Dear Ms. Minor:
I refer you to my letter of 28th December and your response
of 8th January. My wife and I visited the Association to view
the development plans for Mr. La Caze's property which is
adjacent to ours. We could not ascertain from the plan that was
shown to us whether or not the road that we are questioning was
submitted for Association approval. The plan we viewed merely
shows a free drawn road noting existing roadway.
There was and is an existing roadway which is not the one in
question. The road we are questioning has been newly built, is
directly parallel to our boundary line and clearly runs through
the easement.
On questioning this point with your staff, I was told after
reference to you, to contact the architect who had submitted the
plan for Mr. La Caze. I do not see that we should need to
contact the architect for Mr. La Caze, either as our
responsibility or to gain an unbiased opinion. My question is to
the Association in that as far as I am aware, on the rules of the
Association, no construction or pavement, etc. can be built on an
easement.
I did not receive any response from the Rolling Hills
Council to my previous letter and have therefore copied them in.
May I request your response, specifically on the question
raised, i.e. has the La Caze development plan been approved to
allow a new roadway to be constructed on the easement between our
two properties?

24 - Portuguese -Bend - Road, _ are - enclosed._ The affidavits- are _required
.in. connection with- approval of a request for a Variance _of side
yard setback requirements for construction of a tennis court _to
encroach 25 feet into the side yard, and a request for a Conditional
Use Permit for a tennis court, per Zoning Case No. 330.
Also enclosed is a copy of the Findings and Report, prepared
pursuant to the action by the Planning Commission. The Findings
and Report and the recorded Affidavits of Acceptance are to be
retained in your file on the property. When the final plan has
been signed by the City Manager you are authorized to issue the
building permit.

Conditional Use Permit & Variance
This letter is to serve as official notice that.at the meeting
of the City Council on September 28, 1987 the Council adopted
Resolution No. 563, approving a Variance and Conditional Use
Permit for construction of a tennis court on Lot 90-RH, located
at 24 Portuguese Bend Road in Rolling Hills. The approval is
subject to conditions set forth in the resolution, which is
enclosed. A copy of the Findings and Report of the Planning
Commission setting forth conditions of approval by the Commission
on' July 21, 1987, is also enclosed. The approval issubject
to standard conditions of approval of tennis courts, adopted
by the Planning Commission on March 18, 1980 and amended on May
27, 1980, and to Ordinance No. 215, adopted by the City Council
on June 22, 1987. Copies of all documents referred to are enclosed
for your information.
An acceptance form for the Variance and an acceptance form
for the Conditional Use Permit, as required by Ordinance No. 207,
are enclosed. Please complete the forms, have the signatures
notarized, and forward the completed acceptance forms to the
Office of the County Recorder, Room 15, 227 North Broadway, Los
Angeles, CA 90012, with a check in the amount of $7.00 for each
of the documents. When the Affidavits of Acceptance have been
returned to the City, duly executed and recorded, the Los Angeles
County Department of Building and Safety will be notified that
permits for construction of the tennis court can be issued.

As I mentioned in the public hearing on September 9th, I purchased
a five acre parcel in Rolling Hills primarily to have a beautiful
country setting and a tennis court. I fully understand your
concern that the location of some tennis courts might be
construed as an eyesore to some people in the community. With
this concern in mind, I was cognizant that the property I
selected should have a tennis court location which would be
hidden from all of my neighbors, with minimal of earth movage,
and hopefully, the site would not destroy the ecology, i.e.
trees, which have taken forty or fifty years to grow. I have
such a location, which I have showed to Terry Belanger, and he
agrees that this would be the best spot on my property to
effect all of the aforementioned.
Re: Tennis Court, 24 Portuguese Bend.
The City did receive a written complaint from the Bailey's
(which was prompted by a call, you might check with Terry on
this), however they have subsequently removed this objection
verbally at the City Hall front desk. This complaint supposedly
had to do with sound problems. I hired a sound engineer to go to the
Bailey's driveway while balls were being hit on the proposed
location. A copy of said report indicates that tennis noise (balls
being hit and conversation) is approximately the same as general
noises in the area, i.e. birds, cars, horses etc. Hopefully then
this is not a concern anymore.
Needless to say, I paid quite a bit of money for the property with
hope of having my own tennis court, and I am presently in the
planning stages for my landscaping. It would be a great benefit
to me if I could proceed with my application through the planning
department, and either be accepted or rejected as the case may be,
in that my landscape planning is being delayed.
I have informed Terry Belanger that I am willing to comply with
any and all recommendations that might be implemented in the new
city codes, i.e. landscaping and sinking the court partially, so
as to completely minimize any impact on anyone who conceivably
could see it, and surety bonding to guarantee that the work is
completed.

Naturally, I feel my property is unique and my court location
represents a minimal impact on the community. I therefore request
an exclusion from this moratorium. Since there are only two other
properties with applications in progress, I believe we would all
have to be catagorically exempt. I believe that by making us all
agree to the new codes we could be excluded and we would not have
further delay and the city would have new requirements in place
for a win -win situation. I don't believe that three more tennis
courts in the city of Rolling Hills, at this time, constitute a
proliferation of courts. I appreciate your consideraton in this
matter.

