
number of parcels than originally existed is not thereby created; (C) The lot line
adjustment will create parcels that conform to local zoning and building ordinances;
and (D) The lot line adjustment is approved by the City. The City may impose
conditions on the Lot Line Adjustment in order to make the lot conform to local
zoning and building ordinances, to require the prepayment of real property taxes
prior to the approval of the Lot Line Adjustment or to facilitate the relocation of
existing infrastructure or easements.
Section 3. The Planning Commission conducted a duly noticed public
hearing to consider the application at a regular meeting and at a field trip visit on
June 18, 1996.
Section 4. The Planning Commission finds that the project is categorically
exempt from environmental review under the California Environmental Quality
Act pursuant to a Class 5 exemption provided by Section 15305 of the State CEQA
Guidelines.
Section 5. The Planning Commission has considered the evidence, both
written and oral, presented in connection with this application and finds as follows:
A. Section 16.16.010(B) of the Rolling Hills Subdivision Ordinance and
Section 17.16.060(A) of the Rolling Hills Zoning Ordinance requires that each lot in
any subdivision in the RA-S-1 Zone shall have a net area of not less than forty-three
thousand five hundred sixty square feet (1.0 acre) and each lot in any subdivision in

the RA-S-2 Zone shall have a net area of not less than eighty-seven thousand one
hundred twenty square feet (2.0 acres). Lot 1-FT is located in the RA-S-2 Zone and
Lot 6-CH is located in the RA-S-1 Zone. The proposed lot line adjustment will result
in Lot 1-FT to be 2.41 net acres and Lot 6-CH to be 1.8 net acres after excluding
easements. The full portion of each reconfigured lot will remain in its existing zone
by the clerical adjustment of the zoning boundary to the new lot line boundaries.
B. Section 16.16.020 of the Rolling Hills Subdivision Ordinance and
Section 17.16.060(B)(3) of the Rolling Hills Zoning Ordinance require that in all cases
where practicable, the sidelines of lots shall be at approximate right angles or radial
to the street upon which such lot fronts. The existing sidelines of both lots are
approximately at right angles or radial to the street. The proposed adjustment will
allow the westerly side lot line of Lot 1-FT to be parallel to the curve of Portuguese
Bend Road and the front and rear lot lines to be approximately at right angles or
radial to Crest Road. The proposed adjustment will allow the sidelines of irregular
Lot 6-CH to be approximately parallel to each other and radial to the curved
Cinchring and Portuguese Bend Roads.
C. Section 16.20.230 of the Rolling Hills Subdivision Ordinance requires
that ten (10) foot wide easements be dedicated for bridle trail and utility purposes
over the strips and portions of land within and abutting upon the sidelines and rear
lines of each lot. The proposed adjustment will require the relocation of existing
easements so that an existing "L" shaped easement that borders the interior of the
existing Lot 1-FT will be relocated along the westerly side of Portuguese Bend Road
and will result in a 10 foot wide easement along the easterly side lot line of the
adjusted Lot 6-CH along Portuguese Bend Road north to the center of Cinchring
Road.
D. Conditions have been attached to this approval which provide that it
will not impair or limit the City's application of the Site Plan Review Ordinance to
any future development of Lot 1-FT or Lot 6-CH.
Section 6. In accordance with the foregoing findings, a Conditional
Certificate of Compliance for lot line adjustment sought in Zoning Case No 541A as
indicated on the map attached hereto as Exhibit "A" is hereby approved as a
Conditional Certificate of Compliance subject to the following conditions:
A. There exists an "L" shaped private easement shown on the assessor's
map that currently exists on the westerly side of Portuguese Bend Road within the
current boundaries of Lot 1-FT that has an eighty (80) foot width [forty (40) feet on
each side of the centerline of that easement] for the vertical north -south segment of
the "L" and a sixty (60) foot width [thirty (30) feet on each side of the centerline of
that easement] for the horizontal east -west segment of the "L." That portion of this
easement that will exist within the proposed new boundaries of Lot 6-CH after this
lot line adjustment shall be relocated and decreased in size to a ten (10) foot wide
easement abutting and following the western boundary of the existing Portuguese

