A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING
HILLS GRANTING A SITE PLAN REVIEW TO ENLARGE A PORCH LOCATED
ABOVE A GARAGE ON A LOT TI-IAT CONTAINS A CONDITION THAT ANY
FURTHER DEVELOPMENT MUST BE REVIEWED BY THE PLANNING
COMMISSION; VARIANCES TO EXCEED THE STRUCTURAL LOT COVERAGE
AND FOR A NEW OUTDOOR FIRE PLACE CHIMNEY TO EXCEED THE
MAXIMUM 12 FOOT HEIGHT BY 4 FEET, ON A LOT DEVELOPED WITH A
SINGLE FAMILY RESIDENCE AND ACCESSORY STRUCTURES IN ZONING
CASE NO. 775, AT 16 CREST ROAD WEST, (LOT 74-A-MS), (NAGELHOUT). THE
PROJECT HAS BEEN DETERMINED TO BE EXEMPT PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA).
Section 1. An application was duly filed by Mr. and Mrs. Robert Nagelhout with respect to
real property located at 16 Crest Road West, Rolling Hills (Lot 74-A-MS) requesting a Site Plan
Review to enlarge an existing porch by 750 square feet located above the garage, for a total of
1,215 square foot covered porch; Variances to exceed the structural lot coverage, by 0.7% and to
exceed the permitted height of a chimney by 4 feet, on a lot which has a condition that any
further development be reviewed and approved by the Planning Commission. Also proposed is a
400 square foot trellis, outdoor kitchen and a fire place.
Section 2. The Planning Commission conducted duly noticed public hearings to consider the
application at a regular meeting on November 19 and December 15, 2009 and at a field trip to
the property on December 15, 2009. The applicants were notified of the public hearings in
writing by first class mail. Evidence was heard and presented from all persons interested in
affecting said proposal and from members of the City staff and the Planning Commission having
reviewed, analyzed and studied said proposal. The applicants and their representatives were in
attendance at the hearings.
Section 3. At the field visit to the property, the Planning Commission directed staff to
prepare a Resolution of approval for consideration at the January 19, 2010 meeting.
Section 4. In March 1991 in Zoning Case No. 438, the Planning Commission granted to the
previous property owner a Site Plan Review for the construction of a new 7,742 square foot
single family residence with a 1600 square foot semi -subterranean garage, a 630 square foot
swimming pool, pool equipment a 4,108 square foot basement and a Variance to construct a 5-
foot wall in the front yard setback. A request for a CUP for a cabana was denied at that time. A
1,000 square foot set aside area for a future stable and corral was also designated on the plan.
The then existing house was demolished. With the 1991 proposal it was not required to call out
the porches, trellises or other architectural elements on the plans or include them in the
calculations.
Section 5. In March 1999 in Zoning Case No. 593, the Planning Commission approved a
Conditional Use Permit and a Site Plan Review for a 7,000 square foot tennis court on the

This letter shall serve to notify you that the Planning Commission at their field
trip public hearing on December 15, 2009, directed staff to prepare a Resolution,
with conditions, to approve your request in Zoning Case No. 775. The
Commission will review and vote on this resolution at their January 19, 2010
meeting. The meeting starts at 6:30 PM.
The resolution with findings and conditions of approval will be forwarded to
you prior to the next Planning Commission meeting. Please review the
conditions of approval.
The Planning Commission decision shall become effective thirty days after the
adoption of the resolution unless an appeal has been filed by you, any interested
party or the City Council takes jurisdiction of the case within that thirty (30) day
appeal period. (Section 17.54.010(B) of the Rolling Hills Municipal Code). Should
there be an appeal, the Commission's decision will be stayed until the Council
completes its proceedings in accordance with the provisions of the Municipal
Code.
The Planning Commission action, accompanied by the records of the
proceedings will be presented to the City Council as a report item at the
Council's regular meeting following the Commission's approval.

Planning Commission
Dear Planning Commission members:
I wanted to take a moment to send you the documentation to which I referred in you
November 17, 2009 meeting. In this meeting I told the Planning Commission that I had
come to the meeting to ensure that the covered porch expansion would not occur on or
near my property and to remind the City that I believe that several feet of my neighbors'
second driveway and landscaping is on my property. In 2002 when their driveway was
built and landscaping completed, I expressed my concern to the Community Association
that I would lose my property because their driveway was on my land and by all
appearances it looks like their property. I used as proof that my property corner
monument was removed when their driveway was built and that several feet of asphalt
which was on my property was removed. The Don Crocker said that the plan the
Association had approved for 16 Crest had the neighbor's driveway going up to their
property line but not beyond it --see attached approval map. My neighbor did not agree
that the area in contention is on my property. The Association said that a new survey
would need to be done. My neighbors did not want to pay for this and neither did I.
Per our discussion following these meeting the Nagelhout's suggested that to protect my
property rights and yet avoid paying for a survey, they would provide me with the
attached letter and would also send a letter to the Association which recognizes that we
disagree on where the property line is and that by waiting to correct this encroachment
until a survey is done at some point in the future, I am not in any way relinquishing my
property rights.
I send these attachments to you to ensure that the City remains informed that a property
line dispute exists and that I have in no way relinquishing my property rights.

The purpose of this letter is clarify our belief and intention that ifa portion of the
driveway and/or landscaping on the east side of our property, although approved by
permit with the Community Association, encroaches upon your property, that this in no
way eradicates your right to ownership of that portion of the property. In addition, it is
our belief and intention that this applies to all successor owners of your property and our
property.
We have both agreed for economic reasons not to perform a professional survey to
determine the degree to which the driveway and/or landscaping may encroach upon your
property. We acknowledge your belief that the driveway and/or landscaping does
encroach upon your property, and should a condition arise to require a professional
survey, we will engage a mutually agreeable engineering firm to perform the survey.
Cathy, thank you for working out this issue with us in a cordial and collaborative manner.
We have enjoyed having you as a neighbor and look forward to a long and friendly
relationship as part of the Rolling Hills Community.

The Planning Commission scheduled a field inspection of your property to view a
silhouette of the proposed project on Tuesday, December 15, 2009, at 7:30 AM.
The site must be prepared according to the enclosed Silhouette Construction
Guidelines and the following requirements and the silhouette must be erected at
least 5-7 days prior to the meeting.
• A full-size silhouette in conformance with the attached
guidelines must be prepared for ALL STRUCTURES of the
project showing the footprints and roof ridges;
♦ Delineate/stake the location of the required front
setbacks in the area of the proposed trellis;
Please be advised that inaccurate staking could delay the
review of the project. Your neighbors will be notified of
the site visit.
After the field trip, the next regular meeting of the Planning Commission will take place on

SILHOUETTE 1'E CONSTRUCTION GUIDE1..INES
A silhouette of proposed construction must be erected the Week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
I3racing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or thine to aid in the
visualization of the proposed construction.
Property lines, setback lines and casement lines must be staked along the areas of
construction. 2 1/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides: .
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.
