A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS AUTHORIZING THE ISSUANCE OF A CONDITIONAL CERTIFICATE OF COMPLIANCE FOR A LOT LINE ADJUSTMENT FOR PROPERTIES AT 25 PORTUGUESE BEND ROAD (LOT 89-A-RH) AND THE VACANT PARCEL NORTH THEREOF (LOT 89-C-RH) IN ZONING CASE NO. 707 (CHO). 1. The Planning Commission adopted Resolution No. 2005-23, which is attached, on August 16, 2005 at their regular meeting granting approval in Zoning Case No. 707. The vote was 4-0-1. (Commissioner Hanke abstained). 2. The applicants request an adjustment of lot lines between a developed lot at 25 Portuguese Bend Road (Lot 89-A) and a vacant lot north thereof (Lot 89-C). Mr. and Mrs. Cho own both lots. No new lots are being created and no new development on the vacant lot is currently being proposed. 3. The applicants. propose to exchange equal amount of area between the two lots. The applicants proposed to shift 7,760 square feet of land area from Lot 89-A to Lot 89-C, and shift the same size area from lot 89-C to Lot 89-A. The area of the developed lot is 6.64 acres gross, (289,238.4 sq.ft.), and 5.09 acres net, (222,080 sq.ft.). The area of the vacant lot is 4.78 acres gross, (208,216 sq.ft.), and 2.97 acres net (129,373 sq.ft.). After the lot line adjustment the size of both parcels will remain the same. Each of the lots is located within the RA-S-2 Zone and will be in compliance with the size requirements of such zone. 4. The lot at 25 Portuguese Bend Road is developed with a single family residence, garage and a swimming pool. As configured, no buildings on 25 Portuguese Bend Road are located in the area proposed for adjustment, nor will ®Pnnterl on Ret.VCind F'opr„r • • any structures be removed for the purpose of meeting the requirements for lot line adjustment. 5. Pursuant to the Subdivision Map Act, the Planning Commission may not impose conditions or exactions on its approval of a lot line adjustment except to conform to local subdivision, zoning and building ordinances. Section 16.44.040 of the Rolling Hills Subdivision Code enumerate the required findings the Commission must make when approving/denying a lot line adjustment, as follows: 16.44.040 Approval or denial of adjustment The Planning Commission shall determine whether the parcels resulting from the adjustment will conform to the applicable provisions of this title. The Planning Commission may approve, conditionally approve, or deny the lot line adjustment in compliance with this section. Decisions made by the Planning Commission may be appealed to the City Council in compliance with chapter 17.46 Site Plan Review of the Zoning Ordinance. (1) Required findings. A proposed lot line adjustment shall be denied if the Planning Commission finds any of the following: a. The adjustment will have the effect of creating a greater number of parcels than exist before adjustment; b. Any parcel resulting from the adjustment will conflict with any applicable regulations of the zoning ordinance; or c. The adjustment will result in an increase in the number of nonconforming parcels. Conditions of approval. In approving a lot line adjustment, the Planning Commission shall adopt conditions only as necessary to conform the adjustment and proposed parcels to the requirements of this Chapter, Title 17 (Zoning) and Title 15 (Building and Construction) of the Municipal Code, or to facilitate the relocation of existing utilities, infrastructure, trails or easements. Section 17.16.060 of the Zoning Ordinance provides for required lot area and dimensions. Referring to Section 17.16.060(A)(2) Lot Size: Each of the lots will remain greater than the minimum 2 acres net lot area required in the RA-S-2 Zone. Referring to Section 17.16.060(B) Widths and depths of lots. Each proposed parcel will have greater than the required 150 foot frontage along Portuguese Bend Road and will be wider at all points than the required 150 feet. • • 6. Parcel 1 is developed with a 4,980 square foot residence (a 1,222 sq.ft. addition to the residence is currently under construction), 660 sq.ft. garage, 466 square feet covered porches, 1,032 sq.ft. swimming pool with 80 sq.ft. pool equipment structure and 96 sq.ft. service yard. The structural lot coverage (including the addition) is 8,436 square feet or 3.8%, which is within the 20% maximum permitted. The total lot coverage is 18,535 square feet or 8.3%, which is within the 35% maximum permitted. The disturbed area of the lot is 10.8%. The proposed lot line adjustment will have no effect on the percentage of coverage, as the size of the parcel will remain the same. 7. The easements lines will be relocated to correspond to the new lot lines. The Rolling Hills Community Association Board of Directors approved the lot line adjustment with a 10-foot easement on both sides of the new property line. 8. A roadside easement trail is located along Portuguese Bend Road and a trail (not dedicated to RHCA) goes through the vacant lot. 9. In 1996 a subdivision application was approved for these lots. The approval expired in 1999. During the subdivision application proceedings, a Mature Native Vegetation Area (MNV) was designated along Portuguese Bend Road spanning all lots. The proposed lot line adjustment will not affect the MNV area. 10. The Los Angeles County Land Development Division, under a contract with the City, will review the legal descriptions of the newly configured lots, and the Association's Attorney is preparing legal descriptions for the new easements within those lots. Once the lot line adjustment is approved and the legal descriptions for the adjusted