Dr. Richard Henke 7 Crest Road West • November 14, 1985 Rolling Hills Planning Commission Rolling Hills, California 90274 Dear Sirs: I am addressing the Public Hearing to be held Tuesday, November 19, 1985, at 7:30 p.m. concerning Zoning Case No. 322 -- Request for Side Yard Setback Requirements on Lot 55-B-MS. I live at 7 Crest Road West and share a common boundary with the above property. Unfortunately, my wife and I will be in Chicago that week and cannot attend the hearing. However, we do have some concerns which you should be aware of. These are: 1. We have lived in Rolling Hills since 1978. When our remodeling was planned we abided by the requirements of the City and built our pool and home addition in accordance with the City's codes. If these codes are in effect they should be followed. 2. We are concerned about the potential for noise to be created by any motors used to run a waterfall and/or pump for the pool. It should be located so that we, as next door residentsore not subject to noise polution. While I am not knowledgeable about the amount of noise to be produced, I would ask that we have some recourse should its location create a problem for us so that we may come to the City for correction. 3. You must know that the waterfall is into the hillside adjacent to the lot line. We are concerned about the potential for water leakage, erosion or any disruption to this contour as it would affect our property. I have always believed in living with concern for persons around me. We spoke with Rancho Palos Verdes Environmental Director Bret Bernard and established the following information: In February, 1994, the RPV City Council continued the item regarding the preparation of an Environmental Impact Report (EIR) for analyzing proposed overlay development guidelines in the landslide moratorium area until the Redevelopment Agency and Public Works Department consisting of a panel of experts (i.e. including Perry Ehlig, Geologist) and local homeowners at public meetings decide whether an EIR can be funded by (1) the Redevelopment Agency or (2) the formation of a Sewer Assessment District to pay for at least a portion of the sewer costs. The Abalone Cove portion of the landslide area linked to the Zone 2 area (see attached map) are the most important, according to RPV staff. At this writing, no meetings have been calendared nor advertised and this item is on hold. Regarding a proposed golf course development by Hon, Mr. Bernard believes that we are confusing two separate areas. There are no proposals for the area below Crest Road [i e. Peacock Flats (eastern portion of Zone 1)] nor is there a conclusive geological report. RPV staffs concern is about preparation of a limited EIR in Zone 2 (in the vicinity of Narcissa & Vanderlip Drives) where, because of the moratorium, there is a subdivision of 42 vacant lots and other developed properties where the owners are unable to build or make major additions and renovations on their homes.
