17.32.140 Appeal --Persons authorized. The action by
the Planning Commission in matters described in this
chapter shall be by majority vote and shall be final, con-
clusive and effective twenty calendar days after the filing
of notice, as provided in Section 17.32.090, unless within
said twenty -day period an appeal in writing is filed with
the City Clerk by any of .the following:
. A. The applicant;
B. Any person who protested, either orally or in
writing, as a matter of record, prior to the final vote
of the Planning Commission on the matter and who, in
addition, received or was entitled to receive the written
notice specified in subdivision 2 of subsection A of Section
17.40.060; or
C. The City Council, upon the affirmative vote of
three members of the Council. (Ord. 188(part), 1981: Ord.
155 S4, 1978: Ord. 33 S6.14, 1960).
17.32.150 Appeal--Contents--Fee. An appeal from any
order, requirement, decision, or determination under the
title must set forth specifically wherein it is claimed
there was an error or abuse of discretion by the Planning
Commission or wherein the decision of the Planning Commission
is not supported by the evidence in the matter. In
addition, any person appealing the decision of the Planning
Commission must pay to the City Clerk, at the time of filing
the written notice of appeal, the required fee specified by
resolution as hereafter adopted and from time to time
changed by the City Council. (Ord. 188(part), 1981: Ord.
33 56.15, 1960).
17.32.160 Appeal--Recordkeeping. Upon receipt of a
written appeal and the payment of the fee required, the
City Clerk shall advise the Secretary of the Planning
Commission to transmit forthwith the complete record of
the entire proceeding before the Planning Commission. The
Secretary of the Planning Commission shall be charged with
the duty and responsibility of maintaining a complete file
and record on each application processed pursuant to this
chapter which shall contain the original application
processed pursuant to this chapter, all correspondence and
reports pertaining thereto, all affidavits of publication,
posting and mailing, as required by law, minutes of all
meetings of the Planning Commission pertaining to this
matter, advisory reports of technical agents, the report,
findings and decision of the Planning Commission, and an
affidavit of the mailing and the giving of said notice, as

ROLLING HILLS SETTING FEES FOR PLANNING, ZONING,
AND SUBDIVISION SERVICES
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES RESOLVE
AS FOLLOWS:
SECTION i. The following fees are established and charged
for applications for processing variances, site development reviews,
zone changes, conditional use permits and appeals, and shall be paid
by the applicant prior to submission for public hearing, pursuant to
Section 17.40.040 of the Rolling Hills Municipal Code:

Enclosed is a copy of the subdivision map of the property now owned
by Mr. Gerald Turpanjian, Zoning Case No. 442 (formerly owned by
Mr. Ralph Black, P.M. 15809). This map shows the access driveway
to be off of Talley Hand Road, a private driveway. As you know,
the applicant was directed by the Planning Commission to work with
the property owner whose private drive is Talley Hand Road, to come
up with a solution regarding access.
I am also enclosing the Section of the Municipal Code which deals
with basement openings as background information for Zoning Case
No. 444, 7 Maverick Lane, Mr. Bernie Howroyd.

15.04.051 Section 403 amended. Section 403 regarding
the definition of basement of the County of Los Angeles
Building Code is amended to read:
"BASEMENT is any floor level below the first story in
a building, except that a floor level in a building having
only one floor level shall be classified as a basement unless
such floor level qualifies as a first story as defined here-
in. A basement is further restricted to the specifications
contained in the definition of a story herein." (Ord. 203
§2, 1983).
15.04.052 Section 420 amended. Section 420 regarding
the definition of a story of the County of Los Angeles Build-
ing Code is amended to read:
"STORY is that portion of a building included between
the upper surface of any floor and the upper surface of the
floor next above, except that the topmost story shall be that
portion of a building included between the upper surface of
the topmost floor and the ceiling or roof above. There shall
be no habitable space, dncluding garages and storage rooms,
on top of another, except over basements. A basement is not
to exceed a height of five (5') feet above finished grade at
any point immediately adjacent to the basement exterior, and
it shall have no greater than an average 2 1/2 foot exterior
height across the entire structure. Basements may have one
standard door opening not to exceed 3' x 6'8" for ingress/
egress to the exterior, to be accessed by an areaway not to
exceed four (4') feet in width and which shall be incorporated
into the overall design of the building but shall not have
any other exterior openings, sun lights or similar devices."

15.04.060 Section 9906 amended. Section 9906 of the
County of Los Angeles Building Code is amended to read:
"Section 9906: Building Rehabilitation Appeals Board.
In order to bear appeals provided for in Chapter 98 and in
this Chapter, there shall be and is hereby created a Build-
ing Rehabilitation Appeals Board. In the City of Rolling
Hills the City Council shall serve as the Building Rehabili-
tation Appeals Board and the City Manager shall give notice
of substandard property and buildings, consulting with the
City Engineer as deemed necessary." (Ord. 199 S2, 1983:
Ord. 157 §5, 1978).

17.16.040 Lot coverage. A. Main buildings, accessory
buildings, structures, tennis courts, swimming pools, service
yards, (enclosed or unenclosed), stables, or an area of not
less than two hundred square feet for the construction of a
stable, with vehicle access thereto, shall not cover more
than twenty percent of the net lot area; provided further,
that in addition to the above -described improvements, the
areas included within driveways, parking space, walks, patios,
decks, and asphalt or concrete paving of any kind, excepting
roads maintained by the Rolling Hills Community Association,
shall not cover more than thirty-five percent of the net
lot area.
B. For the purposes of this section, "net area" shall
exclude all perimeter easements to a maximum of ten feet and
that portion of the lot or parcel of land which is used for
roadway purposes, and shall also exclude any private drive
or driveway which provides ingress and egress to any other
lot or parcel of land, and access strip portion of any flag
lot. (Ord. 188(part), 1981: Ord. 181 Si, 1980: Ord. 33
S3.04, 1960).
17.16.050 Height limitation. In the RA-S zone, no
building shall exceed one story in height except a barn or
stable which may have a loft without glazed openings to
be used exclusively and only for the storage of feed, tack
and stable equipment. Where a dwelling is constructed on a
split level, such height limitation shall be construed in a
vertical plane, considering only that portion of said build-
ing or dwelling which is on the same level. There shall be
no habitable space, including garages and storage rooms, on
top of another, except over basements.
