FINDINGS AND REPORT
The application of Dr. Richard Macklin, Lot 100-EF, East -
field Tract, for a Variance of Front Yard Requirements under ARTICLE
III, Section 3.06, Ordinance No. 33 came on for hearing on the 18th
day of December, 1979 in the Council Chambers of the Administration
Building, 2 Portuguese Bend Road, Rolling Hills, California, and the
applicant, having submitted evidence in support of the application,
the Planning Commission, being advised, now makes its Findings and
Report as required by the Ordinances of the City of Rolling Hills,
California.
The Commission finds that the applicant, Dr.. Richard Macklin.,
is the owner of that certain real property described as Lot 100-EF,
Eastfield Tract, located at 52 Eastfield Drive in the City of Rolling
Hills, and that notice of the public hearing in connection with said
application was given as required by Sections 8.06 and 8.07 of Ordi-
nance No. 33 of the City of Rolling Hills, California. The Commission
finds that no comment, written or verbal, was received in favor of or
in opposition to the request.
II.
The Commission finds that the applicant. wishes to enlarge
an existing horse shelter located in the front yard approximately
30 feet from the front easement line, and to provide an access road
to the shelter. The Commission further finds that the applicant has
indicated his willingness to raze the existing 12' x 12' shelter and
have the four proposed 12' x 12' stalls built 52 feet from the front
easement line to conform with an amendment to the Zoning Ordinance
which which requires a front yard set back of fifty feet from the
front easement line. The Commission finds that the request should be
approved, and a Variance of Front Yard,Requirements should be granted
in order to preserve substantial property rights in the same vicinity
and zone, and that the granting of such Front Yard Variance would not
be materially detrimental to the public welfare, nor injurious to
property in the same vicinity and zone.

From the foregoing it is concluded that a Variance of Front
Yard Requirements should be granted to Dr. Richard Macklin for remodel
and addition of an existing stable structure in the front yard, subject
to the conditions that the existing stable be relocated to a location
adjacent to the proposed new structures 52 feet from the front easement
line; that a hard surface access road of decomposed granite or .similar
surface be provided; that the construction be landscaped appropriately,
with a standard three rail white fence according to City standards as
corral enclosure, and it is, therefore, so ordered.
This approval shall expire one year from the date of grant,
if not acted on.