Bend Road easement from the centerline of Cinchring Road on the north to the
terminus of the existing "L" shaped easement at its intersection with Portuguese
Bend Road on the south. The map attached to the Conditional Certificate of
Compliance, referred hereto as Exhibit "A" shall delineate and note the easement
specified in this paragraph."
B. The lot line adjustment shall not in any way constitute any
representation that Lot 1-FT and Lot 6-CH can be redeveloped in compliance with
current zoning and building ordinance standards although a single family residence
exists on each lot. No development shall occur on the properties without first
complying with all applicable City Building and Zoning requirements and other
applicable rules and regulations.
C. The lot line adjustment shall not in any respect limit or impair the
City's application of the Site Plan Review Ordinance (Ordinance No 221, 1988) to Lot
1-FT and Lot 6-CH at such time as an application is made for development.
D. The lot line adjustment shall not in any respect waive, release or be
construed to supersede any restriction, dedication or condition set forth on Final
Tract Map Nos. 27516 and 26343, and all such matters are hereby reserved.
E. The Certificate of Lot Line Adjustment shall not be issued until a legal
description complying with the delineation of adjustment, and including, the
required easements as specified in Paragraph A of Section 6 are submitted to, and
approved by the City. Upon the City's approval of the legal description, the
Conditional Certificate of Compliance shall be issued by the City, shall be recorded by
the property owner in the offices of the Los Angeles County Recorder, and evidence
of the recordation shall be returned to the City.
F. The applicants shall execute an Affidavit of Acceptance of all
conditions or this Lot Line Adjustment shall not be effective.

lot line between the two properties will be moved 11 feet east at the north and
15 feet east at the south, thereby transferring a .051 acre rectangular shaped
portion of land from Lot 1-FT to Lot 4-C-CH. No new lots are being created.

centerline of Crest Road to southern end of the lot on Portuguese Bend Road.
10 feet of the same 80 foot wide "L" shaped private easement will be relocated
and decreased in size to a 10 foot easement from the centerline of Crest Road
to the centerline of Cinchring Road for Lot 4-C-CH and to the southern end of
the existing "L" shaped easement on the south on Portuguese Bend Road on
Lot 6-CH.
The area of existing Lot 1-FT is 4.85 acres gross, 2.69 acres net, existing Lot 6-
CH is 1.695 acres gross, 1.30 acres net, and existing Lot 4-C-CH is 2.34 acres
gross, 1.59 acres net. The proposed acreage for Lot 1-FT will be 4.17 acres gross,
2.41 acres net, proposed acreage for Lot 6-CH is 2.38 acres gross, 1.8 acres net
and the proposed acreage for Lot 4-C-CH is 2.39 acres gross and 1.59 acres net.
The net lot area of Lot 4-C-CH will remain the same because the transferred
land will remain an easement and perimeter easements are excluded for the
net lot area calculation.
The full portion of each re configured lot will remain in its existing zone by
the clerical adjustment of the zoning boundary to the new lot line
boundaries. No new lots will be created by this proposal.
According to the Subdivision Map Act, the Planning Commission may not
impose conditions or exactions on its approval of a lot line adjustment except
to conform to local zoning and building ordinances. Attached is Section
17.16.060 of the Zoning Ordinance describing lot area and dimensions.
Referring to Section 16.16.010 Lot Size: Each of the three proposed lots is
greater than the minimum acreage for its zone. Lots 6-CH and 4-C-CH are
greater than the one acre net as required in the RA-S-1 Zone and Lot 1-FT is
greater than the two acre net as required in the RA-S-2 Zone.
Referring to Section 16.16.040 Widths and depths of lots, Lots 6-CH and 4-C-
CH are existing lots that will receive additional acreage. Although Lot 1-FT
will be reduced in size, the proposed lot will exceed minimum dimensions.
2. Lot 1-FT contains an existing house and attached garage that was originally
built in 1955, Lot 6-CH contains an existing house and attached garage that
was originally built in 1955, and Lot 4-C-CH contains an existing house and
attached garage that was originally built in 1962.
3. No development on any of these lots is currently proposed.
4. The project has been determined to be categorically exempt pursuant to the
California Environmental Quality Act (CEQA).
5. Draft resolutions for the proposal are attached.
RECOMMENDATION
It is recommended that the Planning Commission review the proposed plans and

