Resolution No. 91-26: A Resolution of the Planning
Commission of the City of Rolling Hills granting a
Variance for the encroachment of a structure into the
side yard setback, granting a Variance for the
encroachment of a structure into the rear yard setback,
granting a Variance to permit continued vehicular access
to a mixed use structure within twenty-five feet of the
side lot line, and granting a Conditional Use Permit for
the expansion of an existing mixed use structure
consisting of a garage and recreation room.
Dear Mr. Walter:
This letter is to inform you that the City Council, at their
meeting on Tuesday, November 12, 1991, will be notified of the
Planning Commission's APPROVAL of Resolution No. 91-26 in the
subject case.
The approval will become effective:
(1) Twenty days after the receipt of this letter if no appeals
are filed within that time period (Rolling Hills Municipal
Code Section 17.32.140 attached), AND
(2) An Affidavit of Acceptance Form and the subject Resolution
must be filed by you with the County Recorder (Rolling
Hills Municipal Code Section 17.32.087).
We have enclosed a copy of RESOLUTION NO. 91-26, specifying the
conditions of approval set forth by the Planning Commission and the
approved Exhibit A Development Plan to keep for your files. Once
you have reviewed the Resolution, please complete the enclosed
AFFIDAVIT OF ACCEPTANCE FORM, have the signature(s) notarized, and
forward to: County Recorder, Room 15, 227 North Broadway. Los
Angeles, CA 90012 with a check in the amount of $ 5.00 for the
first page and $ 3.00 for each additional page.

No. 452 was APPROVED by the Plannning Commission at their regular
meeting on Tuesday, Octobr 22, 1991.
The final Resolution and conditions of APPROVAL will be forwarded
to you after they are signed by the Planning Commission Chairman
and City Clerk.
The Planning Commission's decision will be reported to the City
Council at their regular meeting on Monday, November 11, 1991. You
should also be aware that the decision of the Planning Commission
may be appealed within twenty days after you receive the final

The following copies of letters and county building permits are being copied
to you as requested by the Planning Commission at the last planning
commission meeting of 17 September 1991.
1. The William Kester letter dated 14 September 1991 is Mr.
Kester's personal affirmation that the bath and servant's
quarters in question are linked to attached LA county building
permit final dated 18 June 1971.
2. The Teena Clifton/City of Rolling Hills letter dated 6 March
1975 is the city's written confirmation that the property at 92
Crest Road East had no architectural or building violations
from either RHCA of the City at the time the letter was written.
This gives the property a clean bill of health as of March 1975.
3. The George Sweeney letter dated 17 September 1991 is Mr.
Sweeney's affirmation that the detached garage with guest
quarters did exist in 1979. Mr. Sweeney goes on to say that said
habitable space was modified...reviewed...and approved...by all
governing agencies as evidenced by sheet 4.3 (on file at the City)
and attached LA county building permit final dated 20 July
1981.

These letters should demonstrate that the detached guest quarters/garage at
92 Crest Road East was in full compliance with all governing agencies at least
as late as 20 July 1981, thus hopefully laying to rest any doubts about the
legality of the guest quarters as had been previously raised in past commission
meetings.

March 6, 1975
In December, 1974, it was brought to the attention
of this office that a room addition at 92 Crest Road
East was not in compliance with the Rolling Hills
Community Association's building regulations. After a
physical inspection of this property I asked Mr. Kester
to provide the Association with plans for bringing the
residence into compliance. On January 6, 1975, those
plans were submitted and approved. The alterations in
compliance with the approved set of plans were approved
by the inspector on January 16, 1975. The building
was also given approval by the City of Rolling Hills'
engineering inspector.
It is my understanding there is a letter dated
March 5, 1975, from Mr. William Magill, senior building
engineering inspector of the City of Rolling Hills, giving.
his comments on the electrical system of the residence.
At this time the William Kester residence at 92 Crest
Road East has no architectural or building violations
from either the Rolling Hills Community A ociation or
the City of Rolling Hills.

modified with the addition of new French doors and an attached deck

plan check review by the Rolling Hills Architectural Committee and
the Los Angeles County Department of Building and Safety ( see
attached copy of sheet 4.3 ).
