Dear Jerry Turpanjian:
O Pinetree Ln (hereinafter "Permittee"), located at 0 Pinetree Lane in the City of Rolling Hills,
is regulated under the General Construction Stormwater Permit (General Permit) and is identified
by WDID No. 4 19C357164. The Permittee's Notice of Intent was processed by the State Water
Resources Control Board on 1/20/2010.
As specified in the General Permit, the Permittee is required to assess the risk level of a
construction site based on both sediment transport load and receiving water proximity. The
Permittee shall follow the requirements in the General Permit Section VIII to determine Risk
Levels 1, 2, and 3, and LUP Risk Type 1, 2 and 3. Also, Section XVI.A of the General Permit
requires the Permittee to submit electronically an annual report by September 1 of each year.
Regional Board staff reviewed your risk level determination and annual report status and found
that you failed to determine your construction site's risk level, and that you have not submitted
your 2010-2011 annual report, which was due on September 1st , 2011.
You are hereby notified that you are in violation of the General Construction Stormwater Permit
(Order No. 2009-0009-DWQ (CAS000002) by failing to determine the risk level of your
construction site and for failing to submit your 2010-11 annual report:
• Failure to asses and determine the risk level of a site is violation of General Permit
Section VIII.
• Failure to submit an annual report is a violation of General Permit Section XVI.A

Failure to determine the risk level and submit and annual report violate the requirements of the
General Permit, the California Water Code, and the Federal Clean Water Act.
The Permittee is required to:
• Immediately assess and determine the risk level of your construction site.
• Immediately submit a complete 2010-2011 annual report through SMARTS at:
https://smarts.waterboards.ca.gov.
• Submit a written response confirming you have corrected these violations with a brief
description of how you have corrected them. Submit a written response by January 9,
2012 to:

These violations of the General Permit subject you to enforcement actions, including
administrative civil liabilities up to $10,000 per day per each violation pursuant to California

stable for his property at 0 Pine Tree Lane be exempt from requiring Conditional Use
Permit (CUP) approval from the City per the impending new requirements.
The stable was staked and flagged for the Planning Commission and for the City
Council as part of the Site Plan Review process. Each body took field trips to the site
and interested neighbors also attended. Following this process each body approved
the residence and the stable.
The stable meets the new zoning requirements which will go into effect shortly.

Subject: Grading #0 Pine Tree Lane:
Dear Mrs. Schwartz:
The rough grading at #0 Pine Tree Lane is in conformance with the approved grading plan.
A GPS system was employed on this job by the grading contractor. A model of the
approved plan was generated and installed into a portable computer that enabled the
grading equipment operator to access precise grading direction continuously.
Bolton Engineering Corp. (BEC) had our survey crew stake the slope tops, toes, keys, and
subdrains throughout the project to assure the accuracy of the grading. After the grading.
was complete BEC filed surveyed the graded site and has prepared the attached "rough as
graded" plan.
The "rough as graded" plan is being processed by the Soils, Geology Consultants, and
Building and Safety with County Engineering office for approval. We submitted biweekly
reports regarding grading at this property to the County. We made inspections of the
grading in order to insure the work was in accordance with the approved plan.
The conditions of approval allowed a disturbed area of 79,217 square feet for this grading
project. The disturbed area on the "rough as graded" plan has 85,000 square feet. The
additional disturbance is in the area of the future barn.
This area was temporarily graded to provide parking and storage of materials during
construction. This area will be restored to its natural condition upon completion of
construction of the seepage pit and barn in this area.
The grading work to date is in conformance with the approved grading plan with a minor
exception that was necessary as described herein. If you have any questions or need

Thank you for obtaining a City of Rolling Hills Construction and Demolition Waste Permits for 5 Crest Road
West, 25 Portuguese Bend Road and 0-Pine Tree Lane. With issuance of the permit and your commitment
and cooperation, we look forward to accomplishing the recycling and diversion goals that the permit is
intended to achieve.
As noted in the permit application, please be mindful that within thirty (30) calendar days following the
completion of each construction project for which your permit is issued, you are required to submit
documentation to the City of Rolling Hills demonstrating that at least 50% of the construction and
demolition waste generated from the project is not disposed at a landfill. Satisfactory documentation of
compliance is necessary for final inspection of the construction project and, if applicable, the issuance
of a certificate of occupancy. In other words, your failure to comply with the recycling/diversion
requirement will cause the City to withhold from your clients final approval of the construction project you
are servicing.
Enclosed you will find a "Recycling and Waste Reduction Compliance Report" for you to document the

originals or photocopies of receipts, weight tickets, invoices or other records of measurement from recycling
companies, the landfill and/or disposal companies. It is strongly recommended that you submit this form
as frequently as you dispose of construction and demolition waste rather than wait until the end of a
project. This will avoid complications with final inspection of the project and with you and your client.
Additional forms can be obtained at City Hall or on the City's website at www.Rolling-Hills.org.
Please be aware that your permits will expire on 11/3/2010, 12/1/2010 and 1/31/2011 respectively, at which

renewed or could be revoked mid -year.

SILHOUETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week _preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.

August 18, 2009 granting your request in Zoning Case No. 767. The vote was 3-1. That action,
accompanied by the record of the proceedings before the Commission will be reported to the
City Council on MONDAY, AUGUST 24. 2009 at a regular meeting beginning at 7:30 PM.

