This letter shall serve as official notification that Modification to Zoning Case No. 403 was
APPROVED by the Planning Commission and the enclosed resolution was approved on
January 11. 1992 at an adjourned regular meeting. The Planning Commission's decision was
reported to the City Council at their regular meeting on January 13. 1992.
The approval will become effective:
(1) Twenty days after the receipt of this letter if no appeals
are filed within that time period (Section 17.32.140 of the
Rolling Hills Municipal Code attached), AND
(2) An Affidavit of Acceptance Form and the subject Resolution
must be filed by you with the County Recorder (Section 17.32.087).
We have enclosed a copy of RESOLUTION No. 92-2 specifying the conditions of approval
set forth by the Planning Commission and the approved Exhibit A Development Plan to
keep for your files. Once you have received the Resolution, please complete the enclosed
AFFIDAVIT OF ACCEPTANCE FORM, have the signature(s) notarized, and forward to:

Dear Lata:
The resolution for the subject case had expired on November 11,
1991. And, under Section 17.34.080.B of the Rolling Hills
Municipal Code, Mr. Calhoun had to reapply for the subject project.
The subject case was approved on December 17, 1991 by the Planning
Commission but, the new resolution has not been finalized.
You should note that grading on the subject property was conducted
without permits and would be a safety hazard if a large hole dug on
the property is not filled as soon as possible.
The current plans meet the requirements of the City of Rolling
Hills Municipal Code but we cannot allow the building permits to be
issued until the new resolution is finalized and the twenty day
appeal period has passed.
Accordingly, we request that you issue a grading permit only for
the subject site at this time.

I understand from City Hall that the field trip to view the lot
of Steve Calhoun is this Saturday a.m. Jim and I wanted to be
present, but our son is graduating from Pepperdine at 10:30 a.m., so
we may have to leave prior to the arrival of the planning commission.
Therefore, I wanted to restate our concerns about the proposed
Calhoun house.
First, the major reason we purchased our house 9 years ago was
for the privacy. At that time, we were told that Mr. Calhoun had
purchased all of the adjacent lots to protect his privacy.
Now, understandably, he wishes his son to build on the lot above
us. From examining the plans it appears the house is placed very far
forward (perhaps into the easement?), which will directly affect our
privacy since the land configuration is of a stair -step nature.
Would the planning commission consider whether the house could be set
back --which would help maintain our privacy-- without causing a
hardship to the Calhouns.
Also, we are very concerned about drainage. In the past, we
have had water runoff down our bank, and wish to be assured that
grading will not make the problem worse or adversely affect us in any
way.
In addition, the Senior Calhouns frequently keep a gate locked
across their driveway. With Steve Calhoun requesting that his garage
be set forward, will there be room for a turn -around for the few --but
necessary --trucks?
If we are not at home, please feel free to come into our drive-
way to the front of the house to see the bank in regard to view and
property.
