HATHAWAY ) Lot 25, Sunny Knolls (R&S 67-31,32)) ) FINDINGS AND FORMAL REPORT The application of Charles F. Hathaway, Lot 25, Sunny Knolls, for a side yard variance came on for hearing on the 21st day of November, 1961, at the hour of 8: 00 .P,,M%,..a~t the,. City. Hall of the City of Rolling Hills, California, at which time the applicant submitted evidence in support of his application. Thereafter, the Planning Commission continued the hearing on the application to December 19, 1961, in order that the Planning Commission could make a personal inspection of the property, and the Commission now having made said inspection and being fully advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California The Commission finds that the applicant, Charles F. Hathaway, is the owner of that certain real property described as Lot 25, Sunny Knolls, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Ordinance No. 33 of the City of Rolling Hills, California. II. That no person appeared at said public hearing in opposition to the application for a variance and that no evidence was received by the Commission in opposition thereto. ,-1- • • III. The Commission further finds that the proposed residence addition of applicant is to be located fifteen (15) feet from the side line of said Lot instead of twenty (20) feet as required by said Zoning Ordinance, and further finds that by reason of the terrain of westerly easement of said Lot 25 being too steep for use as a bridle. trail, and the seventy (70) feet distance between the existing residences on Lots 24 and 25 being insufficient for the location of another residence, the variance should be granted to applicant in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detri- mental to the public welfare or injurious to property or improve- ments in such vicinity and zone in which applicant's property is located, and that there are exceptional and extraordinary circum- stances and conditions by reason of physical location and terrain of said Lot 25 which do not apply generally to other property in the same vicinity and zone. Iv. From the foregoing it is concluded that a variance should be granted by the Planning Commission of the City of Rolling Hills to Charles F. Hathaway of Lot 25 of Sunny Knolls in accordance with the Plot Plan marked Exhibit I on file in these proceedings, and it is, therefore, so ordered.