16.16.010 Lot size. A. Each lot in any subdivision
shall have an area of not less than that required under the
zoning ordinance of the City in effect at the time of sub-
mitting the tentative map. If any lot is in more than one
zone, it shall be of such size as to meet the requirements
of the zone having the'greater minimum size requirement.
B. Each lot in any subdivision located in the RAS-1 zone
shall have a net area of not less than forty-three thousand
five hundred sixty square feet. Each lot in any subdivision
located in the RAS-2 zone shall have a net area of not less
than eighty-seven thousand one hundred twenty square feet.
C. For the purposes of this section, "net area" shall
exclude all perimeter easements to a maximum of ten feet and
that portion of the lot or parcel of land which is used for
roadway purposes, and shall also exclude any private drive or
driveway which provides ingress and egress to any other lot
or parcel of land and the access strip portion of any flag
lot.
D. No lot or parcel of land in the subdivision shall
be divided or separated by access easements or roadways,
unless the separated portion of said lot or parcel of land
contains the minimum acreage specified by the zone in which
said lot or proposed subdivision is located. (Ord. 161
S11-2.151, 1980).
16.16.020 Lot sideline angles. In all cases where
practicable, the sidelines of lots shall be at approximate
right angles to or radial to the street upon which such lot
fronts. (Ord. 161 §11-2.152, 1980).
16.16.030 Frontage. The alignment of streets shall
be such as to provide street frontage for all lots in the
subdivision. (Ord. 161 S11-2.153, 1980).
16.16.040 Widths and depths of lots. Except as pro-
vided in Section 16.16.050, the widths and depths of all lots
shall comply with the following conditions:
A. The abutting footage of any lot along the street
easement line shall be at least equal to or greater than the
depth of the lot divided by two and one-half; provided, that

in no event shall such abutting footage be less than one
hundred fifty feet.
B. The minimum width of any lot at any point, measured
at right angles to the sidelines, shall not be less than one
hundred fifty feet.
C. In the event of a corner lot with abutting streets
on two or more sides, the street having the smallest number
of feet abutting such lot shall, for the purpose of this
section, be considered the street upon which such lot fronts.
Abutting footage shall be measured along the street easement
line, but in the case of a corner lot, shall not include any
footage within the side street easement.
D. All lots shall have a depth with a slope less than
thirty degrees at least equal to the footage abutting the
street easement line. (Ord. 161 S11-2.154, 1980).
16.16.050 Lot footage at turning area at end of cul-de-
sacs. No more than two lots shall front on the turning area
at the end of any cul-de-sac and the turning area of the
paved portion of such cul-de-sac shall have a radius of not
less than thirty-two feet. The abutting footage of each lot
fronting on'such turning area shall be substantially the sane.
(Ord. 161 S11-2.155, 1980).
16.16.060 Staggering of lot sidelines. A. If the plan
of subdivision provides for lots on both sides of a street,
the sidelines of lots on opposite sides of the street, except
at cul-de-sacs and at existing property lines, shall be stag-
gered by not less than forty feet.
B. If the plan of subdivision provides for lots on one
side of a street opposite which there are existing lots or
individual properties usable only as single -residence sites
by recorded restrictive covenants, or under existing zoning
ordinances of the City, the sidelines of lots in the proposed
subdivision shall be staggered by not less than forty feet
from the sidelines of such existing lots or properties on
the opposite side of the street. (Ord. 161 §11-2:156, 1980).
16.16.070 City boundary. No lot shall be divided by a
City boundary line. (Ord. 161 §11-2.157, 1980).
16.16.080 Private streets. All streets shall be shown
on the tentative map and on the final map as private streets,
but the final map shall contain a conditional offer of dedica-
tion which may be accepted by the City Council at such time
as the street is opened to public travel for three months or
more. The subdivider, by means of restrictive covenants or
contracts satisfactory to the Advisory Agency, shall provide
for the payment by the purchasers of land in the subdivision
of all costs of repairing and maintaining such private streets

ADJUSTMENT FOR PROPERTY AT 1 CREST ROAD EAST AND 4
CINCHRING ROAD IN ZONING CASE NO. 541A.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. Paul L. Saffo, III and Mr. Lon
R. Clearwaters with respect to real property located at 1 Crest Road East and 4
Cinchring Road (Irregular Lots 1-FT and 6-CH) requesting a Certificate of Compliance
for a Lot Line Adjustment to move the common side lot lines dividing these two
parcels easterly so that a triangular portion of existing Lot 1-FT is placed into Lot 6-
CH.
Section 2. California Government Code Subsection 66412(d) authorizes lot
line adjustments without requiring a tentative map, parcel map or final map if: (A)
The lot line adjustment involves two or more existing adjacent parcels, where land
is proposed to be taken from one parcel and added to an adjacent parcel; (B) A greater
number of parcels than originally existed is not thereby created; (C) The lot line
adjustment will create parcels that conform to local zoning and building ordinances;
and (D) The lot line adjustment is approved by the City. The City may impose
conditions on the Lot Line Adjustment in order to make the lot conform to local
zoning and building ordinances, to require the prepayment of real property taxes
prior to the approval of the Lot Line Adjustment or to facilitate the relocation of
existing infrastructure or easements.
Section 3. The Planning Commission conducted a duly noticed public
hearing to consider the application at a regular meeting and at a field trip visit on
June 18, 1996.
Section 4. The Planning Commission finds that the project is categorically
exempt from environmental review under the California Environmental Quality
Act pursuant to a Class 5 exemption provided by Section 15305 of the State CEQA
Guidelines.
Section 5. The Planning Commission has considered the evidence, both
written and oral, presented in connection with this application and finds as follows:
A. Section 16.16.010(B) of the Rolling Hills Subdivision Ordinance and
Section 17.16.060(A) of the Rolling Hills Zoning Ordinance requires that each lot in
any subdivision in the RA-S-1 Zone shall have a net area of not less than forty-three
thousand five hundred sixty square feet (1.0 acre) and each lot in any subdivision in

