CALIF. 90274 (213) 377-1321 February 28, 1990 Mr. Mansoor Mirsaidi 1 Maverick Lane Rolling Hills, CA 90274 SUBJECT: PROPOSED RETAINING WALL IN SIDE YARD SETBACK Dear Mr. Mirsaidi: It has been brought to the attention of the City of Rolling Hills that a Mutual Release and Settlement Agreement has been executed by the Rolling Hills Community Association, Stinnetts, and yourself. In said Agreement, a retaining wall, which will be 35 feet long and a maximum 32 inches high, will be built within the easement and side yard setbacks areas of both your property and your neighbor's lot by crossing the mutual property line. In evaluating the Agreement and exhibit prepared by South Bay Engineering, Staff has determined that a variance will be required to construct the proposed wall. As you are aware, your neighbor at 9 Caballeros Road has requested a variance (Zoning Case No. 412, Mr. Gordon Siu) to construct a residential addition into the side yard setback closest to your property. The Planning Commission, at their regular meeting of February 20, 1990, continued Mr. Siu's application to address the proposed development in the easement and side yard area as part of the executed Agreement. Since the proposed retaining wall will be developed over both properties, an additional variance request must be acted upon for both lots. City Staff suggests that a joint application from Mr. Siu and yourself be heard before the Planning Commission. Your attention on this matter to submit an application for variance is required for the Planning Commission to proceed with review of the proposed development on the two properties. Upon submittal of a complete application, the matter can be set forth for public hearing and noticed to surrounding property owners. An application form is enclosed and a filing fee is not anticipated. As per our discussion with Mrs. Betty Volkert and Mr. Terry Bellinger two weeks ago, we assumed that our request had been denied by the Planning Commission and City Council. Based on the Architectural Committee's letter, dated August 1, 1989, we prepared our final plans and after almost one year, we are ready for construction. We request you kindly review your judgment considering the above along with the following information: 1. A two car garage is not enough for the number of persons in our family. 2. On the front and side yards, we tried to keep the garage in line with the existing house. 3. In having the extra garage, it keeps the driveway clean and not cluttered with cars. Also at that meeting, the Planning Commission voted to deny your request for a Variance to encroach into the front yard setback to construct an addition to the existing garage. A resolution stating the conditions and findings of the Planning Commission will be prepared by the City Attorney's office, and will be made available to you upon its completion and receipt by the City. Furthermore, a formal report of the Commission's action is contained in the minutes of the meeting, and will be available after approval by the Commission. Please be advised that, pursuant to Section 17.32.140 of the Rolling Hills Municipal Code, you may appeal the decision of the Planning Commission, in accordance with Section 17.32.150. The fee for filing an appeal is $3,500.00.
