227, To complete the guest house pr, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) ) of ) ) ZONING CASE NO. 227 Mr. Samuel Speranza ) ) Lot 170-A-7-MS ) FINDINGS AND REPORT The application of Mr. Samuel Speranza, Lot 170-A-7-MS, Miscellaneous Tract, for a conditional use permit under Section 3.01 (D), Paragraph 3 (a) of Ordinance No. U-38 came on for hearing on the 14th day of May, 1979 in the Council Chambers of the Adminis- tration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant,'having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. Samuel Speranza, is the owner of that certain real property described as Lot 170A-7-MS, located at 12 Johns Canyon Road in the City of Rolling Hills, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission finds that no comment, written or verbal, was received in opposition to the request, and that Mrs. Shirley Gregory, 13 Johns Canyon Road, called to say that she and Mr. Gregory had no objection to the request. II. The Commission finds that the applicant has requested a con- ditional use permit to permit completion of a guest house which was started prior to the requirement for a conditional use permit f5x. guest houses. The Commission finds that the slab for the guest house was poured and framing was started but for a number of reasons work was stopped and was not resumed before the permit expired, and in the interim a moratorium was imposed on construction of guest houses unless a conditional use permit was obtained. On a field • • trip to the site the Commission found that the property is separated by topography and by a row of mature trees from adjacent properties and construction of a guest house as shown on the plan submitted, Marked Exhibit "A" would not present a hardship to any surrounding property, and further, that Mrs. Dorothy Kuhne, owner of the only property which would be visible from the guest house, expressed her approval of the construction. The Commission finds that a conditional use permit should be granted in order to preserve sub- stantial rights possessed by other properties in the same vicinity and zone, and that the granting of such conditional use permit would not be materailly detrimental to -the public welfare, nor injurious to property in the same vicinity and zone. III. From the foregoing it is concluded that a conditional use permit should be granted to Mr. Samuel Speranza, Lot 170-A-7-MS, 12 Johns Canyon Road, for construction of a guest house, subject to the following conditions: 1. No vehicular access or paved parking areas adjacent to the guest house; 2. Any paved pedestrian access to the street from the guest house is to be reviewed and approved by the Planning Commission before installation; 3. Occupancy of the guest house shall be limited to 90 consecutive days (or such time as specified in ordinances pertaining to guest houses). and it is, therefore, so ordered. This approval shall expire one year from the date of grant, if not acted on. /s/ Joanne Murdock Chairman, Planning Commission cretary, Planning omission' ORDINANCE NO. 137 AN ORDINANCE OF THE CITY OF ROLLING HILLS AMENDING ORDINANCE NO. 33 ENTITLED "AN ORDINANCE OF THE CITY OF ROLLING HILLS, CALIFORNIA PROVIDING FOR ZONING IN SAID CITY" The City Council of the City of Rolling Hills does ordain as follows: Section 1: Article III of Ordinance No. 33, Section 3.04 is amended to read: "Section '3.04, Lot.Coverage. Main buildings,. accessory buildings,. structures, tennis courts, swimming pools,,service yards, (enclosed or unenclosed), stables, or an area of not less .than 200 square feet for the construction of a stable (with vehicle access thereto) shall not cover more than 257 of the net lot area; pro- vided further that in addition to the above described improvements, the areas included within driveways, parking space, walks, patios, decks, and asphalt or concrete paving of any kind excepting roads maintained by the Rolling Hills Community Association, shall not cover more than 50% of the net lot area. (A) For the purposes of this Section, "net area" shall exclude all perimeter easements to a maximum of ten feet and that portion of the lot or parcel of land which is used for roadway purposes, and shall also exclude any private drive or driveway which provides ingress and egress to any other lot or parcel of land, and access strip portion of any flag lot.
