FINDINGS AND REPORT
The application of Mr. Per 0. Blomberg, Lot 87-RH, Rolling
Hills Tract, for a conditional use permit under Section 3.01 (D),
Paragraph 3 (a) of Ordinance No. 150 came on for hearing on the
21st day of February, 1978 in the Council Chambers of the Adminis-
tration Building, 2 Portuguese Bend Road, Rolling Hills, California,
and the applicant, having submitted evidence in support of the ap-
plication, the Planning Commission, being advised, now makes its
Findings and Report as required by the Ordinances of the City of
Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Per Blomberg,
is the owner of that certain real property described as Lot 87-RH,
located at 21 Portuguese Bend Road in the City of Rolling Hills and
that notice of the public hearing in connection with said appli-
cation was given as required by Sections 8.06 and 8.07 of Ordinance
No. 33 of the City of Rolling Hills, California. The Commission
finds further that a letter was entered into the file from Mrs.
Cynthia McBee, 23 Portuguese Bend Road, expressing a concern about
the condition of the driveway which serves the Blomberg and McBee
properties especially after use by heavy construction equipment
and asking that repair of the driveway be made a condition of
approval. The Commission finds that Mr. Frank Balough, the designer,
presented a letter from Mr. Blomberg stating that it is his intention
to resurface the driveway as soon as all construction is completed,
and that the letter was made part of the file.

The Commission finds that the applicant has requested a
conditional use permit for construction of a tennis court in a
legal location on his property, which consists of 5.745 acres in the
RAS-2 Zone, and that the designer has stated that the proposed total
net lot coverage by construction would be 8%, and total percentage of
the lot covered by paved areas in addition to construction would be 15%.
The Commission finds further that the proposed court would not be visible
from Portuguese Bend Road, and that a conditional use permit should be
granted in order to preserve substantial property rights possessed by
other property in the same vicinity and zone, and that the granting of
such a conditional use permit would not be materially detrimental to
the public welfare, ,nor injurious to property in the same vicinity and
zone.
III.
From the foregoing it is concluded that a conditional use
permit should be granted to Mr. Per Blomberg, Lot.87-RH, for construction
of a tennis court, subject to the following conditions: 1) That the
applicant pave the existing dual driveway from Portuguese Bend Road
to his property; 2) That the trees and permanent landscaping remain;
3) That the height of the fence be limited to eight feet, and it is,
therefore, so ordered.