lots verified, staff will prepare the appropriate documents for recordation of the newly configured lots. 11. The project has been determined to be categorically exempt pursuant to the California Environmental Quality Act (CEQA). THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. An application was duly filed by Mr. and Mrs. Philip Cho with respect to real property located on Portuguese Bend Road (Lots 89-A-RH and 89-C-RH) requesting a Certificate of Compliance for a Lot Line Adjustment to move the common side lot line dividing Lot 89-A-RH (25 Portuguese Bend Road) and Lot 89-C-RH (vacant lot north thereof), where 7,760 square feet of Lot 89-A-RH will be transferred to Lot 89- C-RH and the same size area, 7,760 square feet, of Lot 89-C-RH (vacant lot) will be transferred to Lot 89-A-RH. Section 2. California Government Code Subsection 66412(d) authorizes lot line adjustments without requiring a tentative map, parcel map or final map if: (A) The lot line adjustment involves two or more existing adjacent parcels, where land is proposed to be taken from one parcel and added to an adjacent parcel; (B) A greater number of parcels than originally existed is not thereby created; (C) The lot line adjustment will create parcels that conform to local zoning and building ordinances; and (D) The lot line adjustment is approved by the City. The City may impose conditions on the Lot Line Adjustment in order to make the lot conform to local zoning and building ordinances, to require the prepayment of real property taxes prior to the approval of the Lot Line Adjustment or to facilitate the relocation of existing infrastructure or easements. Section 3. The Planning Commission conducted a duly noticed public hearing to consider the application at a regular meeting on July 19, 2005. Section 4. The Planning Commission finds that the project is categorically exempt from environmental review under the California Environmental Quality Act pursuant to a Class 5 exemption provided by Section 15305 of the State CEQA Guidelines. Section 5. The Planning Commission has considered the evidence, both written and oral, presented in connection with this application and finds as follows: A. Section 16.16.010(B) of the Rolling Hills Subdivision Ordinance and Section 17.16.060(A) of the Rolling Hills Zoning Ordinance requires that each lot in any subdivision in the RA-S-2 Zone shall have a net area of not less than eighty-seven thousand one hundred twenty square feet (2.0 acres). The proposed lot line adjustment will result in Lot 89-A-RH being 5.09 acres net and Lot 89-C-RH being 2.97 acres net, exclusive of: (a) the entire area within a recorded roadway easement plus the area within ten feet measured perpendicular to the edge of the roadway easement; (b) the ten foot RESOLUTION NO. 2005-23 • • perimeter of the lot perpendicular to the property lines; (c) any private drive or driveway that provides access to any other lot or parcel of land and (d) the access strip portion of a flag lot. The size of the lots will not change, as an equal amount of area is being exchanged between the lots. B. Section 16.16.020 of the Rolling Hills Subdivision Ordinance and Section 17.16.060(B)(3) of the Rolling Hills Zoning Ordinance require that in all cases where practicable, the sidelines of lots shall be at approximate right angles or radial to the street upon which such lot fronts. This proposal will correct the current condition where the property line is not at right angle to the street. C. Section 16.20.230 of the Rolling Hills Subdivision Ordinance requires that easements, the width of which is to be determined by the Rolling Hills Community Association, be dedicated for bridle trail and utility purposes over the strips and portions of land within and abutting upon the sidelines and rear lines of each lot. The proposed adjustment provides for 10-foot easements, or as otherwise approved by the Rolling Hills Community Association, on each side of the adjusted lot lines, and will be recorded concurrently with the Certificate of Compliance for lot line adjustment. D. Conditions have been attached to this approval which provide that it will not impair or limit the City's application of the Site Plan Review Ordinance to any future development of Lot 89-A-RH and Lot 89-C-R I. Section 6. In accordance with the foregoing findings, a Conditional Certificate of Compliance for lot line adjustment sought in Zoning Case No. 707 as indicated on the map attached hereto as Exhibit "A" is hereby approved subject to the following conditions: A. The Lot Line Adjustment approval shall expire within two years from the effective date of approval as defined in Section 17.46.070, unless otherwise extended pursuant to the requirements of this section. B. There shall be ten (10) feet easements on each side of the adjusted lot lines within the adjusted boundaries of the lots, or as otherwise required by the Rolling Hills Community Association. The map attached to the Conditional Certificate of Compliance, referred hereto as Exhibit "A" shall delineate and note the easements and trails, if any, specified in this paragraph. C. The lot line adjustment shall not in any way constitute any representation that the adjusted lots can be developed in compliance with current zoning and building ordinance standards. No development shall occur on the properties without first complying with all applicable City Building and Zoning requirements and other applicable rules and regulations. D. The lot line adjustment shall not in any respect limit or impair the City's application of the Site