This letter shall serve to notify you that the Planning Commission at their July 21, 2009
meeting, after lengthy discussion and deliberation, voted 3-2 to direct staff to prepare a
Resolution to approve your project, including additional 300 sq.ft. to the stable, for a
total of 750 sq.ft. stable. The stable as presented is to be one story. The Planning
Commission will review and consider the draft resolution, together with conditions of
approval, at an upcoming meeting on August 18, 2009 beginning at 6:30 PM, and make
its final decision on your application at that meeting.
The findings and conditions of approval of the draft resolution will be forwarded to you
before the Planning Commission meeting.
Please submit, by August 7, 2009, detail plans (8 sets) for the stable, paddock, access and
corral, including floor plan and elevation. The Commission will require that the stalls of
the stable be of pervious material and not concrete or other solid floor.
Planning Commission action, accompanied by the record of the proceedings before the
Commission, is tentatively scheduled to be placed as a report item on the City Council's
agenda at the Council's regular meeting on Monday August 24, 2009.
The decision of the Planning Commission shall become effective thirty days after the
adoption of the resolution unless an appeal has been filed or the City Council takes
jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of
the Rolling Hills Municipal Code). Should there be an appeal, the Commission's
decision will be stayed until the Council completes its proceedings in accordance with
the provisions of the Municipal Code.

visit to your property to view the proposed project on Tuesday April 7, 2009.
The Planning Commission expressed concerns regarding the size of the proposed
residence and the amount of grading and disturbance on the lot that would be required
to complete the project. The Commission was also concerned with the sharp resulting
slopes, all of which are 2:1 in grade.
In the past, the Commission approved very few variances for disturbed area or
exceedance of a building pad coverage on vacant properties.
The Planning Commission continued this case to their April 21, 2009 meeting to provide

A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the

Dear Mr. Turpanjian:
Pursuant to state law the City's staff has completed a preliminary review of the
information/plan for the above noted applications and finds that the following
additional information is required to be submitted:
./#• Biological assessment study showing existing sensitive and native plants and an
action plan for their replacement, if 'any are proposed to be removed due to the
construction.
✓ The proposed driveway approach must be reviewed and approved by the Traffic
Commission. Please submit detailed plan of the approach with a letter requesting
review by the Traffic Commission and an application fee for $300, payable to the
City of Rolling Hills. The next Traffic Commission meeting is scheduled for
March 26, 2009. Meanwhile, the Planning Commission will consider your case
but won't make final recommendation until the Traffic Commission reviews the
driveway approach.
• Show any other structures and their size that you may want to construct in the
future, such as pool, spa, pool equipment area, barbecue, trellis or other
structures and include them in the application calculations.
• Show a minimum of 550 sq.ft. corral area adjacent to the future stable.
• Show location of septic tank, if known.
• Show location of the trash yard area (minimum of 96 sq.ft. area, enclosed with
solid wall). May not be in located in setbacks or front yard area.
• Submit elevation plans of the residence/garage showing the height of the
proposed structure.
• Mark the height of walls on the site plan., (not to exceed 5-feet, but on the
average must be no higher than 21/2 feet).
• Identify covered porches, trellises, patios and the proposed breezeway on the site
plan.
• If any deck is proposed to be 12 inches or more above finished grade, an
additional Site Plan review application would be required.
• A 4-foot level path is required to be provided around the entire footprint of the
house and garage. Such path does not need to be paved. From the plan it looks
like a portion of the garage is proposed to be built into the hill. Identify the

height of the breezeway, to determine if an emergency vehicle could access the
rear of the lot from the front beneath the breezeway.
• Show vicinity map on the site plan.
• Mark trails on the property, if any.
• Once plans are finalized, submit 8 copies.

• In order for the case to be considered at the February 17 Planning Commission

information, it is strongly suggested that you supply that information promptly to avoid
any delay in the processing of the application.
Please also be advised that a request for a Variance on an application involving a vacant
lot, where there are no pre-existing conditions warranting variances is difficult to obtain,
as hardship findings must be found by the Planning Commission.
Your request has been tentatively set for public hearing consideration by the Planning
Commission at their meeting on Tuesday, February 17, 2009 beginning at 6:30 PM in the
Council Chambers, Rolling Hills City Hall Administration Building, 2 Portuguese Bend

Dear Planning Commission Members,
I am writing on behalf of my parents, Jerry and Pat Turpanjian, regarding their Site Plan Review submission
for the property located at 0 Pine Tree Lane.
My parents have lived in Rolling Hills for the past 30 years and have great appreciation for the City, its rural
nature and ranch -like atmosphere. They have already build two homes in Rolling Hills (one on
Hummingbird Lane and the other on Portuguese Bend Road), and have especially enjoyed living in their
current residence, which they built 16 years ago. However, recent changes in their personal circumstances
have made the house less suitable to their needs. Their current home has a substantial amount of living
space in the basement. (The home is approximately 10,000 square feet, with 3,000 square feet of the
house located underground but with two light wells.)
In December 2007, my father required spinal surgery, and my mother is currently recovering from a knee
replacement. Additionally, she will be requiring a hip replacement. With their physical ailments, stairs are
extremely difficult to negotiate, therefore a two level home has become burdensome to them. Their primary
objective in the proposed house on Pine Tree Lane is to build a home with the same amenities as their
current home, but all on one level.
Furthermore, we have a rather large family, which has expanded in the last 16 years. My parents have four
children and have been blessed with six grandchildren. Between marriages and births, the immediate
family has more than doubled from 7 to 16 members since the current house was designed. With our family,
there is no such thing as a "small" family gathering. In other words, the space has been fully utilized.
With regard to the compatibility of the size of the proposed home with the neighborhood, my parents had
given lots of thought to this issue before acquiring this property. As a result, they feel it is indeed
compatible. This is especially true when comparing the proposed house to their current one (which is
merely 1500 feet away):

that comprises the lovely City of Rolling Hills.
