The Planning Commission at the public hearing meeting on December 17, 2013
suggested that you revise your project to demolish the residence rather than try
to save a portion that encroaches into the rear setback and apply for a Variance to
re -built that portion of the residence within the current footprint; and relocate the
stable further to the south-east, which would also require a Variance. Please
advise me by December 26, 2013 if you're planning to revise your project, so that
notices for the Variances could be provided in a timely manner as required by
state law.
The Planning Commission also directed staff to prepare a resolution of approval
of your project to be considered at their next meeting, January 21, 2014,
providing they approve the Variances at the same meeting. Should they not
approve the Variances, they will most likely continue the case to allow you more
time to re -design the project.
Please submit additional $625 for the Variances with the appropriate applications
forms, signatures and 7 sets of plans by no later than January 6, 2014. (However,
as stated above, let me know by next week if you're planning to proceed in that
direction).

A RESOLUTION .OF THE PLANNING COMMISSION OF THE CITY QF
ROLLING HILLS GRANTING A SITE PLAN REVIEW FOR CONSTRUCTION
OF A NEW RESIDENCE, AND VARIANCES TO ENCROACH WITH A
PORTION OF THE RESIDENCE INTO THE REAR SETBACK WITHIN THE
FOOTPRINT OF THE EXISTING ENCROACHMENT AND TO ENCROACH
INTO THE SIDE SETBACK WITH THE SET ASIDE AREA FOR A FUTURE
STABLE AND CORRAL IN ZONING CASE NO. 847, AT 2 MIDDLERIDGE
LANE SOUTH, LOT 168-RH, (JOHNSON). THE PROJECT HAS BEEN
DETERMINED TO BE EXEMPT PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Mr. Kenneth Johnson with respect
to real property located at 2 Middleridge Lane South (Lot 168-RH) requesting a Site
Plan Review and a Variance to demolish existing residence and construct a new
residence, a portion of which would encroach into the rear setback within the footprint
of the existing house encroachment and Variance to encroach into the side setback with
a set aside area for a future stable and corral. The proposed residence would be 4,980
square feet with 980 square foot garage. The rear yard encroachment would be 361
square feet.
Section 2 The property is zoned RAS-2 and is located on the corner of
Middleridge Lane North and Middleridge Lane South. Not including the roadway
easements, the lot is 1.88 acres. For development purposes the net lot area of the lot is
70,015 square feet or 1.6 acres. Records show that the house and garage were
constructed in 1948 and the house was remodeled in 1955. The lot is irregular in shape
as it narrows where the two streets converge. The lot is encumbered by wide
easements and front and rear setbacks.
Section 3. The property is developed with a 2,830 square foot single family
residence, 460 square foot garage, a fountain and 200 square foot attached trellis. 361
square feet of the existing residence encroaches into the rear yard setback and is
proposed to be reconstructed within that setback.
Section 4. An area for a future stable and corral is proposed to the south of
the residence, 25-feet from the south property line, with future access from
Middleridge Lane South. This area is relatively flat and minimal grading will be
required. A Variance is requested to encroach 10-feet into the required 35-foot side
setback with the set aside area.

Dear Mr. Johnson:
This letter shall serve to notify you that the Planning Commission at their regular
meeting on January 21, 2014, adopted a Resolution, with conditions, granting your
request in Zoning Case No. 847. That action, accompanied by the record of the
proceedings before the Commission will be reported to the City Council on Monday,
February 10 2014, at their regular meeting beginning at 7:30 PM. You or your
representative should be present to answer any questions the Council may have.
Please submit additional 5 sets of plans for the City Council by February 3.
The Planning Commission's decision in this matter shall become effective thirty days
after the adoption of the resolution by the Commission, unless an appeal has been filed
within that thirty days. However, the City Council could take jurisdiction of the case
within 45 days of Planning Commission's decision, (Section 17.54.010B & 17.54.015B) of
the Rolling Hills Municipal Code). Should there be an appeal, the Commission's
decision will be stayed until the Council completes its proceedings in accordance with
the provisions of the Municipal Code.
If no appeals are filed, as stated above, after adoption of the Planning Commission's
resolution, the Planning Commission's action will become final and you will be required
to cause to be recorded an Affidavit of Acceptance Form together with the subject
resolution in the Office of the County Recorder before the Commission's action takes
effect.
A copy of the staff report to the City Council, including the Resolution, will be
forwarded to you on Friday, February 7, 2014. Following the City Council's action, I will
mail to you instructions for recordation of the Affidavit Of Acceptance Form and the
Resolution, unless there is an appeal or the Council takes this case under jurisdiction.

FIELD TRIP NOTIFICATION
SUBJECT: ZONING CASE NO. 847 Request for a Site Plan Review
Dear Mr. Johnson:
The Planning Commission at the November 17 meeting scheduled a field trip to your
property to view a silhouette of the proposed project on Tuesday, December 17, 2013 in the
morning. I will inform you of the exact time at a later time. Your neighbors will also be
notified of the meeting.
The owner and/or representative must be present to answer any questions the
Commissioners may have regarding the proposal.
The project shall be staked pursuant to the enclosed guidelines and the following:
• A full-size silhouette in conformance with the
attached guidelines must be prepared for ALL
PROPOSED STRUCTURES of the project showing the
footprints, roof ridges, entryways, limits of
porches, walls and all other structures;
• Stake the property lines, setbacks and easements in
the vicinity of the area of grading, construction and
stable set aside
• Show the height of the finished floor of the
proposed addition;

SILHOUETTE CONSTRUCTION GUIDELINES,
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting / field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of construction.
2 lh - 3' high wooden stakes must be used to delineate the lines. Such stakes must be flagged
and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as during
the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.

Since we have opened up the discussion of Variances to encroach on setbacks,
easements, I respectfully submit a scenario considering equal opportunity giving.
The discussion suggested a 10 foot encroachment on a 35 foot side setback between two
residences. My suggestion is to encroach at the least the same amount on a larger rear
setback; thus improving all considerations such as poisonous plants, prevailing winds,
and proximity to swimming pools?