Plan Review Ordinance (Ordinance No 221, 1988) to Lot 89-A-RH and 89-C-RH at such time as an application is made for development. RESOLUTION NO. 2005-23 E. The Certificate of Lot Line Adjustment shall not be issued until a legal description complying with the delineation of adjustment, and including the required easements and trails, if any, as specified in Paragraph C of Section 5 and Paragraph B of Section 6 are submitted to, and approved by the City. Upon the City's approval of the legal descriptions of the new adjusted lines, trails and easements, a Certificate of Compliance shall be issued by the City, shall be recorded by the property owner in the offices of the Los Angeles County Recorder, and evidence of the recordation shall be returned to the City. F. The applicant shall record the deeds of the properties effectuating the transfer concurrently with the Certificate of Compliance for the Lot Line Adjustment and shall submit proof of such recordation to the City of Rolling Hills. G. The applicants shall execute an Affidavit of Acceptance of all conditions of this Resolution or the Lot Line Adjustment shall not be effective. The lot at 25 Portuguese Bend Road is developed with a single family residence, garage and a swimming pool. As configured, no buildings on 25 Portuguese Bend Road are located in the area proposed for adjustment, nor will any structures be removed for the purpose of meeting the requirements for lot line adjustment. Under a separate application, the applicants propose to construct a 7,072 square foot sports court in the vicinity of the area proposed for adjustment. 4. Pursuant to the Subdivision Map Act, the Planning Commission may not impose conditions or exactions on its approval of a lot line adjustment except to conform to local subdivision, zoning and building ordinances. Section 16.44.040 of the Rolling Hills Subdivision Code enumerate the required findings the Commission must make when approving /denying a lot line adjustment, as follows: 16.44.040 Approval or denial of adjustment The Planning Commission shall determine whether the parcels resulting from the adjustment will conform to the applicable provisions of this title. The Planning Commission may approve, conditionally approve, or deny the lot line adjustment in compliance with this section. Decisions made by the Planning Commission may be appealed to the City Council in compliance with chapter 17.46 Site Plan Review of the Zoning Ordinance. (1) Required findings. A proposed lot line adjustment shall be denied if the Planning Commission finds any of the following: a. The adjustment will have the effect of creating a greater number of parcels than exist before adjustment; b. Any parcel resulting from the adjustment will conflict with any applicable regulations of the zoning ordinance; or c. The adjustment will result in an increase in the number of nonconforming parcels. Conditions of approval. In approving a lot line adjustment, the Planning Commission shall adopt conditions only as necessary to conform the adjustment and proposed parcels to the requirements of this Chapter, Title 17 (Zoning) and Title 15 (Building and Construction) of the Municipal Code, or to facilitate the relocation of existing utilities, infrastructure, trails or easements. Section 17.16.060 of the Zoning Ordinance provides for required lot area and dimensions. Referring to Section 17.16.060(A)(2) Lot Size: Each of the lots will remain greater than the minimum 2 acres net lot area required in the RA-S-2 Zone. Each proposed parcel will have greater than the required 150 foot frontage along Portuguese Bend Road and will be wider at all points than the required 150 feet. 5. Parcel 1 is developed with a 6,102 sq.ft. residence, 660 sq.ft. garage, 466 square feet covered porches, 1,032 sq.ft. swimming pool with 80 sq.ft. pool equipment structure and 96 sq.ft. service yard. The structural lot coverage is currently 8,436 square feet or 3.8%, which is within the 20% maximum permitted. The total lot coverage is currently 18,535 square feet or 8.3%, which is within the 35% maximum permitted. The disturbed area of the lot is 10.8%. The proposed lot line adjustment will have no effect on these development coverage, as the size of the parcel will remain the same. 6. The easements lines will be relocated to correspond to the new lot lines. The Rolling Hills Community Association Board of Directors approved the lot line adjustment with a 10-foot easement on both sides of the new property line. 7. There are no trails located on the properties. 8. In 1996 a subdivision application was approved for these lots. The approval expired in 1999. During the subdivision application proceedings, a Mature Native Vegetation Area (MNV) was designated along Portuguese Bend Road spanning all lots. The proposed lot line adjustment will not affect the MNV area. 9. The Los Angeles County Land Development Division, under a contract with the City, will review the legal descriptions of the newly configured lots, and the Association's Attorney is preparing legal descriptions for the new easements within those lots. Once the lot line adjustment is approved and the legal descriptions for the adjusted lots verified, staff will prepare the appropriate documents for recordation of the newly configured lots. 10. The project has been determined to be categorically exempt pursuant to the California Environmental Quality Act (CEQA). RECOMMENDATION It is recommended that the Planning Commission review the staff report, open the public hearing, take public testimony and provide direction to staff.