1. In accordance with your request, noise levels were measured
at the proposed location of your tennis court. All
measurements were made with a GenRad 1565 Sound Levl Meter,
that had been calibrated with a B&K 4230 Acoustical
Calibrator immediately prior to use. A wind screen was
utilized to minimize wind generated noise and A -weighted
meter response was utilized. Ambient measurements were
made with slow meter response and noise from tennis ball
impacts and voice anouncements were measured with fast
meter response.
2. The ambient noise environment at approximately 8:15 A.M. on
the date of the site observation was 43 dBA in the
approximate center of the proposed tennis court location
(Location 1 on the attached site map).
3. Noise measured from tennis ball impacts produced short term
peak noise levels of 55 dBA at a distance of approxiamtely
100' to the southeast of the tennis court (Location 2).
Voice announcements such as typical score announcements at
the same location were measured to be 53 dBA.

It has been brought to my attention that the City of Rolling Hills has
asked Caballeros to investigate the easement and trail situations which
might be affected as a result of the expansion and rehabilitation of
the La Caze property located at 24 Portuguese Bend Road.
As Easement Chairman for Caballeros, I have investigated our maps,
master plan and trail access which might be affected by this property
and have determined that Caballeros sees no conflict or disruption of
any trail or equestrian use. This pertains specifically to the north
end of the property which is adjacent to Mr. Harold Bailey.
We therefore recommend that both the City and Association proceed with
Mr. La Caze as to his proposed development plans.

Dear Mr. La Caze:
At the Planning Commission's August 19, 1986 meeting, it
was determined by Chairman Roberts, that since there is a
Moratorium on the processing and construction of tennis courts,
it would not be appropriate to discuss your request for a
Conditional Use Permit for the construstion of a tennis court
(in your rear yard). At the present time, the Commission is in
no position to render a decision because of the Urgency Ordinance,
and therefore, the public hearing on Zoning Case No. 330 has
been continued to the next regular meeting of the Planning
Commission, on Tuesday, September 16, 1986, at 7:30 p.m:, in the
City Council Chambers, #2 Portugues.e Bend Road, Rolling Hills,
California.

On Monday, September 8, 1986, the City Council will be
considering the matter of letting the Urgency Ordinance lapse.

When I came back from vacation my wife and I saw that the new
location for the tennis court would remove an additional four
Eucalyptus trees which provide privacy for our new (to be built)
bedroom. Unfortunately we were not aware of this when we sent our
July 31 letter saying we would relocate the court. Therefore we,
regretfully, wish to pursue our original plan which requires a
variance into the (so called) side yard.

Dear Al:
I am going to be out of town on the 9th of August, however I
sincerely hope that you will go by and look at my proposed tennis
court location. I have made a decision to pull the tennis court
out of the assumed side yard 35 foot set back, thereby not
requesting a variance,but only a conditional use permit. I have
asked South Bay Engineering to redraw this and we will have
actually both locations staked out. Unfortunately, in doing this
one large tree I was attempting to save will be lost, however at
least it does remove the court somewhat from the setback, and Dr.
Bailey's home. I also plan on having a sound engineer meet with
you on the 9th and do accoustical readings from Mr. Bailey's
drive -way. I suggest that you have the group go down to Mr.
Bailey's driveway and look back up to see what the proposed court
would look like. I also will have my landscape architect present you
with a color rendering showing how the property will be screened,
and I will have delivered to the property prior to your visit four
or five specimen trees that we will be using for screening, and I
will have them set along the location of the fence so the
committee will be able to see exactly the size of tree that we
plan to use.
I will also have the price of the plant materials, installation,
and the irrigation set forth by the landscape contractor. I will
give a cash bond to the City for this amount as assurance that the
work will be done. When I have completed the court and landscaping
to the City's satisfaction I will expect the cash bond to be
released. When I have finished the court, if the material has not
been put in then I hereby authorize the City to use the money to
come on to my property and do said work for me.

As I have mentioned to you I am a person that keeps my word, and I
fully intend to do everything the way it would be set forth and I
believe that the location of my tennis court and the screening
that I plan to do will have a minimal affect on my neighbors. I
met with Dr. Bailey last Sunday and he felt my court should not be
a problem.I certainly hope that the planning commission will grant
me this Conditional Use Permit.
I looked at properties for the past four or five years and at
every one I looked at I tried to consider where would be a logical
place for a tennis court. This property seemed to be the
best situated, most isolated, and I specifically bought this large
a piece of ground because I did want to put in a tennis court. I
hope it will not be denied me.

After walking over the area desired for building this new tennis
court my wife and I both feel that it will just be too close to
our property line. We will not only be able to see the tennis
court fence from our driveway and front entrance but, what is
far worse, hear the exuberant results of the game. We want very
much for our new neighbors to have a tennis court, if that is
what they desire, but feel that they really do have sufficient
other area in which to build.
We well remember, in a previous residence here, that we were exposed
to early and late tennis action which was disturbing. We treasure
our "farm land", trees and isolation. Having lived in Rolling Hills
since 1962 we feel very protective of our environment, our country
quiet.
Thank you for considering this humble opinion. We, of course, will
trust your judgment and abide by your ruling.
