DISCUSSION
The Planning Commission continued this application from the last regular
meeting of September 18, 1990 to conduct a field inspection of the site
and surrounding properties. At the field meeting, it was noted that the
proposed swimming pool and spa were sited inconsistently with the
submitted plans that showed a 20 foot side yard setback. The subject
property is a nonconforming parcel (1.577 acres) within the RAS-2 zone and
borders upon the RAS-1 zone. The required side yard setback in the RAS-2
zone is 35 feet. The applicant informed the Commission that the proposed
project could accomodate the required front yard setback and the 20 foot
side yard setback as prescribed for one -acre zoned lots. Further, it was
indicated that the plans must include a future stable site with vehicular
access. As observed on the inspection, available room for a stable site
can be accomodated toward the rear and access is available through the
perimeter easement. Should the request be approved, and due to the
exposure of the project, a landscaping plan would be required.
RECOMMENDATION
Staff is of the opinion that the findings can be determined to approve the
variance and site plan review requests. Correspondingly, staff would
recommend approval, subject to providing the requirement of a minimum 200
square foot "future" stable with vehicular access and submittal of a
landscaping plan.

Request for Variance to encroach into the side yard setback in
order to construct a swimming pool and spa; Request for Site Plan
Review to determine compatibility of the pool and spa with the
site.
REVIEW AND EVALUATION OF ISSUES
In reviewing the applicant's request under Title 17 (Zoning), staff would
identify the following issues for evaluation:
1. The property under application is a nonconforming lot due to less than
required net lot area in the RAS-2 zone. This double -frontage property
borders the RAS-1 zone along Middleridge Road. -
2. The applicant is proposing a 780 square foot swimming pool and spa
which will encroach 15 feet into the required 35 foot side yard setback.
The proposed project would, however, comply with RAS-1 setback standards.
3. Lot coverage totals will comply with code, and pad coverage is
unchanged, based upon current policy standards.
4. The site plan shall be revised to show a minimum 200 square foot
future pad area for a stable.
5. Landscaping requirements regarding the retention and/or replacement of
vegetation must be addressed.
RECOMMENDATION
Before a variance may be granted, required findings of hardship as set
forth in the ordinance must be determined. Approval of site plan review
also requires affirmative findings. The Commission should receive public
testimony and continue the matter to an adjourned meeting so as to conduct
a field inspection.