hundred twenty square feet (2.0 acres). Lot 1-FT is located in the RA-S-2 Zone and

in Lot 1-FT to be 2.41 net acres and Lot 6-CH to be 1.8 net acres after excluding
easements. The full portion of each reconfigured lot will remain in its existing zone
by the clerical adjustment of the zoning boundary to the new lot line boundaries.
B. Section 16.16.020 of the Rolling Hills Subdivision Ordinance and
Section 17.16.060(B)(3) of the Rolling Hills Zoning Ordinance require that in all cases
where practicable, the sidelines of lots shall be at approximate right angles or radial
to the street upon which such lot fronts. The existing sidelines of both lots are
approximately at right angles or radial to the street. The proposed adjustment will
allow the westerly side lot line of Lot 1-FT to be parallel to the curve of Portuguese
Bend Road and the front and rear lot lines to be approximately at right angles or
radial to Crest Road. The proposed adjustment will allow the sidelines of irregular
Lot 6-CH to be approximately parallel to each other and radial to the curved
Cinchring and Portuguese Bend Roads.
C. Section 16.20.230 of the Rolling Hills Subdivision Ordinance requires
that ten (10) foot wide easements be dedicated for bridle trail and utility purposes
over the strips and portions of land within and abutting upon the sidelines and rear
lines of each lot. The proposed adjustment will require the relocation of existing
easements so that an existing "L" shaped easement that borders the interior of the
existing Lot 1-FT will be relocated along the westerly side of Portuguese Bend Road
and will result in a 10 foot wide easement along the easterly side lot line of the
adjusted Lot 6-CH along Portuguese Bend Road north to the center of Cinchring
Road.
D. Conditions have been attached to this approval which provide that it
will not impair or limit the City's application of the Site Plan Review Ordinance to
any future development of Lot 1-FT or Lot 6-CH.
Section 6. In accordance with the foregoing findings, a Conditional
Certificate of Compliance for lot line adjustment sought in Zoning Case No 541A as
indicated on the map attached hereto as Exhibit "A" is hereby approved as a
Conditional Certificate of Compliance subject to the following conditions:
A. There exists an "L" shaped private easement shown on the assessor's
map that currently exists on the westerly side of Portuguese Bend Road within the
current boundaries of Lot 1-FT that has an eighty (80) foot width [forty (40) feet on
each side of the centerline of that easement] for the vertical north -south segment of
the "L" and a sixty (60) foot width [thirty (30) feet on each side of the centerline of
that easement] for the horizontal east -west segment of the "L." That portion of this
easement that will exist within the proposed new boundaries of Lot 6-CH after this
lot line adjustment shall be relocated and decreased in size to a ten (10) foot wide
easement abutting and following the western boundary of the existing Portuguese

Bend Road easement from the centerline of Cinchring Road on the north to the
terminus of the existing "L" shaped easement at its intersection with Portuguese

specified in this paragraph."
B. The lot line adjustment shall not in any way constitute any
representation that Lot 1-FT and Lot 6-CH can be redeveloped in compliance with
current zoning and building ordinance standards although a single family residence
exists on each lot. No development shall occur on the properties without first
complying with all applicable City Building and Zoning requirements and other
applicable rules and regulations.
C. The lot line adjustment shall not in any respect limit or impair the
City's application of the Site Plan Review Ordinance (Ordinance No 221, 1988) to Lot
1-FT and Lot 6-CH at such time as an application is made for development.
D. The lot line adjustment shall not in any respect waive, release or be
construed to supersede any restriction, dedication or condition set forth on Final
Tract Map Nos. 27516 and 26343, and all such matters are hereby reserved.
E. The Certificate of Lot Line Adjustment shall not be issued until a legal
description complying with the delineation of adjustment, and including, the
required easements as specified in Paragraph A of Section 6 are submitted to, and
approved by the City. Upon the City's approval of the legal description, the
Conditional Certificate of Compliance shall be issued by the City, shall be recorded by
the property owner in the offices of the Los Angeles County Recorder, and evidence
of the recordation shall be returned to the City.
