121, Demo existing garage and Const, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) ) of ) Mr. Gordon Shultz ) Lot 170A-1-MS ) FINDINGS AND REPORT ZONING CASE NO. 121 The application of Mr. Gordon Shultz, Lot 170A-1-MS, Miscellaneous Tract, for a conditional use permit under Article III, Front Yard Re- quirements, Section 3.06 of Ordinance No. 33 came on for hearing on the 17th day of January, 1973 in the Council Chambers of the Adminis- tration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the appli- cant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. Gordon Shultz, is the owner of that certain real property described as Lot 170A-1-MS Miscellaneous Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said appli- cation was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II. The Commission further finds that no person appeared at said public hearing in opposition to the application for a conditional use permit, and that no evidence was received by the Commission in opposition thereto. Further, the Commission finds that Mr. Robert Dunn, developer of the Shultz property, appeared to explain that building regulations of the Rolling Hills Community Association require that each residence have a garage; however, it is neces- sary to remove an existing garage to permit grading of Johns Canyon Road as required by subdivision of the property. The Commission finds further that the applicant requests the conditional use permit for construction of a garage in the front yard of his property, as location is limited by the coutour of the sand, and the garage would be hidden from view by an existing building. The Commission finds that a conditional use permit should be issued in order to preserve substantial property rights possessed by other property in the same vicinity and zone. IV. From the foregoing it is concluded that a Conditional Use Permit for a variance of Front Yard Requirements under Article III, Section 3.06 of Ordinance No. 33 should be issued to Mr. Gordon Shultz, Lot 170A-1-MS, Miscellaneous Tract, in accordance with the plot plan marked Exhibit I on file in these proceedings, and it is, therefore, so ordered. /s/ Godfrey Pernell Chairman, Planning Commission Secretary, Planning Commission
