Section 1. Application was duly filed by Dr. and Mrs. Giancarlo Starinieri
with respect to real property located at 2960 Palos Verdes Drive North (Lot 1-B-RH)
requesting a Conditional Use Permit (CUP) to retain a 405 square foot "as built" guest
house on the lot and Variances to retain the guest house and a 171 square foot solid
roof detached porch in the front yard area of the lot and to set aside an area for a future
stable and corral in the front yard area of the lot. No grading would be required for the
future stable and corral in the proposed location.
Section 2. The property is zoned RAS-1 and consists of 2.68 acres gross,
(excluding roadway easement). The net lot area for development purposes is 101,178
square feet or 2.32 acres. The guest house and a covered patio are located in the front
yard of the property. Pursuant to the Zoning Ordinance, no structures may be located
in front of the leading edge of the residence. Therefore the guest house and the covered
patio require approval of a Variance to remain in their current location.
Section 3. In 1977 building permits were issued for a 1,017 sq.ft. stable which
was to be located in the rear of the residence. The permits expired and the stable was
not constructed. There are no records on file for a stable or guest house in its current
location.
Section 4. The applicant originally proposed to set aside an area for a future
stable and corral in the rear of the property, where a stable structure was approved in
1977. Substantial grading would be necessary to construct in this area, which would
trigger exceedance in the maximum permitted disturbance requirement. A Variance for
disturbance was originally requested. During the field trip , to the property, the
Planning Commission recommended an alternate location for the set aside area for the
future stable and corral. The alternate area would be located in the front yard area of
the lot, but when constructed would notrequire any grading, thus no variance.

This letter shall serve to notify you that the Planning Commission adopted a resolution
on November 16, 2010, granting approval of your request. That action accompanied by
the record of the proceedings before the Commission will be reported to the City Council
on Monday. November 22. 2010. beainnina at 7:30 PM. You or your representative
should be present to answer any questions the Council may have.
The Planning Commission's decision in this matter shall become effective thirty days
after the adoption of the resolution by the Commission, unless an appeal has been filed
or the City Council takes jurisdiction of the case within that thirty (30) day appeal period.
(Section 17.54.010(B) of the Rolling Hills Municipal Code). Should there be an appeal,
the Commission's decision will be stayed until the Council completes its proceedings in
accordance with the provisions of the Municipal Code.
Please review the conditions in the resolution. Should you have any objections to any of
the conditions, you may appeal them to the City Council. The approval calls for two
years to legalize and start the improvements to bring the structure to compliance with the
L.A. County Building Code.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's Resolution, the Planning Commission's action will become final and you
will be required to cause to be recorded an Affidavit of Acceptance Form together with
the subject Resolution in the Office of the County Recorder before the Commission's

This letter shall serve to notify you that the Planning Commission at their regular
meeting on October 19 directed staff to prepare a draft resolution, with
conditions, to approve your request in Zoning Case No. 794, which will be
considered at their November 16, 2010 meeting. However, during the field trip,
the Commission recommended an alternate location for the set aside area for the
future stable and corral. The alternate area is located in the front yard area of the
lot, and requires a Variance. The Variance portion of the application must be
renoticed to the Newspaper and to your neighbors.
Proper notification will be provided and any comments received reported to the
Planning Commission at their November 16 meeting. At the November 16, 2010
meeting the Commission could approve the resolution or consider the case
further.
The Commission requested that the area on the plan originally set aside for the
future agricultural use be removed from the plan. Please have your
representative provide a revised plan and revised calculations for the application
to reflect the revisions, including the condition that the area within 50-feet of the
guest house be landscaped.
The resolution with findings and conditions of approval will be forwarded to
you prior to the next Planning Commission meeting. Please review the
conditions of approval.
The Planning Commission decision shall become effective thirty days after the
adoption of the resolution unless an appeal has been filed by you, any interested
party or the City Council takes jurisdiction of the case within that thirty (30) day

October 13, 2010 at about 8:30 a.m. to view the project.
The Planning Commission will visit another property in the City at 8:00 am and then
proceed to your property, therefore, an exact time of their visit can not be determined.
Please note that the City may require further information in order to clarify, amplify,
correct, or otherwise supplement the application. If the City requires such additional

Following the field trip, the Planning Commission will reconvene deliberation at their

SILHOUETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.

ZONING CASE NO. 794. Request for a Conditional Use Permit and
Variances to retain a converted guest house and to set aside an area for a future
stable and corral elsewhere on the lot.
Dear Dr. and Mrs. Starinieri:
Pursuant to state law the City's staff has completed a preliminary review of the
application noted above and finds that the information submitted is:
X INCOMPLETE as of the date indicated above to allow the application to be
processed.
Reasons:
1. A variance request is required due to the location of the guest house. City Code
prohibits any detached accessory structure to be located in the front yard, which is
defined as the area of the lot between the leading edge of the house and the front
easement line.
2. A variance request is required for exceedance of maximum permitted disturbed
area of the lot. The application submitted by your consultants show that currently the
disturbed area of the lot is over 41%, and with the future stable, will be 47%. Pursuant to
the Zoning Ordinance, the maximum permitted disturbance of any lot in the City is 40%.
Although you have no plans to construct the stable at this time, the code requires that
disturbance and grading be addressed at the time an application is submitted for future
stable to give the Planning Commission a picture of the entire scope of current and
potential development on the lot.
3. Provide grading quantity for the future stable and corral.
4. A fee of $2325 payable to City of Rolling Hills must be paid, as follows:
$1500 for Conditional Use Permit (for the use -guest house)
$625 for Variance to keep the guest house in the front yard
Variance for disturbance $0 (third request has no fee)
$200 - Environmental review
5. Verify size of the house (the Assessors' records indicate a 4,692 sq.ft. home
whereas the application shows 4,240 sq.ft. home)

6. Verify the size of the gross lot and the NET LOT AREA.
7. Identify in detail the type and use of the structure adjacent to the guest house.
8. Verify the size of the pool; the building permit shows a 787 sq.ft. pool, whereas
the application shows a 720 sq.ft. pool.
Please note that the City may require further information in order to clarify, amplify,
correct, or otherwise supplement the application. If the City requires such additional
information, it is strongly suggested that you supply that information promptly to avoid
any delay in the processing of the application.
In order for your application to be considered at the Planning Commission meeting on,
September 21. 2010. you must submit the requested information and fees by August 30.
