Dear Dr. & Mrs. Mirsaidi:

Yesterday afternoon, Thursday, I was at your house as requested
and was very dismayed to find no one there. This was doubly
disappointing as it is the second time I did just as requested
with no reply or response.
I spent the rest of the afternoon, the evening and most of the
night trying to figure out what was wrong. This easement access
is a case of everyone trying to do nothing but help you.
I've come to the conclusion that the entire process has not been
properly explained; you feel unduly pressured.
Even though the Community Association has okayed the grading and
the wall, even though you have okayed the grading and the wall,
by your signing the settlement agreement, the physical
construction of the wall has not been okayed by the city.
The wall location as stipulated in the settlement agreement is
within the side yard setback and therefore requires a variance to
be issued by the City of Rolling Hills.
Since I had met with you about the access from your property to
the easement and the location of the wall and your were happy
with it, the City of Manager suggested the easiest way for the
variance to become a reality was to attach the wall variance to
the site review of the Stinnett property. The fee for your
application waived and the application moved through the process.
The point I'm laboriously arriving at is that any variance when
approved is valid for one year from the date of adoption. There
is no pressure to begin construction, it is simply a matter of
taking care of this final legal step in the process.

I will make myself available any time this weekend to go over the
exact location and height of the access and wall. My office
number is 375-2556 and my home phone is 377-3068. I'm only trying
to help.
Sincerely,
Douglas K. McHattie

Re: Zoning No. 412
Dear Council Persons:
Respectfully we inform you that:
1) The request for this zoning change given to Planning
Commission was not the plan that we had approved,
therefore, matter in front of you has neither been
requested by us, nor has our approval.
2) The adjoining property involved in this easement is
being developed strictly for investment purposes and
we do not know who will be the owner. Therefore, we
would like this matter to be submitted to you in its
final format to eliminate any future confusion among
the neighbors.
We respectfully request that the Council NOT TAKE ACTION ON
CASE NO. 412 AT THIS TIME, until the final format has been
prepared.

Sincerely,
Mansoor and Manzar Mirsaidi
