REQUEST: Request for a variance to encroach into the
front yard setback to construct a retaining
wall; Request for Site Plan Review to
construct new residence.
SUMMARY AND EVALUATION
The applicant is requesting a variance and a site plan review to
construct a retaining wall within the front yard setback and to
develop a vacant parcel with a new residential project. This item
was originally heard at the Planning Commission meeting of October
16, 1990 and adjourned to a Saturday meeting on November 3, to
conduct a field inspection. The first set of plans depicted a 7,550
sq. ft. residence with a 914 sq. ft. garage and a 503 sq. ft.
stable. At the Saturday field meeting the Commission requested the
applicant to revise the plans so that grading would be minimal.
The revised plans show a more compact residence of 6,984 sq. ft.
which has certain rooms stepped down on the eastern portion of the
development resulting in less grading (3,300 c.y. cut and fill
original plan; 3,015 c.y. revised plan).
The driveway design was to be reviewed by the Traffic Commission on
November 30th. At that time it was decided that alternative
driveway access should be offered by the applicant, which would
result in less of a percentage slope and to also consider access
from Talley Hand Road as an alternative. These options are to be
presented to the Traffic Commission at their December 14, 1990
meeting.
RECOMMENDATION
It is recommended that the Commission take testimony if any, hear
the recommendation from the Traffic Commission and take action
accordingly.

REVIEW AND EVALUATION OF ISSUES
In reviewing the applicant's request under Title 17 (Zoning), staff would
identify the following issues for evaluation:
1. The applicant is requesting a variance and site plan review to
construct a retaining wall within the front yard setback and develop a
vacant parcel with a new residential project. Project details show a
7,550 square foot house, 914 square foot detached garage and 503 square
foot stable. Lot and pad coverages will comply with City requirements
(10.31% structure, 22.47% total, 33.1% pad).
2. Grading for the project site will be extensive at a cut/fill balance
figure of 3,300 cubic yards. A new driveway will be graded, and the
access point on Portuguese Bend Road must be reviewed by the City's
Traffic Commission. Impacts to the natural terrain and contours are
significantly affected.
3. This lot was previously created under a two -lot parcel map, and has
vehicular access at the rear to a road formerly called "Talley Hand Road".
RECOMMENDATION
Staff would recommend that the Commission receive public testimony and
continue the application to an adjourned meeting to conduct the field
inspection of the site and surrounding properties.
