Resolution No. 91-26: A Resolution of the Planning
Commission of the City of Rolling Hills granting a
Variance for the encroachment of a structure into the
side yard setback, granting a Variance for the
encroachment of a structure into the rear yard setback,
granting a Variance to permit continued vehicular access
to a mixed use structure within twenty-five feet of the
side lot line, and granting a Conditional Use Permit for
the expansion of an existing mixed use structure
consisting of a garage and recreation room.
BACKGROUND
1. The existing single family residence and an attached garage
were built in 1950. Later, in 1971, a 600 square foot detached
garage was added within the rear yard setback. Previous owners
modified a portion of the garage to include a 359 square foot
separate room that includes a closet, rest room and porch for
a total of 645 square feet with the approval of the City and
the Community Association in 1979. But, there were no Los
Angeles County Building Permits to reflect the modification.
2. The applicant applied for Variances to encroach up to 10 feet
into the side yard setback and up to 41 feet into the rear yard
setback, a Variance to permit continued vehicular access within
twenty-five feet of the side lot line, to construct a 196
square foot addition to the garage and a Conditional Use Permit
to allow a mixed use structure consisting of a 482 square foot
garage and 359 square foot recreation room (A total of 841
square foot).
3. The structural lot coverage will not exceed 5,091 square feet
or 12.9% and the total lot coverage will not exceed 11,099
square feet or 28%.

4. The Planning Commission approved the Variances and the
Conditional Use Permit with conditions requiring that the
applicant apply for proper building permits that reflect the
mixed use, that there be no interior passageway between the
uses, that the interior separating wall meet attachedtownhouse
construction requirements, that there be no sleeping quarters
or kitchen facilities in the mixed use structure, that the
recreation room not be rented or leased, that if the use is
converted the permit shall automatically lapse, and that
landscaping, consisting of mature trees and native vegetation
be provided on the west side of the structure to minimize the
appearance of .the structure from the easement line.
RECOMMENDATION
It is recommended that the City Council receive and file the
subject Resolution No. 91-26.

BACKGROUND
As requested by the Commission, a written chronology was submitted
to staff by Mr. Gibbs on October 7, 1991 (attached). This
chronology reiterates his contention that the guest quarters did
exist in 1979 and were approved by the City. However, Los Angeles
County Building Permits do not reflect his statements.
RECOMMENDATION
It is recommended that the Planning Commission review the proposed
plans and take public testimony.

REQUEST The applicant requests a Conditional Use Permit to permit
the continued use of a structure detached from the main
building for a garage and servants quarters, and requests
a Variance to permit the encroachment into the side and
rear yard setback for the construction of a single car
garage addition to the existing garage.
BACKGROUND
On July 16, 1991, the Planning Commission discussed the conversion
of existing servants quarters to recreational quarters and the
Variance for the setback requirements. The Planning Commission
continued the item so that the applicant's representative, Mr. Kurt
Gibbs could discuss these issues with his client.
Staff was also directed to communicate with the Trails Chairman to
determine the trail access behind the property. Staff has spoken
Mr. Roger Hawkins, President of the Caballeros and Mr. David Basque
and they request that all existing trails be cleared of brush and
debris.
Mr. Gibbs requested that the case be continued to allow him to
further consult with his clients.
RECOMMENDATION
It is recommended that the Planning Commission review the proposed
plans and take public testimony.

BACKGROUND
In reviewing the applicant's request under Title 17 (Zoning), staff
would identify the following issues for evaluation:
1. The single family residence and attached garage was built in
1950. Permits show a 600 square foot detached garage and a
family room dining area were built in 1971; followed by an 85
square foot retaining wall and a pool in 1973; re -roofing in
1975; and then, 336 square feet of retaining walls and a 531
square foot residential addition in 1981.
2. The applicant is also requesting a variance to encroach 8 feet
into the side yard setback and 31 feet into the rear yard
setback to permit a 196 square foot garage addition to the
existing garage.
3. The existing garage does not encroach into the side yard
setback, but, does encroach up to 32 feet into the rear yard
setback.
4. Grading will not be required for the project.
5. The structural lot coverage proposed is 12.9 (20% permitted)
and the total lot coverage proposed is 28% (35% permitted).
6. Coverage on the existing pads, including a 450 square foot
future stable area, is 34.4%.
RECOMMENDATION
It is recommended that the Planning Commission review the proposed
plans and take public testimony.
